THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
SEPTEMBER 17, 1996 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF
THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,

A regular meeting of the Commissioners' Court of Brazos '
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, September 17, 1996, with the following
members of the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of citizens and officials in
attendance.

The County Judge gave the invocation and led the pledge
of allegiance.
There was no citizen input and/or
concerns.
The Court proceeded to consider the change of status of `

The Court next considered the

On motion by Commissioner Cauley, seconded by Commissioner
Walker, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered Budget Amendment #95/96-42,
which would reallocate funds budgeted for Justice of the Peace
Precinct 4, Environment Protection Department, transfer funds
from Contingency to the Brazos Center and District Clerk's
office, and to create a department within the Metropolitan
Planning Organization to track the Brazos Transit contract.
On motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to approve the budget
amendment as submitted, a copy of which is attached hereto.
The next matter before the Court was the renewal of a

Contractual Agreement between Brazos County and the Brazos
County Emergency Communications District (9-1-1) for emergency
communications services dispatching. Effective October 1,
1996, the District is appointed the emergency communications
dispatching authority for Brazos County for the period
October 1, 1996 through and including September 30, 1997. The
County agrees to pay $144,140.00 for the services provided.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to enter into contractual
agreement with the Brazos County Emergency Communications
District (9-1-1) for emergency communications services
dispatching. A copy of the contractual agreement is attached
hereto.
The next matter before the Court was approval of a Grant
Agreement between the State of Texas through the Texas
Department of Transportation and Brazos County. This grant,
to be administered by the County Attorney's office, will
provide funds to operate mobile videos in establishments to
determine the sale of alcoholic beverages to minors and to
file criminal or administrative cases on the sellers/ servers.
Such grant to be in the total amount of $60,015.80 with
seventy five percent (75%) or $45,000.00 to be state funded,
and twenty five percent (25%) or $15,015.80 to be county
funded. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the County Judge to make application on behalf of Brazos

County to the Texas Department of Transportation and accept on
behalf of Brazos County such grant funds as may be tendered.
A copy of the Grant Agreement is attached hereto.
The Court next considered renewal of a lease agreement
between the Brazos Valley Art League and Brazos County for
rental of office space within the Brazos Center located at
3232 Briarcrest Drive, in Bryan, Texas. Term of the lease is
for the period of one year commencing on October 1, 1996 and
ending on September 30, 1997. The Art League agrees to pay
Brazos County fifty dollars ($50.00) per month. On motion by
Commissioner Walker, seconded by Commissioner Norton, the
Court voted unanimously to renew the lease agreement between
Brazos County and Brazos Valley Art League for the period
stated above. A copy of the lease agreement is attached.
The next matter for consideration was a Memo of
Understanding between Brazos County Grounds Maintenance
Division and TAMU College of Architecture for consulting
services for the Juvenile Services Center and fee payment.
On motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute the Memo of Understanding and authorized the
payment of $4,400.00 to TAMU College of Architecture.
The Court next considered Change Order No. 8 for the
Juvenile Justice Center Construction Contract. This Change
order would increase the contract in the amount of $1,001.10.
On motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to approve Change Order
No. 8 for the Juvenile Justice Center Construction Contract.
A copy of the Change order is attached hereto.
The next matter for consideration was an energy
assessment for all County facilities. The assessment is to be
done at no cost to the County and will identify possible cost
effective facility upgrade measures. On motion by the County
Judge, seconded by Commissioner Norton, the Court voted
unanimously to authorize the County Judge to execute the

application authorizing the Energy Conservation Coalition to
conduct an energy assessment for all County facilities.
The Court next considered an incentive package for Texas
Recycling and Reclamation. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the incentive package for Texas Recycling and
Reclamation in accordance with the City of Bryan agreement.
A copy of which is attached.
The next matter for consideration was a supplement to the
Independent Contractor Agreement with Junction Five-0-Five.
This is will add the Raymond Stotzer Parkway (SH 60) Citizen's
Collection Station to the sites already manned by Junction
Five-O-Five. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the supplement to the Independent Contractor Agreement and
authorized the payment of $1,186.50 monthly for the services
rendered by Junction Five-O-Five. A copy of the supplement is
attached hereto.
On motion by Commissioner Sims, seconded by Commissioner

