AUGUST 13, 1996

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, August 13, 1996, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of citizens and official in
attendance.
The County Judge gave the invocation and led the pledge
of allegiance. .
Mr. Louis Newman, III presented the Court with a
statement on behalf of the Brazos County Bush Library Funding
Committee and the Bush Library Foundation formally withdrawing
any and all requests for monetary support of the George Bush
Library. The County Judge voiced his disappointment stating
that he feels the Bush Library will benefit the entire
community. Commissioner Sims stated he was disappointed and
grieved that the funding for the Bush Library by Brazos County
had aired in the news media. He is personally honored that
Brazos County had been selected as the site for the Library.
On motion by the Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the County payroll in the amount of $517,000.00 for the
period ending August 15, 1996.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered Budget Amendment #95/96-37,
which would reallocate funds budgeted for Computer and Network
Services, the County Attorney Kids and Kops grant, Brazos
Center and set up C O projects for Road and Bridge, On motion
by Commissioner Walker, seconded by Commissioner Cauley, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
Next to be considered was a request from the District
Attorney to reduce a full time (40 hour per week) clerical
position to 32 hour clerical position with benefits. He asked
that the remaining funds from the full time position be
transferred to a temporary clerical position. On motion by
Commissioner Sims, seconded by Commissioner Norton the Court
voted unanimously to authorize the creation of the 32 hour
clerical position and transfer of the remaining funds to the
temporary clerical position.
The Court proceeded to consider the change of status of

on motion by Commissioner Sims, seconded by Commissioner
Walker, the Court voted unanimously to approve the changes as
submitted.
The next matter for consideration was funding of the Bush
F Library. The County Judge announced that the Court had, at a
previous. meeting, requested information from the Economic
Development Corporation relative to the economic impact the
Bush Library would have on the community and asked Richard
Smith to proceed with the presentation. -Mr. Smith proceeded

with a visual presentation showing the projected sales tax
receipts over a five year period. After the presentation, Mr.
Smith encouraged the Court to fund the Library.
Commissioner Walker commented that this would be the
tenth presidential library in the library system of the
national archives and deems it an honor that the Library will
be situated in Brazos County. After further comments
Commissioner Walker moved to allocate Fifty Thousand Dollars
($50,000) per year for five years to the Economic Development
Corporation for support of the Bush Library. The County Judge
seconded the motion. Restating the motion the Judge asked for
further discussion.
Commissioner Sims voiced concern relative to the previous
statements by Mr. Newman wishing to withdraw he request for
funding.
Demetrios Baskedas, 7191 Old Reliance Road, Bryan spoke
in opposition of funding questioning the legality of the
funding based on Article 3, Section 52 of the Texas
Constitution, and in his opinion, unfunded needs of the
citizens.
Commissioner Norton spoke in opposition to the funding at
this time citing financial constraints.
Ora Walden, 7520 Old Jones Road, College Station spoke in
opposition of the funding, citing needs of the community that
the County is unable to fund at this time.
Tommy Lyons, Millican spoke in opposition of the Court
funding the Library with tax dollars. He suggested the Court
sponsor a benefit to raise the requested funds to allow the
citizens that could afford to participate and those that could
not afford to would not have to participate and He
volunteered to work with the Court in this endeavor.
Melissa Wilkerson, Millican spoke in opposition of the
funding citing the amount of the salary budgeted for the
Constable, Precinct 1 and the county's ability to fund the
needs of the citizens in Precinct 1.

