BRAZOS COUNTY COMMISSIONERS COURT MEETING
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON MONDAY,
JULY 24, 1995 AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

3. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Cburt on county-related issues not scheduled on the agenda. Please
limit subject matters to five minutes. The Commissioners will receive the information,
conduct research into the matter, and/or place the matter on a future agenda for
discussion. (A recording is made of the meeting; therefore, please give your name and
address for the record.)

JULY 24, 1995
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, July 24, 1995, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;

two employees and a decrease of three budgeted positions to
fund the increase. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered the modification of Brazos
County Animal Control Laws and Resolutions regarding pet
licensing to include microchipping as a licensing option.
This is done at no cost to the taxpayers of the three
participating entities. An installation fee of $10.00 is paid
by the pet owner. On motion by the County Judge, seconded by
Commissioner Norton, the Court voted unanimously to modify the
Brazos County Animal Control Laws to include microchipping.
A copy of the amendment is attached.
The Court next considered an order appointing Claude
Davis to sit as Special Judge in County Court at Law No. 2
July 31, 1995 through August 4, 1995 and August 9, 1995
through August 10, 1995 to allow Judge Ryan to leave the
county. On motion by Commissioner Walker, seconded by
Commissioner Norton, the Court voted unanimously to approve
the Order naming Claude Davis as Special Judge for County
Court at Law No. 2 July 31, 1995 through August 4, 1995 and
August 9, 1995 through August 10, 1995. A full copy of the
Order is attached to and made a part of these minutes.
The Court next considered approval of the certification
of the county maintained road mileage as submitted by the
County Engineer. Richard Vance, County Engineer informed they
Court the County maintained 461 miles of roads. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court'

the County Engineer and to forward a copy to the State Depart-
ment of Highways and Public Transportation.
On motion by Commissioner Norton, seconded by Commis-
sioner Walker, the Court voted unanimously to adopt the
following fees for services in Brazos County effective January
1, 1996, and to remain in effect until further orders of the
Court.
These fees will be for the District Courts, County Courts,
Justice of the Peace Courts and Small Claims Courts.

Department. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
On motion by the County Judge, seconded by Commissioner
Cauley, the Court voted unanimously to adopt a resolution in
support of the development of the El Camino East/West Corridor
between Brunswick, Georgia and E1 Paso, Texas.
The Court next considered approval of a contract for
Residential Services between RECOR and Brazos County Juvenile
Services Department. This is for residential treatment, basic
care, 24-hour supervision, individual and group counseling at
a rate of $83.00 per juvenile per day. The contract'period
will be from July 17, 1995 through December 31, 1996. On
motion by Commissioner Sims, seconded by Commissioner Norton,
the Court voted unanimously to enter into contract for
residential services with RECOR. A copy of the contract is
attached hereto.
The Court acknowledged receipt of the Extension Service
reports for June 1995 and acknowledged receipt of reports from
County and Precinct offices showing revenues collected and
remitted to the County Treasurer. An excerpt from those
reports is attached hereto.
Marc Hamlin, District Clerk asked what the effective date
would be for the fees of office. The members of the Court
informed him it would be January 1, 1996. Commissioner Sims
announced a public hearing would be held at 10:00 a.m. to
consider the posting of a speed limit on Deer Run Drive, in
Deerfield Subdivision in Precinct 3. The County Judge
announced that budget hearings would be held July 24, 1995
through July 28, 1995.
There being no further business to come before the Court,
the meeting was adjourned.

