THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
APRIL 30, 1996 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

APRIL 30, 1996
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, April 30, 1996, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;

Commissioner Walker questioned the separation of the
Commissary Profit and Inmate Trust Funds. The Auditor
explained that the salaries were moving from one fund to
another. On motion by Commissioner Walker, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Walker, the Court voted unanimously to approve the Claims as
submitted.
" The Court next considered Budget Amendment #95/96-25,
which would transfer funds from Contingency to Community
Support, from Auditor's office to Contingency and to correct
the Criminal Justice Department /Juvenile Justice Alternative
grant budget for Juvenile Services Department. On motion by
Commissioner Walker, seconded by Commissioner Cauley, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
On motion by the County Judge, seconded by Commissioner
Sims, the Court voted unanimously to adopt a resolution
congratulating the Texas Adopt-A-Beach program on its 10th
anniversary and expressed its appreciation for its work in
protecting and enhancing Texas open beaches for all Texans.

The Court next considered a request from Constable
Precinct 4, Duane Peters, to appoint Bernard E. Nors as
Reserve Deputy Constable. On motion by Commissioner Sims,
seconded by Commissioner Walker, the Court voted unanimously
to approve the request from Constable Peters to appoint
Bernard E. Nors as Reserve Deputy Constable subject to
appointment being within the allotted number of deputies.
The next matter for consideration was two (2) tax refunds
to Manor East Mall, Inc.. In a Court settlement it was agreed
that the total appraised value for 1994 be lowered from
$3,000,000.00 to $2,500,000.00. On motion by Commissioner
Norton, seconded by Commissioner Walker, the Court voted
unanimously to refund $1,676.85 on Block 7, Lot 1, Manor East
Mall, Ward's end and to refund $1,182.05 on Block 7, Lot 1.1,
Manor East Mall, Fifty Off, Bealls, Carter's Burger portion
in county taxes for 1994 to Manor East Mall, Inc..
The next matter for consideration was the appointment of
a delinquent tax attorney. Commissioners Sims made a few
comments about the evaluation process of tax attorneys, named
committee members and thanked them for their hard work. The

committee members were C. W. Henry from Bryan Independent

School District, David Neal from College Station Independent
School District, Glen Schroeder from the City of College
Station, Tripp Walter from the City of Bryan, Commissioners
Sims and Walker. Commissioner Sims moved to extend a contract ttj
to McCreary, Veselka and Allen subject to negotiation of I
duties and responsibilities. The motion was seconded by
Commissioner Walker. The County Judge asked for clarification
on the negotiation portion of Commissioner Sims motion.

Commissioner Sims explained that since this was a Request For
Proposals portions of it could be negotiated. Commissioner
Norton stated he had concerns regarding proceedings that took
place, the questions asked by the committee and would like to
review the other proposals submitted. He suggested that he
would like to table for further consideration. Jeff Brown,.
representative of Calame, Linebarger et al, spoke about

company's tax collection record and the successes they have
had over that last five years. The County Judge called for
the vote. Commissioners Walker and Sims voted "Aye".
Commissioner Norton voted "No". The County Judge and
Commissioner Cauley abstained. Because this was not the
majority of the Court, the County Judge announced the motion
failed. Commissioner Norton then moved to table consideration
until the next Commissioners Court meeting. The County Judge
seconded the motion. Commissioners Norton, Cauley and the
County Judge voted "Aye". Commissioners Walker and Sims voted
"No". The motion carried.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Ross Viola on
Goodson Bend Road in Precinct 4 to dispose of dead livestock.
On motion by Commissioner Cauley, seconded by Commissioner
Walker, the Court voted unanimously to authorize the work.
The Court next considered approval of a requisition from
Capital Expenditures for the purchase of furniture for the
office of the Purchasing Agent. This is not a budgeted item
in the 1995/1996 county budget but using funds saved from
other purchases. Cost of the desk and chair is $1,416.00. On
motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to approve the requisition
in the amount of $1,416.00 to be paid from Capital
Expenditures for the purchase of furniture for the office of
the Purchasing Agent.
The Court proceeded to consider the following blanket
Purchase Order:
B/CS Eagle Purchasing $1,500
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Order as submitted.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held July 10, 1995; July 17,

The Court received, approved and ordered filed as
submitted the Treasurer's report for March 1996 and Investment
Report for Quarter ending March 31, 1996. A copy of which is
attached to and made a part of these minutes. Commissioner
Sims complimented the Treasurer on investments.
There was no citizen input and/or concerns.
The County Judge made the following comments:
1) Asked Sue Sorensen to come to the bench and
read aloud a resolution in support of National
Day of Prayer.
2) Informed the members of the court that on the
agenda, for the next Commissioners Court
meeting would be an item that would initiate
the process to combine Justice of the Peace
Precincts 1 & 2.
There being no further business to come before the Court,
the meeting was adjourned.

THAT WHEREAS, on April 30, 1996, the Court heard and approved
a budget amendment for the 1995-1996 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 26,
1995 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).

For the quarter of January 1, 1996, through March 31, 1996, the Brazos County
Investment Committee suggested diversifying some of the funds invested with
Texpool. During the 02-20-96 meeting the Committee suggested a purchase of
at least one (1) million dollars with a maximum maturity of 90 days.
At the end of February there was a drop in the Texpool rate (from 5.58% in
January to 5.21% in February). This prompted an even larger movement of funds
from Texpool to other investment securities, hoping to lock in a higher rate of
interest should the rate continue to fall. A total of $9,200,000.00 was moved from 1
Texpool and bids were obtained from the four (4) investment firms the
Investment Committee had approved for this year.
The Investment Committee's suggestion of a 90 day maximum maturity was
extended to 180 days in order to invest the debt service funds more efficiently.
These funds were invested to mature slightly before each bond payment is due
allowing the County to benefit by locking in a higher rate of interest for a longer
period of time. Investment maturity dates for the General Fund and the Road
and Bridge accounts were scheduled to meet the monthly expenditures of
payroll and accounts payable.
