THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON MONDAY,
JUNE 12, 1995 AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

wishing to address the Court on county-related issues not scheduled on the agenda. Please

of McAllester Lane, Stewart's Meadow Subdivision, approximately 2112' from the
intersection with Stewart's Meadow Road for water line installation. Site is located in
Precinct 4.
14. The Preliminary Plat of Creekridge Estates, a private subdivision, W.L. Millican Survey,
A-174, Brazos County, Texas. Subdivision site is located in Precinct 1.
15. Request from GTE to place two (2) road bores and a parallel installation in the right-of-

A regular meeting of the Commissioners' Court of Brazos
County, Texas was.held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, June 12, 1995, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.

Commissioner Walker gave the invocation and led the
pledge of allegiance.
Citizen input - Ronnie Morrison, representative of the
Chamber of Commerce informed the Court that things were moving
forward with both cities with the tax abatement for
Ergonomics.

on motion by Commissioner Norton, seconded by Commissioner
Walker, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
95-01091 through 95-01313
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
On motion by the County Judge, seconded by Commissioner
Walker, the Court voted unanimously to cancel the
Commissioners Court meeting of July 3, 1995.
On motion by Commissioner Cauley, seconded by
Commissioner Walker, the Court voted unanimously to adopt the
recommended calendar for the preparation and adoption of the
1995-1996 budget. A copy of the calendar is attached hereto.
The next matter before the Court was the approval for a
revised grant application for the Youth Drug Detection and
Prevention Program by Juvenile Services. Dan German,
representative of the Juvenile Services Department informed
the Court that the original grant application did not fund
some expenditures. He said that the department was allowed to
submit a revised grant application and that it includes
individual and family counseling with Texas A&M University.

This revised grant application is for the same amount of
money. On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the County Judge to make application on behalf of Brazos
County to the Criminal Justice Division and accept on behalf
of Brazos County such grant funds as may be tendered.
The next matter for consideration was the modification of
the Flexible Base Contract, Bid No. 94-758, for the Woodlake
Subdivision project only. The contractor is hauling 80
thousand pound loads through the woodlake Subdivision and
destroying the roads he is in there to fix. To have the
hauler modify the load to the 58,420 pound limit it would cost
the county an extra $1.15 per ton or a total of $3,500.00
more. On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted unanimously to adjust the
bid amount for this project and look at specifications for
future bids for hauling products.
The Court next considered a request from the City of
College Station for reimbursement by the County for emergency
medical services provided to the southern part of the county.
The rates will be $15.00 per each individual assigned to the
responding unit and $5.00 per mile for each emergency medical
vehicle dispatched to the scene. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to enter into a contract with the City of College
Station for the reimbursement by the County for emergency
medical services to the southern part of the county. A copy
of the contract is attached hereto.
The Court considered a request from the County Treasurer
for approval of a Resolution Amending Authorized Representa-
tives to TexPool. On motion by Commissioner Walker, seconded
by Commissioner Norton, the Court voted unanimously to approve
the resolution and include the names of the following indivi-
duals who are authorized to withdraw funds, issue letters of
instruction and take all other actions deemed necessary or

appropriate for the investment of local funds:

The Court next heard a request from the County Treasurer
for approval of a revised listing of members for the
investment committee for Brazos County. On motion by the
County Judge, seconded by Commissioner Cauley, the Court voted
unanimously to approve the following revised listing of
members for the investment committee:

The Court next considered the request from Brushy Wlter
Supply Corporation to place a 2" service bore in the right-of-
way of McAllester Lane/Stewart's Meadow Subdivision
approximately 2112 feet from its intersection with Stewart's
Meadow Road for water line installation.. The site is located
in Precinct 4. The County Engineer stated that all appeared
to be in order and recommended approval. On motion by
Commissioner Cauley, seconded by Commissioner Sims, the Court
voted unanimously to approve the request of Brushy Water
Supply Corporation and authorized the installation. A copy of
the request is attached hereto.
The Court next considered approval of the Preliminary
Plat Creekridge Estates, a Private Subdivision. Richard
Vance, County Engineer, stated that he had reviewed the plat
and that the subdivision was being platted after the fact.
Commissioner Norton explained that the subdivision was
developed prior to the implementation of the subdivision
regulations and this had come about because of the developer's
desire to replat the subdivision. Commissioner Sims commented
on the less than adequate intersection at Creek Land and
Schein Road. He also asked if the Court accepted the plat,
would all the roads would be brought up to county standards?
The County Engineer and Commissioner Norton replied that they