I. DEFINITIONS
A. "ABANDONMENT": TO DESERT OR LEAVE WITHOUT CARE.
B. "ANIMAL CONTROL AUTHORITY": THE PERSON OR PERSONS
DESIGNATED BY THE COUNTY JUDGE TO ENFORCE THIS ARTICLE
C. "ANIMAL SHELTER": FACILITY DESIGNATED OR RECOGNIZED BY
BRAZOS COUNTY FOR THE PURPOSE OF IMPOUNDING AND
CARING FOR DOGS, CATS, LIVESTOCK, AND MISCELLANEOUS
DOMESTIC ANIMALS.
D. "CAT': FELIS CATUS
E. "DOG": CANIS FAMILIARIS
F. "HUMANE MANNER": CARE OF A DOG OR CAT TO INCLUDE, BUT
NOT BE LIMITED TO: VENTILATION AND SANITARY SHELTER,
WHOLESOME FOOD AND WATER, CONSISTENT WITH THE NORMAL
REQUIREMENTS AND FEEDING HABITS OF THE ANIMALS SIZE,
SPECIES, AND BREED,
G. "LICENSING AUTHORITY": ANY DESIGNATED REPRESENTATIVE
CHARGED WITH ADMINISTERING THE ISSUANCE AND/OR
REVOCATION OF PERMITS AND LICENSES UNDER PROVISIONS

H. "NUISANCE":, A DOG OR CAT SHALL BE CONSIDERED A
NUISANCE IF IT: DAMAGES, SOILS, DEFILES OR DEFECATES ON
PRIVATE PROPERTY OTHER THAN THE OWNER'S OR ON PUBLIC
WALKS AND RECREATIONS AREAS, UNLESS SUCH WASTE IS
s IMMEDIATELY REMOVED AND PROPERLY DISPOSED OF BY THE
OWNER; CAUSES UNSANITARY, DANGEROUS, OR OFFENSIVE
CONDITIONS; CAUSES A DISTURBANCE BY EXCESSIVE
i BARKING OR OTHER NOISEMAKING; OR CHASES'VEHICLES, OR
MOLESTS, ATTACKS, OR INTERFERES WITH PERSONS OR OTHER
DOMESTIC ANIMALS ON PUBLIC OR PRIVATE PROPERTY OTHER

1. "OWNER": A PERSON HAVING THE RIGHT OF PROPERTY OR
CUSTODY OF A DOG OR CAT WHO KEEPS OR HARBORS A DOG

L. "COMMERCIAL BOARDING KENNEL": FACILITIES THAT BOARD
DOMESTIC PETS FOR SET FEES, YEAR ROUND.
II. RABIES VACCINATION AND LICENSING - REQUIRED
A. NO PERSON SHALL OWN. KEEP, OR HARBOR ANY DOG OR CAT
OVER 4 MONTHS OR AGE WITHIN BRAZOS COUNTY UNLESS SUCH
DOG OR CAT IS VACCINATED AND LICENSED. THE PROVISIONS
OF THIS SECTION DO NOT APPLY TO ANIMALS OWNED BY A
LICENSED RESEARCH FACILITY OR HELD IN A VETERINARY
MEDICAL FACILITY OR GOVERNMENT OPERATED ANIMAL
SHELTER, OR COMMERCIAL BOARDING KENNEL.
B. ALL DOGS AND CATS SHALL BE VACCINATED AGAINST RABIES
BY A LICENSED VETERINARIAN IN ACCORDANCE WITH TEXAS
STATE RABIES LAW.
C. A CERTIFICATE OF VACCINATION/LICENSE SHALL BE ISSUED TO
THE OWNER OF EACH DOG OR CAT VACCINATED. EACH OWNER
SHALL ALSO RECEIVE A DURABLE VACCINATION/LICENSE TAG
INDICATING THE YEAR IN WHICH IT WAS ISSUED.
D. THE LICENSING AUTHORITY SHALL DESIGNATE, WHEN
PRACTICABLE. LICENSED VETERINARIANS TO COLLECT THE
ANNUAL LICENSING REGISTRATION FEE. A LICENSED
VETERINARIAN WHO HAS BEEN SO DESIGNATED SHALL
REGISTER DOGS AND CATS AND COLLECT THE ANNUAL
LICENSING REGISTRATION FEE UNDER THE FOLLOWING TERMS
AND CONDITIONS:
(a) IF A LICENSED VETERINARIAN VACCINATES A DOG OR CAT
FOR RABIES, HE SHALL COLLECT THE ANNUAL LICENSING/
REGISTRATION FEE, ISSUE A RABIES VACCINATION/LICENSE
TAG, AND SEND TO THE LICENSING AUTHORITY A COPY OF
A FORM WHICH SHALL INCLUDE THE FOLLOWING

