The Court next considered the following Claims as submitted by the County Treasurer for payment: 95-04605 through 95-04738 on motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. No notice given to property owners or i attempt to work with them on the issue After hearing all the commentary, Commissioner Cauley moved to s` ' temporarily halt work on the site and work with the residents k to see if there is a viable alternative to the dilemma. Commissioner Walker seconded the motion which carried unanimously. The next matter before the Court was the placement of a "Stop" sign on Sweetwater Drive at its intersection with f Greens Prairie Road in Precinct 1. The Court met in Public Hearing on Monday, September 25, 1995, to hear commentary for 'r and against the placement of the "Stop" sign at the entrance/exit of the newly created subdivision for, safety purposes. On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to place a "Stop" sign on Sweetwater Drive at its intersection with Greens Prairie Road in Precinct 1. The Commissioners Court meeting was reconvened at 10:05 a.m.. The Court next considered adopting a Resolution authorizing condemnation proceedings on certain property on Greens Prairie Trail in Precinct 1. Pointing to a map, Commissioner Norton showed the Court the property owned by Robert Palmore and explained the need for the property. Robert Palmore told the Court that sometime back he had asked Commissioner Norton if he had done a feasibility study of road costs. Receiving no reply from the Commissioner, he then decided to circulate a petition. He told the Court that he collected one hundred ten (110) signatures against building the roadway and asked the Court to deny condemnation proceedings on his property. Sue Ann Palmore asked Commissioner Norton if he intended to hand the road over to the state, at which Commissioner Norton replied that he did. Bob Wills showed the Court how the taking would affect his property. The County Engineer explained to the Court that the Palmore property was needed to relocate a pipeline. After much discussion Commissioner Norton moved to adopt a resolution to continue with condemnation proceedings. The next matter for consideration was the renewal of a contract between the Retired Senior Volunteer Program (RSVP) and Brazos County. Brazos County will pay $2,500.00 to RSVP and in exchange, RSVP will provide volunteers to help the citizens of Brazos County. Term of the contract will be from October 1, 1995 to September 30, 1996. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to approve the contract with the Retired Senior Volunteer Program. A copy of which is attached. The Court next considered a preliminary incentive package for RVS/EVAPCO. Marc Willis, representative of the Economic Development Council, informed the Court that RVS/EVAPCO makes parts for industrial air conditioners and that the incentive package, in the form of a 100% tax abatement for seven (7) years was being considered to keep the company in the area. Commissioner Norton stated the he did not want to lose business but he was very concerned over the 100% abatement for the seven (7) year period. He went on to say that was in conflict with EDC guidelines and he did not want to set a precedent. The County Judge moved to approve the incentive package. Commissioner Walker seconded the motion. The County Judge and Commissioner Walker voted "Aye". Commissioners Norton, Sims and Cauley voted "No". The motion failed. Commissioner Cauley moved to provide RVS/EVAPCO with the same incentives as everyone else. The motion died for lack of a second. Commissioner Sims then moved to offer a 5% decreasing abatement over a seven (7) year period. Commissioner Norton seconded the motion. Commissioners Norton, Walker, Sims and Cauley voted "Aye". The County Judge abstained. The Court next considered adopting a Resolution Declaring Intention to Reimburse Certain Expenditures with Borrowing Proceeds. This is to pay capital expenditures in connection with the design, planning, acquisition, construction,- equipping and/or renovating a juvenile detention center and VOL.- Z PADE.~& • 0e [ i Commissioners Court meeting October 2, 1995 the site therefor totaling up to approximately $10,000,000. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to adopt a Resolution Declaring Intention to Reimburse Certain Expenditures with Borrowed Proceeds. The Court next considered an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(4). This is to purchase the personal and/or professional service, Election Consulting Services and Equipment from Bill McLeod of Texas Voting Systems, Inc. The Commissioners Court determined that this was a single source supplier. On motion by Commissioner Cauley, seconded by Commissioner Norton, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements and authorized the payment for all personal /professional services from the designated individual for the November 1995 election. The next matter before the Court was approval of a Contractual Agreement between Brazos County and Texas Voting Systems, Inc. in connection with the Constitutional Amendment Election and Bryan Independent School District Bond Election to be held on November 7, 1995, in Brazos County, Texas. TVS, Inc. will provide services and supplies to be rendered in the election to be held on November 7, 1995. The cost to Brazos County will be $14,110.00. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to enter into contractual agreement with TVS, Inc.. A copy of the contractual agreement is attached hereto. The next matter for consideration was approval to advertise the sale of the System 11 Computer Hardware. This is the old computer that was recently phased out. