THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON MONDAY,
JUNE 26, 1995 AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

wishing to address the Court on county-related issues not scheduled on the agenda.
Please limit subject matters to five minutes. The Commissioners will receive the

16. Approval of a purchase agreement with Roxanne Nemcek for a .1567 acre tract of land
out of the James Hope survey for drainage easement. Site is located in Precinct 1.
17. Call for citizen input and/or concerns.

JUNE 26, 1995
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, June 26, 1995, with the following members of
the Court present:

There was no citizen input.
The Court proceeded to consider the change of status of
the following employees.

Commissioners Court meeting June 26, 1995
The Court next considered the following claims as

submitted by the County Treasurer for payment:
95-01532 through 95-01767
On motion by Commissioner Sims, seconded by commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
The County Judge read aloud a Proclamation designating
Wednesday, July 5, 1995 as "Brazos County Blood Day". The
Court feels that it is the responsibility of the community to
see that blood is available in sufficient quantities to meet
the needs of all hospital patients. On motion by the County
Judge, seconded by Commissioner Sims, the Court moved to
proclaim Wednesday, July 5, 1995 as "Brazos County Blood Day"
throughout Brazos County.
On motion by Commissioner, seconded by Commissioner Sims,

the Court voted unanimously to adopt a resolution authorizing
the Texas Department of Transportation to proceed with quit
claiming a 0.155 acre tract of land in the Zeno Phillips
Survey, Abstract 45, Brazos County, Texas. This land is
surplus to the State's needs and will no longer be needed for
drainage. The County will not need the land for road purposes
so therefore the land will be quit claimed to the adjacent
landowner.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to adopt a resolution
supporting the retention of the "Texas Eagle" AMTRAK route
serving the Dallas, Bryan-College Station, Houston area.
Brazos County joined with the Bryan-College Station Chamber of
Commerce, neighboring counties and other interested entities
in requesting that AMTRAK consider that the discontinued
operation of the route will result in a number of related
assets being diminished.
The County next considered a request from the District
Clerk for participation in the JTPA Employment and Training
Program and subsequent execution of agreement with the Brazos

Valley Private Industry Council. The District Clerk explained
that this program was funded under the Job Training
partnership Act and is designed to provide work experience,
training, and special transition services to assist
participants to make career choices and obtain labor force
exposure. All this is at no cost to the County. On motion by
Commissioner Cauley, seconded by Commissioner Walker, the
Court voted unanimously to enter into agreement with the
Private Industry Council as the JTPA Program Operator. A copy
of the Agreement is attached.
The next matter for consideration was the confirmation of
the annual agreement with Ingram, Wallis & Company for audit
services. This audit will be of the general purpose financial
statements of Brazos County, Texas as of and for the year
ending September 30, 1995. On motion by the County Judge,
seconded by Commissioner Sims, the Court voted unanimously to
enter into agreement with Ingram, Wallis & Company for audit
services. Cost to the County is estimated at $49,000.00 and
will require approximately 1,300 man hours.
The Court next considered Budget Amendment #94/95-21,
which would adjust revenue for the General Fund and Road &
Bridge Fund only. On motion by Commissioner Norton, seconded
by Commissioner Sims, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court next considered authorizing work outside of
county rights-of-way for the enhancement of county road
projects. The Road and Bridge Department requested permission
to enter the private property of Larry Wilding on Ranchero
Road in the Harvey Hillsides Subdivision for the purpose of
constructing a school bus turn around. The site is in
Precinct 3. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to authorize
the work.
The Court next considered authorizing work outside of

county rights-of-ways for the health, safety and welfare of
the general public. The Road and Bridge Department requested
permission to enter the private property of Ruthie Smith on
Taylor Road to remove a dead tree from the right-of-way. The
site is located in Precinct 3. On motion by Commissioner
Norton, seconded by Commissioner Sims, the Court voted
unanimously to authorize the work.
On motion by the County Judge, seconded by Commissioner
Sims, the Court voted unanimously to approve the request of
the Road and Bridge Department for a "(Cash) Change Fund" in
the amount of $50.00 for permitting operations at the Road and
Bridge Department.
The Court next considered the request from GTE Telephone
operations for a road bore/parallel cable installation in the
right-of-way of Democrat Road beginning approximately 1.5
miles southeast of SH21 and extending south for a distance of
2;471 feet. The site is located in Precinct 3. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously
to approve the request of GTE Telephone operations and
authorized the installation. A copy of the request is
attached hereto.
The next matter before the Court was the approval of a
purchase agreement with Roxanne Nemcek for a .1567 acre tract
of land out of the James Hope Survey for drainage easement.
The site is located in Precinct 1. On motion by Commissioner
Sims, seconded by Commissioner Norton, the Court voted
unanimously to approve the Real Estate Sales Contract with
Roxanne Nemcek for the .1567 acre tract of land out of the
James Hope Survey.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