The Court next considered awarding the following bid:
Bid No. 96-037 - Annual Contract for Office Furniture
Cheryl Turney, Purchasing Agent,
explained the reason for removing the
stacking chairs from the tabulation to
allow comparing "apples to apples". On
motion by Commissioner Walker, seconded
by Commissioner Norton, the Court voted
unanimously to award the contract to EOS
and to name Sav-On as the alternate

bidder. A copy of the bid tabulation is
attached hereto.
The Court next considered awarding the following bid:
Bid No. 96-038 - Janitorial Supplies Annual Contract
Cheryl Turney, Purchasing Agent,
recommended acceptance of the bid
submitted by Unisource. On motion by
Commissioner Sims, seconded by
Commissioner Norton, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Unisource. A copy of the bid
tabulation is attached hereto.
The Court next considered approval of a requisition from
General Funds for the purchase of a copier for the Justice of
the Peace, Precinct 4. Cost of the copier is $5,850.00. On
motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to approve the requisition
in the amount of $5,850.00 to be paid from the General Fund
for the purchase of a copier for the office of Justice of the
Peace Precinct 4.
The Court next considered approval of the following three
(3) requisitions from Capital Expenditures:
a) Ladder rack and freon tank tower for
Maintenance. Cost $375.94. On motion by
Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the
requisition in the amount of $375.94 to be paid
from Capital Expenditures for the purchase of a
ladder rack and freon tank tower for Maintenance.
b) Chairs for the Treasurer's office. Cost
$1,110.86. The Treasurer's budget will require
$160.80 in additional funds to cover the cost of
the chairs. Commissioner Walker moved to approve
the requisition and to pay the additional $160.80
from the Capital Projects fund. Commissioner
Norton seconded the motion. Commissioner Norton,
Walker and Cauley voted "Aye". Commissioner Sims
and the County Judge voted "No". The motion
carried.
c) T-lets equipment upgrade for the Sheriff's
office. Total cost $10,456.00. On motion by
Commissioner Norton, seconded by Commissioner
Walker, the Court voted unanimously to approve the
requisition in the amount of $10,456.00 to be paid
from Capital Expenditures for the purchase of an
equipment upgrade for the Sheriff's Office.

The Court proceeded to consider the following blanket
Purchase Order:
Briggs Healthcare Jail $1,000
On motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The next matter for consideration was approval for the
Purchasing Agent to advertise for bids for the following
items:
a) Hot Mix Asphalt Concrete Pavement
b) Aggregate for Surface Treatments
c) Flexible Base
d) Asphalt, Oil and Emulsion Products
e) Culverts
on motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the
Purchasing Agent to advertise for the previously mentioned
bids.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Susan K. Deere's
on Timberwilde Drive in Precinct 3 to construct a driveway for
' school bus activity. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to

authorize the work.
The next matter for consideration was the acceptance of
the City of Bryan's cost estimate of $23,900.00 to relocate
electrical distribution power lines for Fickey Road widening
project in Precinct 2. On motion by Commissioner Walker,

to accept the cost estimate and authorized the payment of
$23,900.00 to the City of Bryan to relocate electrical
distribution power lines.
The Court next considered the request from GTE to place
E' a road bore in the right-of-way of I&GN Road and install
buried cable in the right-of-way of Capstone Drive. The site

is located in Precinct 1. The County Engineer stated that all

appeared to be in order and recommended approval. On motion
by Commissioner Norton, seconded by Commissioner Walker, the
Court voted unanimously to approve the request of GTE and
authorized the installation. A copy of the request is

attached hereto.
The Court next considered approval of the Preliminary
Plat of Lot 1 and 2 & Block 1, Hare Lane Estates in Precinct
2. Richard Vance, County Engineer, stated that he had
reviewed the plat and offered the following comments:
1) Add "Private" notation to Hare Lane
2) Rotate vicinity map 900
On motion by Commissioner Walker, seconded by Commissioner
Norton, the Court unanimously approved the Preliminary Plat of
the Lot 1 and 2 & Block 1, Hare Lane Estates subject to

compliance with the recommendations noted previously.
The Court next considered approval of the Final Plat of
Joy Pottery Subdivision in Precinct 3. Richard Vance, County
Engineer, stated that he had reviewed the plat and offered the

1) Add 10 foot utility easement across back of
lot.
2) In Note #3, the reference to a 5 foot sideline
set back should be 15 foot to match the 15
foot utility easement.
On motion by Commissioner Sims, seconded by Commissioner

Joy Pottery Subdivision subject to compliance with the
recommendations noted previously.

