THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON MONDAY,
JULY 10, 1995 AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF THE

JULY 10, 1995
A regular meeting of the Commissioners'.Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, July 10, 1995, with the following members of
the Court present:

The Sheriff was asked to fill in a portion of Billy Pharris'
Personnel Change of Status form that had been left blank and
if Jones and Guerrero were filling open positions. On motion
by the County Judge, seconded by Commissioner Norton, the
Court voted unanimously to approve the changes with the
exception of those for Juvenile Services, which will be
considered when Mr. Wentrcek returns.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
95-01768 through 95-02065
On motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
The next matter for consideration by the Court was the
'
proposals for compliance review and training with the Fair
Labor Standards Act. The Court received two (2) proposals.
One from the Federal Wage and Labor Law Institute and the
other from Strategic Human Resource Management. Commissioner
Sims questioned the proposal submitted by Strategic Human
Resource Management. He asked who Mr. Eason actually worked

for since his named appeared on the letterhead of both
companies. The County Judge asked for an explanation of
expenses. On motion by Commissioner Norton, seconded by
Commissioner Walker, the Court voted unanimously to accept the

proposal submitted by Strategic Human Resource pending
clarification of the two items questioned.

On motion by Commissioner Norton, seconded by

Commissioner Walker, the Court voted unanimously to set
Monday, July 24, 1995 at 10:00 a.m. as the date and time for
a Public Hearing to establish speed limits on Barron Road and
Deer Run Drive/Deerfield Subdivision in Precinct 1.

motion by Commissioner Norton, seconded by Commissioner
Walker, the Court voted unanimously to authorize the County
Judge to execute on behalf of Brazos County the Special
Warranty Deed to Mid State Trust II.
. On motion by Commissioner Walker, seconded by
Commissioner Norton, the Court voted unanimously to authorize
the County Judge to execute a Tax Resale Deed to the following
individuals:

The next matter before the Court was the establishment of
the fees to be charged by the office of Sheriff and
Constables. On motion by the County Judge, seconded by
Commissioner Walker, the Court voted unanimously to table
consideration until more information is obtained. The Court
asked that the Sheriff, Constables and the District and County
Clerks meet to determine what fees need to be charged for
services.
The Court next considered approval of the "Policies for
the Use and Security of the Brazos County Computer Systems."
On motion by Commissioner Walker, seconded by the County
Judge, the Court voted unanimously to approve the policies and
instructed the Personnel Department to forward a copy to each
employee for his/her signature and then returned to the
Personnel department so it can be added to the personnel
files. The Personnel Department will also include the
policies in the personnel handbook.
On motion by Commissioner Norton, seconded by
Commissioner Walker, the Court voted unanimously to set the
bond for the County Engineer at $10,000.00 and that such bond
be made payable to the County Judge.

Services Only Agreement between Brazos County and Northwestern
National Life Insurance Company for the Integrity Plus
program, a service to identify possible fraud within health
insurance claims. Northwestern National Life Insurance
Company will investigate claims to determine if fraud is being
committed by an employee or a doctor. This will be done at no
cost to the County. On motion by Commissioner Norton,
seconded by the County Judge, the Court voted unanimously to
adopt the Addendum to Administrative Services Only Agreement
between Brazos County and Northwestern National Life Insurance
Company.
The Court next considered setting optional fees to be
collected with vehicle registration. Commissioner Norton
explained why the fees were being collected. On motion by the
County Judge, seconded by Commissioner Walker, the Court voted
unanimously to collect $10.00 for Road and Bridge and $1.50
fo'r school crossing guards.
On motion by Commissioner Cauley, seconded by
Commissioner Walker, the Court voted unanimously to appoint
Bryan City Council member, Dan Galvin; to the Brazos Valley
Development Council Executive Board for a term expiring in
1997.
The next matter before the Court was consideration of
State Purchase Order No. 154260 for seven (7) police pursuit
vehicles for the Sheriff's Office. These vehicles were
ordered in January but will not be delivered until late
September or early October. Currently there are vehicles
available through Orange Ford. The county could cancel the
order through GM and use the encumbered funds ($114,412.97) to
purchase the available vehicles. On motion by.Commissioner
Norton, seconded by Commissioner Walker, the Court voted
unanimously to notify GM of the cancellation and use the
encumbered funds to purchase seven (7) vehicles from Orange

