A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, October 23, 1995, with the following members

Commissioners Court meeting October 23, 1995
Precinct 4, Duane Peters, to appoint Bobbie Gale Jeffries as
Reserve Deputy Sheriff. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the request from Constable Precinct 4, Duane
Peters, to appoint Bobbie Gale Jeffries as Reserve Deputy
Sheriff without pay.
The Court next considered renewal of a lease agreement
between Brazos County and Mike Hensarling of Brazos County for
rental of office space in the building located at 14621 FM
2154, in Wellborn, Texas, for the use of the Justice of the
Peace for Precinct 2. Term of the lease is for the period of
one year commencing on October 1, 1995 and ending on September
30, 1996. The County agrees to pay to Mr. Mike Hensarling the
amount of four hundred sixty dollars (;460.00) per month. On
motion by Commissioner Norton, seconded by Commissioner
Walker, the Court voted unanimously to renew the lease
agreement between Brazos County and Mr. Mike Hensarling for
the period stated above. A copy of the lease agreement is
attached.
The Court combined agenda items 11 and 12 lease of space
for Constable Precinct 7 and contract for remodeling office
space for Constable Precinct 7. Commissioner Sims moved to
table consideration to allow the Court to further investigate
the matter. Commissioner Walker seconded the motion. Commis-
sioners Sims, Walker and the County Judge voted "Aye". Com-
missioner Norton voted "No". Commissioner Cauley abstained.
The motion carried.
The court next considered the renewal of a Contract for
Municipal Advertising between Brazos County and the
Bryan/College Station Eagle. Term of the contract will be for
one (1) year, beginning November 1, 1995 through October 31,
1996. The new rates reflect a 10% increase and will be

Norton, seconded by Commissioner Walker, the Court voted
unanimously to renew the contract with the Bryan/College

Station Eagle for municipal advertising. A copy of the
contract is attached hereto.
On motion by Commissioner Walker, seconded by Commis-
sioner Norton, the Court voted unanimously to exercise a Hold
over" option in lease for office space for Justice of the
Peace, Precinct 3.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following
individual:
Kimmie Davis - Lot 20, Block 2, George McCullough
Subdivision, City of College Station, Brazos
County, Texas
The Court next considered Budget Amendment #94/95-36,
which would reallocate funds budgeted for the Computer /Network
Services Department, Justice of the Peace Precinct 2, Justice
of the Peace Precinct 7-2 and the Sheriff's Office. On motion
by'Commissioner Walker, seconded by Commissioner Cauley, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court next considered Budget •Amendment #95/96-01,
which would correct 1995-1996 budgeted supplemental pay for
juvenile board members and increase contract placement for
juvenile services. On motion by Commissioner Walker, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The next matter for consideration was the payment of five
(5) full time positions at the Brazos Center on a fixed,
guaranteed work period salary according to the recommendation
by Strategic Human Resource Management. In a letter to the
Court, the director of the Brazos Center pointed out the
benefits to both the employee and the County. On motion by
commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to approve the payment of five (5)
full time positions at the Brazos Center on a fixed,

guaranteed work period salary according to the recommendation
by Strategic Human Resource Management.
The Court next considered a lease agreement between the
Boys and Girls Clubs of Brazos Valley and the Brazos County
Juvenile Services Department for rental of space located at
900 west William Joel Bryan Parkway, in Bryan, Texas. This is
for the purpose of operating the Academy for the
Rehabilitation and Motivation of Youth (A.R.M.Y.) Program
through the Brazos County Juvenile Services Department. The
program will be from 5:30 a.m until 4:00 p.m., Monday through
Friday and run from November 6, 1995 through May 29, 1996.
There will be no rent, fees or other consideration paid by
Lessee for the use of the premises. There will however, be a
disclaimer about injury to the Boy and Girls Club employees
that will hold the County harmless. on motion by Commissioner
Cauley, seconded -by Commissioner Norton, the Court voted
unanimously to approve the lease agreement with the Boys and
Girls Clubs of Brazos Valley and the Brazos County Juvenile
Services Department. A copy of the lease agreement is
attached.
The next matter for consideration was approval to
advertise for bids for a Cargo Van for the Brazos Center, a
Transport Van for the Jail, two (2) J ton pickup trucks and
two (2) 3/4 ton trucks for the Road and Bridge Department.
on motion by Commissioner Norton, seconded by Commissioner
Sims, the Court voted unanimously to authorize the Purchasing
Agent to advertise for bids for the previously mentioned
items.