(b) A LICENSED VETERINARIAN WHO HAS BEEN DESIGNATED

AUTHORITY SHALL ESTABLISH A COLLECTION PROCEDURE
FOR THE FEES, A FORMAT FOR THE TAGS, AND SHALL
RECORD ALL DOGS AND CATS REGISTERED, THE NAME OF
THE OWNER, AND OTHER APPROPRIATE INFORMATION.
TAGS FURNISHED BY THE LICENSING AUTHORITY SHALL BE OF
DURABLE MATERIALS. A TAG ISSUED FOR A DOG OR A CAT
MUST BE ATTACHED TO THE COLLAR OF THE ANIMAL AND MUST
BE WORN AT ALL TIMES. TAGS ARE NOT TRANSFERABLE. A
RECORD OF ALL TAGS ISSUED SHALL BE MAINTAINED BY THE
LICENSING AUTHORITY; AND SUCH RECORDS SHALL BE
AVAILABLE TO THE ANIMAL CONTROL AUTHORITY. RECORDS ARE
TO BE KEPT FOR FIVE YEARS.
EXCEPT AS OTHERWISE PROVIDED, THE LICENSING PERIOD
SHALL BE FOR ONE YEAR. EACH APPLICANT SHALL PAY THE
APPROPRIATE FEE ANNUALLY AND SHALL SUPPLY ALL
INFORMATION REASONABLY REQUESTED ON FORMS SUPPLIED
BY THE LICENSING AUTHORITY.
UPON RECEIPT OF THE APPROPRIATE FORMS AND PAYMENT OF
THE SCHEDULED FEE, THE LICENSING AUTHORITY SHALL
PROVIDE A TAG FOR DOGS AND CATS VACCINATED BY A
VETERINARIAN OTHER THAN THE ONE WHO WAS DESIGNATED
TO REGISTER DOGS AND CATS; IN WHICH CASE, THE TAG WILL
BE VALID UNTIL THE RABIES VACCINATION IS DUE AGAIN BY LAW.
LICENSE FEES SHALL BE WAIVED FOR DOGS SERVING THE
BLIND OR DEAR OR GOVERNMENT OWNED DOGS USED FOR LAW
ENFORCEMENT. ALL OTHER LICENSING PROVISIONS APPLY.

III. OWNER RESPONSIBILITY
A. NO DOG OR CAT SHALL BE ALLOWED TO CAUSE A NUISANCE.
THE OWNER OF EVERY DOG OR CAT SHALL BE HELD
RESPONSIBLE FOR EVERY BEHAVIOR OF SUCH DOG OR CAT
UNDER THE PROVISIONS OF THIS ARTICLE.
IV IMPOUNDMENT
A. ANY DOG OR CAT FOUND TO BE A STRAY OR A NUISANCE MAY
BE IMPOUNDED BY ANY CITIZEN IN THE BRAZOS ANIMAL
SHELTER, AND CONFINED IN A HUMANE MANNER. IMMEDIATELY
UPON IMPOUNDMENT OF THE DOG OR CAT, THE SHELTER SHALL
MAKE EVERY REASONABLE EFFORT TO NOTIFY THE OWNER AND
INFORM SUCH OWNER OF THE CONDITIONS WHEREBY CUSTODY

OF THE ANIMAL MAY BE REGAINED. DOGS AND CATS NOT
CLAIMED BY THEIR OWNERS WITHIN A PERIOD OF THREE

COME THE PROPERTY OF THE ANIMAL SHELTER. THE

V. REDEMPTION

A. ANY DOG OR CAT IMPOUNDED MAY BE REDEEMED BY THE
OWNER THEREOF WITHIN THREE (3) DAYS UPON PAYMENT OF
THE IMPOUNDMENT FEE.
B. ANY DOG OR CAT CONFINED FOR RABIES OBSERVATION,
COURT EVIDENCE, OR OTHER PURPOSE MAY BE REDEEMED BY
THE OWNER THEREOF; WITHIN THREE (3) DAYS UPON PAYMENT
OF THE IMPOUNDMENT FEE.

