APRIL 2, 1996
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, April 2, 1996, with the following members of
the Court present:

Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The County-Judge read aloud a Proclamation designating
the month of April as "Sexual Assault Awareness Month". The
Court joins with the local Rape Crisis Center to promote
public understanding of sexual violence and victims of sexual
i violence and emphasize the need to reduce sexual assault
4 through public education and changing public attitudes. The
County Judge then presented the signed Proclamation to Ms
Sherry Hostetler, representing the local Rape Crisis Center.

The Court proceeded to consider the change of status of
the following employees.

Commissioner Norton asked if there hadn't been a problem with
the employee being hired by Justice of the Peace Precinct 1.
He was told that there had been and Commissioner Norton
replied that he hoped the department head was cautious.
Commissioner Sims moved to approve the Change of Status as
submitted. Commissioner Walker seconded the motion.
Commissioners Walker, Sims and Cauley voted "Aye".
Commissioner Norton voted "No". The motion carried.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
96-005421 through 96-005629
On motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered Budget Amendment #95/96-21,
which would transfer funds budgeted from Contingency to
Justice of the Peace Precinct 3 to allow for increased rental
cost. On motion by Commissioner Sims, seconded by Commis-
sioner Walker, the Court voted unanimously to approve the
budget amendment as submitted, a copy of which is attached
hereto.
The Court next considered the allocation of adjacent
office space for the County Tax Assessor-Collector's Office.
This is space next to the Tax Office that was previously
leased by a law firm. The Court discussed possible need for
additional employees, more equipment, cost of remodeling and
security of the area. On motion by Commissioner Walker,
seconded by Commissioner Cauley, the Court voted unanimously
to allocate adjacent office space for the County Tax Assessor-
Collector's Office.

The next matter before the Court was the amendment of the
Policy and Procedures for Purchasing. In a memorandum to the
Court the Purchasing Agent requested a change In purchasing
category descriptions and modify the change order approval
amount. The County Judge voiced concern over the 20% in
change order authority given to the Purchasing Agent. The
County Judge then moved to approve the change in purchasing
categories only and to consider the change order approval
amount at a later date. Commissioner Walker seconded the
motion and it carried unanimously. Amended pages 8 and 9 are
attached.
The Court next considered a proposal for capital
expenditures for purchasing. The proposal is for the purchase
of necessary furniture and equipment for the newly created
Purchasing Department. The Auditor assured the members of the
court that the equipment and furniture currently used by the
Purchasing Agent would be transferred to the new office. This
would still leave a need for two (2) desks, two (2) chairs and
two (2) computers. The Purchasing Agent indicated that there
were funds available in Capital Expenditures resulting from
purchases made at a lesser amount than budgeted. On motion by
Commissioner Norton, seconded by Commissioner Walker, the
Court voted unanimously to accept the proposal from purchasing
to use capital expenditure funds to purchase furniture and
equipment for the purchasing department.
The Court next considered approval of four (4)
requisitions from Capital Expenditures for furniture and
equipment for the Purchasing Agent's office. These are for
three (3) computers, one (1) laser printer, one (1) dot matrix
printer and two (2) desks and two (2) chairs. Total cost will
be $11,125.60. On motion by Commissioner Walker, seconded by
Commissioner Norton, the Court voted unanimously to approve
the requisition in the amount of $5,565.00 to be paid from
Capital Expenditures for the purchase of computers for the I
Purchasing Agent. On motion by Commissioner Walker, seconded

the requisition in the amount of $1,385.00 to be paid from
Capital Expenditures for the purchase of a laser printer for
the Purchasing Agent. On motion by Commissioner Cauley,
seconded by Commissioner Walker, the Court voted unanimously
to approve the requisition in the amount of $1,333.22 to be
paid from Capital Expenditures for the purchase of a dot
matrix printer for the Purchasing Agent. On motion by
Commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to approve the requisition in the
amount of $2,842.28 to be paid from Capital Expenditures for
the purchase of two (2) desks and chairs for the Purchasing
Agent.