The next matter for consideration was approval of a
requisition from Capital Projects for a copier for the Jail
Floor. This is a Sharp Copier at a cost of $6,859.00. On
motion by Commissioner Cauley, seconded by Commissioner
Norton, the Court voted unanimously to approve the requisition
form Capital Projects for a copier for the Jail Floor.
The Court next considered Engineer /Architect services for

Courthouse security. In a memo to Commissioner Walker, the
Purchasing Agent recommended using the services of
ravey*patterson & associates because their references
indicated extensive knowledge of security systems necessary
for this project. On motion by Commissioner Walker, seconded
by Commissioner Cauley, the Court voted unanimously to use the
services of ravey*patterson & associates for the Courthouse
security project.
On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted unanimously to encumber
funds for the Brazos Center Paving and the excavation of,empty
fuel tanks located at the Road & Bridge Shop facility.
On motion by Commissioner Norton, seconded by Commis-
sioner Walker, the Court voted unanimously to table consi-
deration of the request from GTE for a parallel cable install-
ation in the right-of-way of Trotter Lane in Precinct 1.
The Court next considered approval of the Final Plat of
Estates at River Run - Phase II in Precinct 1. Commissioner
Norton asked the County Engineer to check for any duplication
of road names like Mustang Ridge, and if there were any, the
names would have to be changed. The County Engineer pointed
out the following four (4) conditions to be met for approval:
a) On sheet 1 of 4, add note stating "Reserve
Tract "A" shall not be used as a building site.
b) On sheet 2 of 4, show flood plain BFE being
r 230.0 on lot 10, Block 4
c) On sheet 2 of 4, add note of clarification for
maintenance dedication area along Wild Horse Run.
d) On sheet 4 of 4, add note of clarification
concerning multiple easements at ends of Wild Horse
Run and Stallion Ridge utility easement and
r drainage easement.
On motion by Commissioner Norton, seconded by Commissioner
Sims, the Court unanimously approved the final plat of Estates
at River Run - Phase II Subdivision with the above referenced
}
changes.
The Court acknowledged receipt of the Eictension Service

and remitted to the County Treasurer. An excerpt from those
reports is attached hereto.
There was no citizen input and/or concerns.
The Court next heard a presentation by Texas Department
of Health representative, Kathy McCormick, concerning the
Matching Funds Agreement for Medicaid funding. Ms. McCormick
gave an overview of the program and steps necessary to get the
matching funds. The County Judge and members of the Court
thanked Ms. McCormick for the information.
At 10:20 a.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed
executive session to discuss the purchase of real estate as
allowed under Section 551.072 of the Government Code.
At 10:35 a.m. the County Judge announced the meeting open
to the public. On-motion by Commissioner walker, seconded by
Commissioner Cauley, the Court voted unanimously to enter into
negotiation for the purchase of property.
Constable Precinct 7, Winfred Pittman, informed the Court
that he had looked at the proposed office space and the owner
will not renovate at no cost to the county.
The County Judge brought up the following items:
1) Will have another workshop to discuss the
travel policy
2) Mentioned that the Jail Standards Commission
required eighty eight (88) personnel for three
4 hundred (300) inmates.
There being no further business to come before the. Court,
the meeting was adjourned.

LEASE AC3REEMENT
This lease Agreement is made and entered into this 23rdday of October, 1995
by, and between MIKE HENSARLING of Brazos County, herein called "Lessor", and
BRAZOS COUNTY, TEXAS herein called "Lessee".
In consideration of the mutual covenants and agreements herein set forth, and
other good and valuable consideration, Lessor does hereby demise and lease to
Lessee, and Lessee does hereby lease from Lessor, the following described premises
located in Brazos County, Texas:
Office space (approximately 940 sq. ft.) in the building located at 14821
FM 2154 which is on the corner of FM 2154 and Church Street in Wellborn to
include water and sewer along with restroom. It will also provide handicap
access.
TERM
The term of this lease shall be for a period of one year commencing on October
11 1995 and ending on September 30, 1996.