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise the sale of the System it Computer Hardware. The .Court next considered the return of two John Deere Motor Grades to Stewart & Stevenson. In a letter to Stewart ' r 1 Commissioners Court meeting October 2, 1995 i k r I i i i t e f r V i G & Stevenson, Inc., the Purchasing Agent gave notice of intent to exercise the option for guaranteed repurchase of two Motor Graders as provided for in Bid No. 94-781. In that bid, Stewart & Stevenson agreed to buy back both Motor Graders for $108,700.00 each for a total of $217,400.00. on motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to return two John Deere Motor Grades to Stewart & Stevenson. The Court next considered awarding bid no. 95-029, Motor Graders. Cheryl Turney, Purchasing Agent, recommended acceptance of the bid submitted by Mustang Tractor and to waive the performance bond requirement. The savings of $2,240.00 for the performance bond would be passed on to the county. Commissioner Norton move to accept the recommendation of the purchasing agent and accept the bid submitted by Mustang Tractor and to waive the performance bond requirement. Commissioner Sims seconded the motion. Commissioners Norton, Walker, Sims and Cauley voted "Aye". The County Judge abstained. A copy of the bid tabulation is attached hereto. on motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to execute a Tax Resale Deed to the following individual: Darrel A. Pearce - Lots 9 and 10, Block 115, Millican Townsite, Brazos County, Texas The next matter for consideration was a letter of agreement between Wellborn Water. Corporation and Brazos County for the placement of Wellborn Water lines in the county right- of-way on the southwest side of Dowling Road in Precinct 1. This is necessitated because of resistance from property owners to the procurement of needed right-of-way. on motion by Commissioner Walker, seconded by Commissioner Norton, the Court voted unanimously to approve a letter of agreement with Wellborn Water Corporation and allow the placement of Wellborn Water lines in the county right-of-way. The Road and Bridge Department requested permission to enter the private property of E. wayne Hopkins on Cliff Road to clear out a channel to allow water to drain from the roadway and driveway. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered approval of the Resubdivision Plat of all of Blocks D & E, and part of Lots 7 & 9, Benjamin Graham Subdivision. Ray Crow, Engineering Aide, stated that all appeared to be in order. On motion by Commissioner Norton, seconded by Commissioner Walker, the Court unanimously approved the final plat of the Subdivision as submitted. The Court next considered Budget Amendment 194/95-33, which would reallocate funds budgeted for Computer & Network Services Department, Justice of the Peace, Pct. 7-2, and Justice of the Peace, Pct. 3. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. Under citizen input and/or concerns the County Judge made the following comments: a) Hazardous Materials and Waste Training for all employees will be presented by the Texas Association of Counties on October 21, 1995 at various times during the day. b) Since the Courthouse is a smoke free environment, he would like to remove the cigarette machine from second floor. , c) Would like to set a deadline for 94/95 budget amendments. Brazos County, Texas agrees to pay the total sum of $2,500 to RSVP in a single payment on or before March 31, 1996. All payments will be payable to the Retired Senior Volunteer Program and mailed to their current address: 305 S. Main Suite 100; Bryan, Texas 77803. II. RSVP agrees to provide the service of its program to the citizens of Brazos County. There is not established any definite program of assignments; but, the number of volunteers and assignments can be changed throughout the term of this contract by agreement of all parties. RSVP does agree to address the mutual goals of RSVP and Brazos County, Texas by assisting with senior volunteer recruitment for: A. The Brazos County Health Department. B. The County Extension Aging committee. C. The Brazos County Adult Probation Department. D. The Brazos County Juvenile Probation Department. E. The Civil Defense program. F. The Brazos County Tax Office-voter registration drive. G. The District Attorney's Office Victim Assistance Program. H. The County Commodity Distribution program. I. The County Extension office. J. Clerical support for county offices and programs. The terms of this contract will be October 1, 1995 to September 30, 1996. III. Volunteer placements will be made as appropriate at volunteer workstations throughout the community. All workstations will have a signed Memorandum of Understanding on file with RSVP. IV. Any invention of literacy or artistic production arising out of an assignment shall be the exclusive property of the Volunteer Station and the Volunteer shall have the right to produce additional copies and distribute to the general public. Volunteer Station may consent to other uses by the Volunteer. V. Volunteers shall comply with all the rules and standards exercised by the employees in the department to which she or he is assigned. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF BRAZOS COUNTY, TEXAS THAT: Section 1. This Resolution declares the intention of the Issuer to reimburse the expenditures for the Project with the proceeds of a borrowing. The Issuer presently intends to reimburse the expenditure by incurring debt the interest on which is excludable from gross income under section 103 of the Internal Revenue Code of 1986, as amended. Section 2. The Issuer reasonably expects to incur debt, in one or more series of obligations, with an aggregate maximum principal amount now estimated to not exceed $10,000,000 for the purpose of paying the c costs of the Project. A portion of the proceeds received by the Issuer from a borrowing in an amount estimated not to exceed $5,000,000, are reasonably expected to be used to reimburse the General Fund from which such capital expenditures are expected to be made for the Project. Section 3. The Issuer intends that this Resolution satisfy the official intent requirement set forth in Section 1.103-18 of the Treasury Regulations and evidences its intentions under Article 717k-6. The Issuer has no funds or sources of funds, other than the proceeds of the debt to be incurred, which the Issuer has, or reasonably expects to be, reserved, allocated on a long-term basis, or otherwise set aside in the Issuer's budget or other financial policies with respect to the expenditures to be reimbursed. Section 4. All costs to be reimbursed pursuant hereto will be capital expenditures within the meaning of Section 1.103-18(cx2xiii) of the Treasury Regulations. None of the expenditures to be reimbursed pursuant to this Resolution have been allocated to expenditures entered on the books and records of the Issuer earlier than the date on which such expenditures are paid. Moreover, no debt obligations will be issued by the Issuer in furtherance of this Resolution after a date which is later than one year after the later of (1) the date the expenditures are paid or (2) the date on which the property, with respect to which such expenditures were made, is placed in service. Section S. The Issuer declares that this Resolution will be maintained as a public record available for inspection by all persons in accordance with the provisions of Chapter 552, Texas Government Code and that no later than 30 days after this date, this Resolution will be made available for inspection by all members of the general public at the offices of the issuer.
