V0 P A Q F, COMMISSIONERS' COURT SPECIAL MEETING i i i F SEPTEMBER 18, 1995 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, September 18, 1995, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Sandie Walker, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Under Citizen input and/or concerns, Mrs. Naomi Fackler, representative of the League of Women Voters read a statement to the Court against cuts in the Sheriff's budget for fiscal year 1996 and that holding a Public Hearing and voting on the budget the same day did not give the Court adequate time to consider citizen input. The Court next heard a presentation by Edsel Jones concerning the opening of the abandoned Missouri-Pacific Railroad right-of-way as a county road. The Court next considered the following Claims as submitted by the County Treasurer for payment: 95-04055, 95-04057 through 95-04283 On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the Claims as submitted. r , The Court next considered Budget Amendment $94/95-31, r s which would reallocate funds budgeted for the following departments: County Judge, County Auditor, District Attorney, ` Agriculture Extension, Brazos Center and Sheriff. On motion by Commissioner Sims, seconded by Commissioner Cauley, the 1 Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The next matter before the Court was approval of a br Contractual Agreement between Brazos County and the Bryan k Independent School District to hold a joint election on t; Tuesday, November 7, 1995. One ballot will contain all Texas Constitutional Amendments and Bond Propositions for Bryan Independent School District, there will be one set of ballot } boxes, and election forms and records will be adequate to ' Commissioners Court meeting September 18, 1995 record and report the results of the election for Brazos County and Bryan Independent School District. On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to enter into contractual agreement with the Bryan Independent School District to hold a joint election on Tuesday, November 7, 1995. A copy of the contractual agreement is attached hereto. i E C t On motion by the Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to adopt an order for a joint election to be held by Brazos County and the Bryan Independent School District on the 7th day of November, 1995. Brazos County will be holding a special election on November 7, 1995 for the purpose of adopting or rejecting the Constitutional Amendments as submitted by the 74th Legislature, Regular Session, of the State of Texas. Bryan Independent School District will hold an election on the same day to determine whether the governing body shall be authorized to issue bonds of said District for the construction and equipment of school buildings and the purchase of necessary sites. A full copy of the Order is attached hereto. The Court next considered the posting of speed limits on Arrington Road and South Oaks Drive, South Oaks Subdivision in Precinct 1. A Public Hearing was held on Tuesday, September 12, 1995 to hear commentary for or against such action. At the hearing, a 35 mph speed limit was recommended for South Oaks Drive and a 45 mph speed limit was recommended for Arrington Road. On motion by Commissioner Norton, seconded by f Commissioner Walker, the Court voted unanimously to set a speed limit of 35 mph on South Oaks Drive and 45 mph on Arrington Road. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the F general public. The Road and Bridge Department requested permission to enter the private property of Willie Ruder on Vp 6 PAQE I • • Commissioners Court meeting September 18, 1995 Ruder Road to transport several bails of hay to be used for erosion control on Jones Road. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. The next matter for consideration by the Court was acceptance of an easement grant conveyed to Brazos County for the purpose of expanding and improving Hicks Lane in Precinct 3. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept the easement grant from Terri A. Sandvik on the expansion of Hicks Lane located in Precinct 3. The Court next considered the request from the Road & Bridge Department for acceptance of a cost estimate from GTE to realign approximately 150 feet of buried cable located in the right-of-way of Dilly Shaw Tap Road. The total cost will not exceed $1,495.00. The site is located in Precinct 2. On motion by Commissioner Walker, seconded by Commissioner Norton, the Court voted unanimously to approve the request from Road & Bridge Department and authorized the expense. A copy of the request is attached hereto. The next matter before the Court was a Services Agreement between Brazos County Juvenile Services and Bryan Medical Laboratory for the purpose of performing laboratory services. Bryan Medical Laboratory will provide courier services, reporting services, client services, phlebotomy services and billing enhancements. Cost to the county is on the attached price sheet. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to enter into Agreement with Bryan Medical Laboratory for the purpose of performing laboratory services. There was no citizens input and/or concerns. There being no further business to come before the Court, the meeting was adjourned. W I T N E S S E T H WHEREAS, the Governor of the State of Texas has ordered a Special Election to be held in all counties on Tuesday, November 7, 1995 for the purpose of adopting or rejecting the proposed Constitutional Amendments as submitted by the 74th Legislature, Regular Session, of the State of Texas. WHEREAS, the Board of Trustees of the Bryan Independent Schools District has ordered a Bond Election to be held Tuesday, November 7, 1995 for the purpose of determining whether said governing body shall be authorized to issue bonds of said District. WHEREAS, Section 271.002 (b) of the Texas Election Code authorizes more than one political subdivision to enter into an agreement to hold elections jointly; and WHEREAS, BRAZOS COUNTY and THE BRYAN INDEPENDENT SCHOOL DISTRICT will hold elections on the same day; and WHEREAS, the parties to this agreement desire that a joint election be held that is cost effective and convenient for the citizens of Brazos County and The Bryan Independent School District; NOW THEREFORE BE IT RESOLVED that a joint election be held by BRAZOS COUNTY, TEXAS and THE BRYAN INDEPENDENT SCHOOL DISTRICT under the following terms and conditions, and the parties herewith agree with said conditions: I. That there shall be one ballot that contains all Constitutional Amendments and Propositions. II. That there shall be one set of ballot boxes to be used at the common polling places. III. V. That the Bryan Independent School District shall be responsible for the Spanish translation of all propositions. VI. That the implementation and actual management of the joint election shall be with BRAZOS COUNTY. The implementation and management of the election shall include the following: A. The securing of qualified individuals to serve as election judges for each voting box within the voting precinct. B. The securing of the location and facilities where and within which election is to located. C. The securing of the official ballots and election materials and supplies requisite to the proper administration of elections under the Texas Election Code. D. Securing of a contract for election services and supplies which includes counting of ballots with Texas Voting Systems, Inc. E. COUNTY to be responsible for conducting early voting at the Brazos County Courthouse, Galilee Baptist Church, Arena Hall, College Station Independent School Administration Building and Memorial Student Center on Texas A&M Campus. VII. The amount to be paid by the BRYAN INDEPENDENT SCHOOL DISTRICT to BRAZOS COUNTY for services rendered by said County in the Special Election to be held on Tuesday, November 7, 1995 is: A. BRAZOS COUNTY will pay all cost in total. B. THE BRYAN INDEPENDENT SCHOOL DISTRICT will reimburse BRAZOS COUNTY for certain costs in accordance with the following schedule. 1. Forty percent of 'all costs incurred for polling place located in the District. 2. Forty percent of compensation paid to Judges and Clerks at all polling places located in the District. or,J l i 61 i 3. Forty percent of cost of services and Jupplies for polling places located in the District. 4. Forty percent of the cost of publication of all required notices. 5. COURIER SERVICES BML maintains an extensive courier system. The courier will deliver supplies and pickup specimens from your office. Lockboxes for after hours specimen pickup can be provided for our mutual convenience. Supplies are provided at no additional charge for the collection of specimens sent to BML. These supplies are ordered via a printed supply requisition provided to each client and delivery is made by the courier within two working days. Courier services are available for 9:00 A.M. until 5:00 P.M. weekdays. REPORTING SERVICES Reports will be delivered VIA courier. CLIENT SERVICES BML Client Services Department responds to physicians' and patients' telephone inquiries concerning specimen requirements, test results, add-on tests and general information during the hours of 8:00 A.M until 5:00 P.M. In addition, these representatives will report STAT test results and critical values.