I
Lessee agrees to pay to Lessor as rent for the leased premises the sum of
FOUR HUNDRED SIXTY DOLLARS ($460.00) per month on the first of each month.
USE OF PREMISES
The leased premise shall be used only as an office and Lessee shall not permit
the leased premises or any part thereof to be use for: (a) the conduct of any

offensive, noisy, or dangerous activity that would increase the premiums for fire

insurance on the leasod premises; (b) the creation or maintenance of a public
nuisance; (c) anything which is against public regulations or rule of any public

authority at any time applicable to the leased premises; or (d) any purpose or in
any manner which will obstruct, interfere with, or infringe on the rights of other

tenants or adjoining property owned by Lessor, nor shall the leased premises be
occupied by any person or persons other than the person or persons authorized by
Lessee.

INDEMNITY AGREEMENT
Lessee agrees to indemnify and hold Lessor and the property of Lessor,
including the leased premises, fee and harmless, from any and all liability for injury
to, or death of, any person, including employees of Lessee or for damage to property
arising from the use and occupancy of the leased premises by Lessee or from the act
or omission of any person, or persons, including employees of Lessee, in or about
the leased premises with the express or implied consent of lessee; provided that
nothing in this agreement shall expand or enlarge the liability of lessee greater than
that of Lessee under the Texas Tort Claims Act.
ALTERATIONS AND WROVEMENTS
Lessee shall make no alterations to the building on the leased premises nor
construct any buildings or other improvements on the leased premises without first
having obtained the written consent of Lessor.
LESSOR REPAIRS
Lessor shall, at his expense, change, clean, or replace all air conditioning
filters as he deems necessary for the proper maintenance of the air conditioning
equipment. Lessor shall, after notice and at his expense, make all roof, floor (other
than surface material), pavement, electrical, plumbing, air condition, heating,
structural repairs and replacements, including but not limited to those required by
public authorities, all repairs and replacements to and painting of the exterior walls,
(outside doors and overhead doors are considered as outside walls). Lessor shall
replace all broken window and plate glass except damage resulting from negligence.

corrections which, under the terms hereof Lessor is required to make after written
notice to Lessor by Lessee, or having started such repairs or corrections, Lessor
fails to complete them within a reasonable time, Lessee may cause such repairs or
corrections to be made or completed at Lessor's cost and expense and may deduct
from subsequent installments of rent an amount sufficient to reimburse itself for
costs and expenses incurred. Unless otherwise herein provided, all normal repairs,
painting and replacements to the inside of buildings shall be made at the expense of
Lessee which shall surrender the same at the end of the Lease term or any extension
thereof in substantially as good condition as when received, ordinary wear and tear,
damage by fire or the elements and unavoidable casualties excepted.
DESTRUCTION OF PRE USES
Should any building or improvements on the leased premises be damaged or
destroyed by fire, the element's, acts of God, or other causes not the fault of Lessee
or any person in or about the leased premises with the express or implied consent
of Lessee, they shall be repaired or replaced by Lessor at his own cost and expense
and the rent payable by Lessee pursuant to this lease shall be abated to the extent
such damage or destruction renders the leased premises uninhabitable by Lessee.
Provided however, should the cost of repairing or restoring any buildings or
improvements so damaged or destroyed exceed twenty-five percent (25%) of the
replacement cost of all buildings and improvements now located on the leased
premises, or if more than fifty percent (50%) of the total floor space of the leased
premises shall be rendered unfit for Lessee's occupancy this lease may be terminated
by either party by ten (10) days written notice. If less than fifty percent (50%) of
the total floor space of leased premises shall be uninhabitable and repair and
restoration can be accomplished within ninety (90) days, Lessor may, at his option,
either repair and restore the damaged buildings and improvements or cancel this

lease and return any unearned rent previously paid by Lessee under this lease.
CONDITION OF PREMISES
Lessee stipulates that the leased premises, as well as all building and
improvements located thereon, are at the date of this lease in good order, repair and
a safe and clean condition.
UTILITIES
All charges for electricity, shall be paid by Lessee. All charges for water and
other utility services shall be paid by Lessor.
IMPROVEMENTS PROPERTY OF LESSOR
All alterations, changes, and improvements built constructed, or placed in the
leased premises by Lessee, other than movable personal property shall, unless
otherwise provided by written agreement between Lessor and Lessee, be the
property of Lessor and remain in the leased premises at the expiration or sooner
termination of this lease. Lessee at the termination of the lease shall not be required
to restore the improvements to their original condition. Nothing contained in this
paragraph, however, shall authorize Lessee to make or place any such alteration,
change, or improvements on the leased premises without having first obtained the
written consent of Lessor.
ASSIGNMENT AND SUBLETTING
Lessee shall not assign this lease nor sublet the leased premises or any
interest therein without first obtaining the written consent of Lessor, which consent
shall not be unreasonably withheld. A consent by Lessor to one assignment or
subletting shall not be deemed to be a consent to any subsequent assignment or
subletting. An assignment or subletting without the written consent of Lessor, shall
be void and shall, at the option of the Lessor, terminate the lease.