Dear Judge Jones:

We are pleased to confirm our understanding of the services we are
to provide for Brazos County, Texas for the year ended September
30, 1995.
We will audit the general-purpose financial statements of Brazos
County, Texas as of and for the year ended September 30, 1995. The
general-purpose financial statements consist of the combined
balance sheets, the related statements of revenues and
expenditures, statements of changes in fund balances and statements
of cash flows for the proprietary funds and the accompanying notes
to the financial statements. In addition, the financial statements
will have included the Schedule of Federal Financial Assistance
that will be subjected to the auditing procedures applied in our
audit of the financial Statements.
Our audit will be made in accordance with generally accepted
auditing standards and will include tests of your accounting
records and other procedures we consider necessary to enable us to
express an unqualified opinion that your financial statements are
fairly presented, in all material respects, in conformity with
generally accepted accounting principles. If our opinion is other
than unqualified, we will fully discuss the reasons with you in
advance.

Our audit will also be a Single Audit conducted in accordance with
the standards for financial audits contained in Government Auditing
Standards issued by the Comptroller General of the United States
(the Yellow Book) as it relates to financial audits; the Single
Audit Act of 1984; and the provisions of OMB Circular A-128, Audits
of State and Local Governments.

Our reports will include a report on the Schedule of Federal
Financial Assistance, the required reports on compliance with laws
and regulations related to the financial statements and to the
Federal financial assistance programs. Additionally, we will
report on internal control in relation to the general-purpose
financial statements and to the Federal financial assistance
programs. You acknowledge that you are responsible for determining
the compliance requirements and will make us aware of all such
requirements.
Our procedures will include tests of documentary evidence
supporting the transactions recorded in the accounts, tests of the
physical existence of inventories and fixed assets, and direct
confirmation of certain terms, transactions, assets and liabilities
by correspondence or other means with selected customers,
creditors, banks and their employees. We will request written
representations from your attorneys as part of the engagement, and
they may bill you for responding to this inquiry. At the
conclusion of our audit, we will also request certain written
representations from management about the financial statements and
related matters.
An audit includes examining, on a test basis, evidence supporting
the amounts and disclosures in the financial statements; therefore,
our audit will involve judgement about the number of transactions
to be examined and the areas to be tested. Also, we will plan and
perform the audit to obtain reasonable assurance about whether the
financial statements are free of material misstatement. As
required by the Single Audit Act of 1984 and OMB Circular A-128,
our audit will include tests of transactions related to the Federal
financial assistance programs for compliance with laws and
regulations and appropriate tests of the control structure over
such programs. Additionally, we will perform appropriate tests
related to the "general requirements" as outlined in the Compliance
Supplement for Single Audits of State and Local Governments (1990
edition), published by OMB.
However, because of the concept of reasonable assurance and
because we will not perform a detailed examination of all
transactions, there is a risk that material errors, irregularities,
or illegal acts, including fraud or defalcations, may exist and not
be detected by us. We will advise you, however, of any matters of
that nature that come to our attention. Additionally, you
acknowledge the requirement in certain circumstances for us to
directly report certain identified illegal acts to the oversight
agency. Our responsibility as auditors is limited to the period
covered by our audit and does not extend to any matters that might
be incurred during any later periods for which we were not engaged
as auditors.

We understand that you will provide us with the basic information
required for our audit and that you are responsible for the
accuracy and completeness of that information. We will advise you
about appropriate accounting principles and their application and
will assist in the preparation of your financial statements, but
the responsibility for the financial statements remains with you.
This responsibility includes the maintenance of adequate records
and related internal control policies and procedures, including
controls over compliance with laws and regulations, the selection
and application of accounting principles, and the safeguarding of
assets.
You agree that your employees will assist in preparing schedules,
type correspondence and confirmations we request, and will locate
an
y invoices selected by us for testing.

We expect to begin our final audit work in early November and issue
our reports no later than February 20. You agree that all of the
reports referenced above will be bound into one document with the
general-purpose financial statements.
Our fees for these services will be based on the actual time spent
at our standard hourly rates, plus travel and other out-of-pocket
costs such as report production, typing, postage, etc. Our
standard hourly rates vary according to the degree of
responsibility involved and the experience level of the personnel
assigned to your audit. Our invoices for these fees will be
rendered periodically as work progresses and are payable on
presentation.
We estimate that the engagement will require approximately 1300 man
hours and the approximate percentage of time required by level is
as follows:

It is understood that in the event of extenuating circumstances or
unanticipated internal control problems that may be encountered the
proposer may ask for the Audit Committee to re-examine the pricing
for years after fiscal year ended September 30, 1995. The
subsequent year fee schedules will be evaluated each year
immediately after the completion of the prior year's audit.

