THE COMMISSIONERS COMM WILL MEET IN REGULAR SESSION ON MONDAY,
JULY 17, 1995 AT 6:30 P.M. IN THE COMMISSIONERS' COURTROOM OF THS
BRAZOS COMM COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

3. Citizens input and/or concerns. At this time, the Judge will
open the floor to citizens wishing to address the Court on
county-related issues not scheduled on the agenda. Please
limit subject matters to five minutes. The Commissioners will
receive the information, conduct research into the matter,
and/or place the matter on a future agenda for discussion. (A
recording is made of the meeting; therefore, please give your
name and address for the record.)
4. Presentation by Hart Information Services relative to proposal
for election services for the 1995 General Election to be held ,
November 6, 1995.

JULY 17, 1995
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 6:30
p.m. on Monday, July 17, 1995, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Walker gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The first matter before the Court was a presentation by
Gary Gandy and Don Blakely, representatives of Hart
Information Services, relative to a proposal for the election
services of the 1995 General Election to be held November 5,
1995. The County Judge thanked the men for the information
and said the Court would take it into consideration.

The Court proceeded to consider the change of status of
the following employees.

The County Judge voiced concern over the promotion of a jailer
to a deputy at this time when the County is beginning the
budget process for fiscal year 1996. Commissioner Sims moved
to approve the changes as submitted. Commissioner Norton
seconded the motion. Commissioners Norton, Walker, Sims and
Cauley voted "Aye". The County Judge abstained.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Walker, seconded by
Commissioner Norton, the Court voted unanimously to approve
the Claims as submitted.
On motion by the County Judge, seconded by Commissioner
r Sims, the Court voted unanimously to table consideration of

establishing fees,to be charged by the office of Sheriff and
Constables.
The next matter for consideration was authorization to
increase pet licensing fees from $7.00 to $10.00. The Court
received a letter from Kathy Bice, Executive Director of the
Animal Shelter, stating a need for the increase. Commissioner
Sims asked if microchiping would be included in today's
action. The County Judge indicated it would be considered at
the next meeting. on motion by Commissioner Cauley, seconded
by Commissioner Walker, the Court voted unanimously to
increase the pet license fee from $7.00 to $10.00 effective
October 1, 1995.
The next matter before the Court was approval of an
Interlocal Agreement between Brazos County and the Houston-
Galveston Area Council '(H-GAC) for the purchase of goods and

services for Brazos County. Term of the contract will be from
October 1994 through September 30, 1995. The cost to the
County will be based on a fee charged on the purchase total.
On motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to enter into an Inter-
local Agreement with the Houston-Galveston Area Council (H-
GAC) for the purchase of goods and services for Brazos County.
A copy of the contractual agreement is attached hereto.
The Court next considered Purchase order #2800-ct04 for
the purchase of vehicular equipment for the Sheriff's Depart-
ment License and Weight Unit. Cost of the 1995 Ford half-ton
pickup is $13,338.31, a new camper shell $542.60 and HGAC fees
of $277.62 for a total of $14,158.53. On motion by Commis-
sioner Sims, seconded by Commissioner Norton, the Court voted
unanimously to approve Purchase Order #2800-ct04 for the pur-
chase of a half toll pickup truck for the Sheriff's Department
at a cost of $13,338.10, camper shell for $542.60 and HGAC
Purchasing fee of $277.62.
The next matter for consideration was a request from the
Sheriff's Department to purchase overhead lights, radio and
radar unit for the license and weight vehicle for a total cost
of $2,945.00. Some members of the Court questioned the need
for radar. Commissioner Sims moved to approve the request to
purchase overhead lights at a cost of $450.00 and radio at a
cost of $1,200.00 and deny the purchase of the radar unit.
Commissioners Norton, Sims and Walker voted "Aye". Commis-
sioner Cauley voted "No".
The Court next considered Budget Amendment X194/95-23,
which would reallocate funds budgeted for the Treasurer's
office and County Court at Law I and to set up a budget for
vehicles. On motion by Commissioner Norton, seconded by
Commissioner Walker, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The next matter before the Court was a request from the

Road and Bridge department for reviewing and payment proces-
sing of the City of Bryan's total cost of 68,720.75 for the
Macey Road distribution line relocation project in Precinct 2.
On motion by commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the payment
of 68,720.75 to the City of Bryan for the Macey Road distri-
bution line relocation project in Precinct 2.
The Court next considered a request from the Road and
Bridge Department for acceptance of the City of Bryan's fee of