Robert Worley, 3523 Midwest Drive, Bryan, Executive
Director of the Bryan/College Station Economic Development
Corporation, spoke in favor of the County funding the Library
stating it to be a good investment for the County and as a tax
payer he encouraged the Court to provide the funding.
Ronnie Morrison, 707 Avondale, Bryan, President of the
Bryan/College Station Chamber of Commerce, spoke in favor of
the funding of the Library stating it would be in the best
interest of all citizens in the county.
The County Judge called for the vote of the Court by
asking those in favor of the motion to raise their right
hands. ( The County Judge, Commissioners Sims and Walker
raised their right hands.) Those opposed by the same sign.
(Commissioner Norton raised his right hand.) The County Judge
announced the motion passed by a vote of three to one, with
one abstention.
The next matter for consideration by the Court was a
written request submitted by the Juvenile Services for out-of-
state travel state travel for training for J. David Haines.
Mr. Hanines would be traveling to Longmont, Colorado to attend
a course on "Training for Trainers". This advanced course is
not available in the State of Texas. On motion by
commissioner Walker, seconded by Commissioner Sims, the Court
voted unanimously to grant the request from the Director of
Juvenile Services and approved payment of out of state travel
expense for Mr. Haines.
The Court next considered a contract with Unified and
Involved Action Network to proved chemical dependency
assessment and evaluation services for Juvenile Services. The
charge for this service will be $35.00 per assessment. On
motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to approve the contract.

Next to be considered by the Court was the reduction of
funds budgeted for personnel position to the actual salaries
and the transfer of excess funds to contingency. On motion by

Commissioner Sims, seconded by Commissioner Cauley the Court
voted unanimously to reduce the dollars budgeted for personnel
positions to the amount of the actual salary of filled
positions and to step two for vacant positions or those
positions currently filled at a step one. This action does
not effect the agreement currently in place with the District
Attorney's Office.
The Court next considered a Memo Of Understanding between
the Brazos Center and the Brazos Valley Solid Waste Management
Agency (BVSWMA) for the purpose of establishing terms for
constructing and maintaining a Composting Demonstration Garden
on the Brazos County Park grounds. The cost to the only or
this project would be only for irrigation and some supervisory
duties. Commissioner Sims questioned if this was in conflict
with the Master Gardener Project at the Extension Offices.
After considerable discussion and on motion by Commissioner
Walker seconded by Commissioner Norton, the Court voted
unanimously to enter into contract with the Brazos Valley
Solid Waste Management Agency (BVSWMA) for the construction
and maintenance of a Composting Demonstration Garden on the
Brazos County Park grounds.
The Court next considered acceptance of a Warranty Deed
for right-of-way on Fickey Road in Precinct 2. On motion by
Commissioner Walker, seconded by Commissioner Norton, the
Court voted unanimously to authorize the County Judge to
accept on behalf of Brazos County a Warranty Deed from Ila
Loren Schram, Brenda L. Pitts and Carolyn L. Bonifazi for the
expansion and improvements to Fickey Road.
The Court next considered the request from GTE to place
a buried cable in the right-of-way of Mumford Road beginning
approximately 5925 feet northwest of the Bryan City Limits and
extending for a distance of 1653 feet. The site is located in
Precinct 4. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by
Commissioner Cauley, seconded by Commissioner Sims, the Court

voted unanimously to approve the request from GTE and
authorized the installation. A copy of the request is
attached hereto.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested

permission to enter the private property of R. G. Epting
located off Cody Drive for the purpose of utilizing pasture as

truck to the County by agreement that the County
would then transfer the fire truck to the Precinct
3 Volunteer Fire Department. The County is
researching the process for transferring the
property.
There being no further business to come before the Court,

On this the 13th day of August 1996 at a regular meeting of the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Sandie Walker, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;

The following proceedings were held:
THAT WHEREAS, on August 13, 1996, the Court heard and approved
a budget amendment for the 1995-1996 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 26,
1995 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).

assessment and evaluation services for youth either detained or on probation within your jurisdiction. We are

We would also like to develop another contract to provide intensive intervention services. We are currently
developing the program and will notify you upon completion as to program parameters.