Estimated fees for our services are noted in a prior section of
this letter. Our fee estimate is based upon 1300 hours and assumes
that the reporting requirements of the County will remain the same
as prior years, and that the County will provide the assistance
discussed on the previous page. If, for whatever reason, the
County does not provide the aforementioned assistance or additional
services are required after December 31, additional fees will be
charged at our standard rates.

On this the 26th day of June 1995 at a special meeting of the
Commissioners' Court, the following members were present:

Subject: Request for Revenue Budget Amendment
We are requesting that the attached request for budget amendments be placed on the
Commissioners Court agenda for approval June 26, 1995. The two request adjust revenue
for General Fund and Road & Bridge Fund only.
The General Fund revenue has been reviewed and determined that several line items have
exceeded the original expected collection, therefore, have been increased. Some of the
findings are budget that will not be utilized this year, such as Fees-Training Program,
Transfer from Inmate Commissary, and Fees-Constable Pct.l. We have analyzed the
revenue line item Refunds-Ct.Appt.Attorneys and have determined that this should be a
reductions of the appropriate expenditures. This revenue is an inflation of the actual
revenues. Over all, this amendment is increasing the revenue which in turn reduces the
need to use Reserve Fund Balance to support expenditures.
The Road & Bridge Fund revenue included a line item for Fees-License & Weight which
is collected and accounted for within the General Fund. Also, the Fees-Vehicle
Registration line item was overstated. This revenue is calculated and set by the state
each January. The actual amount is not known at the time the county is setting the annual
budget. This amendment will increase the need to use Reserved Fund Balance.

Agreement
JTPA Employment and Training Program
This memorandum of agreement sets forth the individual and mutual responsi-
bilit'es of the Private Private Indu;tryCouncil, as he JTPA Program Operator; and

as the
worksite agency, hereinafter called the "Worksite"; and all JTPA participants
assigned to this worksite. The objective of this agreement is to promote an
effective and beneficial experience for the worksite agency and the JTPA
participant through mutual agreement to responsibilities and objectives by all
the parties involved.
I. Purpose of the JTPA Employment and Training Program
•
This special program funded under the Job Training Partnership Act
(JTPA), is designed to provide work experience, training, and special
transition services to assist participants to make career choices and
obtain labor force exposure. Work experience must be meaningful, with
emphasis placed both on the return to school by dropouts and inschool
youth, and on transition to employment for out-of-school participants,
both dropouts and graduates.
II. Allowable Activities and Services
The primary activities of the program are well-supervised work
experience, job training, career orientation, vocational exploration,
and job rotation. These activities are provided by the Worksite Agency
in coordination with the JTPA. Supervision of participants is a
responsibility of the Worksite Agency and is extremely important to the
career development of the youth assigned.
III. Supervisory Responsibilities for the Worksite Agency

As an employer, Worksite Agencies have responsibility for:
o Assuring that those individuals directly involved in the day-to-
day supervision of participants receive an orientation and
training on the objectives and expectations of the program;
o Assuring that those individuals (named herein), directly involved
in the day-to-day supervision of participants, receive a copy of
this agreement for use in managing worksite activities;
o Assuring that the Child Labor provisions of the Fair Labor
Standards Act are adhered to;
o Instructing the participant in the performance of his/her job on a
daily basis;

o
Providing continual supervision by checking the participant's
progress at various times each day; providing sufficient work to
occupy the participant during working hours; and providing
sufficient equipment and materials to carry out their work
assignment.
o
Assuring that the participant does not exceed authorized working
hours and that time will not be recorded for payment for unexcused
absences, unworked hours of recreation, leaves, holidays, or lunch
period.
o
Assuring that the participant's work time is accurately recorded
daily by the responsible supervisor and is signed for both by the
supervisor and the participant. (A daily time-in and time-out log
used in conjunction with the JTPA Time Sheet is strongly
recommended.)
o
Assuring that the conditions of work are safe and that the
participant work in a safe manner (SEE SAFETY);
o
Discussing informally with the participant any minor job-related
problems;
o
Compliance with the Federal Regulations governing the Employment
and Training Program.
IV. The
Program Operator's Responsibilities
The
subcontractor implementing the local program has the responsibility
for:
o
Providing each individual involved in the day to day supervision
(including part-time replacement supervisors) with orientation and
training on the objectives and expectations of the program.
o
Informing participants of their Civil rights and of the