C. NO DOG OR CAT REQUIRED TO BE LICENSED OR VACCINATED
UNDER THIS ARTICLE MAY BE REDEEMED UNTIL THE PROVISIONS
FOR SUCH LICENSING AND VACCINATION HAVE BEEN FULFILLED.
VI. ABANDONMENT
A. IT SHALL BE UNLAWFUL TO ABANDON, DESERT OR DUMP ANY
DOG OR CAT IN BRAZOS COUNTY.
VII. FEES
A. ANY AND ALL FEES REQUIRED BY THIS ARTICLE SHALL BE SET BY
RESOLUTION OF THE COUNTY COMMISSIONERS COURT.
VIII. RABIES CONTROL
A. THIS ORDINANCE ADOPTS THE RABIES CONTROL ACT OF 1981,
ARTICLE 4477-6a.VACTS IN PARTS THAT DO NOT CONFLICE WITH
THE PROVISIONS OF THIS ARTICLE.
IX. ANIMAL SHELTER
A. THIS ORDINANCE ADOPTS THE ANIMAL SHELTER ACT, ARTICLE
4477-6b.VACTS, IN PARTS THAT DO NOT CONFLICT WITH THE
PROVISIONS OF THIS ARTICLE.
X. PENALTY

On this the 2 4 t h day of July _ 1995, the Commissioners Court of Brazos County,
Texas, convened in Regular Session at the Special Tenn of the Court, at the Brazos County Courthouse,
in the City of Bryan, Texas, with the following members present, to-wit:

WHEREAS, the Honorable Sarah Ryan, Judge of the County Court at Law No. 2 of Brazos
County, Texas, having made known to the Commissioners Court of Brazos County, Texas, that on July
31, 1995 through August 4, 1995, and August 9, 1995 through August 10, 1995, she will be out of the
county, and
WHEREAS, she has requested the appointment of the Hon. Claude Davis to sit as Special Judge
of the County Court at Law No. 2 of Brazos County, Texas on July 31, 1995, through August 4, 1995,
and August 9, 1995, through August 10, 1995, in all matters that are, or may be, docketed on the Court's
dockets for those days, and to have and exercise all powers of a Special Judge in relation to matters
involved, it is therefore:
ORDERED, ADJUDGED AND DECREED, pursuant to the authority of Article 30.03, Section
2, Code of Criminal Procedure, that the Hon. Claude Davis, sit and hear all matters that are, or may be,

THE COMMISSIONERS COURT OF BRAZOS COUNTY, TEXAS supports the
development of the El Camino East/West Corridor between Brunswick, Georgia and El Paso,
Texas.
The creation of a four-lane highway connecting the east coast directly to the heart of Texas
would be a major advancement for transportation, industry and tourism. The economic impact
of such a venture for the State of Texas and the community of Bryan-College Station will be
limitless. A four-lane highway in this east-west corridor will also serve to improve the ease and
safety of travel through these southern coastal states. With the continued growth of Texas A&M
University and the development of the George Bush Presidential Library and Museum, access to
Brazos County and the Bryan-College Station community is more critical than ever before.
Therefore, the Commissioners Court of Brazos County are pleased to endorse the development
of the El Camino East/West Corridor.

