THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
MAY 14, 1996 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE.
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,

discussion. (A recording is made of the meeting; therefore, please give your name and

Mumford Road to remove existing fence, clear existing fence line of brush and build
approximately 1,700 feet of new fence for site distance around sharp curve. Site is
located in Precinct 4.
16. Request by Road and Bridge to enter Nance Broach's property located off Castenson Road
to dispose of dead livestock for the health, safety and welfare of the general public. Site
is located in Precinct 2.
17. Requisition from Capital Projects for a computer hard drive and memory upgrade for
Emergency Management.
18. Call for citizen input and/or concerns.
19. Announcement of interest items and possible future agenda topics.
20. Call for Executive Session in accordance with Section 551.074 of the Texas Open
Meetings Act regarding personnel matters.

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, May 14, 1996, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of names of citizens and officials in
attendance.
Commissioner Walker gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The first matter for consideration was budget line
transfers and changes in job descriptions in the Juvenile
Services department. This was tabled at the previous
Commissioners Court meeting to allow the Judge to meet with
the Juvenile Board. On motion by the County Judge, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the budget line transfers and changes in job descriptions in
the Juvenile Services department as attached.
The Court proceeded to consider the change of status of
the following employees.

on motion by Commissioner Sims, seconded by Commissioner
Cauley Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:.
96-006657 through 96-006833
on motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered Budget Amendment #95/96-27,
which would reallocate funds budgeted for the Juvenile
Services Department. on motion by Commissioner Walker,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the budget amendment as submitted, a copy of which
is attached hereto.
The County Judge read aloud a Proclamation designating
the week of May 20 through 26, 1996 as "Respect for Law Week".
The Court joins with the local optimist clubs in carrying the
message of combating crime and encouraging a respect for the
law. on motion by the County Judge, seconded by Commissioner
Norton the Court moved to proclaim the week of May 20 through
26, 1996 as "Respect for Law Week" throughout Brazos County.
The next matter for consideration was the contract for
the Delinquent Tax Attorney. Commissioner Sims explained that
the contract fulfilled the county's needs and then moved to
accept the proposal submitted by Veselka, McCreary et al.
Commissioner Walker asked for clarification of item 8 in the
contract and then seconded the motion. The motion•carried
unanimously to accept the proposal submitted by Veselka,
McCreary et al. Commissioner Sims pointed out to the
representative of Veselka, McCreary that he worked for the
Court and not the Tax Assessor. A copy of the contract is
attached hereto.

to Issue Certificates of Obligation. The notice will be
published May 17, 1996 and the meeting will be held June 4,
1996 at 10:00 a.m..
The Court next considered a request from Constable
Precinct 4, Duane Peters, to appoint William J. Cross as
Reserve Deputy Constable. On motion by Commissioner Walker,
seconded by Commissioner Norton, the Court voted unanimously
to approve the request from Constable Peters to appoint
William J. Cross as Reserve Deputy Constable subject to
appointment being within the allotted number of deputies.
This is a non salaried position.
The Court next considered approval of a Brazos County
Public Document Cost Recovery Policy and Schedule of Charges.
Chapter 552 of the Government Code (V.T.C.A) provides for the
release of public information upon request and §552.261
(Subchapter F - Cost of Copies) provides that the cost to the
public to obtain a copy of documents and data maintained by
the County shall be reasonable. Therefore, on motion by
Commissioner Walker, seconded by Commissioner Norton, the
Court voted unanimously to adopt a Resolution authorizing the
charging for the copy services for copies of public
information, except for those offices which are specifically
excepted by chapter C,• §552 of the Government Code (V.T.C.A.).
A copy of the schedule is attached hereto.
The Court next considered acceptance of a Warranty Deed
for right-of-way on Mumford Road in Precinct 4. On motion by
Commissioner Cauley, seconded by Commissioner Sims, the Court
voted unanimously to authorize the County Judge to accept on
behalf of Brazos County a Warranty Deed from Esther Jane Grant
McDougal for the expansion and improvements to Mumford Road.
The Court next considered approval of the Preliminary
Plat of Willow Run Phase Two Subdivision in Precinct 1.
Richard Vance, County Engineer, stated that he had reviewed
the plat and made the following recommendation:
The addition of a culvert and its calculated size
under proposed Headwater Lane (private road) is to
be shown on the plat.