The Court acknowledged receipt of the Order Determining

Compensation of the County Auditor, Assistant Auditors and

Court Reporters.
There was no citizen input and/or concerns.
The County Judge made the following comments:
1) TxDOT is asking counties to list areas of
traffic hazard for its 1999 Federal Hazard
Elimination Program
2) Referenced Texas Natural Resource Conservation
Commission (TNRCC) memo relative to Municipal Solid
Waste Permit that allows medical waste disposal in
the North Point Industrial area..

3) Compensatory time balances. If an overpayment
was made for compensatory time balances, the County
would need to collect funds from employees.
Commissioner Sims made the following comment:
1) The Subdivision Regulation Committee meets in
Austin on September 19, 1996 and an agenda item is
detrimental to county government.
Commissioner Cauley made the following comment:
1) The Citizen's Collection Station on Raymond
Stotzer Parkway (SH 60) will open September 23,
1996 and follow the same hours as the Smetana site.
The County Judge commented that the Order setting the
compensation for the Auditor was received after the budget was
set and that he would speak to the District Judges about it.
Commissioners Sims and Norton both question the title of
Assistant County Auditors given to all employees in the
department. Commissioner Norton then asked where the funds
were coming from to fund these raises. The County Judge
replied the funds would come from the Contingency Fund.
Commissioner Cauley asked to see budgetary printouts from 1992
to 1995. Commissioner Norton noted that one District Judge
had refused to sign the Order because it was done after the
budget was set. He stated that it was the prerogative of the
Court to determine where funding comes from. He then
suggested that it come from the supplement paid to the
District Judges'
There being no further business to come before the Court,
the meeting was adjourned.

On this the 17th day of September 1996 at a regular meeting of the
commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Sandie Walker, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;

The following proceedings were held:
THAT WHEREAS, on September 17, 1996, the Court heard and
approved a budget amendment for the 1995-1996 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adoptad September 26,
1995 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).

THIS AGREEMENT is entered into this 11th day of September, 1996 A.D., by and
between BRAZOS COUNTY, Texas (County) and the Brazos County Emergency
Communications District 9-1-1 (District) pursuant to the authority of the Texas Interlocal
Government Cooperation Act, Article 4413(32c), V.T.C.S.
WHEREAS, pursuant to Article 1432 (e), V.T.C.S. , the District has been formed and is
a political subdivision of the State of Texas; and,
WHEREAS, Brazos County is also a political subdivision of the State of Texas authorized
to enter into interlocal cooperative governmental agreements; and,
WHEREAS, the Brazos County Commissioners in public meeting find that it is mutually
beneficial for the County and the District to enter into an agreement for the District to
perform for the County, Emergency Communications Services Dispatching;
NOW THEREFORE; IN CONSIDERATION of the mutual promises to each other made
hereinafter, the undersigned parties agree as follows:
Effective October 1, 1996, the District is hereby appointed the emergency communications
dispatching authority for Brazos County for the period October 1, 1996, through and
including September 30, 1997.
The District, shall be responsible for providing a functioning computer aided dispatch
system to the County.

The County agrees to pay and the District agrees to accept as compensation for the
services provided a flat fee of one hundred forty four thousand one hundred and by
($144.140) and N01100 DOLLARS. The County shall pay the full amount due within ten
days of invoice from the District. All payments shall be subject to the Texas Prompt Payment
Act. Should there arise any dispute, disputed amounts shall be deposited in a mutually agreed
upon escrow account until a resolution.
District employees shall not be considered as County employees.
The County and the District understand and agree to be subject to all the laws, ordinances
and regulations which govern and affect Emergency Communications Dispatching and
National Crime Information Computer network telecommunications as promulgated by the
State of Texas or the United States Government or any of its appropriate Agencies, such as
the Texas Department of Public Safety or the Federal Bureau of Investigation.
This agreement is made in accordance with the Texas Emergency Telephone Number Act,
Section 772.301 et seq., Texas Health and Safety Code.
Each of the parties to this agreement agrees to hold the other harmless for any and all
claims of whatsoever nature or kind which may arise as a result of that party's fulfillment of
this agreement.
Each party hereby empowers and authorizes its Chief Administrative Officer to be
signatory agents for any required documentation to implement the intent of this Agreement.
This agreement contains all of the commitments and covenants of the parties and any oral
or written promises not contained herein shall have no force or effect to alter any term or
condition of this agreement.
This agreement may only be modified or amended in writing by the mutual consent of the
parties with said modification being attached to and incorporated into this agreement by this
reference for all purposes.