The Court next considered approval of a requisition from
Capital Expenditures for the purchase of a fertilizer seeder
spreader for the Road & Bridge Department. Cost of the
fertilizer seeder spreader is $339.00. On motion by
Commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to approve the requisition in the
amount of $339.00 to be paid from Capital Expenditures for the
purchase of a fertilizer seeder spreader for the Road & Bridge
Department.
The Court next considered approval of a requisition from
Capital Expenditures for the purchase of a computer for the
District Attorney's Office. This is a budgeted item in the
1995/1996 county budget. Cost of the computer is $1,855.00.
On motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to approve the requisition
in the amount of $1,855.00 to be paid from Capital
Expenditures for the purchase of a computer for the District
Attorney's Office.
The.Court next considered approval of a requisition from
Capital Expenditures for the purchase of a laser printer for
the Risk Manager's Office. Cost of the printer is $834.73.
On motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to approve the requisition
in the amount of $834.73 to be paid from Capital Expenditures
for the purchase of a laser printer for the Risk Manager's
Office.
The Court next considered approval of a requisition from
the General Fund for the purchase of a laptop computer for the
Risk Manager's Office. Cost of the computer is $5,448.00. On
motion by Commissioner Cauley, seconded by Commissioner
Norton, the Court voted unanimously to approve the requisition
in the amount of $5,448.00 to be paid from the General Fund
for the purchase of a laptop computer for the Risk Manager's
Office.

The Court next considered approval of a requisition from
the General Fund for the purchase of a camera for the County
Attorney's Office. Cost of the camera is $242.11. On motion
by Commissioner Sims, seconded by Commissioner Cauley, the
Court voted unanimously to approve the requisition in the
amount of $242.11 to be paid from the General Fund for the
purchase of a camera for the County Attorney's Office.
The Court next considered approval of a requisition from
Capital Expenditures for the purchase of ICE.TCP upgrades for
50 users in various departments. Cost of the upgrades is

$849.50. On motion by Commissioner Walker, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the requisition in the amount of $849.50 to be paid from
Capital Expenditures for the purchase of ICE.TCP upgrades for
the various departments.

The next matter before the Court was the adoption of a
Resolution stating that the Commissioners Court of Brazos
County designates all vehicles used in the various law
enforcement departments: District Attorney, and Sheriff
Department shall carry Regular-License Exempt Plates and shall
so be designated. On motion by Commissioner Norton, seconded

the Resolution and authorize the Purchasing Agent to execute

all documents pertaining to Regular License Exempt Plates. A
copy of the Resolution is attached hereto.
The Court next considered approval of the Preliminary
Plat of Hicks Lane Estates in Precinct 3. Richard Vance,
County Engineer, stated that he had reviewed the plat and it
appeared to be in order. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court unanimously
approved the Preliminary Plat of the Hicks Lane Estates.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Robert Beamon on
Twin Creek Circle in Precinct 3 to clean out an existing drain
channel to allow water to drain into the culvert under Rustic
Oaks Drive. Excavation will begin at Rustic Oaks Drive and

proceed upstream in the existing channel no more than 40 feet
into the Beamon property. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the work.
The Court next considered the request from GTE to place
a buried cable in the right-of-way of Rye School Road
beginning at its intersection with FM 1687 (Sandy Point Road)
and extending for a distance of 2,143 feet. The site is
located in Precinct 4. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Cauley, seconded by Commissioner Sims, the
Court voted unanimously to approve the request from GTE and
authorized the installation. A copy of the request is