Walker, the Court unanimously approved the Preliminary Plat of
the Willow Run Phase Two Subdivision with the noted
recommendation.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the Diebel Family Partners, Ltd. property
on Mumford Road in Precinct 4 to remove an existing fence,
clear the existing fence line of brush and build approximately
1,700 feet of new fence for site distance around a sharp
curve. Commissioner Cauley moved to authorize the work. The
motion was seconded by Commissioner Sims. Commissioners
Norton, Walker and Cauley voted "Aye". Commissioner Sims
voted "No". The motion carried.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Nancy Broach on
Castenson Road to dispose of dead livestock. On motion by
Commissioner Walker, seconded by Commissioner Sims, the Court
voted unanimously to authorize the work.
The Court next.considered approval of a requisition from
Capital Expenditures for the purchase of a hard drive and 16
Meg memory upgrade for the office of Emergency Management.
Cost of the hard drive is $239.00 and the 16 Meg memory
upgrade is $220.00. On motion by Commissioner Walker,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the requisitions in the amount of $459.00 to be
paid from Capital Expenditures for the purchase of a hard
drive and memory upgrade for the' Office of Emergency
Management.
Under citizen input and/or concerns, Floyd Wells,
military liaison, reminded-the Court of the Armed Forces
Weekend coming up and invited them to see the military display

in the parking lot on William Joel Bryan Parkway and
Washington Street.
The County Judge made the following comments:
a) Representative Kubiak was holding a public
hearing in Austin and invited the court to
attend a meeting to discuss salaries for the
Extension Service.
b) He was going to visit with the Bickerstaff law
firm attorneys to discuss combining Justice of
the Peace, Precincts 1 and 2
c) Commissioners Sims and Norton will be going to
Somerville County to look at their Expo Center
d) Olympic Torch Day is May 21, 1996 and it will
pass by the Courthouse at 11:05 a.m..
e) Departmental budget hearing were fast
approaching and encouraged department heads to
schedule a time.
Commissioner Cauley made the following comment:
a) There will be an energy audit of the
courthouse and outlying buildings
At 9:34 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed
executive session to discuss personnel as allowed under
Section 551.074 of the Texas Open Meetings Act.
At 10:19.m. the County Judge announced the meeting open
to the public and stated that no action would be taken on the
closed executive session.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 14th day of May 1996 at a special meeting of the
Commissioners' Court, the following members were present:

THAT WHEREAS, on May 14, 1996, the Court heard and approved a
budget Pmendment for the 1995-1996 budget year for Brazos County,
Texas..
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 26,
1995 the following amendment(s) to the original are hereby
authorized, as described on~the attached page(s).

County), acting herein by and through its governing body, and McCreary, Veselka, Bragg and Allen,
P.C. (The Firm), 5929 Balcones Drive, P.O. Box 26990, Austin, Texas, 78755.
1.
The County agrees to employ and does hereby employ The Firm to enforce by suit or otherwise
the collection of all delinquent taxes, penalty and interest owing to The County. Current year taxes
which become delinquent within the period of this contract shall become subject to the terms of the
contract upon the following conditions:
A. Taxes on real estate that become delinquent during the term of this contract, that are not
delinquent for any prior years, become subject to the terms of this contract on July 1 st of the year in which
they become delinquent. Taxes on personal property shall become subject to this contract thirty (30) days
after delinquency as defined by the Texas Property Tax Code.
B. Taxes that become delinquent during the term of this contract, on property that is delinquent
for prior years and is the subject of a suit to collect the prior years delinquent taxes, shall become subject
to its terms on the first day of delinquency as defined by the Texas Property Tax Code.
II.
The County agrees to furnish all necessary delinquent tax information to The Firm on all property
within the boundaries of The County. The County shall provide The Firm a computer tape of all
delinquent taxes each quarter of the year. The County hereby authorizes The Firm to determine the
name, identity and location of necessary parties and to procure necessary legal descriptions of property
and hereby assigns to The Firm the right to recover the costs of obtaining such information.
' III.
CONTRACT FOR THE COLLECTION OF
DELINQUENT PROPERTY TAXES