This agreement is made between BRAZOS COUNTY, TEXAS, hereinafter called Lessor, and PRAZOS
VALLEY ART LEAGUE, hereinafter called Lessee is as follows:
Lessor, the Owner of the Brazos Center, a multi-use building and the adjacent grounds has agreed and
does hereby agree, to lease and demise unto Lessee, a portion of the Brazos Center, hereinafter described,
upon the following terms and conditions.
1. Lessee shall be entitled to the space allocated to it by the Director of the Center
for a term beginning October 1, 1996 and ending September 30, 1997. The space
allocated to Lessee is described in Attachment "A" hereto, which has been signed
by the Director of the Center.
2. A. In consideration therefore, Lessee agrees to pay the Lessor on the first day of
each calendar month during the term hereof, in advance, the sum of $50
representing the agreed monthly rental for use of such space as herein set forth.
B. In addition Lessee has permission to use Concourse and other space needed
which has been scheduled with the Brazos Center for three art shows per year.
Two shows, the Juried Art Show as well as the Nature in Art Show are to be the
responsibility of Lessee. At least one other show, thrr Youth Art Show, has
permission to use similar space scheduled with Brazos Center agreement if Lessee
has agreed to serve as prime consultants.
3. Lessee agrees to arrange and hang work of local artists on a continual basis in
Showcase Ill. Artists works chosen to be spotlighted are the sole responsibility of
Lessee. At least six artists per year will be featured.
4. Lessor shall furnish all utilities, including gas, water and electricity.
5. Lessee will pay the regular User fees for space used by it, other than space
allocated to it under this agreement.
6. Lessor does not provide and will not provide furnishings, custodial care, or
maintenance of the space allocated to Lessee under this agreement.
7. Lessee shall take good care of the space allocated to it, reasonable wear and tear
only excepted, and shall surrender the premises at the termination of this
agreement.
8. Lessee agrees that no improvements to or alterations to the space shall be made
without the consent of Lessor in writing.

9. Risk of loss of all property owned by Lessee shall remain with Lessee, it being
understood that Lessor will maintain no insurance on such property. Any insurance
desired by Lessee on Lessee's property shall be purchased by Lessee at its

10., Lessor shall not be liable to Lessee or the Lessee's employees for any damage to
person or property caused by the negligent act of Lessor, its agent, servants,or
employees or due to the act of any other tenant in the building, or due to any
defect or want of repair in any part of the building of which the allocated space
forms a part.
11. Lessee agrees to hold Lessor harmless from any and all claims, damages, expenses,
including attorney's fees, growing out of or arising from any negligent act on the
part of Lessee, its agent, servants or employees.
12. No sign shall be placed at, on, or about the premises by Lessee except with the
approval of the Center Director in writing.

This is a memo of understanding by and between Brazos County-Grounds Maintenance
Division and TAMU College of Architecture for consulting services and fee payment as
described herein:
Services to be provided to Brazos County:
Survey and assessment of the landscape needs for the Juvenile Services Center.
Supervision of Graduate Student(s) work relating to the Juvenile Services Ccnter
landscape plans and implementation thereof.
Signature of approval on final working plans for both landscape and irrigation.
Professional services to be provided by Jon Rodiek, Ph.D., ASLA of the TAMU College
of Architecture.
Consulting fees of $4,400 will be paid to TAMU College of Architecture as follows:
$2,200 on or before November 1, 1996
$2,200 on or before March 1, 1996
Due to the professional nature of the services described herein, standards of performance
have been agreed to by both parties as outlined in Attachment 1 (revised June 25, 1996).