The Court received, approved and ordered filed as
submitted the Treasurer's report for March 1996. A copy of
which is'attached to and made a part of these minutes.
Under citizen input and/or concerns, the County Clerk
informed the Court that the news media had announced that if
a person did not vote in the primary then they would be
ineligible to vote in the runoff election. She also announced
that early voting will end on Thursday at 8:00 p.m. because
the Courthouse would be closed on Friday.
The County Judge made the following comments:
a) Rent for the office of Justice of the Peace
Precinct 3 had increased by an additional
$350.00 monthly. He said it was time to look
at building an office to hold both the Justice
of the Peace and Constable. He also mentioned
the possibility of locating a place to build
an office for Justice of the Peace Precinct 2
and Constable office.
b) The County Judge said he was looking into the
procedure for combining the offices of Justice
of the Peace Precincts 1 and 2 and Constable
Precincts. He also considering expanding
Justice of the Peace Precinct 7 as the City of
College Station expands. Commissioner Norton
said he was looking for a location along
Greens Prairie Trail for an office for Justice
of the Peace Precinct 2.
c) The County Judge said he was doing background
work on an Expo Center for Brazos County and
would be visiting with Commissioner Cauley
concerning this matter.
d) The County Judge asked if sheriff deputies
were providing service at activities in the
County. He was informed that they were. He_
then voiced concern that the officers were
using county vehicles and the county not
receiving pay for it.
e) A workshop will be held on April 9, 1996 to
discuss financing the Road & Bridge and
Juvenile departments.
There being no further business to come before the Court,
the meeting was adjourned.

PURCHASE CATEGORIES
The County has established various levels of purchasing categories that have been outlined
below. The purchase of all goods and services described in this manual fall within one of the
established categories. These categories are necessary in order to evaluate whether or not
competitive bidding requirements apply to the purchase. If it is determined that competitive
bidding requirements do not apply, then the purchase category will indicate what pricing
information must be obtained from vendors before a purchase order can be placed.
When evaluating which category a purchase will fall into, it is important to bear in mind certain
requirements established by County Statutes and State Law. The Texas Local Government Code
requires competitive bidding or proposals for all County purchases exceeding $15,000.00 in
amount for a product or with a vendor. The laws also prohibit the County from making
"separate, sequential, or component purchases to avoid the competitive bidding requirements."
A violation is a Class B misdemeanor ($2,000.00 fine and/or 180 days in jail) and conviction
results in immediate removal from employment and ineligibility for other public office for four
years (LGC Section 262.034 - 262.035).
By routing all purchases through the Purchasing Department, it becomes possible for purchases
of similar goods and/or services to be identified and the purchase from the same vendor to be
noted. In this manner it becomes possible to identify areas where competitive bidding or
proposals will be required.
THE PURCHASING AGENT RESERVES THE RIGHT TO DEVIATE FROM THE POLICY
FOR ANY PURCHASES UNDER THE $15,000.00 COMPETITIVE BIDDING THRESHOLD,
if it is in the best interest of the County, if it will facilitate specific County operations. If a
deviation from the policy is required, the Purchasing Agent will authorize the deviation by
signing the Purchase Order giving approval. A written explanation may be requested from the
using department by the Purchasing Agent.
I. CATEGORY I - PURCHASE LESS THAN $500.00
A. The individual department head may exercise discretionary purchasing and acquisition of
such purchases as authorized within the scope of this manual and within the authority
provided within the current fiscal year budget. These purchases will be accomplished
through the use of purchase orders created and issued directly by the department, and
approved by the Department Head and County Judge (no requisition required).
Competitive quotations are encouraged, but not required.
II. CATEGORY 2 - PURCHASES $500.00 OR MOR BUT LESS THAN $2.000.00
A. Three telephone quotations, at minimum, are required for purchases of goods and services
with a total cost of $500.00 or more, but less than $2,000.00. All such purchases require
a purchase order. The ordering department may solicit the quotations or leave the
responsibility up to purchasing. The department is still responsible for initiating the
requisition.

III. CATEGORY 3 PURCHASES $2,000.00 OR MORE BUT LESS THAN $10,000
A. A minimum of three written quotations are required for purchases of goods and services
with a total cost of $2,000.00 or more, but less than $10,000.00. The ordering department
may solicit the quotations or leave the responsibility up to purchasing. The department is
still responsible for initiating the requisition. All such purchases require a purchase order
approved by the Purchasing Agent.
IV. CATEGORY 4 -PURCHASES OF 510,000.0 OR MORE BUT LESS THAN S15,000
A. The Purchasing Department will be responsible for securing specifications and for
soliciting vendor responses and price quotes. All purchases require a minimum of three
written quotations, or at the discretion of the Purchasing Agent competitive bid responses
may be solicited. All purchases require a purchase order approved by the Purchasing
Agent and the County Judge.

