BRAZOS COUNTY COMMISSIONERS COURT MEETING
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
MAY 7, 1996 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNT COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.
I. Invocation - Commissioner Norton.
2. Pledge of Allegiance - Commissioner Norton.
3. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Court on county-related issues not scheduled on the agenda. Please
limit subject matter to five minutes. The Commissioners will receive the information,
conduct research into the matter, and/or place the matter on a future agenda for
discussion. (A recording is made of the meeting; therefore, please give your name and
address for the record.)
Consider and take action on agenda items 4 - 15:
4. Personnel Change of Status.
5. Payment of Claims.
6. Approval of County Payroll.
7. Budget Amendment No. 95/96-26.
8. Budget line item transfers and changes in job positions for Juvenile Services Department.

13. Request from GTE to place a buried cable in the east right-of-way of Grassbur Road
beginning at the first curve past Vick's Lane and extending south for a distance of 480
feet. Site is located in Precinct 3.

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, May 7, 1996, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1, Absent;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of citizens and officials in
attendance.
Commissioner Walker gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The County Judge announced item #8 should be considered
prior to item #4 and asked the court's approval to do so,
which was given.
The Court proceeded to consider budget line item
transfers and changes in job positions for the Juvenile
Services Department. Commissioner Sims voiced concern about
the changes and the director's recommendation to delete a
position prior to moving into the new facility. He
recommended waiting for budget time. Commissioner' Walker
reminded the Court that these changes were not an increase to
the budget. The County Judge indicated that- he too would like
to study the matter more and discuss it with the Juvenile
Board. Commissioner Cauley moved to approve the request as
submitted. Commissioner Walker seconded the motion.
Commissioners Walker and Cauley voted "Aye". Commissioner
Sims and the County Judge voted "No". The motion failed and

Commissioner Sims move to approve the change of status with
the exception of the ones submitted for Juvenile Services.
The County Judge seconded the motion. Commission Sims and the
County Judge voted "Aye". Commissioner Cauley voted "No" and
Commissioner Walker abttained. The county Judge announced
that no personnel action was approved at this time.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
96-006490 through 96-006656
with the exception of claim #96-00644
On motion by Commissioner Sims, seconded by Commissioner
Walker, the Court voted unanimously to approve the Claims as
submitted.
On motion by Commissioner Walker, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the County, payroll of $511,955.01 for the period ending May 3,
1996.
The Court next considered Budget Amendment #95/96-26,
which would reallocate funds budgeted for Justice of the Peace
Precinct 3, Metropolitan Planning Organization,- and the

Juvenile Services Department. On motion by Commissioner
Walker, seconded by Commissioner Cauley, the Court voted
unanimously to approve the budget amendment as submitted with
the exception of the Juvenile Services amendment. A copy of
which is attached hereto.
The County Judge informed the Court that he wanted to
return to item #4 because he was concerned that it would be
unjust not to approve the personnel change of status because
there were other departments involved. It was pointed out to
the Judge that the changes were approved by the vote. Ernie
Wentrcek, Director of Juvenile Services, informed the Court
that the request for Elias Hernandez was due to cleaning up
position numbers in his department and was merely a paper

transfer with no money involved. Commissioner Sims then moved
to amend his motion to approve all personnel action requests
submitted other than Juvenile Services but to include the
request for Elias Hernandez in Juvenile Services.
Commissioner Cauley seconded the amended motion and it carried
unanimously.
The Court proceeded to consider the following blanket
purchase orders:

Werlinger & Assoc 272nd Dist Crt $1,000
Cain's Coffee Jail $ 800
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the blanket
purchase orders as submitted.
The Court next considered approval of two requisitions
from Capital Expenditures for the purchase of a card cabinet
for the Tax Office and computer and monitor for the Juvenile
Service department. Cost of the card cabinet is $3,275.00 and
cost of the computer and monitor is $2,134.00. On motion by
mmissioner Sims, seconded by Commissioner Cauley, the Court
ted unanimously to approve the two requisitions in the
ount of $3,275.00 and $2,134.00 to be paid from Capital
penditures for the purchase of a card cabinet for the Tax
face and computer and monitor for Juvenile Services.