would be if they were to be maintained by the county. On
motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court unanimously approved the Preliminary Plat of
the Creekridge Estates Subdivision.
The Court next considered the request from GTE Telephone
operations to place two (2) road bores and a parallel
installation in the right-of-way of Tall Timber/Timbercrest
Subdivision. The site is located in Precinct 1. The County
Engineer stated that it was necessary to get the bores and
installation deep enough to not interfere with drainage work
and to be as close to the property line. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to approve the request of GTE Telephone
Operations and authorized the installation. A copy of the
request is attached hereto.
The Court next considered Budget Amendment ##94/95-19,
which would increase funds budgeted for Foster Care due to
court ordered responsibility for indigent children. On motion
by Commissioner Sims, seconded by Commissioner Norton, the
Court voted unanimously to approve the budget amendment with
the correction of a typo. A copy of the budget amendment is
attached hereto. z
The County Judge announced that there would be a workshop
session at 3:00 p.m to discuss the following topics:
a) Travel
b) Teen Curfew
c) The purchase of a burster
There being no further business to come before the Court,
the meeting was adjourned.

RECOMMENDED CALENDAR FOR PREPARATION Ile
AND ADOPTION OF
1995-96 BUDGET
June 12 The Commissioners' Court meets to establish the dates for the County Judge
to hold budget hearings during the month of July.
June 15 County Auditor required to have preliminary revenue budget for the 1995-96
fiscal year to the County Judge and members of the Commissioners Court.
June 19 County Judge and County Auditor begin distribution of budget requests forms
and instructions to all departments.
July 10 Budget request forms are due back into the County Judge's office for
assimilation and comparative analysis.
July 17-28 Budget Hearings are held. Elected officials and Department Heads will meet
with the County Judge and Commissioners Court as scheduled.
August 2 County Auditor prepares for the County Judge and Commissioners Court a
revised revenue budget.
August 14 County Auditor prepares for the County Judge and Commissioners Court a
combined budget by fund.
August 21 County Judge presents proposed budget to Commissioners Court.
Commissioners Court sets date and time for public hearing on budget.
August 22 Notice of Public Hearing on proposed budget published in Eagle. (Ten days
notice given.)
September 5 Hold Public Hearing on proposed budget. Commissioners Court meeting to
approve budget. Set Tax Rate for 1995.
If tax rate is to be increased more than 3%, Commissioners Court must give notice of intent to
increase tax rate. The following steps must then be taken:
September 7 Notice of Public Hearing on tax increase (7 days notice).
September 14 Hold Public Hearing on tax increase.
September 16 Publish notice of vote on tax rate.
September 20 Commissioners Court meeting to vote on tax increase and tax rate officially
set for 1995.

A RESOLUTION AUTHORIZING APPLICATION
FOR GRANT ENTITLED YOUTH DRUG DETECTION &
PREVENTION PROGRAM
WHEREAS, the Governor of Texas, through the Criminal Justice Division,
under the provisions of the Juvenile Justice and Delinquency Prevention Act and
within the authority of the Texas Family Code, has set forth a program to
provide special services for juvenile offenders; and
WHEREAS, in implementing the aforementioned program, the Governor is
making grant funds available for drug detection and prevention programs for
juvenile offenders; and
WHEREAS, the Juvenile Court serving Brazos County has continuing need for
a wide range of services to be provided to selected juveniles.
NOW, THEREFORE, BE IT RESOLVED BY THE CON[1I 1SSIONER'S
COURT OF BRAZOS COUNTY at its meeting on the 12th day of June, 1995,
that:
1. The County Judge of Brazos County be authorized to make
application to the Criminal Justice Division, Office of the Governor,
for grant funds to be used for a drug detection and prevention
program for selected juvenile offenders;
2. The County Judge be authorized to accept such grant funds should
they be tendered;
3. This Resolution becomes effective upon its adoption.

MUTUAL AID AGREEMENT
THE STATE OF TEXAS §
COUNTY OF BRAZOS §
THIS AGREEMENT is made and entered into this 26 day of September
1995 , by and between the City of College Station, Texas, a Home Rule Municipal
Corporation of the State of Texas, hereinafter referred to as "the City" and Brazos
County, Texas, hereinafter referred to as "the County", each acting herein by and through
its duly authorized officials;
WHEREAS, the City is the owner of certain vehicles equipped and designed for
emergency medical assistance to persons; and
WHEREAS, the City and the County have authority to enter into an
intergovernmental agreement providing for the use of medically equipped vehicles and
emergency medical services for the citizens outside of the Municipal Corporate limits;
and
WHEREAS, Brazos County is desirous of obtaining emergency medical services
for their citizens;
NOW, THEREFORE, for and in consideration of the premises and of the mutual
benefits to be derived by each of the Parties hereto, which said Parties now agree to be a
valuable and sufficient consideration, said Parties agree in covenant as follows:
I.
The City agrees to furnish emergency medical equipment, supplies and personnel
outside the city limits of College Station and within Brazos County limits until this
agreement is terminated by proper notice.

