BRAZOS COUNTY COMMISSIONERS COURT MEETING
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
DECEMBER 19,1995 AT 6:30 P.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.
1. Invocation - Commissioner Norton.
2. Pledge of Allegiance - Commissioner Norton.
3. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Court on county-related issues not scheduled on the agenda. Please
limit subject matters to five minutes. The Commissioners will receive the information,
conduct research into the matter, and/or place the matter on a future agenda for
discussion. (A recording is made of the meeting; therefore, please give your name and
address for the record.)
Consider and take action on agenda items 4 - 13:
4. Authorization for Cox, Croslin and Associates to advertise for bids for construction of the
Brazos County Juvenile Justice Center
5. Appointment of County representative to the Board of Managers of the Brazos County
Emergency Communications District.
6. Budget Amendment 95/96-07.
7. Reclassification of 3/4 time position to full-time position using budgeted dollars.
8. Request from GTE to place a cable in the right-of-way of P;ae Road approximately 150
feet from its intersection with Gold Nugget Road for a distance of 1517 feet. Site is
located in Precinct 3.
9. The Final Plat of Rustic Oaks Subdivision Phase Two, 51.49 acres, Wesley Berryman
Survey, in Brazos County. Site is located in Precinct 3.
10. Approval to advertise for the following bids for Road & Bridge Department:

REGULAR MEETING

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 6:30
p.m. on Tuesday, December 19, 1995, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2, Absent;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Norton gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The first matter before the Court was authorization for
Cox, Croslin and Associates to advertise for bids for
construction of the Brazos County Juvenile Justice Center.
The Judge turned the meeting over to Chuck Croslin, who
informed the Court of the name change of the company from Cox/
Croslin to Croslin and Associates. He then went on to tell
the Court that he had an 88 page construction document that
was ready for the Court's approval. In it he said, was a
revised budget showing an increase in cost of structural

steel, mechanical and security equipment reflecting a 4.9%
increase in cost since June of 1995. The estimated cost of
the project would now be $5,165,842, contingency will be
$516,000. This is an increase of $249,000 from the July
estimate. Alternate 1 - shell out the additional pod at a
cost of $261,265.00 and Alternate 2- to finish the pod brings
the total cost to $6,270,000.00. The County Judge commented
that he did not like the 10% contingency fee of $516,000.00
and that the 7.5% architect fee put the project over 6 million
dollars. Commissioner Norton moved to authorize Chuck Croslin
to advertise for bids for the construction of the Juvenile
Justice Center. Commissioner Sims seconded the motion.
Commissioners Norton, Walker, Sims and Cauley voted "Aye".
The County Judge voted "No". The motion carried. The bid
will be advertised from January 3, 1996 February 14, 1996.
On motion by Commissioner Norton, seconded by the County
Judge, the Court voted unanimously to appoint Commissioner
Randy Sims to be the County's representative to the Board of
Managers of the Brazos County Emergency Communications
District (9-1-1).
The Court next considered Budget Amendment #95/96-07,
which would reallocate funds budgeted for the Elections
Department. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The next matter before the Court was consideration of a
request from the CNS department for the reclassification of a
3/4 time position to a full time position using budgeted
dollars. M. J. Deen, Manager of the CNS department, explained
that she would be combining two positions, that of the
receptionist and the night operator and will not require a
budget amendment to fund the position. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to approve the request from the CNS

department for the reclassification of a 3/4 time position to
a full time position using budgeted dollars.
The Court next considered the request from GTE to place
a cable in the right-of-way of Pate Road approximately 150
feet from its intersection with Gold Nugget Road for a
distance of 1517 feet. The site is located in Precinct 3.
The County Engineer stated that all appeared to be in order
and recommended approval. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously
to approve the request from GTE and authorized the
installation. A copy of the request is attached hereto.
The Court next considered approval of the Final Plat
Rustic Oaks Subdivision Phase Two in Precinct 3. Richard
Vance, County Engineer, stated that he had reviewed the plat
and it appeared to be in order. On motion by Commissioner
Sims, seconded by Commissioner Norton, the Court unanimously
approved the final plat of the Rustic Oaks Subdivision Phase
Two in Precinct 3.
The next matter for consideration was approval to
advertise for bids on the following items:
a) Hydrated Lime, Annual Contract
b) Concrete, Annual Contract
c) Portland Cement, Annual Contract
d) Materials Hauling, Annual Contract
o On motion by Commissioner Norton, seconded by Commissioner
Sims, the Court voted unanimously to authorize the Purchasing
Agent to advertise for bids on the previously noted items.
The Court next considered a request from the Sheriff's
Office to modify the probationary period of selected employees
who are re-hires. Commissioner Sims stated he was in favor of
the group 8 step 2 classification but did not approve of
giving the employees accrued vacation hours. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to modify the probationary period of
selected employees but to deny giving accrued vacation hours.

The Court proceeded to consider the change of status of
the following employees.

On motion by Commissioner Norton, seconded by Commissioner
Sims, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
The County Clerk notified the members of the Court that
the County had entered into contract with the Democratic and
Republican Parties for the primary elections.
The Court next considered a presentation by the Chamber
of Commerce representative concerning an Incentives Proposal
for the Alenco Expansion. Gary Basinger, representative of
the Chamber of Commerce, explained the Incentives Proposal to
the Court. He showed the Court the following five year tax
abatement schedule for the $1,800,000 in equipment needed for
the expansion:

He went on to say that the Bryan-College Station Economic
Development Corporation would provide a $40,000 cash incentive
to Alenco. Commissioner Sims moved to approve the concept of
the incentive proposal and to agree with the presentation.
Commissioner Norton seconded the motion and it carried
unanimously.
The Court acknowledged receipt of the Extension Service
reports for November 1995 and acknowledged receipt of reports
from County and Precinct Offices showing revenues collected

and remitted to the County Treasurer. An excerpt from those
reports is attached hereto.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 19th day of December 1995 at a special meeting of the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Sandie Walker, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;
Mary Ann Ward, County Clerk.
The following proceedings were held:
THAT WHEREAS, on December 19, 1995, the Court heard and
approved a budget amendment for the 1995-1996 budget year for
Brazos'County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 26,
1995 the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).
ADOPTED AND APPROVED this the 19th day of December 1995

GENERAL TELEPHONE NOTICE OF COMMUNICATION
COMPANY LINE INSTALLATION
November 28, 1995
TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Texas as follows:
Beginning point is on Pate Road, 150 feet southwest
of Gold Nugget Road. A buried drop will be,placed
southwest for an approximate distance of 1517 feet.
This drop will be placed along and within 5 feet of
the right of way boundary.
The location and description of this line and associated
appurtenances is more fully shown by four copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin in December 11, 1995.