THIS CONTRACT is made and entered into b and between The Count of Brazos Texas (The

The Firm agrees to mail the tax notices required by Section 33.07 of the Texas Property Tax Code
at no charge provided that The County furnishes the current year delinquent tax information on computer
tape to The Firm on or before the 10th day of May of each year.

IV.
The County shall provide Office Space in the County Tax Office to accommodate two (2)
employees of The Firm and system access for The Firm's two (2) computer terminals and a printer.
V.
The Firm is to intervene on behalf of The County in all suits for ad valorem taxes hereafter filed
by any other taxing unit on property located within its boundaries.
The Firm is to advise The County of errors, double assessments or other discrepancies coming
under observation during the progress of the work.

The Firm agrees to make written delinquent tax collection progress reports to The County
quarterly or upon request.
VIII.
A collection goal of fifty percent (50%) of the balance of the current taxes due on July 1 st to be
collected by the following June 30th is established for the City of College Station and the College Station
Independent School District. A collection goal of forty-five percent (45%) of the balance of the current
taxes due on July 1 stVlo be collected by the following June 30th is established for the City of Bryan and
The County. The ~E shall escrow ten percent (10%) of the fees payable to The Firm in an interest
bearing account. As soon after June 30th that it is determined that the goals were attained or not, the
principal shall be distributed to The Firm or the applicable taxing unit, and the interest shall be paid fifty
percent (50%) to The County and fifty percent (50%) to The Firm.
IX.
The County agrees to pay The Firm, for services rendered, fifteen percent (15%) ofall delinquent
taxes, penalty and interest collected by The County for itself and all the taxing units for which it collects
except for the Bryan Independent School District, for years covered by this contract. The penalty
imposed pursuant to Section 33.07 of the Property Tax Code is not subject to this contractual fee.
The County shall pay fees due The Firm monthly by check.

The Firm agrees to include with its tax lien foreclosures, for the Cities of Bryan and College
Station, any other city liens which are assessed against the same properties. An additional title research
fee of twenty-five dollars ($25.00) shall be charged against these properties to be collected as court costs
and paid to The Firm.
XI.
The Firm agrees to pay in the month of July all the taxes, penalties and interest on those accounts
on which the total due is one dollar ($1.00) or less.

The Firm shall and does hereby agree to indemnify and hold harmless The County, its officers
and employees, from any and all damages, loss, or liability of any kind whatsoever, by reason of injury
to property or third persons occasioned by any error, omission or negligent act of The Firm, its officers,
agents, employees, invitees, and other persons for whom it is legally liable, with regard to the
performance of this Contract, and The Firm will, at its cost and expense, defend and protect The County
against any and all such claims and demands.
XIII.

This contract is drawn to cover a period beginning June 1, 1996, and ending June 30, 1998, and
each party shall have the right to terminate this contract by giving at least thirty (30) days written notice
of such intention; provided however, that The Firm shall have an additional six (6) months to reduce
to judgment and sale all tax collection lawsuits filed and collect all bankruptcy claims filed prior to the
date last mentioned and shall have the exclusive right to compensation of fees earned due to these suits
during this six (6) month period. Inconsideration ofthe terms and compensation herein stated, The Firm
hereby accepts said employment and undertakes the performance of this contract as above written.
XIV.
The Firm fully incorporates into this contract all terms and conditions presented to The County

