THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
AUGUST 27, 1996 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,

REGULAR MEETING
August 27, 1996
A regular meeting of the Commissioners'
Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, August 27, 1996, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding=
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct
2, Absent;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of citizens and officials in
attendance:
The County Judge gave the invocation and led the pledge
of allegiance.
There was no citizen input or concerns.
The Court proceeded to consider the change of status of
the following employees.

transferring the
employee from Hot Check to the County Attorney's office.
On motion by Commissioner Cauley, seconded
by Commissioner
Sims, the Court voted unanimously to approve the changes as
submitted.

The Court next considered the following Claims as
submitted by the County Treasurer for payment:
96009666 through 96009928
On motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered Budget Amendment #95/96-39,
which would reallocate funds budgeted for the 361st District
Court, Brazos Center, Court and Jury Services, and the
Sheriff's Office. Commissioner Sims questioned the transfer
of funds to the miscellaneous account. On motion by
Commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the County
payroll in the amount of $522,000.00 for the period ending
August 29, 1996.
The next matter for consideration by the Court was a
written request submitted by the Building Maintenance
Department requesting authorization to hire a temporary part-
time janitor. One of the regular part-time janitors is
recovering from an extended illness and is not expected to
return to work until sometime in November and he would like to
hire someone until that time. On motion by Commissioner
Cauley, seconded by Commissioner Sims, the Court voted
unanimously to grant the request and authorize the position.
On motion by Commissioner Cauley, seconded by
Commissioner Norton the Court voted unanimously to authorize
the Purchasing Agent to obtain Requests For Proposals for a
personnel and salary study.
The Court next considered Change Order numbers 3, 4, and
7 for the contract with Chappell Hill Construction Company for
the construction of the Juvenile Justice Center. Change Order
number 3 would decrease the contract in the amount of
$1,170.00, Change order number 4 would increase the contract

in the amount of $832.00 and Changer order number 7 would
increase the contract in the amount of $414.75. On motion by
Commissioner Sims, seconded by Commissioner Norton the Court
voted unanimously to approve Change Orders number 3, 4 and 7
as submitted. Copies of the Change Orders are attached
hereto.
Next to be considered was an agreement with the City of
Bryan for housing, labor, supplies, equipment and maintenance
of the Brazos County Law Library. For the above mentioned
services the County would pay to the City of Bryan $10,956.00
payable in installments of $913.00 per month. On motion by
Commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to enter into agreement with the City
of Bryan for the maintenance of the Brazos County Law Library.
The next matter for consideration was approval of a
requisition for payment from the General Fund for two (2)
typewriters for the County Attorney's Office in the amount of
$564.98. On motion by Commissioner Sims, seconded by
Commissioner Norton the Court voted unanimously to approve the
requisition from the General Fund and authorized the payment
$564.98 for two (2) typewriters.
The next matter for consideration was approval of a
requisition for payment from Capital Expenditures for three
(3) replacement chairs for the County Attorney's Office in the
amount of $747.00. On motion by Commissioner Sims, seconded
by Commissioner Cauley the Court voted unanimously to approve
the requisition from the Capital Expenditures and authorized
the payment $747.00 for three (3) chairs.
The Court next considered bid number 96-034 for the sale
of miscellaneous law books. The County Judge recommended the
withdrawal of item number twenty-seven (27) which was the law
books for the jail. After discussion and on motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to withdraw item number twenty-seven (27)
and to accept the bids received on the following items:

On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the following Blanket Purchase Orders:

The Court next considered purchasing procedures for
sealed competitive bids for the Road and Bridge Department.
After discussion of the procedures and releasing encumbered
funds on open purchase orders Commissioner Norton moved to
approve the Purchase Procedures for Sealed Competitive Bids as
submitted for a ninety (90) day period before final
implementation. The motion was seconded by Commissioner Sims
and carried unanimously. A copy of the Procedures is attached
to and made a part of these minutes.

on motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to approve the above
listed requisitions for the Road and Bridge Department.
The next matter before the Court was the adoption of a
Resolution stating that the Commissioners Court of Brazos
County designates all vehicles used by the Constable Precinct
4 Department which are used for law enforcement shall carry
Regular License Exempt Plates and shall so be designated. The
County Judge voiced concerns about this request by Constable
Precinct 4. After discussion, Commissioner Norton moved to
adopt the Resolution that would designate the vehicles in the
Constable 4 Precinct used for law enforcement to carry Regular
License Exempt Plates. The motion was seconded by
Commissioner Cauley, with Commissioners Norton, Cauley and
Sims voting "AYE". The County Judge voted "NO" whereupon the
motion was announced carried. A copy of the Resolution is
attached hereto.

