VO PAGE 4J?- . f c i r} i c COMMISSIONERS' COURT SPECIAL MEETING MAY 30, 1995 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, May 30, 1995, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Sandie Walker, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The Court first considered the personnel change of status. Due to some confusion, the item was, tabled for a few minutes to allow time to gather additional information. The Court next considered the following Claims as submitted by the county Treasurer for payment: 95-000620 through 95-000856 On motion by commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. Commissioners Court meeting May 30, 1995 The Court next considered awarding the following bids: Bid No. 95-004 - Brazos Center parking lot lighting • Total Bid Contractor Exceptions Price Bayer Construction None $116,248.00 Britt Rice No Bid UM Sign Assembly Unit $ 98,626.00 Coll Sta Electric None $131,425.30 Universal Elec Const Co. Unsigned Bid Prop $108,651.00 Cheryl Turney, Purchasing Agent, recommended acceptance of the low bid submitted by Britt Rice Electric. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Britt Rice Electric. The next matter for consideration was the final design plan for the Juvenile Justice Center. Commissioner Norton • • moved to approve the plan submitted 5-22-95, minus one pod, pour the slab for a complete gym but only enclose half of it. Stub out all utilities to the gym wall for future expansion, remove two classrooms they won't be needed as a result of deleting one pod. Commissioner Sims seconded the motion. Commissioners Norton, Walker, Sims and Cauley voted "Aye". The County Judge voted "No". The motion carried. The Court proceeded to consider the change of status of the following employees. C I h t c f i v, Commissioners Court meeting May 30, 1995 on motion by the County Judge, seconded by Commissioner Walker, the Court voted unanimously to approve the personnel change of status with the exception of Fickey and Ramirez from the Sheriff's department. On motion by Commissioner Sims, seconded by Commissioner Walker, the Court voted unanimously to advertise for a utility vehicle for the sheriff's department to be used in the license and weight division. On motion by Commissioner Walker, seconded by Commissioner Sims, the Court voted unanimously to advertise for bids on dust control material and application. The County Engineer explained that this is a new material that the county will be using. The Court next considered approval to advertise for the sale of law books purchased from the Jail Commissary Fund. These books were, used by the inmates and many are in the original cartons having never been opened. The Court was informed that the books had to be sold and the funds returned to the Jail Commissary Fund. Commissioner Cauley asked how the fund worked. The County Auditor explained it to the Court. Commissioner Sims suggested contacting the Bryan Library to see if any law books needed to be replaced. On motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to advertise for the sale of law books. On motion by Commissioner Norton, seconded by Commis- sioner Walker, the Court voted unanimously to approve the list of surplus equipment for auction on June 17, 1995. The Purchasing Agent informed the Court that both the cities of Bryan and College Station would be participating in the auction. A copy of the list of surplus equipment is attached hereto. The Court next considered the request from Wickson Creek Special Utility District for the relocation of water lines in the right-of-way of Macey Road in Precinct 2. The cost to the VO PACIEL .Z0. i i 1 i • • • Commissioners Court meeting May 30, 1995 County will be $1,681.00 Commissioner Sims asked the engineer to please talk to Wickson Creek Special Utility District about properly back filling the holes. On motion by Commissioner Walker, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Wickson Creek Special Utility District and authorized the payment of $1,681.00. The next matter before the Court was approval to extend Greens Prairie Road from F.M. 2154 to State Highway 30 and the authorization to acquire right-of-way for the extension. A representative of the Road & Bridge Department showed the Court the route on a map. He informed the Court that the Texas Department of Transportation favored a 175 foot right- of-way for a possible four lane road. Commissioner Cauley asked if the monies were budgeted for this year. He was informed that they were not. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the extension of Greens Prairie Road from F.M. 2154 to State Highway 30 and authorized the acquisition of right-of-way for the extension. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Joe B. Bomnskie off FM 974 to dispose of dead livestock. On motion by Commissioner Walker, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. The Court next considered the request from Wickson Creek Special Utility District for a water line installation project as follows: (a) two (2) road bores in the right-of-way of Dyess Road (approximately 25 feet from its intersection with Hardy Weedon Road) and Lake Front Drive (approximately 50 feet from its intersection with Hardy Weedon Road) (b) parallel line along Hardy Weedon Road right-of-way (a distance of 1,050 feet from Dyess Road). On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Wickson Creek Special Utility District and authorized the installation. Richard Vance, County Engineer, stated that he had reviewed the plat and it appeared to be in order. On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court unanimously approved the final plat of the German Acres Subdivision. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to adopt an order amending a previous order for the creation of additional precincts to comply with the City of Bryan single member district lines. The original Order did not state with which precincts, precincts 51A, 51B, 79A and 79B would be consolidated: The Court next considered renewal of a lease agreement between Brazos County and the Junior League of Brazos County for rental of a portion of the Brazos Center, in Bryan, Texas. Term of the lease is for the period of one year commencing on June 1, 1995 and ending on May 31, 1996. The Junior League agrees to pay to Brazos County the amount of five hundred dollars twenty five dollars ($525.00) per month. On motion by Commissioner Walker, seconded by Commissioner Cauley, the ! A copy of the lease agreement is attached. The Court next considered a tax abatement for Neutral Posture Ergonomics. This is an eight (8) year declining tax abatement for the company to stay in Brazos County. The County Judge moved to approve the abatement process for eight (8) years. Commissioner Norton seconded the motion. Commissioner Cauley, Sims and Walker and Norton voted '.'No". Commissioner Sims stated he had not had enough time to review the abatement plan. He then moved to table consideration until the next Commissioners Court meeting to allow time to review the documents. Commissioner Norton seconded the motion and it carried unanimously. The Court next heard from Ernie Wentrcek, Director of Juvenile Services, who informed the Court that the Brazos County Juvenile Services Department had been notified of its eligibility for Title 4-E funding. This is a federal program that refunds contract placement dollars to the county when the child meets federal guidelines for reimbursement. There was no citizen's input. ' 1. Lessee shall be entitled to the space exclusively allocated to it by the Director of the Center for a term extending from June 1, 1995 until May 31, 1996. The space allocated to Lessee is described in Attachment 'A' hereto attached, which has been signed by the Director of the Center. 2. Zn addition, fees for temporary use of space required for provisional, membership and board of directors meetings are included in this contract as well as space for the League Placement Fair and space occupied by two storage cabinets in the Brazos Center receiving area. A11 meetings held in other than League office space should be scheduled as far in advance as possible on a • space available basis. 3. Fees for meetings involving small spaces for puppet show practice as well as for committee meetings are also covered in this contract provided the following conditions prevail: a. Meetings in small rooms are to be held only during normal business hours or after 5 p.m. when another activity is scheduled requiring a Brazos Center attendant to be on the premises; b. If the space used for the meeting has been previously set-up for a meeting scheduled at a later time by another group, the committee chairman will be responsible for determining that the room 1B In the exact state as when the room was entered; c. The committee chairman should give the Brazos Center office a notice of intention to meet no less than • one week in advance. d. The League member in charge of the meeting will alga a sheet kept in the Brazos Center office noting the date, name the committee meeting, the entry time and the departing time. VOiI,_, E_PAOE~~ t. Zn consideration therefore, Lessee agrees to pay the Lessor, on the first day of each calendar month during the term hereof, in advance, the sum of $525.00 (five hundred and twenty-five dollars) for rental of exclusively occupied space as well as for fees assessed for space for temporary uses described above. Zn addition, Lessee has permission for free use of Assembly Z, Assembly ZZZ and/or Assembly ZV for two six-hour periods as scheduled in advance with the Brazos Center. Additional uses of Assembly Z, Assembly ZZZ and/or Assembly ZV for membership meetings may be scheduled on a first-come, first-serve basis for $50 per day for each space. S. Additional charges may be made for activities other than those specified in this contract. Lessee will pay the regular User fees for space used by it, other than space allocated to it under this agreement. 6. A. Lessor shall furnish all utilities, including gas, water and electricity. B. Lessee shall furnish telephone and answering service for itself. 7. Lessor does not provide and will not provide furnishings, custodial care, or maintenance of the space i i• allocated to Lessee under this agreement. 8. Lessee shall take good care of the space allocated to it, reasonable wear and tear only excepted, and shall surrender the premises at the termination of this agreement. 9. Lessee agrees that no improvements to or alterations to the space shall be made without the consent of Lessor in writing. 10. Risk or loss of all property owned by Lessee shall remain with Lessee, it being understood that Lessor will maintain no insurance on such property. Any insurance desired by Lessee on Lessee's property shall be purchased by Lessee at its expense. 11. Lessor shall not be liable to Lessee or the Lessee's employees for any damage to person or property caused by the negligent act of Lessor, its agent, servants, or employees or due to the act of any other tenant in the building, or due to any defect or want of repair in any part of the building of which the allocated space forms a part. Lessee agrees to hold Lessor harmless from any and all claims, damages, expenses, including attorney's fees, growing out of or arising from any negligent act on the part of Lessee, its agents, servants or employees. 13. No sign shall be placed at, or on, or about the premises by Lessee except with the approval of the Center Director in writing. 11. Lessee president, as designated below right, shall be issued only one key to the office allocated space and one key to storage closet space. By accepting the key, Lessee president agrees on behalf of all Lessee associates to: (a) use the allotted space only when the Brazos Center is open for business or in use, and (b) allow no copies or duplicates of the key to be made. Lessor agrees to keep two duplicate keys on file in its office which will be available for use to those deemed qualified by Lessee.
