SPECIAL MEETING
MAY 1, 1995
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, May 1, 1995, with the following members of the
Court present:

Commissioner Cauley gave the invocation and led the
pledge of allegiance.
The County Judge called for citizen input/concerns.
Reverend Floyd Polk, representative of the Bryan Independent
School District asked the Court for help in getting a load of
soil, donated by Monterey Mushroom Farm, to the alternative
school for the garden project. The County Judge informed
Reverend Polk that the Court would see what could be done.
The County Judge read aloud a Proclamation designating
May 4, 1995 as "National Day of Prayer" in Brazos County. The
Court joins with the national government to recognize the role
of faith and prayer in the lives of the American people. On
motion by Commissioner Sims, seconded by Commissioner Norton
the Court moved to proclaim May 4, 1995 as "National Day of

Prayer" throughout Brazos County. The County Judge then
presented the signed Proclamation to Ms Ann Horton,
representing Aldersgate Church.
The County Judge read aloud a Proclamation designating
the week of May 8 through 17, 1995 as "Respect for Law Week".
The Court joins with the local Optimist Club to promote
support programs aimed at combating crime and encouraging a
respect for law. On motion by the County Judge, seconded by
Commissioner Cauley the Court moved to proclaim the week of
May 8 through 17, 1995 as "Respect for Law Week" throughout
Brazos County. The County Judge then presented the signed
Proclamation to Mr. Ernie Wentrcek, representing the local
Optimist Clubs.
The Court next considered a Performance Agreement for
Sanderson Farms. Brazos County does not enter into a
Performance Agreement with Sanderson Farms but with the
Economic Development Council. Brazos County is protected by
this agreement. No action was necessary on this item.
The Court next considered doctors services in the
Juvenile Detention Center. Ernie Wentrcek, Director of
Juvenile Services, briefed the court on a proposal submitted
by Dr. James F. Cooper M.D. He explained that a supervision
doctor would be needed for the nurses to the inmates in the
juvenile detention facility. The doctor would consult with
the nurses via the telephone and would come in to the
detention center to see the children if necessary, issue
prescriptions and provide a medical examination prior to
children being sent for placement. Cost of services will be
$400.00 per month or $4,800.00 annually. On motion by
Commissioner Cauley, seconded by Commissioner Norton, the
Court voted unanimously to approve the proposal submitted by
Dr. Cooper. A copy of the proposal is attached hereto.
On motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to purchase a Compaq
Prolinea Computer and color monitor for the Treasurer's office

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to table consideration of
the sale of a 1.52 acre tract of land. Commissioner Sims
indicated that this might be delayed because of a current
class action law suit. Commissioner Norton felt the bidders
had waited long enough for this to be finalized. T h e
court next considered awarding the following bid:

submitted by Orange Ford. On motion by
Commissioner Sims, seconded by
Commissioner Norton, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Orange Ford. A budget
amendment would be necessary to augment
the amount currently encumbered for the
purchase.
on motion by the Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to adopt a
resolution authorizing the District Clerk to collect an
additional $50.00 fee to compensate the county for accounting
and administrative expenses incurred in handling trust funds.
This is authorized by Section 117.055(a) of the Local
Government Code. The effective date will be June 1, 1995.
The Court next considered a proposed fee schedule for an
electronic filing system within the District Clerk's office.
In a memo to the Court the District Clerk explained that the
local Bar Association had expressed interest in furnishing a
fax machine to the District Clerk's office for the purpose of
"Fax Filing". Also the local Defense Bar stated that their
organization was contemplating covering the installation costs
of a dedicated telephone line to the fax machine. The
District Clerk went on to explain that the only cost to Brazos

County would be the normal operation costs such as supplies
and maintenance for the fax machine. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court

The Court next
considered authorizing work outside of
county rights-of-way
for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter
the private property of Pat Bond on
Brookwood Lane to clean out a drainage area to allow water to
drain from the road.
On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to
authorize the work.