Brazos County Public Document Cost Recovery Policy
and Schedule of Charges
WHEREAS, Chapter 552, of the Government Code (V. T. C. A.) provides for the release
of public information upon request; and
WHEREAS, §552.261 (Subchapter F - Cost of Copies) provides that the cost to the
public to obtain a copy of documents and data maintained by the County shall be reasonable; and
WHEREAS, §552.262 provides the County with the ability to adopt the charges
established by the General Services Commission of the State of Texas for such services; and
WHEREAS, the Commissioners' Court is of the opinion that the fee schedule as adopted
by the General Services Commission is reasonable for the copy services in Brazos County;
NOW, THEREFORE, we, the undersigned members of Commissioners' Court for
Brazos County, Texas hereby order;
1. that the following fees be charged for the copy services for copies of public
information, except for those offices which are specifically excepted by Chapter
C, §552 of the Government Code (V. T. C. A.):

ORDER APPROVING AND AUTHORIZING
PUBLICATION OF NOTICE OF INTENTION TO ISSUE
CERTIFICATES OF OBLIGATION
WHEREAS, the Commissioners Court of Brazos County, Texas (the "County"), finds that the design,
planning, acquisition, construction, and equipping of a juvenile detention center and the site therefor and road and
bridge improvements and construction, and acquisition of rights-of-way therefor, and the payment of contractual
obligations for professional services in connection with such project (including, but not limited to, financial
advisory, legal, architectural and engineering), would be beneficial to the inhabitants of the County, and such
property is needed to perform essential governmental functions, and the Commissioners Court has determined that
certificates of obligation (the "Certificates") should be issued pursuant to the provisions of the Certificate of
Obligation Act of 1971, Section 271.041 et seq., Texas Local Government Code (the "Act"), for such purposes;
WHEREAS, prior to the issuance of the Certificates, the Commissioners Court is required under the Act
to publish notice of its intention to issue the Certificates in a newspaper of general circulation in the County, the
notice stating (i) the time and place the Commissioners Court tentatively proposes to pass the ordinance
authorizing the issuance of the Certificates, (ii) the maximum amount of Certificates proposed to be issued, (iii)
the purposes for which the Certificates are to be issued, and (iv) the manner in which the Commissioners Court
proposes to pay the Certificates;
NOW, THEREFORE, BE IT ORDERED BY THE COMMISSIONERS COURT OF BRAZOS
COUNTY, TEXAS, THAT:
SECTION 1. The form and substance of the form of notice of intention to issue the Certificates which
is attached hereto as "Exhibit A" is hereby adopted and approved.
SECTION 2. The County Judge or the County Clerk shall cause the notice to be published, in
substantially the form attached hereto, in a newspaper, as defined in Article 2051.044, Texas Government Code,
of general circulation in the County for two consecutive weeks, the date of first publication to be at least 14 days
prior to the date tentatively set for the ordinance authorizing the issuance of the Certificates.
SECTION 3. The County Judge and the County Clerk are hereby authorized and directed to execute the
Certificate to which this Order is attached on behalf of the Commissioners Court and to do all things proper and

NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION
NOTICE is hereby given that it is the intention of the Commissioners Court of Brazos County, Texas
(the "County") to issue interest-bearing Certificates of Obligation of the County to be designated and known as
the "BRAZOS COUNTY, TEXAS CERTIFICATES OF OBLIGATION, SERIES 1996" (the "Certificates") for
the purpose of providing for the payment of contractual obligations to be incurred for the design, planning,
acquisition, construction, and equipping of a juvenile detention center and the site therefor and road and bridge
improvements and construction, and the payment of contractual obligations for professional services in connection
with the above project (including, but not limited to, financial advisory, legal, architectural, and engineering).
The Commissioners Court tentatively proposes to authorize the issuance of the Certificates at its regular meeting
place in the Commissioners Courtroom, Brazos County Courthouse, 300 East 26th, Bryan, Texas, at a Regular
Meeting of the Commissioners Court to be commenced at 10.00 a.m., on the 4th day of June, 1996, in an amount
not to exceed $10,000,000. The Commissioners Court presently proposes to provide for payment of the
Certificates by the pledge of an annual ad valorem tax levied upon all taxable property within the County, within
the limits prescribed by law, and the pledge of the revenue of the Brazos Center. The Certificates are to be
issued, and this notice is given, pursuant to Section 271.041, el seq., Texas Local Government Code.
