BRAZOS COUNTY COMMISSIONERS COURT MEETING
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON MONDAY,
JUNE 19, 1995 AT 6:30 P.M. IN THE COMMISSIONERS' COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

3. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Court on county-related issues not scheduled on the agenda. Please
limit subject matters to five minutes. The Commissioners will receive the information,
conduct research into the matter, and/or place the matter on a future agenda for
discussion. (A recording is made of the meeting; therefore, please give your name and

the purpose of cleaning out existing drainage channel along west side of timbered area
approximately 300' from Dilly Shaw Tap Road to allow water to drain from culvert under
roadway for the health, safety and welfare of the general public. Site is located in
Precinct 2.
12. Request permission to enter Tammy Oehlert's property located off Bickham Cemetery
Road for the purpose of disposing of dead livestock for the health, safety and welfare of
the general public. Site is located in Precinct 2.

of Bush Lane approximately 1,875' from its intersection with Silver Hill Road. Site is

Addition, City of Bryan, to Richard Pena.
15. Tax Resale Deed and authorization for County Judge to execute deed for Lot 6, Block 4,

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 6:30
p.m. on Monday, June 19, 1995, with the following members of
the Court present:
Alvin W. Jones, County Judge, Absent;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Presiding;
Carey Cauley, Jr., Commissioner of Precinct 4;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
There was no citizen input and/or concerns.
The first matter for consideration by the Court was the
is
incentive package for Neutral Posture Ergonomics, Inc.. Mark
Willis, representative of the Chamber of Commerce, briefed the
Court on the progress to date. He said that the City of
College Station had tentatively agreed to the package and that
the City of Bryan had agreed to pay $25,000 per year for three
(3) years to keep the business in Brazos County. Commissioner
Sims moved to approve the incentive package subject to
approval by the City of College Station. Commissioner Cauley

seconded the motion. Commissioner Norton asked to include
approval by the City of Bryan. Commissioner Sims agreed to
amend his motion to include approval by the City of Bryan.
Commissioner Cauley amended his second. The Court voted
unanimously to approve the incentive package for Neutral
Posture Ergonomics, Inc. subject to approval by the Cities of
Bryan and College Station.
The next matter for consideration was the participation
in the acquisition of dry fire hydrants. Frenchy Bennett,
representative of the Brazos County Fire Fighters Association,
told the Court that due to $32,000.00 in unutilized grant
funds, the county has the opportunity to reapply for dry fire
hydrants from the Texas Forest Service. These funds would be
used to install a network of fire hydrants throughout
Brazos County. Mr. Bennett explained that the Natural
Resources Conservation Service would supply the dry hydrant
head and screen assembly for each volunteer fire department,
the Volunteer Fire Departments could supply technical
assistance for site selection and installation and Brazos
County would supply a back hoe and gravel if needed for the
installation. On motion by Commissioner Cauley, seconded by
Commissioner Norton, the Court voted unanimously to prepare a
dry hydrant resolution, (a copy of which is attached) and to
apply for the county wide dry hydrant cost share program
funds. On motion by Commissioner Cauley, seconded by
Commissioner Walker, the Court voted unanimously to appoint
Luther Olden as County Project Officer for the dry hydrant
project.
The Court next considered the purchase of a new burster
for the Treasurer's Office. Kay Hamilton, County Treasurer,
explained to the Court that the current burster is having
mechanical problems. The only firm willing to work on it is
in Austin and that would make necessary repair work cost
prohibitive. She continued, telling the Court, another reason
for the purchase of a second burster is that payroll and

vendor checks are carried from the courthouse to the annex for
bursting and then returned to the courthouse for processing.

Mrs. Hamilton then asked to look at a heavy weight model on a
stand. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve
the request of the Treasurer to purchase a burster but limited
her to expending no more than $5,500.00.
On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the payment of $29,700.00 to R. M. Dudley Construction for the
interior modifications to the Brazos Center.
The Court next considered an Order appointing Claude

Davis to sit as Special Judge in County Court at Law II on
June 22 and 23, 1995 to allow Judge Ryan to attend a Juvenile
legislation seminar. On motion by commissioner Walker,
seconded by Commissioner Norton, the Court voted unanimously
to approve the Order naming Claude Davis as Special Judge for
County Court at Law II on June 22 and 23, 1995. A full copy
of the Order is attached to and made a part of these minutes.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(4). This is for the purchase of professional
services from Carlomagno Surveying, Inc.. On motion by
Commissioner Norton, seconded by Commissioner Walker, the
Court voted unanimously to approve the Exemption of
Competitive Bidding Requirements and authorized the payment
for services rendered during 1995 fiscal year.
The Court next considered authorizing work outside of

county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of John Schram on
Dilly Shaw Road to clear out a channel. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to authorize the work.

seconded by Commissioner Norton, the Court voted unanimously
to,authorize the work.