V. CATEGORY 5 - PURCHASES MORE THAN $15.000.00
A. Sealed competitive written bids or proposals must be secured by the Purchasing
Department for all transactions reasonably anticipated to be in excess of $15,000.00.
This category not only includes single product or service purchases, but several purchases

with the same vendor for different products (Site Section on Competitive Bid Process).

RESOLUTION
The Commissioners Court of Brazos County, Texas meeting in regular session the 2nd
day of April 1996, among other proceedings considered the following resolution:
WHEREAS, House Bill 763 by the 70th Legislature has changed the procedures in
issuance of Exempt License Plates; and
WHEREAS, Regular Licenses Exempt Plates (previously referred to as undercover) are
still available to exempt agencies that qualify under V.C.S. 670 lm-2; and
WHEREAS, the need to designate vehicles used by various law enforcement personnel
of Brazos County exists; now
THEREFORE, BE IT HEREBY RESOLVED, the Commissioners Court of Brazos
County designates all vehicles used in the various law enforcement departments: District
Attorney, and Sheriff Department shall carry Regular License Exempt Plates and shall so be
designated and attached to this Resolution.
IT IS ALSO ORDERED, that the Purchasing Agent for Brazos County, shall
execute all documents pertaining to said vehicles assigned to law enforcement for Brazos
County; and
BE IT FURTHER KNOWN, that this resolution shall become effective immediately
upon adoption.
NOW, THEREFORE we the undersigned members of Commissioner Court of Brazos
County, Texas hereby approve the Purchasing Agent to execute all documents pertaining to
Regular License Exempt Plates.

School Road beginning at its intersection with FM 1687 (Sandy Point Road) and
extending for distance of 2.143'. Site is located in Precinct 4.

1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction Is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees,
etc. from county right-of-way.
D) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
' Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Texas as follows:
Beginning at the junction of Rye School Rd. and
FM 1687, 2143' of buried cable will be placed
northwest at 5' within the new southwest right-
of-way of Rye School Road. The proposed cable
will be buried at a minimum depth of 30".
The location and description of this line and associated
appurtenances is more fully shown by two (2) copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-:*ay in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin in April 8, 1996.

BRAZOS COUNTY COMMISSIONERS COURT

The Commissioners Court of Brazos County, Texas will hold a Public Hearing to consider the
posting of speed limits on Scasta Road in Precinct 3.
The place of the hearing will be the Commissioners' Courtroom, Brazos County Courthouse,
Room 115, 300 East 26th Street, Bryan, Texas. The date of the hearing will be Tuesday, April
2, 1996 and the time of the hearing will be 10:30 a.m.
All interested persons are invited to attend said hearing and present their cause, if any, for or
against the posting of speed limits on Scasta Road in Precinct 3.

APRIL 2, 1996
The Commissioners' Court of Brazos County, Texas held a
Public Hearing to consider traffic Regulation on various
county roads pursuant to Section 2.301 of the County Road and
Bridge Act, Art. 6702-1 subchapter D, Vernons Civil Statutes
in the Commissioners' Courtroom in the Courthouse in Bryan,
Brazos County, Texas, beginning at 10:30 a.m. on Tuesday,
April 2, 1996, with the following members of the Court
present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:
Susan Gandy Admin. Assist. to County Judge
Ray Crow Road & Bridge
The purpose of the Public Hearing was to hear commentary
for and against the proposed posting of speed limits on Scasta
Road in Precinct 3. There was no one from the general public
present.
Ray Crow, representative of the Road and Bridge
Department, informed the Court that all necessary traffic
counts were taken and the 85 percentile showed the average
speed was 37.9 miles per hour. He then recommended a speed
limit of 35 miles per hour be posted on Scasta Road.
There being no further commentary the Public Hearing was
closed.
