BRAZOS COUNTY COMMISSIONERS COURT MEETING
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
MARCH 19, 1996 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.
I. Invocation - Commissioner Walker.
2. Pledge of Allegiance - Commissioner Walker.
3. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Court on county-related issues not scheduled on the agenda. Please
limit subject matters to five minutes. The Commissioners will receive the information,
conduct research into the matter, and/or place the matter on a future agenda for
discussion. (A recording is made of the meeting; therefore, please give your name and
address for the record.)
Consider and take action on agenda items 4 - 18:
4. Personnel Change of Status.
5. Payment of claims.
6. Budget Amendment 95/96-19.
7. Request by District Attorney to create two part-time positions in lieu of one full time
Juvenile Court Attorney.
8. Approval of Agreement for Akin, Gump, Strauss, Hauer & Feld, L.L.P. to act as bond
counsel for Brazos County.
9. Application for a tax refund to Scandia Apartments LTD.
10. The Replat of Lots 2, 3 & 4, Block 1 Timbercreek at Steep Hollow, James W. Scott
League. Subdivision is located in Precinct 3.
11. Request for permission to enter Hugh Lindsay's property located off Batts Ferry Road for
the purpose of disposing of dead livestock (cow) for the health, safety and welfare of the
general public. Site is located in Precinct 1.
12. Request from Wickson Creek Special Utility District to place a road bore in the right-of-
way of Kurten Cemetery Road approximately 0.7 mile from its intersection with FM 2776.

17. Requisition from Capital Expenditures for a lawn tractor for the Brazos Center.
18. Requisition from Capital Expenditures for an evaporative cooler for the Brazos Center
greenhouse.

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, March 19, 1996, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;

The Court proceeded to consider the change of status of

On motion by Commissioner Sims, seconded by Commissioner 4
Walker, the Court voted unanimously to approve the changes as

submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
96-005010 through 96-005211
On motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered Budget Amendment #95/96-19,
which would transfer funds budgeted for contingency to the
County Auditor's Office, Health Department, Juvenile Services,
reallocate funds in the office of Justice of the Peace,
Precinct 5 and increase the budget of Constable Precinct 1, 2,
4, 5 and 7 from revenue funds for training. On motion by
Commissioner Walker, seconded by Commissioner Cauley, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The next matter before the Court was a request submitted
by the District Attorney to create two part-time positions in
lieu of one full time Juvenile Court Attorney. Commissioner
Walker moved to approve the request. Commissioner Cauley
seconded the request. After some discussion Commissioner
Walker withdrew her motion and Commissioner Cauley withdrew
his second. Then on motion by Commissioner Walker, seconded
by Commissioner Cauley, the Court voted unanimously to table
discussion until a later date to allow the Court to gather
more informW.on.
On motion by Commissioner Sims, seconded by the County
Judge, the Court voted unanimously to table consideration of
an agreement with Akin, Gump, Strauss, Hauer & Feld, L.L.P.
until additional information could be obtained..
The next matter for consideration was a tax refund to
Scandia Apartments LTD. In a Court settlement it was agreed
that the appraised value for 1994 be lowered from
$3,118,900.00 to $2,800,000.00 On motion by Commissioner

Sims, seconded by Commissioner Walker, the Court voted
unanimously to refund $1,334.28 in county taxes for 1994 to
Scandia Apartments LTD.
The Court next considered approval of the Re-Plat of Lots
2, 3, & 4, Block 1 Timbercreek At Steep Hollow Subdivision in
Precinct 3. Richard Vance, County Engineer, stated that he
had reviewed the plat and it appeared to be in order. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court unanimously approved the Re-Plat of the Timbercreek
At Steep Hollow Subdivision.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Hugh Lindsay on
Batts Ferry Road in Precinct 1 to dispose of dead livestock.
On motion by Commissioner Norton, seconded by Commissioner
Walker, the Court voted unanimously to authorize the work.
The Court next considered the request from Wickson Creek
Special Utility District to place a road bore in the right-of-
way of Kurten Cemetery Road approximately 0.7 mile from its
intersection with FM 2776. The site is located in Precinct 2.
The County Engineer stated that all appeared to be in order
and recommended approval. On motion by Commissioner Walker,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the request of Wickson Creek Special Utility
District and authorized the installation. A copy of the
request is attached hereto.
The Court next considered authorizing work outside of

general public. The Road and Bridge Department requested
permission to enter the private property of Allen Oehlert on
Locke Road in Precinct 2 to dispose of dead livestock. On
motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the work.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to hold a Public Hearing
to consider the posting of speed limits on Scasta Road in
Precinct 1 on Tuesday, April 2, 1996 at 10:30 a.m.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following
individual:
Pete De La Garza and Alice De La Garza - Part of
Lots 1 and 2, Park Heights Subdivision, Brazos
County, Texas.
The Court next considered approval of a requisition from
Capital Expenditures for the purchase of a lawn tractor for
the Brazos Center. Cost of the lawn tractor is $1,399.00. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the requisition in the
amount of $1,399.00 to be paid from Capital Expenditures for
the purchase of a lawn tractor for the Brazos Center.
The Court next considered approval of a requisition from
Capital Expenditures for the purchase of an evaporative cooler
for the Brazos Center. Cost of the cooler is $399.00. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the requisition in the
amount of $399.00 to be paid from Capital Expenditures for the
purchase of an evaporative cooler for the Brazos Center.
The Court acknowledged receipt of the Extension Service
reports for February 1996 and acknowledged receipt of reports
from County and Precinct Offices showing revenues collected
and remitted to the County Treasurer. An excerpt from those
reports is attached hereto.
There was no Citizen input and/or concerns.
The County Judge made the following comments:

look over department printouts
b) Need to get a Legislative agenda ready for Del
Lago meeting
c) Referenced a letter written to Sheriff Riggs
and himself from Mr. Jack Crump of the Criminal
Justice Department indicating that paper ready
inmates would be transferred to Texas Department of
Corrections within 21 days.
d) In house Audit Committee comprised of Randy
Sims, Gary Norton, and Mary Kay Moore. Mrs. Moore
has left the area. County Judge has asked Tom
Brymer to serve.
Commissioner Sims made the following comment:
a) Congratulated Tony Jones on being the
Republican nominee for Commissioner Precinct 1
County Attorney, Jim Kuboviak made the following
comment :
a) The American Heart Association is sponsoring
corporate games and suggested putting together a
county team to participate. The games will be held
Saturday, June 8, 1996.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 19th day of March 1996 at a special meeting of the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Sandie Walker, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;

The following proceedings were held:
THAT WHEREAS, on March 19, 1996, the Court heard and approved
a budget amendment for the 1995-1996 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 26,
1995 the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

Formal notice Is hereby given that (applicant) Wickson Creek S.U.D. proposes
to place a (type) Water line vjL4rAjhe right-of-way of (road).
Kurten Cemetery Rd. In Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and right-of-ways will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.

4. That Brazos County is in no way responsible for any damage that might
occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-of-
way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight inches
(48") lower than the center of the roadway whether there Is, or Is not, a
borrow ditch.
7. That all sites will be barricaded during the construction period.
Construction of this line will begin on or after (date) 12thday of
March , 19 96