On motion by Commissioner Walker, seconded by
Commissioner Norton, the Court voted unanimously to authorize
the County Judge to execute a Tax Resale Deed to the following
individual:

on motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following

The Court next considered Budget Amendment #94/95-20,
which would reallocate funds budgeted for the Constable
Precinct 4 Department, increase the budget for the landfill,
and reclassify line items in the Treasurer's office. On
motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to approve the budget
amendment as submitted, a copy of which is attached hereto.
The Court proceeded to consider the change of status of
the following employees.

On motion by Commissioner Walker, seconded by Commis-
sioner Norton, the Court voted unanimously to approve the
Claims as submitted.
The Court acknowledged receipt of the Extension Service
reports for May 1995 and acknowledged receipt of reports from
County and Precinct offices showing revenues collected and
remitted to the County Treasurer. An excerpt from those
reports is attached hereto.

DRY FIRE HYDRANT RESOLUTION
•
•
WHEREAS, according to the Texas Commission of Fire Protection, 42,000 of the 88,000
fires recorded in 1991 occurred in rural Texas; and
WHEREAS, in many rural areas of Texas, a lack of water mains and domestic fire
hydrants can impair a volunteer fire department's ability to effectively extinguish fires; and
WHEREAS, the Resource Conservation and Development (RC&D) Areas, Soil
Conservation Service (SCS), Texas Forest Service (TFS), and the Volunteer Fire Departments
(VFD) are providing the materials and technical assistance to effectively install dry fire hydrants;
and
WHEREAS, the RC&D Areas in Texas, SCS, TFS and VFD have demonstrated a
positive force for the past four years to improve the quality of life through rural fire protection;
and
WHEREAS, the dry fire hydrants conserve fuel through shorter water haul distances in
a shorter time period; and
WHEREAS, dry fire hydrants use water from ponds, lakes and streams, thus saving
energy through the use of non-processed water which, in turn, saves precious drinking water; and
WHEREAS, the dry fire hydrant program is a partnership between government entities
and volunteers, it is imperative that Texas county government take the leadership role of
protecting rural residents from uncontrolled fires.
NOW, THEREFORE, BE IT RESOLVED by the Commissioners Court of Brazos
County, Texas, this the 19th day of June, 1995, that the members of this Court hereby officially
recognize the importance of promoting the dry fire hydrant program in Brazos County for the
purpose of improved rural fire protection, conservation of treated water supplies, conservation
of energy and promotion of economic development; and
That the members of this Court will assist in establishing an organizational structure
which allows community volunteer fire departments to work together to promote dry hydrant
water delivery systems for rural fire protection; and
The members of this Court will support the installation of dry hydrants, through in-kind
contributions, such as providing materials and/or equipment used for installation.

23, 1995, she will be at a seminar on 1995 juvenile legislation;
and
WHEREAS, she has requested the appointment of the Hon. Claude
Davis to sit as Special Judge of the County Court at Law
No. 2 of Brazos County, Texas on June 22 and 23, 1995 in all
matters that are, or may be, docketed on the Court's dockets for
that day, and to have and exercise all powers of a Special Judge in
relation to matters involved, it is therefore:
ORDERED, ADJUDGED AND DECREED, pursuant to the authority of
Article 30.03, Section 2, Code of Criminal Procedure, that the Hon.
Claude Davis, sit and hear all matters that are, or may be,
docketed on any of the Court's dockets on June 22 and 23, 1995, and
shall have and exercise all powers of such Special Judge in
relation to the matters involved;
WHEREAS, the Court having considered the proposed order and
deeming that it should be approved; it is therefore:

The location or description of the proposed Installation is more fully shown by
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction In order that they might be on hand to designate the actual
location of the installation
2. That sit damage to the roadways acid right-of-ways will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way
4. T hat Brazos County is in no way responsible for any damage that might
occur to any existing utility lines In the right-of-way.
5 That the line will be constructed and maintained on the County right-of-
way In accordance with governing laws.
6 That the line or lines will be constructed no less than forty-eight inches
(48") lower than the center of the roadway whether there Is, or is not, a
borrow ditch.
7. That all sites will be barricaded during the construction period.

On this the 19th day of June 1995 at a special meeting of the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Sandie Walker, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;
Mary Ann Ward, County Clerk.
The following proceedings were held:
THAT WHEREAS, on June 19, 1995, the Court heard and approved
a budget amendment for the 1994-1995 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 8,
1994 the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).
ADOPTED AND APPROVED this the 19th day of June 1995