The County will reimburse the City for expenses incurred by the City in the
furnishing of these services. The amount of the reimbursement to the City will be S 15.00

per each individual assigned to the responding unit and $5.00 per mile for each
emergency medical vehicle dispatched to the scene. The City will submit an itemized bill
to the County each month setting forth the amounts owed to the City by the County, and
the County shall pay each monthly bill within fifteen (15) days of the date on which the
bill is submitted.
III.
This agreement may be terminated by either the City of College Station or Brazos
County by the giving of thirty (30) days written notice of intent to terminate.
This Agreement is made under and shall be governed by the laws of the State of
Texas. The parties agree that performance and all matters related thereto shall be in
Brazos County, Texas.
No subsequent alteration, amendment or addition to this Agreement shall be

binding upon the parties unless reduced to writing and signed by them.
If any provision of this Agreement shall be held to be invalid, illegal or
unenforceable by a court or other tribunal or competent jurisdiction, the validity, legality,
and enforceability of the remaining provisions shall not in any way be affected or
impaired thereby. The parties shall use their best efforts to replace the respective
provision or provisions of the Agreement with legal terms and conditions approximating
the original intent of the parties.

RESOLUTION
AMENDING AUTHORIZED REPRESENTATIVES
WHEREAS, BRAZOS COUNTY
(the "Participant") is a political subdivision of the State of Texas and is empowered to delegate
to a public funds investment pool the authority to invest funds, to act as a custodian of
investments purchased with local investment funds; and
WHEREAS, the Treasurer of the State of Texas, acting by and through the Texas
Treasury Safekeeping Trust Company (the "Trust Company"), has created "TexPool". a public
funds investment pool, to effectuate the goals of providing investments at the highest possible
yield and maintaining complete safety of the funds of the Participant;
WHEREAS, the Participant hereby requests the following changes regarding the
individuals authorized to act on behalf of the Participant;
NOW THEREFORE, be it resolved as follows:
A- That BRAZOS COUNTY
has entered into a Participation Agreement and has established an account
in its name with the Trust Company's Local Government Investment Pool,
"TexPool", for the purpose of transmitting local funds for investment by the
Trust Company in TexPool;
B. That the following individuals, whose signatures appear on page 2 of this
Resolution, are officers, employees. or authorized representatives of the
Participant and are each hereby authorized to transmit funds to the Trust
Company for investment in TexPool and are each further authorized to
withdraw funds from time to time, to issue letters of instruction, and to take
all other actions deemed necessary or appropriate for the investment of
local funds:

GENERAL TELEPHONE NOTICE OF COMMUNICATION
COMPANY LINE INSTALLA?ION
June 1, 1995
TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE :
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Texas as follows:
Beginning at the function of Tall Timber and Stagecoach
Road, 1159' of buried cable will be placed southeast
5' within the east right-of-way of-Tall Timber. The
road will be crossed at two points by bores. The proposed
cable will be buried to a minimum depth of 30".

The location and description of this line and associated
appurtenances is more fully shown by two copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, ea3ement, license, authority,
permission, privilege or.right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.

BUDGET AMENDMENT(S) FOR THE 1994-1995 BUDGET YEAR
NO. 94/95-19
On this the 12th day of June 1995 at a special meeting of the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Sandie Walker, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;
Mary Ann Ward, County Clerk.
The following proceedings were held:

THAT WHEREAS, on June 12, 1995, the Court heard and approved
a budget amendment for the 1994-1995 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 8,
1994 the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).
ADOPTED AND APPROVED this the 12th day of June 1995

To increase County Foster Care budget from $37,900 to $68,000. Primary reason for
increase is due to the Doty kids not being eligible for state support. Thus, responsibility
for care of Doty kids is shifted to Brazos County.
To decrease budget of state support for foster care program from $1,266,500 to
$316,500. Amount at beginning of FY 95 was incorrectly stated.

The Commissioners' Court of Brazos County, Texas met in a
workshop Session in the Commissioners' Courtroom in the Courthouse
in Bryan, Brazos County, Texas, beginning at 3:00 p.m. on Monday,
June 12, 1995, with the following members of the Court present:

The Court discussed the following topics
3. Family Practice Residency Training Program - Doctor Kelly
Hester and Doctor H. D. Pope, representatives of the
TAMU Medical School, explained that this was a
community based program with an emphasis on rural
health care for under serviced areas in the Brazos
Valley. The targeted starting date is July of 1997.
1. 1995-1996 budget preparation - The County Judge outlined
his expectations and discussed at length pay raises
and the methods in which to implement them.
2. Travel policy - It was noted that no departments had a
copy of the travel policy. The two most important
issues were the set $65.00 reimbursement for a hotel
room per day and a per diem rate of $25.00.
4. Teen Curfew - Ernie Wentrcek supplied the members of the
Court with a handout outlining the scope and limits
of the teen curfew.
5. Burster for the County Treasurer's Office - The County
