BRAZOS COUNTY COMMISSIONERS COURT MEETING
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
MAY 28, 1996 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY-COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

3. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Court on county-related issues not scheduled on the agenda. Please
limit subject matter to five minutes. The Commissioners will receive the information,

way of Wallis Road at its intersection with Old Reliance Road to provide service to
county resident. Site is located in Precinct 3.
14. Request by Road & Bridge to enter Nantucket, Ltd. property located off Arrington Road

A regular meeting of the commissioners, Court of Brazos .
County, Texas was held in the-Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, May 28, 1996, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk. '
Attached is a list of citizens and officials in
attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The Court proceeded to consider the change of status of •

Sims, the Court voted unanimously to approve the Claims as
submitted.

The Court next considered Budget Amendment #95/96-29,
which would reallocate funds budgeted for the office of
Constable Precinct 2; make an adjustment to the Texas
Juvenile Probation Commission, Project Star Grant, and setup
the Brazos Valley Narcotics Trafficking Task Force Grant for
the new budget year. Commissioner Sims questioned adjusting
Contract Placement in Juvenile Services and voiced his
concern. On motion by Commissioner Walker, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to authorize the County
Judge to execute the Grantee Acceptance Notice and accept such
grant funds as will be awarded to the Brazos Valley Narcotic
Trafficking Task Force grant number DB96-N-04-09576.
On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to authorize
negotiations with the firm of Bickerstaff, Heath, Smiley,
Pollan, Kever & McDaniel, L.L.P. to study realigning the
Justice of the Peace and Constable precincts of Brazos County.
The Court next considered adopting a Resolution and
executing a contract for participation in the state's Live
Scan and Electronic Reporting Project Grant which is part of
the Texas Criminal History Improvement Project (TCHIP). This
grant is for electronic arrest updating and programming and
interface to the new live scan fingerprinting equipment. The
Director of the Computer Network Services Department informed
the Court that the grant is in the amount of $36,000 with a
very good possibility of receiving the remaining $11,00 later
in the year. She then asked the Court to commit $11,000 from
the 95/96 budgeted funds in the capital projects-computer
software account should the state not fund the full $47,000
needed to complete the project. On motion by Commissioner
Walker, seconded by Commissioner Norton, the Court voted
unanimously to adopting a Resolution and executing a contract

motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the work.
The Court next considered the request from Wickson Creek
Special Utility District to place a road bore in the right-of-

the Court voted unanimously to approve the request of Wickson

Vance, County Engineer, stated that he had reviewed the plat
and that the preliminary plat was approved as a two lot
subdivision. This plat shows those lots combined into one
lot. On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court unanimously approved the final plat of the
Lot 1, Block 1 Withers Subdivision as submitted.
The Court next • considered approval of two (2)
requisitions from the Brazos Valley Narcotics Trafficking Task
Force for the purchase of Criminal Activity Tracking System
program update and a video recorder. Cost of the program
update is $995.00 and the video recorder is $1,099.00. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the two (2)
requisitions for a total of $2,094.00 to be paid for the
purchase of a program update and a video recorder for the Task
Force.
The Court next considered approval of a requisition from
the District Attorney's Crime Fund for the purchase of a 14
inch color monitor and Compaq Deskpro computer for the
District Attorney's Office. Cost of the monitor is $270.00

and computer is $1,723.00. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the two requisitions for a total amount of
$1,993.00 to be paid from District Attorney's Crime Fund for
the purchase of a color monitor and computer for the District
Attorney's office.
The Court next considered approval of a requisition from
Metpolitan Planning Organization for a 14 inch color monitor,
and 8 meg upgrade for three computers plus installation
charges. Total cost $796.49. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the requisition in the amount of $1,249.00 to be
paid from Metropolitan Planning organization funds.
The Court next considered approval of a requisition from
Capital Expenditures for the purchase of two (2) 48 inch box
fans for the Road and Bridge shop area. Cost of the two (2)
fans is $499.98., On motion by Commissioner Norton, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the requisition in the amount of $499.98 to be paid from
Capital Expenditures for the purchase of two (2) :Fans for the
Road and Bridge shop area.
The Court proceeded to consider the following blanket
purchase orders:
Cains Coffee Co. Jail $800
Standard Coffee Jail $150
On motion by Commissioner Sims, seconded by commissioner
Cauley, the Court voted unanimously to approve the blanket
purchase orders as submitted.
The Court next considered awarding the following bid:
Bid No. 95-006 - Uniform Rental Contract
Cheryl Turney, Purchasing Agent,
recommended acceptance of the low bid
submitted by Mission Uniforms. On motion
by Commissioner Sims, seconded by
Commissioner Walker, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Mission Uniforms. A copy of
the bid tabulation is attached hereto.
The next matter for consideration was approval of an
Interlocal Agreement between the Cities of Bryan, College