On motion by Commissioner Sims, seconded by Commissioner
Norton the Court voted unanimously to ratify the Blanket
Purchase Order in the amount of $5,000 to Manpower for the
Risk Management Department.
The Court next considered renewal of a lease agreement
between Brazos County and the Junior League Of Bryan/College
Station for lease of space in the Brazos Center. The Court
was advised that there is no change in this lease from the
previous year. Term of the lease is for the period of one
year commencing on June 1, 1996 and ending May 31, 1997. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to renew the lease agreement
between Brazos County and the Junior League of Bryan/College
Station. A copy of the lease agreement is attached.
The Court next considered acceptance of the Sweetwater
Subdivision as a Brazos County maintained subdivision. The
County Engineer stated that the two-year contract maintenance
agreement has expired and the subdivision has passed the
County Engineer's inspection. On motion by Commissioner
Norton, seconded by Commissioner Sims, the Court voted
unanimously to accept the Sweetwater Subdivision as a County
maintained subdivision.
Next to be considered was the appointment of a member to
the Brazos Valley Development Council Board of Directors.
Commissioner Sims moved to appoint Commissioner Cauley to the
Board. The motion was seconded by Commissioner Norton, with
Commissioners Sims and Norton and the County Judge voting
"AYE". Commissioner Cauley abstained.
Under citizen input, Jerry Brown recommended that the
Court give consideration to computerizing the Brazos County
Law Library using CD Rom and if the County must provide a law
library for jail inmates allow them access to the Brazos
County Law Library and eliminate the need for two libraries.
There being no further business to come before the Court
the meeting was adjourned.

On this the 27th day of August 1996 at a regular meeting of the
Commissioners' Court, the following members were present:

THAT WHEREAS, on August 27, 1996, the Court heard and approved
a budget amendment for the 1995-1996 budget year for Brazos County,
Texas.

meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 26,

PREAMBLE
This agreement -is made and entered into on this the 2"_ day of
A ve. AJ *r , 1996, by and between the Commissioner's Court of Brazos County, Texas,
hereinafter "COUNTY", and the City of Bryan, a Municipal Corporation of the State of
Texas, hereinafter "CITY." The parties to this agreement are authorized to make and
enter into this agreement under the Interlocal Cooperation Act, Chapter 791,
Government Code. Tex. Goy'T CODE ANN. §791 (Vernon 1994 & Supp. 1996). Said
Act shall govern the relationship between the parties to the extent required to bring this
agreement under the authority of the Act. The parties agree as follows:
1. MUTUALLY BENEFICIAL AGREEMENT
1.1 In and for the consideration of mutual benefits as set forth herein,
COUNTY agrees to loan the Brazos County Law library to CITY for CITY to house
and maintain in the Bryan Public Library, a place known to be both convenient and
accessible to the judges and litigants of Brazos County, Texas.
1.2 CITY acknowledges it benefits from having the law library collection housed
in the Bryan Public Library in that it serves as a valuable resource for legal information
that is available to the general public, students, litigants, business professionals, and city
and county government officials.
13 COUNTY acknowledges it benefits from having CITY house and maintain
the law library collection in that the county is relieved of operating a professional law
library maintained by professional librarians, all located in a quiet, academic environment

open to the public six days a week. By housing the law library collection in the Bryan '
Public library the county is afforded the considerable benefit of not being required to
provide and maintain supervision, electronic surveillance, furnishings, rest rooms, water
fountains, telephones, copiers, additional book shelves, and a workroom.