CONTRACT FOR RESIDENTIAL SERVICES
The Brazos County Juvenile services Department, hereinafter called
Brazos County, and RECOR - Kerrville Juvenile Detention Facility,
hereinafter the Service Agency, by this agreement and in
consideration of the mutual promises set forth below agree that:
1. PROVISIONS OF SERVICE
The Service Agency agrees to provide the following services,
which shall be limited to alleged or adjudicated juvenile
offenders in licensed juvenile care facilities while
juvenile is on Conditional Release, Informal Adjustment or
Court Probation through Brazos County:
Residential treatment, basic care, 24-hour supervision,
individual and group counseling: as per the Texas Health
&
Human Services Coordinating Council Rate Schedule and
Definitions for Level of Care for Level IV (Children and
adolescents at this level of care have physical, mental, and
emotional needs and behaviors that may present a low to
moderate risk of causing harm to themselves or others. They
require physical environments and treatment programs in
which most activities are therapeutically designed to
improve social, emotional and educational adaptive behavior.
These children may require psychological or psychiatric
services which are integrated into the residential program
to assess and monitor admission, discharge, and treatment
plans.)
A. For and in consideration of the above-mentioned services,
Brazos County agrees to pay the Service Agency an amount
not to exceed Level IV $83.00 per juvenile per day. This
fee does not exceed the actual cost of child care in the
Service Agency, and does not exceed the amount allowed in
the Texas Health Human Services Coordinating Council's
Definitions of Levels of Care. The Service Agency will
not change the Level of Care of a particular juvenile
without written acknowledgement of Brazos County.

B. Recognizing that part of a juvenile's rehabilitation
program may include time away from the residential
setting of the Service Agency such as weekends, holidays,
etc., and that the Service Agency must retain space for
this juvenile until his return, Brazos County will pay
the Service Agency the above agreed upon amount for such
regularly scheduled days away from the Service Agency or
its program providing they do not exceed ten (10) days at
any one time.
C. If a juvenile makes an unauthorized departure from the
Service Agency, Brazos County shall be notified
immediately. If the juvenile returns to the Service
Agency within ten (10) days or prior to the last billing
day of the month, whichever shall occur first, the
Service Agency shall receive payment for those days the
juvenile was absent from the Service Agency, but not to
exceed ten (10) days' payment.
D. The Service Agency is under no obligation to retain space
for the juvenile in unauthorized departure situations;
however, every effort should be made to reconcile the
incident to both parties' satisfaction.
E. Payment is to be made monthly. Claim for payment will be
submitted no later than ten (10) days from the last day
of the month for which payment is being requested.
P. Each billing should contain the name of the juvenile(s)
for whom payment is being requested along with the number
of days (stated consecutively) for which payment is
requested. Billing should begin no earlier than the
Court ordered day of disposition into the program' to the
end of the month and first day of the month through the
last day of the month thereafter.

INDIVIDUAL PROGRAM AND FAMILY INVOLVEMENT
A. Each juvenile placed with the Service Agency shall have
a written Individualized Program Plan (IPP) developed in
concert with the juvenile and mutually agreed upon by the
appropriate Service Agency staff and assigned probation
officer. A copy of the IPP shall be sent to the
probation officer no later than six weeks after
placement.
B. The goals in the IPP shall be reviewed jointly by the
appropriate Service Agency staff, the juvenile, and the

assigned probation officer at reasonable intervals, not
{
to exceed ninety (90) days, to assess the juvenile's
progress with modification of the IPP being made when
needed. A copy of the revised IPP shall be given to the
assigned probation officer.
C. The IPP shall contain the reasons why the placement will
f benefit the juvenile; shall specify behavioral goals and
! objectives being sought for each juvenile; shall state
• - how the goals and objectives are to be achieved in the
Service Agency placement; and shall state how, if at all,
t
the parent(s), guardian(s), and where possible,
grandparents or other extended family members will be
t involved in -the Individual Program Plan to assist in
preventing or controlling the juvenile's alleged
delinquent behavior or alleged conduct indicating a need
for supervision as defined in the Texas Family Code.
D. The Service Agency shall remain in telephone contact with
assigned probation officer regarding juveniles progress
and provide a written report of progress upon request.