The next matter
before the Court was consideration of a
request from the Road and Bridge Department for acceptance of
the City of Bryan's cost estimate for the relocation of a

Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to accept the City of Bryan's cost estimate

The Court next considered a request from the Road and
Bridge Department for acceptance of Wickson Creek Special
Utility District's cost estimate for the relocation of
approximately 700 feet of water line in the right-of-way of
Hicks Lane in Precinct 3 for road improvements. The estimated
project cost is $2,000.00. On motion by Commissioner Sims,
is seconded by Commissioner Norton, the Court voted unanimously
to accept the cost estimate for the relocation of

The Court next considered the request from Wickson Creek
Special Utility District to place a road bore in the right-of-
way of Collette Lane. The site is located in Precinct 2. The
County Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Norton,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the request of Wickson Creek Special Utility
District and authorized the installation. A copy of the
request is attached hereto.
On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the County Judge to execute a Tax Resale Deed to Twin City
Mission described as:
Part of Lots 3 thru 5, Block 105, City of Bryan,
Brazos County, Texas
on motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to authorize the County
Judge to execute the a Tax Resale Deed to the following
individuals Herbert Carter and Dorothy L. Carter described as:
Lots 6 and 7, Block 165, City of Bryan, Brazos
County, Texas
The Court next considered Budget Amendment #94/95-16,
which would transfer funds to the Constable Precinct 4 office
for the purchase of a vehicle, transfer funds from contingency
to Juvenile Services and Justice of the Peace Precinct 3, and
from the District Attorney to contingency. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.

CONTRACT FOR SERVICES
THIS CONTRACT AND AGREEMENT is entered into by and between the
parties shown as Contracting Parties.
I. CONTRACTING PARTIES:
The Receiving Party: Brazos County Juvenile Services
("BCJS") 300 East 26th Street
Suite 106, Bryan, Texas 77803
The Performing Party: James F. Cooper, M.D.
1830 Greenfield Plaza
Bryan, Texas 77802
II. STATEMENT OF SERVICES TO BE PERFORMED:
Dr. James F. Cooper agrees to provide the following
physician services to the Brazos County Juvenile Services
Department.
1. Provide telephonic consulting services to support Desert
Hill's nursing services in the Brazos County Juvenile
Detention Center.
2. Upon request by the Desert Hill's nurse Dr. Cooper will
come to the Brazos County Juvenile Detention Center to
determine a child's medical needs, and provide such
medical services that can be performed in the detention
center environment.
3. Prescribe medicines deemed necessary to meet the medical
needs of those children being held in the Brazos County
Juvenile Detention Center.
4. Conduct physical examinations of those children being
sent to contract placement facilities by the Juvenile
Courts of Brazos County.
III. BASIS FOR PAYMENT:
BCJS agrees to make payment to Dr. James F. Cooper at a
monthly rate of $400.00 or $4800.00 annually.
IV. TERMINATION:
Dr. James F. Cooper and BCJS agree that, upon thirty (30)
days written notice to the other party to this contract,
either party may terminate this contract without cause. The
thirty days shall be calculated from the day the notified
party receives the written notification.

V. INTEGRATION CLAUSE:
This contract supersedes any and all other agreements,
either oral or in writing, between the parties with respect
to the subject matter of this contract, and contains all of
the covenants and agreements between the parties with
respect to the subject matter. Each party to this contract
acknowledges that no representations, inducements, promises,
or agreements orally otherwise, have been made by any party,
or anyone acting on behalf of any party, that are not set
forth in this contract, and that no agreement, statement, or
promise not contained in this contract shall be valid or
binding.
VI. PARTIAL INVALIDITY:
If any term or provision of this agreement is held by a
court of competent jurisdiction to be invalid, void, or
unenforceable, the remainder of the provisions of this
agreement shall remain in full force and effect and shall in
no way be affected, impaired, or invalidated.
VII. NOTICE:
Any notice provided for under the terms of this contract by
either party to the other shall be in writing and may be
effected by personal delivery or registered or certified
mail, return receipt requested. Notice to BCJS shall be
sufficient if made or addressed to 300 East 26th Street,
Suite 106, Bryan, Texas, 77803. Notice to Dr. James F.
Cooper shall be sufficient if made or addressed to 1830
Greenfield Plaza, Bryan, Texas, 77802. Each party may change
the address at which notice may be sent to that party by
giving notice of such change to the other party in
accordance with the provisions of this Paragraph.
VIII. FORCE MAJEURE:
In the event that performance by Dr. James F. Cooper of any
of his obligations under the terms of this agreement shall
be interrupted or delayed by an act of God, by acts of war,
riot, or civil commotion, by an act of State, by strikes,
fire, flood, or by the occurrence of any other event beyond
the control of the parties hereto, they shall be excused
from such performance for such period of time as is
reasonably necessary after such occurrence abates for the
effects thereof to have dissipated.

