Request for permission to enter Reagan Brown's property located off Britten Road for the purpose of excavating an outlet channel approximately 50 feet into property to allow water to drain from culvert under roadway for health, safety and welfare of the general public. COMMISSIONERS' COURT REGULAR MEETING MARCH 12, 1996 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, March 12, 1996, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Sandie Walker, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Susan Gandy John Reynolds Kay Hamilton Richard Vance Bobby Riggs Linda Muegge Fred Forsthoff Marijane Deen Jim Kuboviak Sheila Walker Naomi Fachler Phyllis Fahlquist Raymond Stutz Executive Assistant Secretary to County Judge Auditor Treasurer County Engineer Sheriff Road & Bridge Emergency Management Computer Network Services County Attorney Brazos Center League of Women Voters League of Women Voters Brazos County Resident Commissioner Norton gave the invocation and led the pledge of allegiance. Under citizen input and/or concerns, the County Attorney reported that he had filed a claim against Ramiro Quintero Bail Bondsman who has recently filed bankruptcy. S.~._..«.a_.-_=_... -L- • • • The Court next considered the following Claims as submitted by the County Treasurer for payment: 96-004727 through 96-005009 On motion by commissioner Walker, seconded by Commissioner Norton, the Court voted unanimously to approve the Claims as submitted. On motion by the Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the County payroll of $513,036.15 for the period ending March 24, 1996. The Court next considered Budget Amendment #95/96-18, which would transfer funds from contingency to the Purchasing Department and transfer funds from the Auditors office to contingency. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The next matter for consideration was the production of the educational publication "Know Your County". Referencing a memorandum from the District Attorney, the County Judge stated that the county can not make the contribution to the League and then have them print the guide, but the League can provide the material to the County and then the County can have it printed. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to have the League provide the county with the "Know Your County " material and the county will have it printed. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to designate County Court at Law I Judge, Steve Smith as a member of the Y County Bail Bond Board. The next matter for consideration by the Court was a written request submitted by the department head of the Computer Network Services department requesting approval for out of state travel for Sok Woo Yoon. Mr. Yoon would be traveling to Las Vegas, Nevada to attend a "Network Interop Conference 11 during the week of April 1 through April 6, 1996. Commissioner Cauley moved to approve the request to pay for out of state travel expenses for Sok Woo Yoon. Commissioner Sims seconded the motion. Commissioners Norton, Walker, Sims and Cauley voted "Aye". The County Judge voted "No". The motion carried. The Court next considered approval of a requisition from Capital Expenditures for the purchase of a DOAR wireless presenter and receiver for use by the Narcotics Task Force. Cost of the DOAR wireless presenter and receiver is $6,000.00. This equipment will be used for development and presentation of visual aids during trials. The District Attorney Crime i Fund will contribute $1,000 toward the purchase. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition in the amount of $6,000.00, $5,000.00 of which is to be paid from Capital Expenditures for the purchase of the DOAR wireless presenter and receiver for the Narcotics Task Force. ` The Court next considered approval of a requisition from Capital Expenditures for the purchase of two (2) farm tractors for the Road and Bridge Department. Cost of the two (2)' tractors is $43,549.00. On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition in the amount of $43,549.00 to be paid from Capital Expenditures for the purchase of tractors for the Road and Bridge Department. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Edmund Sikorski on Opersteny Road in Precinct 3 to dispose of dead livestock. On motion by commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. Laine Subdivision in Precinct 4. Richard Vance, County Engineer, stated that he had reviewed the plat and it appeared to be in order. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court unanimously approved the Preliminary Plat of the Michael C. Laine Subdivision. The Court next considered the request from GTE to place a road bore and remove 4 poles located in the right-of-way of Rock Prairie Road. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Norton, seconded by Commissioner Walker, the Court voted unanimously to approve the request of GTE and authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Reagan Brown on Britten Road in Precinct 4 to excavate an outlet channel approximately 50 feet into the property to allow water to drain from the culvert under the roadway. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. The Court next considered acceptance of a Warranty Deed for right-of-way on Rye School Road in Precinct 4. On motion by commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from Dorcas Higgs Haltom for the expansion and improvements to Rye School Road. 61 aT 1f PAQF. - Under Citizen input and/or concerns, Phyllis Fahlquist, representative of the League of Women Voters asked why the county and not the property owner disposed of dead livestock. Commissioner Sims replied that the county has always done it for the health and safety of the residents of the area. The County Judge made the following comments: a) During the last 5 month period 42% of budget time has elapsed and asked that all department heads check to see if they coincide with this figure. b) Chappell Hill has been awarded the contract construct of the Juvenile Justice Center. Sims said that the contract is in the hands of the attorneys. c) Reminded everyone that this was election day. The location and description of this line and associated appurtenances is more fully shown by two (2) copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-w.ay in accordance with governing laws.
