THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,

15. Acceptance of the City of Bryan's cost estimate of $6,641.76 for North Dowling Road
pole relocation project. Site is located in Precinct 1.
16. Request from Ferguson Burleson County Gas Gathering System to place a road bore in
the right-of-way of Favor Road for the purpose of installing a 4.0" steel pipeline
approximately 0.1 mile northwest of its intersection with Dowling Road. Site is located
in Precinct 1.
17. Tax Resale Deed and authorization for County Judge to execute deed for 50 feet by 66.1
feet, out of the Richard Carter Survey, Abstract #8, being more particularly described as
the Second Tract described in Volume 298, Page 297, Deed Records of Brazos County,
Texas to Charles H. Szabuniewicz, Trustee.
18. Acknowledgement of monthly reports from elected officials and department heads.
19. Call for citizen input and/or concerns.
20. Announcement of interest items and possible future agenda topics.

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 6:30
p.m. on Tuesday, February 20, 1996, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Norton gave the invocation and led the
pledge of allegiance.
Under citizen input, the following comments were made:

Paul Pratt-of Pratt Road in College Station spoke
of petition being circulated in his neighborhood
containing 53 signatures requesting the paving of
Straub Road and adjoining roads in the subdivision.
He asked that the Court vote on the request.
County Judge-informed Mr. Pratt that the Court
could not take action because the item was not on
agenda.
Commissioner Norton-informed the Court that one
section of the road has 620 cars a day and another

section has only 290 cars a day traveling on it.
Stousland Road has 298 cars a day traveling. With
I&GN Road it was cheaper to hard surface the road
than trying to control the dust.
Annette Smith-stated that all her questions had
been answered by Commissioner Norton.
The Court proceeded to consider the change of status of
the following employees.

on motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Walker, seconded by Commis-
sioner Norton, the Court voted unanimously to approve the
Claims as submitted.
The Court next considered Budget Amendment #95/96-15,

which would reallocate funds budgeted for the Risk Manager's
Department, County Auditor and County Treasurer. Commissioner

Walker moved to approve the Risk Manager's budget amendment as
submitted. Commissioner Norton seconded the motion.
Commissioner Sims questioned the over use of contingency funds
to offset budget amendments. Commissioner Cauley also spoke
at length about the use of contingency funds. Commissioner

Walker then withdrew her motion and Commissioner Norton
withdrew his second. Commissioner Walker then moved to
approve all budget amendments with the exception of the one
for Risk Management. Commissioner Norton seconded the motion.

Commissioners Norton, Walker, Cauley and the County Judge

voted "Aye". Commissioner Sims voted "No". A copy of which `
is attached hereto.

The next matter before the Court was approval of the
extension of the original contract agreement between Brazos
County and Montgomery KONE Inc. for elevator maintenance.
The cost to Brazos County will be $524.7 monthly and $66.67
labor per hour. This is under the same terms and conditions
of the existing contract. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to enter into contractual agreement with Montgomery KONE Inc..
A copy of'the contractual agreement is attached hereto.
The next matter before the Court was approval of a

Contractual Agreement between Brazos County and Brazos
Beautiful, Inc. for the aesthetic appearance of Brazos County.
Brazos Beautiful shall provide services in litter control and
beautification and develop programs directed toward solid
waste management and recycling. Brazos County will fund
Brazos Beautiful in the amount of Twelve Thousand Dollars
($12,000.00) for fiscal year 1995-1996. On motion by
Commissioner Walker, seconded by Commissioner Cauley, the
Court voted unanimously to enter into contractual agreement
with Brazos Beautiful, Inc.. A copy of the contractual
agreement is attached hereto.
The next matter before the Court was consideration of
incentives for economic development for Alenco. The tax
abatement that was approved by the commissioners court on
December 19, 1995 was subsequently found to be prohibited by
state statutes because Alenco is leasing and not purchasing
the MASX Building. Because of that, the Chamber of Commerce
was requesting that the Court consider giving Alenco a cash
incentive package in the amount of $3,887.00 over a five (5)
year period as follows:

On motion by the County Judge, seconded by Commissioner Sims,
the Court voted unanimously to approve the cash incentive

package in the amount of $3,887.00 over a five (5) year
period.
The Court next considered a requisition from the County
Clerk's for the purchase of a laser jet printer from the
County Clerk's Records Management Funds for the County Clerk's
office. Cost of the printer will be $1,385.00. On motion by
Commissioner Walker, seconded by the County Judge, the Court
voted unanimously to approve the requisition for the purchase
of a laser jet printer for the County Clerk's office. Such
purchase to be paid with County Clerk's Records Management
Funds.
The Court next considered a requisition from the Capital
Expenditures Fund for the purchase of four (4) laser jet
printers for the District Judges to use with the West Law
Library. Cost of the printers will be $3,338.92. This is a
non-budgeted purchase. On motion by Commissioner Walker,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the requisition for the purchase of four (4) laser
jet printers for the District Judges.
The Court next considered a requisition from the Capital

