Jones, County Judge, Presiding; Gary Norton, Commissio ner of Precinct 1; Sandie Walker, Commiss ioner of Precinct 2; Randy Sims, Commission er of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. There was no citizen input and/or concerns. The Court proceeded to consider the change of status of the following employees. The Court next considered the following Claims as submitted by the County Treasurer for payment: 96-006095 through 96-006308 On motion by Commissioner Walker, seconded by Commissioner Norton, the Court voted unanimously to approve the Claims as submitted. On motion by Commissioner Walker, seconded by Commissioner Sims, the Court voted unanimously to approve the County payroll of $519,845.09 for the period ending April 19, 1996. • is The Court next considered Budget Amendment #95/96-19, which would reallocate funds budgeted for the Court and Jury Services Department and Emergency Management; to transfer funds from Contingency to County Fire Protection and to create a budget for revenue and expenditures in Juvenile Services. On motion by Commissioner Walker, seconded by Commissioner Norton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The County Judge read aloud a Proclamation designating April 23, 1996 as "Arbor Day" in Brazos County. The Court urges the appropriate recognition thereof. on motion by the County Judge, seconded by Commissioner Cauley the Court moved to proclaim April 23, 1996 as "Arbor Day" throughout Brazos County. On motion by the County Judge, seconded by Commissioner Walker, the Court voted unanimously to table consideration of a pay increase for Dr. Rany Cherian. The next matter for consideration was the selection of a financial advisor for Brazos County. The following entities submitted proposals: Coastal Securities $ 9,750 Apex Securities $10,000 Rauscher Pierce Refsnes $15,000 Southwest Securities $19,550 First Southwest Company $25,200 FAer. -3'7 ~L 4 r i On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to select Coastal Securities as the financial advisor for Brazos County. The Court next considered approval of Brazos County's Equal Employment Opportunity Policy. Commissioner Sims asked that the policy statement be amended to include age in paragraphs 1, 2 and 3. The then moved to approve the policy as submitted. The motion was seconded by Commissioner Cauley and carried unanimously. A copy is attached hereto. The next matter before the Court was approval of a contract with Southwest Texas State University and Brazos County Juvenile Services for the holding of a "Juvenile Law Update" workshop and the setting of the fee for said workshop. This is a six hour workshop to be held at the Brazos Center on May 15, 1996 from 9:00 to 4:00 p.m.. On motion by Commis- sioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to contract with Southwest Texas State University and Brazos County Juvenile Services for the holding of a "Juvenile Law Update" workshop and the setting of the fee at C• $7.50 for non county employees. The Court next considered adopting a Resolution establishing a $50.0.0 fee to be collected by the County Clerk to compensate for accounting and administrative expenses incurred in the handling of trust funds. On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to adopt a Resolution authorizing the County Clerk to collect a $50:00 fee when handling a trust fund for the benefit of litigants in civil proceedings. On motion by Commissioner Cauley, seconded by Commis- sioner Sims, the Court voted unanimously to rescind approval of Purchase Order #03266 for the purchase of a lawn tractor for the Brazos Center. The next matter before-the Court was consideration of modification of Bid No. 95-024 Flexible Base Contract to allow 4 for the reduction in load capacity of haul trucks to 58,420 VOL • • • 4 lbs.. In a memo to the Court, the Purchasing Agent informed them that the modification was necessary due to the truck weight of 80,000 lbs. was excessive and damaging the road far greater than the additional expense of modifying the contract to allow for 58,420 lbs. trucks. The cost to the County would be an additional $1.00 per ton of flexible base. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to authorize the modification of Bid No. 95-024 Flexible Base Contract to allow for the reduction in load capacity of haul trucks to 58,420 lbs.. The Court next considered approval of the following requisitions from Capital Expenditures for the purchase of: a. Printers and printer stand for District Attorney $668.28 and $229.99 b. Furniture for Auditor's Office $1,085.72 c. Networking expansion for Commissioners Court $2,262.00 d. Computer software for the office of Constable, Precinct 4 $257.00 e. Radios for the Sheriff's Office $3,849.00 On motion by Commissioner Walker, seconded by Commissioner Norton, the Court voted unanimously to approve all the requisitions to be paid from Capital Expenditures for the purchase of the previously mentioned items. The Court proceeded to consider the following blanket Purchase Orders: Rugby Laboratories Jail $1,000 Fikes Sanitizing Brazos Center $1,500 Central Garden Brazos Center $1,000 Sunbelt Management Brazos Center $1,000 Briggs Healthcare Jail $1,000 B/CS Eagle Sheriff $ 750 On motion by Commissioner Norton, seconded by Commissioner Walker, the Court voted unanimously to approve the Blanket Purchase Orders as submitted. The next matter for consideration was the transfer of a vehicle to Road and Bridge Department from the Sheriff's office. On motion by Commissioner Walker, seconded by commissioner Norton, the Court voted unanimously to transfer a Crown Victoria with 84,771 miles from the Sheriff's Office to the Road and Bridge Department. The Road and Bridge Department requested permission to enter the private property of Danny McClain on Macey Road in Precinct 2 to add material to a.driveway that will be used as a parking area for County owned equipment. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Taffie Pruett on J.C. Long Drive in Precinct 4 to clear out an existing drainage channel to allow water to drain from the roadway; old concrete slab will be replaced with culvert pipes; broken concrete will be placed in gully at northeast edge of property for erosion control. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. The next matter before the Court was acceptance of the City of Bryan's cost estimate of $200.00 for Grassbur Road pole relocation project/Royce Bordman property in Precinct 3. