THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
JULY 23, 1996 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,

A regular meeting of the Commissioners' Court of Brazos

County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
w
a.m. on Tuesday, July 23, 1996, with the following members of

the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of citizens and officials in
attendance.
Commissioner Walker gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The Court proceeded to consider the change of status of
the following employees.

The Court next considered the following Claims as
submitted by the County Treasurer for payment:
96-008625 through 96-008833
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve-the Claims as
submitted.
The Court next considered Budget Amendment #95/96-34,
i
which would reallocate funds budgeted for the Metropolitan
Planning Organization. Commissioner Sims asked why the
Metropolitan Planning Organization director had not signed the
budget amendment. On motion by Commissioner Walker, seconded
by Commissioner Norton, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court next considered a proposal submitted by William
H. McLeod, President of Texas Voting Systems, to clean and
repair the voting equipment owned by the County. In his
letter to the Court Mr. McLeod proposed the following rates:
1) Total cleaning cost $2,212.00
2) Total repair cost $1,520.00
3) Total complete repair and cleaning cost $3,732.00
On motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to accept the proposal for
cleaning and repair cost and authorize the payment of
$3,732.00. Such contract would be paid from the Election
budget under the repairs line item.
The next matter for consideration was financial support
for the Bush Library. Commissioner Sims explained that this
request for $500,000.00 was to be spread over a five (5) year
period. The Library will bring in business and increased
sales tax and will reduce the ad valorem tax on the individual
tax payer. He went on to suggest that since the university
had not requested funds for Easterwood Airport, the county
could direct that $100,000.00 to the Library. Commissioners
Norton, Walker and Cauley all agreed with Commissioner Sims
about the benefits that will be derived from the Library but
• each one noted that since the County could not give raises to

its employees, could not buy equipment for Road and Bridge and
were asking departments to reduce their staff, they could not
see spending $500,000.00 at this time. The County Judge
stated that the Library would bring a great economic increase
to the County. On motion by Commissioner Sims, seconded by
Commissioner Walker, the Court voted unanimously to table
consideration to allow the County Judge time to research the
revenue the Library will bring to Brazos County.
The next matter for consideration were two (2)
applications for military service credit. One from Christy W.
Benson, Jr. and the second from Harrold G. Simpson. On motion
by Commissioner Norton, seconded by Commissioner Walker, the
Court voted unanimously to forward the applications to the
Texas County and District Retirement System along with Mr.
Benson's check in the amount of Three Hundred Sixty Dollars
($360.00) and Mr. Simpson's check in the amount of Five

Hundred Forty Dollars ($540.00) which represents their
contribution for the months of military service for which they
seek credit. The County will match the contribution of each
employee.
The Court next considered a map endorsement with Liberty
Marketing Company. Commissioner Walker moved to approve the
endorsement. Commissioner Cauley seconded the motion.
Commissioner Sims voiced concern that the County is endorsing
private industry. Commissioner Norton claimed he knew nothing
about the company and asked why they needed the County's
support. Commissioner Walker withdrew her motion to approve
the endorsement. Commissioner Cauley withdraw is second. On
motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to table consideration
pending further information.
On motion by Commissioner Norton, seconded by
• Commissioner Sims, the Court voted unanimously to appoint the
following members of the Court as liaisons to the various
departments:

The next matter for consideration by the, Court was a
written request submitted by the County Auditor requesting
approval for out of state travel for himself. Mr. Reynolds
would be traveling to Bethlehem, Pennsylvania to attend the
111996 Government Systems Client Conference" sponsored by
Pentamation. The conference will be held September 8 through
the 11, 1996. On motion by Commissioner Walker, seconded by
Commissioner Norton, the Court voted unanimously to grant the
request from the County Auditor and approved payment of out of
state travel expense for him.
The next matter for consideration was the appointment of
a County representative to the Brazos Valley Development
Council Executive Board. On motion by Commissioner Sims,
seconded by Commissioner Walker, the Court voted unanimously
to appoint the County Judge as Brazos County's representative
to the Brazos Valley Development Council Executive Board.
Such appointment is for a three year term beginning October 1,
1996 an ending September 30, 1999.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to continue collecting
special vehicle registration fees in the amount of $1.50 for
school crossing guards and $10.00 Road and Bridge fees.
Commissioner Norton explained the fees.
The Court next considered acceptance of the City of
Bryan's cost estimate of $4,100.00 to relocate facilities for
Leonard Road widening project. The site is located in
Precinct 4. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to accept the
cost estimate and authorize the payment of $4,100.00 to
relocate facilities for the Leonard Road widening project.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the

general public. The Road and Bridge Department requested
permission to enter the private property of Ronald E. Holmes
on Sandy Point Road in Precinct 4 to dispose of dead
livestock. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the work.
The Court next considered the request from GTE to
construct two (2) road bores for buried cable installation in
the rights-of-way of Democrat Road and Hearne Lane. Both
sites are located in Precinct 3. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the request GTE and
authorized the installation. A copy of the request is
attached hereto.
The Court next considered the request from Wickson Creek

County Engineer, stated that he had reviewed the plat and made
the following exception:
1) Addition of the signature line with
acknowledgement paragraphs for all owners.
On motion by Commissioner Walker, seconded by Commissioner
Norton, the Court unanimously approved the final plat of the
Four Counties Subdivision with the previously noted exception.
The Court next considered acceptance of the City of
Bryan's cost estimate of $601.56 for a 200 amp three phase

c) Parking lot striping for Brazos Center - $2,899.00
d) Bench seat-for the van for the Brazos Center
on motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve requisitions
a, b & c to be paid from Capital Expenditures and requisition
number d, the bench seat for Brazos Center van was tabled.
The Court acknowledged receipt of the Extension 'Service
reports for June 1996 and acknowledged receipt of reports from
County and Precinct offices showing revenues collected and
remitted to the County Treasurer. An excerpt from those
reports is attached hereto.
The County Judge presented the Proposed Budget for the
1996/1997 fiscal year and announced that it would be filed in
the County Clerk's office. He then set August 5, 1996 as the-
date for the Public Hearing and adoption of the budget.

The County Judge made the following comments:

Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on July 23, 1996, the Court heard and approved
a budget amendment for the 1995-1996 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 26,
1995 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).

A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees,
etc. from county right-of-way.
D) Construction shall be In strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

location of our proposed buried cable line on County Roads in
Brazos County at Kurten, Texas.

COMPANY LINE INSTALLATION

TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road in
Brazos County, Texas as follows:
Beginning 360' northeast of the intersection of Democrat
Rd and Oak Lake Rd, we propose to place a buried line
along, parrallel to and 5' inside of the south R.O.W. of
Democrat Rd, a distance of 360' in southeasterly direction.
At this point we propose to bore under the culvert crossing
under Democrat Rd. We then propose to continue placing
buried cable in a northeasterly direction within the
south R.O.W. of Democrat Rd. a distance of 1584' (boring
under an existing tree in front of the A.E. Newcomb

Formal notice is hereby given that (applicant) Wickson Creek, S. U.D-proposes
to place a (type) waterline the right-of-way of (road),
Grassbur Rd, in Brazos County, Texas as ~`ollows:
The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and right-of-ways will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.
4. That Brazos County is in no way responsible for any damage that might
. occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-of-
way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight inches
(48") lower than the center of the roadway whether there is, or is not, a
borrow ditch.
7. That all sites will be barricaded during the construction period.

July 19 96

1. PRESENTATION:
A) No worts will be permitted between front slope andfor back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees,
etc. from county right-of-way.
D) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, -published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.
