THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON MONDAY,
AUGUST 14, 1995 AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,

Alexander Road for disposal of dead livestock for the health, safety and welfare of the

Cauley, the Court voted unanimously to approve the changes as
submitted. ,
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
95-02924 through 95-03227
On motion by Commissioner Norton, seconded by Commis-sioner
Sims, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered authorizing the Brazos County
Bar Association Law Library Committee to write a new contract
between Brazos County and the City of Bryan for the Brazos
County Law Library. On motion by Commissioner Norton,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize Jerry Brown, President of the Bar Association,
Law Library Committee to negotiate a new contract between
Brazos County and the City of Bryan.
On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted unanimously to table
consideration of requesting bids for the construction of the
Brazos County Juvenile Justice Center. This was premature

because the construction documents were only now being

prepared.
The Court next considered Change Order No. 1 to Contract
No. BC-95 with McCord Engineering, Inc. for the Brazos Center
Parking Lot Lighting. This change order is necessary to
change the design to increase the lighting level at the back
of the parking area of the Brazos Center to the same level of
lighting as the rest of the parking area. On motion by
Commissioner Sims, seconded by Commissioner Walker, the Court
voted unanimously to approve Change Order No. 1 for the Brazos
Center Parking Lot Lighting at an additional cost of
$1,540.00.
The Court next considered a hiring freeze from August 14,
1995 until October 1, 1995. Commissioner Cauley stated that
it appeared that the Court was engaging in double talk. He
referred to the Commissioners Court meeting of June 23, 1995
where statements were made about a department head knowing
what was best for his department. The County Judge moved to
withdraw the item from consideration.- Commissioner Walker
seconded the motion.
On motion by Commissioner Walker, seconded by Commis-
sioner Sims, the Court voted unanimously to appoint the
following persons as presiding judge and alternate judge for
the current voting year at the following voting precincts:

On motion by Commissione

sioner Walker, the Court voted unanimously to purchase
"Benefits
Manager Module"
software for the Personnel
Department. Cost of the package is $3,500.00.
The Court next considered
a request by the District Clerk
to increase the cash allotment
for that department by $300 and
implement
new cash drawer monitoring procedures. Mr. Hamlin
stated in
his memorandum that
he had discussed this with the
County Auditor and that they agreed this was a necessary
procedure to update the department's accounting process. On
motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to approve the request of
the District Clerk and allow an increase in the cash allotment
" by $300.00.

the appraised value for 1994 be lowered from $1,800,533.00 to

Commissioner Cauley, the Court voted unanimously to refund
$4,959.84 in county taxes for 1994 to Weatherford US, Inc..
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following
individuals:
William E. Harris and Mary Catherine Harris - Lots 1-3,
Block 4, Pearce Addition, City of College
Station, Brazos County, Texas
The next matter for consideration was approval to

Purchasing Agent to advertise for bids for the previously
mentioned items.
The Court next considered the construction of a parking
lot at the Brazos County Pavilion. Mike Kristynik, Executive
Director of Planning and Operations for the Bryan Independent
'
School District, contacted the County Engineer and proposed a
joint venture for the construction of the parking lot at the
Brazos County Pavilion site. Bryan Independent School
District would pay for all materials in exchange for daily use
of the lot by staff and patrons of Bonham School. The Road &
Bridge Department would provide the labor and machinery
necessary to construct the lot. On motion by Commissioner
Sims, seconded by Commissioner Walker, the Court voted

unanimously to construct a parking lot on the Pavilion site in
conjunction with the Bryan Independent School District by
r
supplying the manpower and the necessary machinery. The Road
and Bridge Department will do the work as time allows.
The court next considered the request from GTE to place

county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Petra Santana on
Alexander Road to bury a dead calf. On motion by Commissioner
Walker, seconded by Commissioner Norton, the Court voted
unanimously to authorize the work.
The Court next considered authorizing work outside of
county rights-of-ways for the Health, safety and welfare of
the general public. The Road and Bridge Department requested
permission to enter the private property of Thomas H. Welsh,
Jr. on Timberline Drive Road to clean out an existing drainage
channel to allow water to drain from the road ditch. On
motion by Commissioner Norton, seconded by Commissioner
Walker, the Court voted unanimously to authorize the work.
The Court next considered the refiled Plat of Creekridge
Estates, Phase One, a private subdivision in Precinct 1. The
County Engineer indicated that this was a name change only
from Fawn Lane to Wild Burro. On motion by Commissioner
Norton, seconded by Commissioner Walker, the Court voted
unanimously to approve the ref iled plat of Creekridge Estates,
Phase One.
.The Court next considered the request from Wellborn Water
Supply for a road bore in the right-of-way of North Dowling
Road: The site is located in Precinct 1. The County Engineer
stated that all appeared to be in order and recommended
approval. On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted-unanimously to approve