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to accept the cost estimate for the pole relocation and authorized the payment of $200.00. The Court acknowledged receipt of the Extension service reports for March 1996 and acknowledged receipt of reports from County and Precinct Offices showing revenues collected and remitted to-the County Treasurer. An excerpt from those reports is attached hereto. There was no citizen input and/or concerns. The County Judge made the following comments: a) He is putting an Expo Committee together. b) Budgets are due in by 5:00 p.m. on May 3rd. i VOL - f- r • • Commissioner Sims made the following comments: a) Tax Attorney interviews will be on Friday. b) Presented a list of projects Council of Urban Counties wants to address this legislative year. c) He will speak to the Bryan City Council this evening about parks. Commissioner Cauley made the following comments: a) Commented on Tax Attorney saying that he would like to see a local attorneys make a presentation to the committee or let all attorneys make a presentation to the entire court rather than to the committee and have them make a decision for the entire Court. Commissioner Norton said that no local attorney was qualified or equipped to perform as a tax attorney. Commissioner Sims explained the committee selection process. b) Thanked Linda Muegge, Right-of-Way Agent; Richard Vance, County Engineer; and the Court for approving the purchase of property for the Citizen Collection Station site on FM 60. Recitals 1. The County is contemplating the sale of debt obligations from time to time in amounts to r be determined for various purposes. i 2. This agreement shall apply to the issuance of certificates of obligation to provide funds ' for the construction of a juvenile detention center (approximately $5.5 million) and funds for road and bridge work, including right-of-away acquisition (approximately $3 million) and any E refunding obligations issued in conjunction therewith (the "Obligation"). " 3. The County intends to retain Aldn, Gump, Strauss, Hauer and Feld, L.L.P., a recognized firm of municipal bond attorneys ("Bond Counsel"), who will prepare the proceedings and advise r the steps necessary to be taken in the legal issuance and final delivery of Obligations and who will F issue an opinion approving the legality of such Obligations. t • Now, therefore, in consideration of the promises and other good and valuable consideration and of the mutual benefits, covenants and respective agreements hereinafter set forth and expressed, the County and Coastal agree as follows: I Coastal will serve as financial advisoi to the County in connection with the sale of Obligations by the County and in such capacity Coastal will perform those services normally performed by financial advisors, and such other services as, in our judgment, may be necessary or advisable ' including, as follows, to: 1. ProVde our professional services and our facilities as Financial Advisor and agree to direct ' and coordinate all programs of financing as may be considered and authorized during the period E in which this agreement shall be effective. 2. Review the financial resources of the County in order to devise a plan of financing, a maturity schedule for each issue of Obligations, options of prior payment and other such matters of a financial nature, all in order to issue Obligations under terms and conditions most t advantageous to the County consistent with a minimum effective interest rate. Advise the County of current bond market conditions, forthcoming bond issues and other general information and economic data which might be normally expected to influence bids and interest rates and to recommend the best method of sale, the date and conditions for sale. 5. Coordinate the preparation of the offering documents approved for use in the sale of the Obligations (the "Offering Documents") containing information and data ordinarily found in such documents and to arrange for the publication and distribution of the Offering Documents. The Offering Documents shall be approved by the County upon or prior to the sale of the Obligations. 6. Recommend the advisability of obtaining a credit rating or ratings and coordinate the preparation of such information required for submission to the rating agency, or agencies. Where the advisability of personal presentation of information to the rating agencies is appropriate, arrange for such personal presentations and be represented at such presentations. 7. Represent the County at the sale of the Obligations by negotiating with the underwriter(s) to ensure the bonds are sold on favorable terms and conditions or, if bonds are sold at competitive sale, tabulate the bids and make a recommendation as to the best bid. 8. Coordinate with Bond Counsel to make appropriate arrangements for the delivery of the Obligations to the purchaser. 9. Perform such other duties as are customary in the performance of financial advisory services as necessary, in the judgement of Coastal, or as requested by the County. II The County, in consideration of the services to be performed by Coastal, agrees to pay a fee to be computed in accordance with Exhibit A. Such fee shall become due and payable as soon as practicable after delivery of the Obligations. The County also agrees to pay the costs set out in Exhibit A. III • With the consent of the County, it is further understood and agreed that Coastal reserves the right, alone or in conjunction with others, to submit a bid for any Obligations issued under this Agreement which the County advertises for competitive bids. IV This Agreement shall become effective at the date of acceptance by the County set out herein and below and may be terminated with or without cause by the County upon thirty (30) days written notice. In the event of such termination, it is understood and agreed that only the amount due to Coastal for services provided and expenses incurred to the date of termination will be due and payable. No penalty will be assessed for termination of this Agreement. The University through its Institute of Criminal Justice Studies agrees to: (1) Provide a training package: Juvenile Law Update consisting of six hours of credit in compliance with Texas Commission on Law Enforcement Officer Standards and Education Rules and Regulations, allowing for breaks and orientation. (2) Provide all course materials and handouts necessary for successful completion of the courses. (3) Provide certificates for all participants who attend the full six hours and successfully complete the course. III. Miscellaneous provisions and conditions: (1) The University may terminate this contract at any time by giving written notice to the contractor. (2) This instrument contains the entire agreement between the parties relating to the rights herein granted and the obligations herein assumed. Any oral representations or modifications concerning this instrument shall be of no force or effect excepting a subsequent modification in writing, signed by the parties or their representative and attached hereto.