Station, Bryan Independent School District and Brazos County
to hold an auction June 22, 1996. On motion by Commissioner
Norton, seconded by Commissioner Cauley, the Court voted
unanimously to approve the Interlocal Agreement between the
Cities of Bryan, College Station, Bryan Independent School
District and Brazos County to hold an auction June 22, 1996.
A copy of the Agreement is attached hereto.
The Court next heard a presentation by Bob Cusack, a
representative from Enershop concerning an energy audit of
County facilities. After hearing the presentation, it was the
consensus of the Court to authorize the Purchasing Agent to
advertise for Requests for Proposals.
There was no citizen input and/or concerns.
The County Judge made the following comments:
a) Right-of-way for FM 1688 has been acquired.
b) Recommended that the meeting of June 25, 1996
be canceled.
c) Thanked all who participated in observance of
the Olympic torch relay.
d) Announced he was negotiating with the
Bickerstaff law firm on the redistricting of
Justice of the Peace, Precincts 1 and 2.
e) Announced that budget hearings were on going.
f) Commissioner Sims had met with representatives
about the Family Practice Medical School.
g) At the 2020 Vision meeting there were 6
projects discussed and the County's project
the Expo Center is one of the,top 6 projects.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

That whereas Brazos County ,
hereinafter referred to as Grantee, has heretofore submitted a grant application to the Governor's Office,
State of Texas, entitled _Brazos Valley Narcotic Trafficking Task Force ,
and further identified by grant number DB-96-N04-09576 ; and
Whereas, the Governor of the State of Texas has approved the g nt'app c~ Q as evidenced by the
Statement of Grant Award from the Governor's Office dated AT 1 ly~ which contained
certain special requirements; and
Whereas, the Grantee desires to accept the grant award, the Uniform Grant and Contract Management
Standards, and special requirements as evidenced by the Statement of Grant Award;
Now, therefore, the Grantee accepts the aforementioned Statement of Grant Award, the Uniform Grant
and Contract Management Standards and special requirements in the grant application and the Statement of
Grant Award as evidenced by the agreement, executed by the project director, the financial officer, and the
official authorized to sign the original grant application, or the official's successor, as presiding officer of
and on behalf of the governing body of this grantee; and
Now, therefore, the Grantee shall designate either the project director or the financial officer to
coordinate and be solely responsible for submission of adjustments pertaining to both program and
financial elements of the application, and the POSITION authorized to submit adjustments
is Project Director

NON-LOBBYING CERTIFICATION:
We, the undersigned, certify that none of the grant funds, regardless of their source or character,
including local cash assumption of cost funds, shall be used in any manner to influence the outcome of any
election or the passage or defeat of any legislative measure.
A finding that a grantee has violated this certification shall result in the immediate termination of funding
of the project and the grantee shall not be eligible for future funding from the Governor's Office,
Criminal Justice Division.

The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and right-of-ways will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.
4. That Brazos County is in no way responsible for any damage that might
occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-of-
way in accordance with governing laws.

6. That the line or lines will be constructed no less than forty-eight inches
(48") lower than the center of the roadway whether there is, or is not, a
borrow ditch.
7. That all sites will'be barricaded during the construction period.

THIS CONTRACT AND AGREEMENT, made and entered into this _ day of
, 19_, by and between the City of Bryan, City or Coll9ge Station, the County of
Brazos, Bryan Independent School District and possibly other public entity, each participating
government acting by and through its respective executive office hereunto duly authorized by
resolution of the governing body.
WITNESSETH:
WHEREAS, the respective participating governments are authorized by the Interlocal
Cooperation Act, V.T.C.A. Government Code Chapter 791, to enter into joint contracts and
agreements for the performance of governmental functions and services including administrative
functions normally associated with the operation of government such as purchasing of necessary
materials and supplies;

WHEREAS, it is the desire of the aforesaid participating governments to comply with and
further the policies and purposes of the Interlocal Cooperation Act;
WHEREAS, the participating governments cannot normally obtain the best possible
commission for the sale of surplus equipment and materials acting individually and without
cooperation; and
WHEREAS, it is deemed in the best interest of all participating governments that said
governments do enter into a mutually satisfactory agreement for the sale of equipment and
materials at a prorated cost of advertising and commission;
NOW, THEREFORE, the parties hereto, in consideration. of the mutual covenants and
conditions contained herein, promise and agree as to each of the other parties and as to all the
parties as follows;
1. The City of Bryan shall be responsible for such administrative duties as may be
necessary to facilitate processing and preparation of a contract with the successful
vendor.
•
2. Brazos County shall provide location to host such sale.
3. Brazos County shall not be liable for theft or damage to any items while on said
entity's property. All items provided for the sale are owned by the participating
entity and each entity is responsible for goods before, during, and after the sale.
Any unsold items shall be removed from said property promptly.
4. Auctioneer shall be responsible for payment to each participating entity for goods
sold and monies collected, less all listed expenses and fees, within seven banking
days of stated auction date.