established grievance procedure if they wish to register a E
complaint or grievance;
o
Counseling participants on personal and job-related matters;
o
Collecting and verifying participant's time sheets; and
o
Monitoring worksites for compliance with State and Federal
regulations and this Agreement.
V. General Provisions
A. Termination of JTPA Participants
If a participant is not performing satisfactorily, the JTPA
Counselor should be contacted to discuss the problem. If the
problem cannot be resolved, then a transfer to ¬her worksite or

termination from the program will be considered by the Program
Operator. The Counselor will work with the worksite supervisor to
ensure that problems will be resolved in a reasonable and mutually
satisfactory manner.
If the situation warrants, the worksite supervisor may suspend a
participant from the workstation for a period not to exceed two
days. In the event of a suspension, the immediate supervisor
should contact the JTPA Counselor or a staff member of the BVPIC
immediately. If JTPA counseling has been provided and the
situation continues, the worksite may request that the participant
be removed permanently.
Continuation of work with the worksite agency is at the sole
discretion of that worksite agency.
In any event, JTPA participants must be assured of equal, fair,
and just treatment under the U.S. Civil Rights Act. Each
participant, upon acceptance into the program, will have been
notified in writing of his/her rights under the act and of the
procedures to follow in the event he/she has a complaint.
B. Safety and Healthy Environment
It is necessary for the supervisor and the Worksite Agency to
comply with the Child labor laws under the Fair Labor Standards
Act. Detailed information on the Child Labor laws can be found in
Child Labor Bulletin 101, a Department of labor publication. The
agency will be in compliance if the following condition is met
(paraphrased from Bulletin 101):
No participant under 18 years of age may be employed in any
nonagricultural occupation which has been declared hazardous by
the Secretary of Labor. This generally applies to any work which
could be considered unsafe or hazardous. (A detailed list of
these occupations is found on pages 9 - 33 in the Child Labor
Bulletin 101.)
Generally, the following conditions must also be met to help
prevent accidents which might otherwise occur because of
carelessness or laxity on the part of the participant or the
supervisor:
o Youth 14' and 15 years of age cannot be assigned to work
which involves the use of power driven mowers or cutters by
these youth. Further details on the employment of youth 14
and 15 years of age can be found on pages 6-9 in the Child
Labor Bulletin 101;
o The Worksite Agency and supervisor should take any necessary
precautions to insure a safe worksite for all youths
employed through this program.

o No youths under 18 may be assigned to work which requires
heavy lifting;
o All youths involved in moderate lifting as part of the job
must be thoroughly instructed in "safe" lifting procedures
and precautions, and must be closely supervised on the job;
o When a youth is assigned a job which normally requires
safety equipment, special shoes, etc., the youth must be
supplied with this equipment and oriented on the use of such
equipment along with safety precautions to be taken on the
job. (Examples of such jobs are grounds work or work in
maintenance and storage yards, warehouses, shops, etc.); and
o Youths working in painting, ground work, light maintenance,
etc., must be supervised closely either individually or in
groups not exceeding six per supervisors.
C. Insurance (Worker's Compensation)
In the event an accident does happen on the job, the participant
is covered by Worker's Compensation Insurance which includes the
cost of emergency medical treatment. If a minor, Contact his
parents and get the youth to his/her doctor, hospital, or clinic
as soon as possible. Immediately contact the JTPA Counselor in
your area. If you cannot get in touch with the Counselor, call
this number (409)822-0797 for further instructions. Please make
note of how the accident occurred, when and where it happened, and
obtain the names of witnesses. (This information must be recorded
on an employer's report of injury for the Worker's Compensation
carried and for the Industrial Accident Board.)
0. Worksite Agency Time and Attendance Polic
It is the policy of alrcry S c./
to provide standard workin hours between 7:00 a.m. and 5:00 p.m.
with an appropriate lunch break, 5 days a week. Work may be
permitted at irregular hours and on Saturdays as long as hours do
not exceed 8 hours per day or 40 hours per week.
Because of the nature of the work performed, it is the policy of
this agency to provide, at the discretion of the workstation
supervisor, flexible paid/nonpaid break periods.
E. This agreement must contain a listing of the following items
before any participant can begin employment or training in the
JTPA program:
1. Name and address of Agency Workstations (if there are more
than one);
2. Names of the Worksite Supervisors assigned to supervise the
activities of the JTPA participants;

Formal notice is hereby given that GTE will construct a'
communication line within the right-of-way of a County Road
in Brazos County, Texas as follows:
A
On Democrat Road, approximately 1 1/2 miles southeast
of Hwy 21, a buried cable will be placed in west ROW
extending south for a distance of 2471'. The cable
will be placed 5' in the ROW at a depth of 30".
The location and description of this line and associated
appurtenances is more fully shown by two copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin in July, 1995.