Expenditures Fund for the purchase of two (2) laser jet
printers for the Sheriff's office and a computer work station.
Cost of the printers will be $2,770.00 and the work station I
will be $318.95. Commissioner Walker moved to approve the I
requisition for the purchase of the computer work station but
not the two (2) laser jet printers for the Sheriff's office.
The County Judge seconded the motion. Commissioners Walker,
Cauley and the County Judge voted "Aye". Commissioner Sims
voted "No". The motion carried.
The next matter before the Court was consideration of a
requisition from Capital Expenditures for the
purchase of a
Hewlett Packard Laser Jet Printer and a Panasonic Dot Matrix

requisition for the purchase of the two (2) printers for the
County Extension office.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the increase
to the exemption from competitive bidding requirements for
Trane Service Company for chiller repairs to the Courthouse
cooling system.
The Court next considered acceptance of the City of
Bryan's cost estimate of $6,641.76 for the North Dowling Road
pole relocation project in Precinct 1. The estimate includes
labor (including line design), material and relocation of an
existing recloser pole out of the proposed right-of-way. On
motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to accept the cost
estimate of $6,641.76 and authorized the payment thereof to
the City of Bryan for the North Dowling Road pole relocation
project in Precinct 1.
The Court next considered the request from Ferguson
Burleson County Gas Gathering System to place a road bore in
the right-of-way of Favor Road or the purpose of installing a
4.0 inch steel pipeline approximately 0.1 mile northwest of
its intersection with Dowling Road in Precinct 1. Included
with the request is company check #4548 in the amount of
$500.00. The County Engineer stated that all appeared to be
in order and recommended approval. On motion by Commissioner
Walker, seconded by Commissioner Cauley, the Court voted
unanimously to approve the request of Ferguson Burleson County
Gas Gathering System and authorized the installation. A copy
of the request is attached hereto.
On motion by Commissioner Walker, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the County Judge to execute the a Tax Resale Deed to the
following individual:
Charles H. Szabuniewicz, Trustee - 50 feet by 66.1
feet out of the Richard Carter Survey, Abstract #8,
being more particularly described as the second

The Court acknowledged receipt of the Extension Service
reports for January 1996 and acknowledged receipt of reports
from County and Precinct Offices showing revenues collected
and remitted to the County Treasurer. An excerpt from those
reports is attached hereto.
There was no citizen input and/or concerns.
The County Judge made the following comments:
a) An Emergency Order prohibiting burning will be
re-issued for another seven (7) days.
There being no further business to come before the Court,
the meeting was adjourned. i

WHAT WHEREAS, on February 20, 1996, the Court heard and

WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 26,
1995 the following amendment(s) to the original are hereby
authorized:

THE STATE OF TEXAS
COUNTY OF BRAZOS
This is an agreement by and between the County of Brazos
(hereinafter referred to as "COUNTY") and BRAZOS BEAUTIFUL, INC.,
a non-profit association for the improvement of the aesthetic
appearance of Brazos County (hereinafter referred to as "BRAZOS
BEAUTIFUL").
WHEREAS, BRAZOS BEAUTIFUL has been created to provide
assistance to the community in litter control and beautification;
WHEREAS, BRAZOS BEAUTIFUL has expanded its efforts into solid
waste management and recycling;
NOW, THEREFORE, FOR AND IN CONSIDERATION of mutual promises
recited herein, the parties agree as follows:
1. BRAZOS BEAUTIFUL shall provide services in litter control
and beautification and will develop programs directed toward solid
waste management and recycling. BRAZOS BEAUTIFUL shall also assist
in conducting a pilot program for the County Citizen Collection and
Recycling Stations for the rural citizens of Brazos County.
2. BRAZOS BEAUTIFUL will be funded by the COUNTY in the
amount of Twelve Thousand Dollars ($12,000.00), from the County
1995-96 Fiscal Year Funds.
3. BRAZOS BEAUTIFUL shall maintain fiscal records and
supporting documentation in the form of canceled checks, payroll
records, invoices, or other documents required for all expenditures

of funds made under this agreement.
4. BRAZOS BEAUTIFUL shall submit a financial statement to
COUNTY annually.
5. All notices and documentation required to be sent to

7. Either of the parties shall have the right to terminate
this agreement in whole or in part at any time. Notice to
terminate this agreement will be given in writing at least thirty
(30) days prior to the date of termination. The notice shall
include the reasons for such termination, the effective date of the
termination, and in the case of partial termination, the portion of
the agreement to be terminated.

LOCAL GOVERNMENT CODE, SECTION 262.024(a)(1).

servicing the Courthouse, and hereby grants an exemption from the competitive bidding
requirement from the following vendor: Trane Service Company as an item that must be
purchased promptly to preserve the property of the County, as provided in the Local Government
Code, Section 262.024(a)(1). The Court hereby approves payment for said costs in an amount
not to exceed $.50.000.00

they might be on hand to designate the actual location of the installation.

3. That BRAZOS COUNTY reserves the right to require Applicant to relocate or lower any
such line at no cost to BRAZOS COUNTY, should same hecome necessary due to
widening or lowering, or other alteration of Ilia roadway or right-of-way.

Formal notice is hereby given that (Applicant) Fergtlson-Burteson County Gas Gathering
System proposes to place a (type) M v SYE'EL_ pipeline within the right-or-way of
(roars in Brazos County, Texas as follows:
The location or description of the proposed Installation is snore folly shown by one copies
of the drawings attached to this notice.
6. That the line or lines will he constructed no less than forty-eight inches (48') lower than
the lowest part of the drainage or bar ditch and the drainage is to be considered at least
two feet (2') below (lie center of the roadway.
7. That all roads shall he bored in accordance with the Utility Accomodation Policy of the
Texas Department of Transportation Baled 1989.
8. That all sites will tic barricaded during construction period.
9. That the normal charge. is $500 per crossing and/or $40 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