CONTRACT FOR SERVICES
The Unified and Involved Community Action Network (U & I CAN), hereinafter referred to as,
"U&I CAN," and Brazos County Juvenile Services, hereinafter referred to as, Juvenile Services,"
by this agreement and in consideration of the below, agree as follows:
1. U & I CAN agrees to provide substance abuse assessment and evaluation services to Juvenile
Services for probationers or clients detained in the Detention Center of Brazos County Juvenile
Services as follows.
A. Written substance abuse assessmcnts/evaluations on probationers and/or clients
detained Juvenile Detention Center which would include substance abuse history, results of the
evaluation, and recommendations;
B. Substance abuse asscssments/cvaluations will be submitted to Juvenile Services within
seven working days (7) from intake of information;
C. Additional reports and/or recommendations will be made available, if needed, to
satisfy information requests from Juvenile Services or Brazos County Courts;
D. U & I CAN will notify the assigned probation officer in the event a probationer fails to
report for the above described services located at U & I CAN or at Juvenile
Probation/Detention;
E. • U & I CAN agrees to adopt implement work place guidelines concerning persons with
AIDS and HIV infection and to develop and implement. confidentiality of AIDS and HIV-
related medical information for employees of U&I CAN and for clients, detainees, and
residents served by U&I CAN, in accordance with the provisions found in ACTS a989, 71st
Legislature, Ch. 1195, Section 5.03 and 5.04.
F. Charges for written substance abuse assessments/cvatuations will be at the rate of
$35.00 per assessment beginning July 1, 1996; U&I CAN will bill Juvenile Services on the last
working day of each month for services rendered that month. Payment will be made from
Juvenile Services to U&I CAN within 30 working days.
II. The venue of this contract is Brazos County, Texas and this contract shall be governed by and in
accordance with the laws of the State of Texas. ,
M. This contract may be terminated by either party thirty (30) days subsequent to receipt of
written notification by either party.
IV. This contract shall become void if there is a sufficient reduction in funding to U&I CAN which would not
permit delivery of services outlined above.
V. This contract will booome effective July 3, 1996 and will terminate July 31, 1997, the end of the fiscal
year for U&I CAN.

MEMO OF UNDERSTANDING
This is a memo of understanding by and between the Brazos Center
and the Brazos Valley Solid Waste Management Agency (BVSWMA). The
purpose of this document is to establish terms upon which the
BVSWMA may construct and maintain a Composting Demonstration Garden
on the grounds of the Brazos County Park.
The following terms are understood and agreed upon by the
designated representatives of both entities:
The location, size, design, signage, and methods of
construction will be approved in advance by the Director of
the Brazos Center.
BVSWMA will maintain the entire garden including, but not
limited to; construction, seasonal plantings,
repair/replacement of any structures, soils, footing
maintenance, plant maintenance, and irrigation installation
and maintenance.
The Brazos Center will not be responsible for any of the cost
incurred in the construction or maintenance of this garden.
The Brazos Center will only be responsible for normal trash
pick-up in the garden.
Either party may discontinue this agreement at any time, for
any reason, upon written notification to the other party,
allowing 30 days from the date of notification for the removal
of the garden. BVSWMA will be responsible for the removal of
the garden and the return of the park area to its original
condition.
This agreement is in effect for three years from the date of
signature.

1. PRESENTATION.
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees,
etc. from county right-of-way.
D) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

Enclosed are two copies of Form ED-135 and work location sketch
showing the location of our proposed buried cable on County Roads
in Brazos County at Bryan, Texas.
This work is to be completed on Work Order 9P606GR #039 which is
scheduled for August 12, 1996. If you have any questions
concerning this work, please contact Richard Wallace office in
Bryan, telephone 409-821-4752 within 15 days so that we may explain
or modify our proposal, otherwise, it is understood that this
proposal is approved.

GENERAL TELEPHONE NOTICE OF COMMUNICATION
COMPANY LINE INSTALLATION
July 31, 1996
TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of County Road in Brazos
County, Texas as follows:
Beginning at a point approximately 5925' northwest
of the Bryan city limits on Mumford Road, 1653' of
buried cable will be placed northwest at 5' within
the southwest right-of-way of Mumford Road. The
proposed cable will be buried to a minimum depth of
30". This replaced an existing cable in route.
The location and description of this line and associated
appurtenances is more fully shown by two (2) copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by the GTE
Southwest Incorporated does not constitute a waiver, surrender,
abandonment of impairment of any property rights, franchise,
easement, license, authority, permission, privilege or right now
granted by law or may be granted in the future and any provision or
provisions so construed be null and void.
Construction of this line will begin on or after the 12th day
of August 1996.