the request of Wellborn Water Supply and authorized the
installation. A copy of the request is attached hereto.
The next matter before the Court was a request from the
Road and Bridge Department to grant a right-of-way easement to
the City of Bryan for the placement of power poles at the
Jones Road citizens' collection site in Precinct 4. This is
for the maintenance and operation of an electric distribution
system for the collection station. On motion by Commissioner
Cauley, seconded by Commissioner Sims, the Court voted
unanimously to grant a right-of-way easement to the City of
Bryan for the placement of power poles at the Jones Road
citizen's collection site in Precinct 4.
The Court next considered a request from the Road and
Bridge Department for acceptance of the City of Bryan's fees
of $14,659.50 and payment thereof to provide a 200 amp-three
' phase service to the compactor at the citizens' collection
site on Jones Road in Precinct 4. Commissioner Cauley asked
if this was the best price the city could give the county.
The County Engineer replied that the city was having to
install poles and all equipment for the 200 amp-three phase
service. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to accept the
City of Bryan fee estimate of $14,659.50 with the stipulation
that the City provide an itemized list of charges.
The Court next considered Budget Amendment 1194/95-26,
which would reallocate funds budgeted for the Juvenile
L Services Department, Sheriff's Department, Road & Bridge
Department, District Clerk, Adult Probation and Boonville
Cemetery Fund and transfer funds from Commissioners Court

Contingency to Personnel for the purchase of the Benefits
Package Module. On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.

review employment applications for Risk
Manager and to report back to the Court
in two (2) weeks.
2. Mentioned that at the Juvenile Board
meeting, questions were raised on
Courthouse security and suggested that
the Court proceed with the review.
There being no further business to come before the Court,
the meeting was adjourned.

C) If clearing of brush, trees and other obstruction Is necessary, It shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees
etc. from County right-of-way.
D) Construction shall be In strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

This notification is a follow-up to our conversation with Ray Crow
on July 26th. To enable us to expedite initial telephone service
to our customer, oral approval was granted.
Enclosed are Form ED-135 and work location sketch showing the
location of our proposed road bore and buried cable line on County
roads in Brazos County at Bryan, Texas.
This work is to be completed on Work Order 9P506GR #22 which is
scheduled for September, 1995. If you have any questions concerning
this work, please contact Brenda Vajdak at our office in Bryan,
telephone 409-821-4770 within 15 days so that we may explain or
modify our proposal, otherwise, it is understood that this proposal
is approved.

COMPANY LINE INSTALLATION
July 28, 1995
TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY COMMISSIONER: Randy Simms
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Bryan, Texas as follows:
Beginning at the intersection of Reliance Road and
Old Reliance Road, we propose to bore under Reliance
Road to place a buried line along, parallel to and
5' inside of the north right-of-way of Old Reliance
Road a distance of 1404' in a southeasterly direction.
The location and description of this line and associated
appurtenances is more fully shown by two copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and'void.
Construction of this line will begin in September, 1995.

i. PRESENTATION:
A) No work will be permitted between from slope and/or bads slope.
B) The line shall be Installed within 3-5 of and parallel to the dghtof-way
line.
C) H clearing of brush, trees and other obstruction Is necessary, it shall be
the Applicants responsibility to do so and to remove all cleared brush, trees
etc. from County dghtof-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test
Method No. D-698; test shall be conducted by an Independent Geotechnical
testing Iirn; copies of all test results shall be furnished to the office of the
Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Tmfflc Control Dovicos for Stroots and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

The location or description of the proposed Installation Is more fully shown by

1 understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction In order that they might be on hand to designate the actual
location of the Installation.
2. That all damage to the roadways and right-of-ways will be repaired to
their original condition to the satisfaction of the County Engineer.

3. That Brazos County reserves the right to require Applicant to relocate
i or lower any such line at no cost to Brazos County, should some become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.
4. That Brazos County Is in no way responsible for any damage that might

5. That the line will be constructed and maintained on the County right-of-
way In accordance with governing laws.