E. If a juvenile in placement at the Service Agency makes an
unauthorized departure, becomes seriously ill, or is
involved in a disruptive incident, the Service Agency
shall notify the juvenile's probation officer or other
probation staff within a twenty four hour period
following the incident and ensure that parents, proper
authorities, the Texas bepartment of Human Services, or
the police are notified if appropriate. A written
incident report and/or police report shall be sent to the
assigned probation officer no later than five (5) working
days after the occurrence.
F. Brazos County reserves the right to terminate the
juvenile's placement at the Service Agency at its
discretion. The Service Agency must not release the
juvenile to any person other than Brazos County without
the express consent of Brazos County.
G. Brazos County must approve the juvenile's participation
in any furloughs, home visits, or extended agency trips.
H. Unless otherwise stipulated by Brazos County, the
juvenile may visit freely with parents and relatives at
the Service Agency in accordance with established Service
Agency policies.
I. Suspected or alleged cases of child abuse must be
immediately reported to the assigned probation officer
and the Texas Department of Human Services.
III. EXAMINATION OF PROGRAM AND RECORDS

A. The Service Agency agrees that it will permit Brazos
County to examine and evaluate its program of services
provided under the terms of this Contract and to review
Brazos County juvenile records. This examination and
evaluation of the program will include unscheduled site
visitations, observation of programs in operation, and

B. The Service Agency agrees to maintain and make available
for inspection, audit or reproduction by an authorized
representative of Brazos County Juvenile Services and the
State of Texas, books, documents, and other evidence
pertaining to the cost and expenses of this Contract,
hereinafter called the Records.
C. The Service Agency agrees to maintain these records for
three (3) years after final payment or until the state-
approved audit has been made and all questions therefrom
are resolved.
FEE ASSESSMENT
A. Juvenile or their families shall not be assessed fees for
services by the service Agency unless arrangements are
specified by the Court. This does not preclude
reasonable attempts to seek voluntary contributions from
families of County juveniles for donations of clothing,
personal articles, and funds to assist in supporting a
juvenile's rehabilitation.
-B. If a juvenile is eligible for fiscal support from another
state agency or organization, the Service Agency shall
ensure that Brazos County is not charged for such fiscal
support for which the juvenile is-otherwise eligible.
DEFAULT
A. Brazos County may, by written notice of default to the
Service Agency, terminate the whole or any part of this
Contract in any of the following circumstance:
1. If the Service Agency fails to perform the work
called for by this Contract within the time
specified herein or any extension thereof; or

2. If the Service Agency fails to perform any of the
other provisions of this Contract, or so fails to
prosecute the work as to endanger performance of
this Contract in accordance with its terms, and in
either of these two circumstances does not cure
such failure within a period of ten (10) days (or
such extension as' authorized by Brazos County in
writing) after receiving notice of default.
VI. TERMINATION
A. This contract may be terminated by either party by giving
ten (10) days written notice to the other party hereto of
the intention to terminate.
B. Termination of the juvenile's residence with or receipt

of services from the Service Agency shall occur only

causes and with sufficient lead time of at least ten (10)

C. The decision of the terminating party shall be final and
conclusive unless within thirty (30) days from the date
of receipt and of a written copy of the decision, the

nonterminating party mails or otherwise furnished to the
terminating party, a written appeal addressed to the
~i Criminal Justice Division or its authorized
representative, shall be final and conclusive, absent a
i showing of fraud, caprice, arbitrariness or gross error
implying bad faith, in some court of competent
jurisdiction.
VII. LAW AND VENUE
In any legal action arising under this Contract, the laws of
Texas shall apply and venue shall be in Brazos County.

VIII. APPLICATION PROCEDURES
The Service Agency shall agree to accept the State of Texas
Common Application for Placement of Children in Residential
Care for admission review on juveniles referred from Brazos
County. Brazos County will provide Service Agency with a
report on recent physical, dental, psychological, and
psychiatric examinations if required by Service Agency and
any social history available to the Court.
XI. CONTRACT PERIOD
The Contract period will begin on the 17th day of July,
1995, and will terminate on the 31st day of December, 1996.