Introduction
The following proposal outlines the work to be accomplished in order for a
planting Master Plan to be produced for Brazos County Events Facilities. The
planting Master Plan will be presented in three phases.
1. In phase one a base Master Plan will be developed at an appropriate scale
so that a site preparation plan can be delineated. A site preparation plan
will identify the following tasks:
1. Reuse of cidsting soil, plants, rocks and building materials so as to
enhance the design character of the site.
2. Stockpiling of on-site construction debris and excess materials left from
building construction.
3. Stockpiling of construction materials related to the plant master plan
implementation.
4. Protection of on site trees, drainage ways, natural areas.
5. Pruning of existing on site trees to achieve desired design effect.
6. Stakeout and grading of special areas prior to actual construction.
II. In phase two a master planting plan will be presented at a scale of 1: = 40'-
00". This plan will include all trees, shrubs. sod areas, hydromulching
areas and wildflower areas to be located on the site. This phase of work
will include a complete plant list which specifies the genus, species,
common name, quantity, size and special conditions necessary to carry out
the plan on the site. Also planting details for all tree and shrub types will
be developed.
III. In phase three a master irrigation plan will be presented at an appropriate
scale. This plan will include irrigation pipe layout, irrigation head size and
scheduling. Also construction details will be developed.

Scope of Work
The Planting Master Plan shall include a planting plan that
comprehensively describes the construction of a landscape plan for the
Juvenile Justice Center. which is divided into three related areas: 1. The
employee parking lot on the west side of the building, 2. The back area of the
facility, the loading area. and 3. The surrounding grounds or open field area to
the north of the building. L#
The planting plan will be derived using a low maintenance concept Low
maintenance does not mean "no maintenance". It means a realistic amount of
maintenance will be applied to the site in a judicious manner. This concept
requires the selection of native plant species, and low maintenance plant
species requiring low to normal amounts of irrigation and light-schedule
cultivation, pruning, mowing and cutting.
The entry signage area will be designed so as to carry out this low
maintenance concept. This area will be given the attention a public entry
requires. A quality visual image will be, created along this entry so as to modify
the perception of the facility as being a totally negative place to be. Rather it
should be portrayed in terms of its landscape elements as part of the cultural
and social fabric of the City of Bryan.
Tree and shrub selection will be based on a survey of the local
surrounding plant communities. The selection will also be based on the
availability of plant materials from within the central Texas region.
An irrigation plan will be developed so as to keep the grounds in the
primary, secondary and tertiary area under the same kinds of supplemental
watering. Leery effort will be made to conserve water and limit Its use over
the growing season.
Client Meetings
We wish to have at least three meetings with the client representative.
An initial meeting should be held in early July to review the proposal and to
visit the site. A mid-project meeting should be held to review progress being
made in late October. A formal presentation of the Master Plan might be held
around December 10. 1996.
We can have subsequent meetings as required given proper notice in
advance. We have scheduled the months of February and March as
supervision time. We will meet on an as-needed basis at that time.

Conservation Coalition (ECC) conduct a no cost preliminary survey of our
facilities to identify possible cost effective Facility Upgrade Measures.
These measures along with Operation and Maintenance (O&M)
modifications will reduce our utility costs and will assist in funding our facility

SUPPLEMENT TO INDEPENDENT CONTRACTOR AGREEMENT
WHEREAS, Brazos County, Texas, acting by and through its duly
elected Commissioners Court (hereinafter "COUNTY") and Junction
Five-O-Five, a Texas non-profit corporation (hereinafter
"JUNCTION"), executed an Independent Contract Agreement dated the
17th day of November 1992 for the establishment and management of
recycling centers in Brazos County, Texas (hereinafter the
"Agreement"); and
WHEREAS, it was contemplated by the parties that additional
recycling center sites would be added over time to be operated upon
the same terms and conditions set forth in said Agreement.
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that for and in
consideration of the mutual conditions and covenants herein set
forth the receipt and sufficiency is hereby acknowledged, the
parties hereto agree as follows:
1. To add to the list of recycling center sites
to be operated pursuant to the Agreement the
sites(s) described on Exhibit "A": attached
hereto and made a part hereof for all
purposes.
2. COUNTY agrees to pay JUNCTION the sum of One
thousand one hundred eighty six and 50/100
Dollars ($1,186.50) per month for the services
to be rendered by JUNCTION at the site(s)
described pursuant hereto and the Agreement.
In all other respects the terms and conditions of the
Agreement remain unaltered and the parties hereto confirm, ratify
and reaffirm the terms and conditions of said Agreement.

1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees,
etc. from county right-of-way.
D) Construction shall be In strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility constrictlon.

From College Station take Wellborn Road towards