The Court next considered approval of a requisition from
the General Fund for the purchase of a Fax machine for the
office of Justice of the Peace Precinct 3. This is a budgeted
item in the 1995/1996 county budget. The budget amendment was
approved earlier in the Commissioners Court meeting of this
` date. Cost of the Fax machine is $487.20. On motion by
Commissioner Walker, seconded by Commissioner Cauley, the
Court voted unanimously to approve the requisition in the
amount of $487.20 to be paid from the General Fund for the
purchase of a Fax machine for the Office of Justice of the
Peace Precinct 3.
The Court next considered the request from GTE to place
two road bores for buried cable installation in the right-of-
way of Nunn Jones Road beginning approximately 225 feet south
of Deerfield Drive and extending for a distance of 1,649 feet.
The site is located in Precinct 3. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Sims, seconded by Commissioner Walker,
the Court voted unanimously to approve the request from GTE
and authorized the installation. A copy of the request is
attached hereto.
The Court next considered the request from GTE to place

The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Mary Horn on Koppe
Bridge Road to dispose of dead livestock. On motion by

I Commissioner Walker, seconded by Commissioner Cauley, the
Court voted unanimously to authorize the work.
The next matter for consideration was the initiation of
the process for combining Justice of the Peace, Precinct 1 and
Justice of the Peace Precinct 2 and Constable Precinct 1 and
Constable Precinct 2. Mary Horn, Justice of the Peace
Precinct 2, Tommy Lyons, Justice of the Peace, Precinct 1 and
Maria Wilkerson, resident of Millican, all spoke against the
combining of precincts arguing that because of the area is so
spread out, they need their Justice of the Peace and Constable
f near by. Commissioner Sims and the County Judge cited
economic considerations. Commissioner Cauley said that he
would like to wait unit the next census. The County Judge
then moved to initiate the process for combining Justice of
' the Peace, Precinct 1 and Justice of the Peace Precinct 2 and
Constable Precinct 1 and Constable Precinct 2. Commissioner
Sims seconded the'motion. Commissioners Walker, Sims and the
County Judge voted "Aye". Commissioner Cauley voted "No".
There was no citizen input and/or concerns.
There were no announcements of interest items or possible
future agenda topics.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 7th day of May 1996 at a special meeting of the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Sandie Walker, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;
Mary Ann Ward, County Clerk.
The following proceedings were held:
THAT WHEREAS, on May 7, 1996, the Court heard and approved a
budget amendment for 'the 1995-1996 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be'
reasonably included in the original budget adopted September 26,
1995 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).
ADOPTED AND APPROVED this the 7th day of May 1996

right-of-way of Nunn Jones Road beginning approximately 225' south of Deerfield Dr

SOURCE OF FUNDS: N/A
I. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-0f-way
line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees,
etc. from county right-of-way.
D) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

COMPANY LINE INSTALLATION
April 23, 1996
TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE: Al Jones
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Texas as follows:
On Nunn Jones Rd. approximately 225' south of
Deerfield Rd. a buried cable will be placed 4'
in the west R.O.W. extending south for a distance
of 17'. The cable will then cross the road to
the east R.O.W. extending south for a distance of
1632' then will' cross back to the west R.O.W. and
end at this point.
The location and description of this line and associated
appurtenances is more fully shown by four (4) copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin in May 10, 1996.

ITEM: Request from GTE to place a buried cable in the east right-of-way of Grassbur
Road beginning at the first curve past Vick's Lane and extending south for a distance
of 480'. Site is located in Precinct 3.
SOURCE OF FUNDS: N/A
1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees,
etc. from county right-of-way.
D) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

COMPANY LINE INSTALLATION
April 24, 1996
TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE: Al Jones
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Texas as follows:
On Grassbur Rd. at the first curve past Vick's
Lane a buried cable will be placed 4' in the
east R.O.W. extending south for a distance of
480'.
The location and description of this line and associated
appurtenances is more fully shown by four (4) copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin in June 3, 1996.