61,673.56 to provide a 200 amp-three phase service to the
compactor site on Kathy Flemming Road in Precinct 1. Commis-
sioner Norton explained that this will enable the County to
operate the compactor. On motion by Commissioner Norton, se-
conded by Commissioner Cauley, the Court voted unanimously to
accept the City of Bryan's fee of 61,673.56 to provide a 200
amp-three phase service to the compactor site in Precinct 1.
The Court next considered the request from GTE to place
a parallel installation (buried cable) in the right-of-way of

Hearne Road beginning approximately 0.6 mile southeast of its

intersection with Democrat Road and extending for a distance

of 1,356 feet. The site is located in Precinct 3. On motion
by Commissioner Sims, seconded by Commissioner Cauley, the

Court voted unanimously to approve the request of GTE and

authorized the installation.
The Court next considered the request from GTE to place

a road bore for buried cable in the right-of-way of Grassbur
Road at its intersection with Shady Lane for a parallel
installation in the right-of-way of Shady Lane extending for
a distance of 504 feet. The site is located in Precinct 3.
The County Engineer stated that all appeared to be in order
and recommended approval. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously

to approve the request from GTE and authorized the instal-
lation. A copy of the request is attached hereto.-

r county rights-of-ways for the health, safety and welfare of
the general public. The Road and Bridge Department requested

permission to enter the private property of Ed Drath on Meadow
Lark Circle in Precinct 2 to remove fourteen (14) bales of hay

to be used for erosion control on county rights-of-way. On
motion by Commissioner Walker, seconded by Commissioner
i
t Cauley, the Court-voted unanimously to authorize the work.
The next matter for consideration by the Court was the
r
granting of a right-of-way easement to the City of Bryan as
easement for the placement of power poles at the Kathy Fleming
Road Citizen's Collection Site in Precinct 1. On motion by
k Commissioner Norton, seconded by Commissioner Walker, the
Court voted unanimously to authorize the County Judge to
i execute the easement grant to the City of Bryan.
The Court next considered approval of the Resubdivision
of Lots 17-1, 17-2, 17-3, 17-4, Block 7, (28.10 acres),
Rainbow Acres, 2nd Installment. Richard Vance, County
Engineer, indicated that Lot 17-1R was platted with 50 feet of
road frontage instead of the required 70 feet. This is all
the road frontage available outside the flood plain. No
building may be constructed in this narrow part of the 7.75
acre lot because of existing easements. He said that a
variance would have to be granted. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court unanimously
approved the resubdivision of Lots 17-1, 17-20, 17-3, 17-4,
Block 7, 28.10 acres, Rainbow Acres, 2nd Installment with the

THIS INTERLOCAL CONTRACT ("Agreement"), made and entered into pursuant to the Texas Intergovernmental Cooperation
Act (Government Code, Title 7, Chapters 741 d: 7911 by and between the Houston-Galveston Area Council, hereinafter referred
to as "H-GAC," having its principal place of business at 3555 Timmons Lane, Suite 500, Houston, Texas 77027, and
BRAZOS COUNTY hereinafter referred to as the "local
government having its principal place of business at 300 E-Mth 5t.~ite 314 Bryan, TX 77803
WITNESSETH

WHEREAS, H-GAC is a regional planning commission created under Acts of the 59th Legislature, Regular Session, 1%5,
! recodified as Texas Local Government Code, Chapter 391; and
WHEREAS, H-GAC has entered into this contract with the local government on the 17th day of June
19__25 ;and
4 WHEREAS, the local government registers its desire to purchase certain governmental administrative functions, goods, or
services; and
WHEREAS, H-GAC hereby agrees to perform the scope of services outlined in ARTICLE 5, as hereinafter specified in
:z accordance with this contract/agreement; and
NOW, THEREFORE, H-GAC and the local government do hereby agrek as follows:

ARTICLE 1: LEGAL AUTHORITY
The local government warrants and assures H•GAC that it possesses adequate legal authority to enter into this contract. The local
government's governing body has authorized its signatory official(s) to enter into this contract acid to bind the local government
to the terms of this contract and any subsequent amendments hereto.
ARTICLE 2: APPLICABLE LAWS
H-GAC and the local government agree to conduct all activities under this contract in accordance with all applicable rules,
regulations, ordinances and laws in effect or promulgated during the term of this contract
ARTICLE 3: WHOLE AGREEMENT
The Interlocal Contract and any attachments, as provided herein, constitute the complete contract between the parties hereto. and
supersede any and all oral and written agreements between the parties relating to matters herein. Except as otherwise provided
herein, this contract cannot be modified without written consent of the parties.
ARTICLE, 4: PERFORMANCE PERIOD
The period of this contract shall be for the balance of the fiscal year of the local government which began October 1 ,
19(14_ and ends SQntember 31 , 19_U_. This contract shall thereafter automatically be renewed annually for each
succeeding fiscal year, provided that such renewal shall not have the effect of extending the period in which the local government
may make any payment due H-GAC beyond the fiscal year in which such obligation was incurred under this contract.
H-GAC or the local government may cancel this contract at any time upon 30 days written notice to the other party to this
contract. The obligations of the local government, including its obligation to pay H-GAC for all costs incurred under this contract
prior to such notice shall survive such cancellation, as well as any other obligation incurred under this contract, until performed
or discharged by the local government.
RTICLE S: SCOPE OF SERVICES
The local government appoints H-GAC its true and lawful purchasing agent for the purchase of certain products and services
through the H-GAC Cooperative Purchasing Program, as enumerated through submission of any duly executed purchase order,
order form or resolution. All products purchased hereunder shall be in accordance with specifications established by H-GAC.
All products and services shall be procured by H-GAC in accordance with procedures governing competitive bids and competitive
proposals, and at prices and administrative fees listed in current Contractor/Vendor Price Lists and H-GAC Forms.

ARTICLE Si, SCOPE OF SERVICES (continued)
Ownership (title) of products purchased shall transfer directly from the contractor/vendor to the local government. The local
government agrees to provide H-GAC with documentation of receipt and acceptance of products and services within five (5) days
of acceptance of same.
RTICLE 6:
In accordance with the tams of this contract, the local government agrees that, upon presentation by H-GAC of a properly
documented, verified proof of performance and a statement of costs H-GAC has incurred, it shall upon delivery and acceptance
of products and services, promptly pay H-GAC, from current revenues available to the local government during the current fiscal
year.
RTICLE_7: CHANGESJUVD A11iENDMENTS
Any alternations, additions, or deletions to the terms of this contract which are required by changes in Federal and State law or
regulations are automatically incorporated into this contract without written amendment hereto, and shall become effective on
the date designated by such law or regulation.
H-GAC reserves the right to make changes in the scope of services and products offered through the H-GAC Cooperative
Purchasing Program to be performed hereunder.
ARTICLE 9: TERMINATION PROCEDURES
Either H-GAC or the local government may cancel or terminate this contract upon thirty (30) days written notice by certified
mail to the other party. In the event of such termination prior to completion of any purchase provided for herein, the local
government agrees to pay for services on a prorated basis for materials and services actually provided and invoiced in accordance
with the terms of this contract, including penalties, less payment of any compensation previously paid.
ARTICLE 9: SEVERABILITY
All parties agree that should any provision of this contract be determined to be invalid or unenforceable, such determination shall
not effect any other term of this contract, which shall continue in full force and effect.
RTICLE 10: FORCE MAJEURE
To the extent that either party to this contract shall be wholly or partially prevented from the performance within the tam
specified of any obligation or duty placed on such party by reason of or through strikes, stoppage of labor, riot, fire. flood, acts
of war, insurrection, accident, judgment, act of God, or specific cause reasonably beyond the party's control and not attributable
to its neglect or nonfeasance, in such event, the time for the performance of such obligation or duty shall be suspended until such
disability to perform is removed. Determination of force majeure shall rest solely with H-GAC.
ARTICLE 11: VENUE
Venue and jurisdiction of any suit, or cause of action arising under, or in connexion with, this contract shall lie exclusively in
Harris County, Texas.

On this the 17th day of July 1995 at a special meeting of the
Commissioners' Court, the following members were present:

reasonably included in- the original badget adopted September 8,
1994 the following amendment(s) to the original are hereby

SOURCE OF FUNDS: N/A
1. PRESENTATION:
A) No work will be permitted between from slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees
etc. from County right-of-way.
D) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

ATTENTION COUNTY JUDGE: AL JONES
Formal notice is hereby given that GTE SOUTHWEST INCORPORATED will construct a communication line
within the right-of-way of a County Road in Brazos County,
Texas as follows:
On Hearne Lane approximately 6/10 of a mile southeast of Democrat Road
a buried cable will be placed in the east right-of-way extending southeast
for a distnace of 1356'.
The location and description of this line and associated appurtenances is more fully shown
by four copies of drawings attached to this notice. The line will be constructed and maintained
on the County Road right-of-way in accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice
by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may
be granted in the future and any provision or provisions so construed shall be null and void. ~i

1. PRESENTATION:
A) No work will be permitted between from slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees
etc: from County right-of-way.
D) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, pub!ished by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.