CHOICE OF LAW:
This agreement shall be governed by and construed in
accordance with the laws of the State of Texas.

VENUE:
The obligations and undertakings of each of the parties to
this agreement shall be performed in Brazos County, Texas.
ZI.
ATTORNEY FEES:
If any legal action is brought by either of the parties
hereto, it is expressly agreed that the prevailing party in
such legal action shall be entitled to recover from the
other party reasonable attorney's fees in addition to any
other relief that may be awarded. For the purposes of this
clause, the prevailing party is the party in whose favor
final judgment is entered. In the event that declaratory or
injunctive relief alone is granted, the court may determine
which, if either, of the parties shall be considered to be
the prevailing party. The amount of reasonable attorney's
fees shall be determined by the court, in the trial of such
action or in a separate action brought for that purpose.
Attorney's fees awarded under the provisions of this
paragraph shall be in addition to any other relief that may
be awarded.
ZII.
INTEREST:
Interest will accrue on all sums due or found to be due
under this contract at the rate of the lesser of 18 percent
interest per annum or the highest rate allowed by law. If
judgement shall be rendered on a suit brought under this
contract, interest shall accrue on such judgment, until such
judgment is satisfied, at the rate of the lesser of 18
percent per annum or the highest rate allowed by law.
ZIII.
TERMS OF CONTRACT:
This contract is to begin May 1, 1995 and shall terminate
September 30, 1996.

RESOLUTION:
WHEREAS, Section 117.055(a) of the Local Government Code, allows the county to
be compensated for the aocounting and administrative expenses incurred in handling the trust
funds for the benefit of litigants in civil proceedings; and
WHEREAS, a county may collect from the nonprevailing party in the litigation or from
the party the court designates; and
W RFAS, the court shall designate a fee in an amount set by the commissioners cmirt,
but not to exceed $50.00; and
WHEREAS, this fee is in addition to any fees the district clerk collects as authorized by
statute or court order, and
WHEREAS, funds so Collected shall be deposited by the county treasurer in the general
fund of the county, it is
THEREFORE, RESOLVED by the Commissioners Court of Brazos County, Texas that
the District Clerk of Brazos County, Texas, shall, as authorized by Section 117.055(a) of the
Local Government Code, collect a $50.00 fee when handling a trust fund for the benefit of

Collette Lane In Brazos County, Texas as o ows:
The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and right-of-ways will be repaired to . • .
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.
4. That Brazos County is in no way responsible for any damage that might
occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-of-
way in accordance with governing laws.

6. That the line or lines will be constructed no less than forty-eight inches
(48") lower than the center of the roadway whether there is, or is not, a
borrow ditch.
7. That all sites will be barricaded during the construction period.

BUDGET AMENDMENT(S) FOR THE 1994-1995 BUDGET YEAR

On this the 1st day of May 1995 at a special meeting of the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
• Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;
Mary Ann Ward, County Clerk.
The following proceedings were held:
THAT WHEREAS, on May 1, 1995, the Court heard and approved a
budget amendment for the 1994-1995 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 8,
1994 the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).
ADOPTED AND APPROVED this the lst day of May 1995