2. TERM
2.1 This Agreement shall remain in full force and effect for a term of one year
beginning with the date specified in the Preamble and may be renewed annually. Any ,
party desiring to terminate this agreement shall give advance notice of its intention by
written notice to the other party not less than ninety (90) days before the next annual
renewal date. Any notice required by this agreement shall be sent to, respectively:

2.2 Upon termination, COUNTY, at its expense, shall cause the Brazos County

Law library to be removed from the Bryan Public Library. `
2.3 Removal of the Brazos County Law Library by COUNTY shall be
completed in a reasonable time, but in no event later than 5:00 p.m. on the one-
hundredth (100th) day following the day notice of termination is received by the other
party.
3. HOUSING, LABOR, SUPPLIES, EQUIPMENT, AND MAINTENANCE j
3.1 In consideration for CITY agreeing to house and maintain the Brazos
r County Law Library, COUNTY agrees to pay to CITY the annual sum of $10,956.00, '
payable in installments of $913.00 per mbnth, as compensation for the labor, supplies,
equipment, maintenance, and housing of the law library collection '

j 32 COUNTY shall pay the first monthly installment within ten (10) days of
the day this Agreement is executed by the parties.
3.3 COUNTY shall pay the second monthly installment on the fifteenth (15th)
day of the month following the month this Agreement is executed.
3.4 Each subsequent payment shall be on the fifteenth (15th) day of each
month until the Agreement is terminated by one of the parties.
3.5 The final payment under this Agreement shall be calculated on a pro rata
basis; the pro rata figure is to be calculated by dividing the monthly payment by thirty
(30) days.
3.6 The annual sum payable from COUNTY to CITY shall be reviewed on an
annual basis and, when deemed necessary by the parties to this agreement, revised to
reflect a more equitable arrangement. Any review and revision shall take place in July;
the effective date shall be the first month of COUNTY's fiscal year which, at the time
of this agreement, is October - September.
3.7 COUNTY shall compensate CITY by payments made from current revenues
available to COUNTY.
4. USE
4.1 At the time of this Agreement, the Brazos County Law Library includes the
following:
(a) Legal publications and materials owned or leased by COUNTY;
(b) Equipment consisting of a video cassette recorder, card catalog, monitor,
utility cart, book truck, kick-stool, and three (3) Remington-Rand bookcases
(14 sections per range); and

(c) Legal publications and materials on loan to COUNTY from members of
the Brazos County Bar Association.
4,2 Title to these publications, materials, and items shall remain vested in
COUNTY and those members of the Brazos County Bar Association who have loaned
publications and materials to the Brazos County Law Library.
4.3 All requests by the members of the Brazos County Bar Association to
remove their loaned materials from the Brazos County Law Library shall be approved
by COUNTY and submitted to CITY for fulfillment.
4.4 CITY agrees to house the Brazos County Law Library in the Bryan Public
Library where it will be available to the public during the normal operating hours of the
Library.
4.5 Use of the law library collection shall be subject to the rules and
regulations of the Bryan Public library as they now exist or as they are later amended.
4.6 The law library collection shall not be available for circulation to patrons.
4.7 CITY shall seek to protect the law library collection by using any electronic
surveillance or electronic book monitoring system which is utilized throughout the Bryan
Public Library. Any charge or expense, including labor, for the implementation of such
a system as it pertains to the law library collection shall be borne by COUNTY.
5. PROPERTY INSURANCE
Insuring the collection and equipment of the Brazos County Law Library shall be
the responsibility of County and at COUNTY's expense.
6. MAINTENANCE OF COLLECTION
6.1 The staff of the Bryan Public Library shall process, catalog, and shelve the
publications and materials as they are received into the law library collection.

6.2 All publications and materials received by the Bryan Public Library for the
Brazos County Law Library shall be stamped "Property of Brazos County Law Library".
63 On the date this Agreement is executed by the parties, a list of publications
and materials comprising the law library collection shall be attached hereto as Exhibit
"A".
6.4 Additions to the law library collection shall be subject to the same
provisions as the initial collection.
7. SELECTION OF PUBLICATIONS AND MATERIALS
7.1 The selection of publications and materials to be added to or deleted from
the law library collection shall be made by the County Law Library Committee of the
Brazos County Bar Association.
7.2 Pursuant to Section 323 of the Local Government Code, the actions of the
committee are subject to approval of the commissioner's court. Tex. Loc. Gov't. Code
Ann. $323.024 (Vernon 1988 and Supp. 1996).
73 All additions, as well as the cost of keeping the law library collection
current (i.e., pocket parts, new and revised volumes, and other supplemental materials)
shall be borne by COUNTY.
IN WITNESS WHEREOF, COUNTY and CITY have signed this agreement, in
multiple originals, effective on the date specified in the Preamble.

