P~ N f, \n ~ i i 9v 100" vv • COMMISSIONERS' COURT f: REGULAR MEETING OCTOBER 1, 1996 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, October 1, 1996, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Sandie Walker, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of citizens and officials in attendance. Commissioner Walker gave the invocation and led the pledge of allegiance. There was no citizen input and/or concerns. The Court next considered Budget Amendment #95/96-44, which would reallocate funds budgeted for the Sheriff's office and Non Departmental department, transfer funds from f Contingency to Indigent Health Care and Non Departmental. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. t VOL The court proceeded to consider the change of status of the following employees. He had questions on the promotion and pay increase given to Vickie Saxon. Commissioner Walker moved to approve the changes as submitted. Commissioner Cauley seconded the motion. Commissioners Norton, Walker and Cauley voted "Aye". Commissioner Sims voted "No". The motion carried. The Court next considered the following Claims as submitted by the County Treasurer for payment: 97-000001 through 97-000202 On motion by Commissioner Cauley, seconded by Commissioner Walker, the Court voted unanimously to approve the Claims as submitted. The Court next considered a Quit Claim Deed. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to execute a Quit Claim Deed for Lot 6, Block 2, Ettle Addition, City of Bryan, to Saul Guevara. The next matter for consideration was a change of benefits for the County health insurance for 1997. On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to approve the attached changes as recommended by the insurance Committee. f. v U .At a , 1 i Y 0 e I The Court next considered the appointment of two (2) members to the Brazos County Historical Commission. On motion , by Commissioner Sims, seconded by Commissioner Cauley, the ; Court voted unanimously to appoint Mrs. Julie Schultz and Mrs. i Thena Parrott to the Brazos County Historical Commission for I the remainder of this year. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to adopt a Resolution in support of the proposed senate bill by Senator Tom Haywood returning five cents from every dollar of the Texas state lottery ticket sales to the cities and counties. The Court next considered renewal of a lease agreement between Brazos County and Phyllis Hobson of Brazos County for rental of office space in the building located at 1502 Nantucket Drive, Brazos County, Texas, for the use of the Justice of the Peace for Precinct 1. Term of the lease is for the period of one year. The County agrees to pay to Ms. Hobson the amount of four hundred eighty five dollars ($485.00) per month. On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to renew the lease agreement between Brazos County and Ms. Hobson for the period stated above. A copy of the lease agreement is attached. The next matter for consideration by the Court was a written request submitted by County Extension Agent, Jim Mazurkiewicz requesting approval for out of state travel for Greg Kaase and himself. Dr. Mazurkiewicz and Mr. Kaase would be traveling to Kansas City, Missouri with the livestock judging teams to attend the national 4-H livestock contest during the week of November 14 through the 17, 1996. On motion by Commissioner Cauley, seconded by Commissioner Norton, the Court voted unanimously to grant the request from the Extension Agent and approved payment of out of state travel expense for Dr. Mazurkiewicz and Mr. Kaase. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the VOL~,._ Pace, .A. general public. The Road and Bridge Department requested permission to enter the private property of Bill Scarpinato on Rye Loop Road in Precinct 4 to clear out a ditch along the side of the driveway to allow water to drain properly. On motion by Commissioner Cauley, seconded by Commissioner Walker, the Court voted unanimously to authorize the work. The Court next considered approval of the Final Plat of Lots 1 & 2, Block 1, Hare Lane Estates in Precinct 2. Richard Vance, County Engineer, stated he had reviewed the plat and made the following comment: Show dimension of additional right-of-way dedication along Hare Lane. On motion by Commissioner Walker, seconded by Commissioner Norton, the Court voted unanimously to approve the final plat of the Hare Lane Estates. The Court next considered the request from GTE to place two road bores in the right-of-way of Elmo Weedon Road. The site is located in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from GTE and authorized the installation. A copy of the request is attached hereto. The Court next considered Budget Amendment $96/97-01, which would transfer funds budgeted from contingency to Community Supervision, adjust the Metropolitan Planning Organization Grant to the approved 96/97 budget and adjust the Texas Juvenile Probation Commission Grants. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The County Judge made the following comments: 1) Announced that persons interested in filling the unexpired term of Justice of the Peace Precinct 5 should apply in writing to the County Judge's office. 2) There will be no Commissioners Court meeting on October 15, 1996. 3) Judge Delaney will chair a committee considering electronic access to Courthouse information. This is being considered to reduce calls to various offices and the cost can be assessed to the user. q ~s 4 . i S 1 1 t d V t 4) Judge Steve Smith met with the municipal Service Bureau to discuss the collection of fines for the Courts. 5) Talked with representatives of Bickerstaff about the realignment of Justice of the Peace precincts. Commissioner Norton made the following comment: 1) Met with the visiting judge who received the threatening phone call from the jail. Suggested that the calls be recorded. There being no further business to come before the Court, the meeting was adjourned. Following are the committee's final recommendations. All savings are based on the claim dollars paid out through July 31, 1996, are estimated according to the current trend and can vary. MEDICAL COVERAGE Total claim dollars paid out through 7/31/96 $1,320,581.00 1. PRESCRIPTION DRUG CARD - COPAY & DEDUCTIBLE PLANS: • Increase the co-pay to $10.00 for generic drugs and $15.00 for name brand drugs. Savings: $39,617 2. MENTALINBRVOUS, ALCOHOL & SUBSTANCE ABUSE - COPAX & DEDUCTIBLE PLANS: Add a combined $25,000 Lifetime Maximum; and Add a combined Calendar Year Maximum of $10,000. Savings: $79,234 4 3 3. C~ f GENERAL TELEPHONE NOTICE OF COMMUNICATION COMPANY LINE INSTALLATION September 19, 1996 TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY ATTENTION COUNTY JUDGE: Formal notice is hereby given that GTE will construct a communication line within the right-of-way of County Roads in Brazos County, Texas as follows: Beginning at the intersection of State Hwy. 21 and Luza Lane a buried communication cable will be placed 5' in the south R.O.W. extending east- north for distance of 1742'. The cable will then turn to a southeasterly direction for a minimum depth of 30". The location and description of this line and associated appurtenances is more fully shown by four (4) copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment of impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so construed be null and void. BRAZOS COUNTY BRYAN, TEXAS RESOLUTION relating TO THE PROPOSED SENATE BILL REGARDING THE TEXAS LOTTERY WHEREAS, the Texas ~ ottery Commission has conducted the Texas Lottery since its implementation in 1992; and WHEREAS, Senator Tom Haywood has proposed a senate bill to be presented in the 1997 legislative session of the Texas Senate that would require the Texas Lottery Commission to return five cents of every lottery sales dollar to the city where the sales was transacted or to the county where the sales transaction location was in the unincorporated area of the county; and NOW THEREFORE. BE IT RESOLVED, on October 1, 1996, the County Commissioners of Brazos County adopted an official Resolution approving the acceptance of the proposed senate bill by Senator Tom Haywood returning five cents from every dollar of the Texas state lottery ticket sales to the cities and counties. /I Alvin W.