handled in the previous action.
The Court. next considered the purchase of consulting
services for the evaluation of Group Health and Life
Insurance, RFP $95-023. Commissioner Norton explained to the
Court that Mr. Don Grey had previously done consulting for
Brazos County. On motion by the County Judge, seconded by
Commissioner Norton, the Court voted unanimously to retain the
consulting services of Don Gray for $125.00 per hour plus
expenses. Mr. Gray will begin reviewing the RFP's after
August 4, 1995. Because of this late date, Ruth McLeod voiced
concern about the extension of the current policy should the
County change providers.
The Court next considered options for the purchase of a
utility vehicle for the Sheriff's Office License and Weight
unit. The Court discussed various types of utility vehicles
like the Jeep and 'the Ford Explorer and the option to purchase
through the Houston-Galveston Area Council of Governments. On
motion by Commissioner Norton, seconded by Commissioner
Walker, the Court voted unanimously to purchase a utility
vehicle through the Houston-Galveston Area Council of
Governments.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and Community
Corrections. Community Corrections will provide residential
treatment, basic care, 24 hour supervision, individual group
counseling as per the Texas Health & Human services
Coordinating Council Rate Schedule and Definitions for level
of Care for Level V. These are children and adolescents with
severe emotional or behavior disorders or conditions such that
a highly structured program is essential to improved function
or maintenance. These children and adolescents present a
moderate to severe risk of causing harm to themselves or
others. The cost to Brazos County will be $78.40 per juvenile
per day. Contract period will begin on the 1st day of July,
1995 and will terminate on the 30th day of September 1996. On

motion by Commissioner Walker, seconded -by Commissioner
Norton, the Court voted unanimously to enter into contractual
agreement with Community Corrections, Inc.. A copy of the
contractual agreement is attached hereto.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfaze of the
general public. The Road and Bridge Department requested
permission to enter the Bright Light Church property on Pate
Road in Precinct 3 to construct a driveway in the county
right-of-way to promote proper drainage. On motion by
Commissioner Norton, seconded by Commissioner Walker, the
Court voted unanimously to authorize the work.
The Court next considered the request from GTE place a
road bore and/or parallel cable installation in the right-of-
way of Dilly Shaw Tap Road. The site is located in Precinct
2. The County Engineer stated that all appeared to be in
order and recommended approval. On motion by Commissioner
Walker, seconded by Commissioner Norton, the Court voted
unanimously to approve the request of GTE and authorized the
installation. A copy of the request is attached hereto.
The Court next considered Budget Amendment $94/95-22,
which would reallocate funds budgeted for the office of
Constable Precinct 2. On motion by Commissioner Walker,
seconded by Commissioner Norton, the Court voted unanimously
to approve the budget amendment as submitted, a copy of which
is attached hereto.
The County Judge announced that budget hearings 'will
begin on July 17, 1995.
There being no further business to come before the Court, .
the meeting was adjourned.

STATE OF TEXAS
COUNTY OF BRAZOS
CONTRACT !OR RESIDENTIAL SERVICES
The Brasos county Juvenile Services Department, hereinafter called
Brazos County, and Community Corrections, Inc., hereinafter the
Service Agency, by this agreement and in consideration of the
mutual promises set forth below agree that:
1. PROVISIONS OF SERVICE
The Service Agency agrees to provide the following services,
which shall be limited to alleged or adjudicated juvenile
offenders in licensed juvenile care facilities while
juvenile is on Conditional Release, Informal Adjustment or
Court Probation through Brazos County:
Residential treatment, basic care, 24-hour supervision,
individual and group counselingt as per the Texas Hoall
Derinicion for Level of Care for Level V (Children and
adolescents at this level of care have severe emotional or
behavior disorders or conditions such that a highly
structured program is essential to improved function or'
maintenance. They may present a moderate to severe risk of
causing harm to themselves or others.)
A. For and in consideration of the above-mentioned services,
Brazos County agrees to pay the Service Agency an amount
not to exceed Level V $78.40 per juvenile per day. This
fee does not exceed the actual cost of child care in the
Service Agency, and does not exceed the amount allowed in
the Texas Health Human Services Coordinating Council's
Definitions of Levels of Cars. The Service Agency will
not change the Level of Care of a particular juvenile
without written acknowledgement of Brazos County.