This agreement between BRAZOS COUNTY, TEXAS, hereinafter called
Lessor, and JUAX0r'LSAf1f1B'°0VDR1AN1C10LLsaz sTATION; hereinafter called
Lessee, is made as follows:
Lessor, the owner of the Brazos Center, a multi-use building and the
adjacent grounds has agreed and does hereby agree, to lease and demise
unto Lessee, a portion of the Brazos Center, hereinafter described, upon
the following terms and conditions.
1. Lessee shall be entitled to the space exclusively
allocated to It by the Director of the Center for a term
extending from Jane 1 :29.9.6 ~ttj7t~L.L.tlfdp X31 JP-499x. The
space allocated to Lessee is described in Attachment "A"
hereto attached, which has been signed by the Director
of the Center.
2. In addition, fees for temporary use of space required
for provisional, membership and board of directors
meetings are included in this contract as well as space
for the League Placement Fair and space occupied by two
storage cabinets In the Brazos Center receiving area.
All meetings held in other than League office space
should be scheduled as far in advance as possible on a
space available basis.
3. Fees for meetings Involving small spaces for puppet show
practice as well as for committee meetings are also
covered in this contract provided the following
conditions prevails
a. Meetings in small rooms are to be held only during
normal business hours or after 5 p.m. when another
activity Is scheduled requiring a Brazos Center
attendant to be on the premises;
b. If the space used for the meeting has been previously
set-up for a meeting scheduled at a later time by
another group, the committee chairman will be
responsible for determining that the room is in the
exact state as when the room was entered;
c. The committee chairman should give the Brazos Center
office a notice of intention to meet no less than
one week in advance.
d. The League member in charge of the meeting will sign
a sheet kept in the Brazos Center office noting the
date, name the committee meeting, the entry time
and the departing time.

4. Zn consideration therefore, Lessee agrees to pay the
Lessor, on the first day of each calendar month during
the term hereof, in advance, the sum of $525.00 (five
hundred and twenty-five dollars) for rental of
exclusively occupied space as well as for fees assessed
for space for temporary uses described above. Zn
addition, Lessee has permission for free use of Assembly
Z, Assembly ZZZ and/or Assembly ZV for two six-hour
periods as scheduled in advance with the Brazos Center.
Additional uses of Assembly Z, Assembly ZZZ and/or
Assembly ZV for membership meetings may be scheduled on
a first-come, first-serve basis for $50 per day for each
space.
5. Additional charges may be made for activities other than
those specified in this contract. Lessee will pay the
regular User fees for space used by it, other than space
allocated to it under this agreement.
6. A. Lessor shall furnish all utilities, including gas,
water and electricity.
B. Lessee shall furnish telephone and answering service
for itself.
7. Lessor does not provide and will not provide
•
furnishings, custodial care, or maintenance of the space
allocated to Lessee under this agreement.
8. Lessee shall take good care of the space allocated to '
It, reasonable wear and tear only excepted, and shall
surrender the premises at the termination of this
agreement.
i 9. Lessee agrees that no improvements to or alterations to
the space shall be made without the consent of.Lessor in
writing.
10. Risk or loss of all property owned by Lessee shall
remain with Lessee, it being understood that Lessor will
maintain no insurance on such property. Any insurance
desired by Lessee on Lessee's property shall be
purchased by Lessee at its expense.
11. Lessor shall not be liable to Lessee or the Lessee's
employees for any damage to person or property caused by.,
the negligent act of Lessor, its agent, servants, or
•
; employees or due to the act of any other tenant in the
building, or due to any defect or want of repair in any '
part of the building of which the allocated space forms
a part.

12. Lessee agrees to hold Lessor harmless from any and all
claims, damages, expenses, Including attorneys fees,
growing out of or arising from any negligent act on the

part of Lessee, Its agents, servants or employees.
13. No sign shall be placed at, or on, or about the premises
by Lessee except with the approval of the center
Director In writing.
11. Lessee president, as designated below right, shall be
Issued only one key to the office allocated space and
one key to storage closet space. By accepting the key,

Lessee president agrees on behalf of all Lessee
associates to: (a) use the allotted space only when the
Brazos Center Is open for business or in use, and
(b) allow no copies or duplicates of the key to be made.
Lessor agrees to keep two duplicate keys on file in its
office which will be available for use to those deemed
qualified by Lessee.
IN TESTIMONY WHEREOF, the parties to this agreenent have hereunto set
their hands in duplicate, the day and year written below.