LESSEE'S RIGHT TO PERFORM
In the event Lessor violates or fails to perform any provisions or agreements
of the lease to be performed or complied with by Lessor, and such violation or failure
continues for fifteen days after written notice thereof to Lessor, Lessee may, in
addition to all remedies available to it, be entitled to perform on behalf of Lessor and
deduct all such payments from the rent.
DEFAULT BE LESSEE
Should Lessee be in default for a period of more than ten (10) days in the
payment of any rent payable under this lease or in the performance of any other
provision of this lease and such default continues for thirty (30) days after written
notice, Lessor may terminate this lease and regain possession of the leased premises
in the manner provided by the laws of the State of Texas in effect at the date of such
default.
HOLD OVER
At the expiration of this lease, should Lessee hold over for any reason
whatsoever, it is hereby agreed that in the absence of a written agreement to the
contrary, such tenancy shall be from month to month only under the same conditions
and at the same monthly rental as provided herein.
SUBORDINATION OF LEASE
This lease and Lessee's leasehold interest under this lease are and shall be
subject, subordinate, and inferior to any lien or encumbrance now on the leased
premises by Lessor.
RIGHT OF INSPECTION
Lessor and his agents have the right at all reasonable times during the terms
of this lease to enter the leased premises for the purpose of inspecting them and all

building and improvements thereon; provided however that the right of inspection
shall not extend to any record, the disclosure of which is prohibited by law.
PARKING
Ample space will be provided for parking vehicles.
NOTICES
Any and all notices or other communication required or permitted by this lease
to be served on or given to either party to this lease by the other party hereto shall
be in writing and shall be deemed duly served and given when personally delivered
to the party to whom it is directed, or in lieu of such personal service, when
deposited in the United States Mail, postage prepaid, addressed to Lessor, Mike
Hensarling, P. O. Box 126, Wellborn, Texas 77881; addressed to Lessee, Brazos
County, 300 East 26th Street, Bryan, Texas 77803-5327, until otherwise notified.
Either party hereto may change his address for the purpose of this paragraph by
giving written notice of such change to the other party in the manner provided for
in this paragraph.

The leased premises are to be used as office space for the Justice of the Peace
for Precinct Two (2) of Brazos County.
LOCATION FOR BENT PAYMMXT
Unless changed by written notice pursuant to the provisions in the above
heading under Notices, all rent payable under this lease shall be paid to Lessor at
P. O. Box 126, Wellborn, Texas, 77881.
ATTOBNEWS FEES
Should any litigation be commenced between the parties hereto concerning the
leased premises, this lease, or the rights and duties of either party in relation

thereof, the party prevailing in such litigation shall be entitled, in addition to such
relief as may be granted, to a reasonable sum as and for his attorney's fees in such
litigation.
TEXAS LAW TO APPLY
This agreement shall be construed under and in accordance with the laws of
the State of Texas, and all obligations of the parties created hereunder are
performable in Brazos County.
LEGAL CONSTRUCTION
In case any one or more of the provisions contained in the agreement shall for
any reason be held to be invalid, illegal or unenforceable it shall not affect any other
provision thereof and this agreement shall be construed as if such invalid, illegal or
unenforceable provision had never been contained herein.
PRIOR AGREENEXTS SUPERSEDED
This agreement constitutes the sole and only agreement of the parties hereto
and supersedes any prior understandings or written or oral agreements between the
parties respecting the within subject matter.
AMENDMENT
No amendment, modification, or alteration of the terms hereof shall be binding
unless the same be in writing, dated subsequent to the date hereof, and duly
executed by the parties hereto.
OPTION TO RENEW
Lessee may renew this lease for one year by giving Lessor written notice of
such renewal at least thirty (30) days prior td the expiration of the then'current
term. Each such renewal shall be upon the same terms and conditions.