B. The Service Agency agrees to maintain and make available
for inspection, audit or reproduction by an authorized
representative of Brazos County Juvenile Services and the
State of Texas, books, documents, and other evidence
pertaining to the cost and expenses of this Contract,
hereinafter called the Records.
C. The Service Agency agrees to maintain these records for
three (3) years after final payment or until the state-
approved audit has been made and all questions therefrom
are resolved.
IV. FEE ASSESSMENT '
A. Juvenile or their families shall not be assessed fees for
services by the Service Agency unless arrangements are
specified by the Court. This does not preclude
reasonable attempts to soak voluntary contributions from
families of county juveniles for donations of clothing,
personal articles, and funds to assist in supporting a
juvenile's rehabilitation.
B. If a juvenile is eligible for fiscal support from another
state agency or organization, the Service Agency shall
ensure that Brazos 'County is not charged for such fiscal
support for which the juvenile is otherwise eligible.
V. DEFAULT
A. Brazos County may, by written notice of default to the
Service Agency, terminate the whole or any part of this
Contract in any of the following circumstance:
1. If the Service Agency fails to perform the work
called for by this Contract within the time
specified herein or any extension thereof; or

II. INDIVIDUAL PROGRAM AND FAMILY INVOLVEMENT

A. Each juvenile placed with the Service Agency shall have
a written Individualized Program Plan (IPP) developed in
concert with the juvenile and mutually agreed upon by the
appropriate service Agency staff and assigned probation
officer. A copy of the IPP shall be sent to the
probation officer no later than six weeks after
placement.
B. The goals in the IPP shall be reviewed jointly by the
appropriate service Agency staff, the juvenile, and the
assigned probation officer at reasonable intervals, not
to exceed ninety (90) days, to assess the juvenile's
progress with modification of the IPP being made when
needed. A copy of the revised IPP shall be given to the
assigned probation officer.
C. The IPP shall contain the reasons why the placement will
benefit the juveniles shall specify behavioral goals and
objectives being sought for each juvenile; shall state
• how the goals and objectives are to be achieved in the
Service Agency placement; and shall state how, if at all,
the parent(s), guardian(s), and where possible,
grandparents or other extended family members will be
involved in the Individual Program -Plan to assist in
preventing or controlling the juvenile's alleged
delinquent behavior or alleged conduct indicating a need
for supervision as defined in the Texas Family Code.
D. The Service Agency shall remain in telephone contact with
assigned probation officer regarding juvenilegs progress
and provide a written report of progress upon request.

N. If a juvenile in placement at the Service Agency makes an
unauthorized departure, becomes seriously ill, or is
involved in a disruptive incident, the Service Agency
shall notify the juvenile's probation officer or other
probation staff within a twenty four hour period
following the incident and ensure that parents, proper
authorities, the Texas Department of Human services, or
the police are notified if appropriate. A written
incident report and/or police report shall be sent to the
assigned probation officer no later than five (5) working
days after the occurrence.
F. Brazos County reserves the right to terminate the
juvenile's placement at the Service Agency at its
discretion. The Service Agency must not release the
juvenile to any person other than Brazos County without
' the express consent of Brazos County.
G.
Brazos County must approve the juvenile's participation
in any furlqughs, home visits, or extended agency trips.
H.
Unless otherwise stipulated by Brazos County, the
juvenile may visit freely with parents and relatives at
the Service Agency in accordance with established Service
Agency policies.

Suspected or alleged cases of child abuse must be
immediately reported to the assigned probation officer
and the Texas Department of Human Services.
III. EXAMINATION OF PROGRAM AND RECORDS
A.
The Service Agency agrees that it will permit Brazos
County to examine and evaluate its program of services
provided under the terms of this Contract and to review
Brazos County juvenile records. This examination and

evaluation of the program will include unscheduled site
visitations, observation of programs in operation, and
interviews with the staff of the Service Agency and the
juvenile.