A carrying charge of 1 1/2 per month will be charged on all accounts not paid In full by the 15th day of the
month following advertising insertion. The Advertiser also convenants to pay all costs Incurred by The Eagle
enforcing this Contract, Including collection and attorney's fees (up to 60% of the amount In default) should the
Advertiser default In payment.
For value received, Advertiser assigns to*The Eagle all right, title and Interest to all layouts of advertisements
placed with The Eagle which represent the creative effort of the newspaper and/or utilization of its own
illustrations, labor, composition or material. Advertiser understands that because of said assignment, he cannot
authorize photographic or other reproduction of any such advertising layout appearing In The Eagle in any other
publication without the express written consent of The Eagle.
It is further understood that this assignment does not preclude Advertiser from supplying to other publications
similar or Identical material or Information for production of advertisements by such publications or from
suggesting the content or form of such advertisements.
H disaster, work stoppage, newsprint rationing, or other emergency shall cause publishing difficulties, the
Publisher shall have the right to revise this Contract so as to prorate the available space on an equitable basis.

LEASE AGREEMENT
This Lease Agreement is entered into on this the day of
6C+bbr , 1995, by and between the Boys' and Girls' Clubs of Brazos Valley,
900 West William Joel Bryan Parkway, Bryan, Brazos County, Texas, hereinafter referred
to as "Lessor", and Brazos County and the Brazos County Juvenile Services Department,
Brazos County Courthouse, 300 E. 26th Street, Bryan, Brazos County, Texas, hereinafter
referred to as "Lessee".
Lessor agrees to lease to Lessee certain premises located at 900 West William Joel
Bryan Parkway, Bryan, Brazos County, Texas ("Leased Premises") for a term commencing
on November 6, 1995 and ending May 29, 1996 for the purpose of operating the Academy
for the Rehabilitation and Motivation of Youth (A.R.M.Y.) Program through the Brazos
County Juvenile Services Department.
It is understood and agreed that Lessor is donating the use of said premises to
Lessee. There will be no rent, fees, or other consideration paid by Lessee for the use of
the Leased Premises.
It Is expressly understood and agreed that Lessor will continue to use the Leased
Premises during the term of the lease. Lessee agrees not to unreasonably interfere with
Lessor's operation at the Leased Premises. Lessee's program at the Leased Premises
will be from the hours of 5:30 a.m. until 4:00 p.m., Monday through Friday. Lessee will not
use and will vacate the Leased Premises (not including the portable building described
below) during Lessor's standard hours of operation.

It is agreed by the parties to this lease that Lessee will place on the grounds of the
Leased Premises a portable building for its exclusive use. Lessee will be solely
responsible for maintenance and repair to such portable building, including the
responsibility to secure any appropriate insurance for the portable building.
Lessor shall not be responsible for any loss, injury, death, or damage to persons or
property which at any time may be suffered or sustained by Lessee or any person
whomsoever may at any time be using or occupying or visiting the Leased Premises at
Lessee's request or arising out of or as a result of Lessee's occupancy of the Leased
Premises. Lessor shall not be responsible for any loss, injury, death, or damage shall be
caused by or anyway result from arise out of any act, omission or negligence of Lessee or
any occupant, visitor and user of any portion of the Leased Premises, or shall result from
or be caused by in any manner from Lessee's use of the Leased Premises. Lessee shall
indemnify Lessor against all claims, liabilities, loss, or damage whatsoever on account of
such loss, injury, death, or damage arising out of or as a result of Lessee's use of the
building, whether such loss, injury, death, or damage is caused in whole or in part by the
negligence of Lessor. Lessor shall indemnify and hold harmless Lessor from any loss,
injury, death, or damage caused in whole or in part by the actions of Lessee's employees,
representatives, or any persons under the supervision and control of Lessee.
Lessee shall maintain in effect through the term of this lease liability insurance
covering the Leased Premises and in activities at the Leased Premises in the amount of
FIVE HUNDRED THOUSAND AND NO/100 ($500,000.00) DOLLARS for injury to or death
to one person and ONE MILLION AND NO/100 ($1,000,000.00) DOLLARS for injury to
or death of any number of persons in one occurrence. Such insurance shall specifically

Insure Lessee against.all liability assumed by it hereunder, as well as liability imposed by
law, and shall insure both Lessor and Lessee, but shall not be so endorsed as to create
the same liability on the part of the insurer as though separate policy had been written for
Lessor and Lessee. Lessee will provide a certificate of Insurance to evidence such policy.
The undersigned parties hereby acknowledge the foregoing as a complete rendition
of the agreement between said parties and further acknowledge that o other terms or
conditions exists or shall be imposed upon either as a result of this contract or any other
agreement not expressly contained herein unless said agreement shall serve to modify this
understanding.