B. Recognizing that part of a juvenile's rehabilitation
program may include time away from the residential
setting of the Service Agency such as weekends, holidays,
etc., and that the service Agency must retain space for
this juvenile until his return, Brazos County will pay
the service Agency the above agreed upon amount for such
regularly scheduled days away from the Service Agency or
its program providing they do not exceed ten (10) days at
any one time.
C. If a juvenile makes an unauthorized departure from the
Service Agency, Brazos County shall be notified
immediately. If the juvenile returns to the Service
Agency within ten (10) days or prior to the last billing
day of the month, whichever shall occur first, the
Service Agency shall receive payment for those days the
juvenile was absent from the Service Agency, but not to
exceed ten (10) days' payment.
O. The Service Agency is under no obligation to retain space
• for the juvenile in unauthorized departure situations;
however, every effort should be made to reconcile the
incident to both parties' satisfaction.
E. Payment is to be made monthly. Claim for payment will be
submitted no later than ten (10) days from the last day
of the month for which payment is being requested.
F. Each billing should contain the name of the juvenile(s)
for whom payment is being requested along with the number
of days (stated consecutively) for which payment is
requested. Billing should" begin no earlier than the
Court ordered day of disposition into the program to the
and of the month and first day of the month through the
last day of the month thereafter.

2. If the Service Agency fails to perform any of the
other provisions of this Contract, or so fails to
prosecute the work as to endanger performance of
this Contract in accordance with its terms, and in
either of these two circumstances does not cure
such failure within a period of ten (10) days (or
such extension as authorized by Brazos county in
writing) after receiving notice of default.
TERMINATION
A. This contract may be terminated by either party by qiving
ten (10) days written notice to the other party hereto of
the intention to terminate.
B. Termination of the juvenilefs residence with or receipt
of services from the Service Agency shall occur only
after notifying the assigned probation officer of the
causes and with sufficient lead time of at least ten (10)
days to allow alternate placement or referral for
service.. .
C. The decision of the terminating party shall be final and
conclusive unless within thirty (30) days from the date
of receipt and of a written copy of the decision, the
nonterminating party mails or otherwise furnished to the
terminating party, a written appeal addressed to the
Criminal Justice Division or its authorized
representative, shall be final and conclusive, absent a
showing of fraud, caprice, arbitrariness or gross error
implying bad faith, in some court of competent
jurisdiction.
LAW AND VENUE
In any legal action arising under this Contract, the laws of
Texas shall apply and venue shall be in Brazos County.

VIII. APPLICATION PROCEDURES
The Service Agency shall agree to accept the State of Texas
Common Application for Placement of Children in Residential
Care for admission review on juveniles referred from Brazos
County. Brazos County will provide Service Agency with a
report on recent physical, dental, psychological, and
psychiatric examinations if required by Service Agency and
any social history available to the Court.
IX. CONTRACT PERIOD
The contract period will begin on the 1st day of July, 1995,
and will terminate on the 30th day of September, 1996.

ITEM: Request from GTE for a road bore and /or parallel cable installation in the
right-of-way of Dilly Shaw Tap Road. Site is located in Precinct 2
SOURCE OF FUNDS: N/A
1. PRESENTATION:
A) No work will be permitted between front slope end//or back slope.
B) The line shall be installed within 3.5' of and parallel to the right-of-way
line.
C) If clearing of Brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees
etc. from County right-of-way.
D) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Texas as follows:
From Bryan on FM 974, turn right on Dilly Shaw Tap
Road, go about 4 to 5 miles on left. Need a bore
at entrance of Lilly Dairy inside green fence for
service to house behind brick house. Bore will be
at L-10634, ped 26.
The location and description of this line and associated
appurtenances is more fully shown by two copies of drawings
• attached to this notice. The line will be constructed and
maintained on the County Road right-of'-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights., franchise, easement, license, authority, y
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin in July 5, 1995. r

On this the 10th day of July 1995 at a special meeting of the
Commissioners' Court, the following members were present:

THAT WHEREAS, on July 10, 1995, the Court heard and approved
a budget amendment for' the 1994-1995 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 8,
1994 the following amendment(s) to the original are hereby
authorized, as described*on the attached 1 page(s).
