right-of-way of Marino Road approximately 0.8 miles from its intersection with SH 21
for water line installation. Site is located in Precinct 2.
16. Request from Wickson Creek Special Utility District for a proposed road bore in the
right-of-way of Harris Lane approximately 1.2 miles from its intersection with FM 2776
for water line installation. Site is located in Precinct 2.
17. Request from Road & Bridge for acceptance of Wickson Creek Special Utility Districts
cost estimate of 528,750.00 for water line(s) relocation on Elmo Weedon Road. Site is
located in Precinct 3.
18 Preliminary Plat of Carter Lake Acres, 15.20 acres, Thomas Caruthers League, A-9,
College Station. Subdivision site is located in Precinct 1.
19. Request from Fairview Smetana Water Supply for a proposed road bore in the right

APRIL 10, 1995
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, April 10, 1995, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;

Commissioner Norton gave the invocation and led the
pledge of allegiance.
There was no citizen's input/concerns.
The County Judge read aloud a Proclamation designating
the day of April 12, 1995 as "W. D. "Bill" Fitch Day". The
Court joins with the rest of the community in acknowledging
the multitude of accomplishments of Mr. Fitch. On motion by
Commissioner Sims, seconded by Commissioner Cauley the Court
moved to proclaim April 12, 1995 as "W. D. "Bill" Fitch Day"
throughout Brazos County.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held February 6, 1995, February
13, 1995 and February 17, 1995. On motion by Commissioner

Sims, seconded by Commissioner Cauley, the Court voted
unanimously to approve the minutes as submitted.
The Court next considered an order appointing Claude
Davis to sit as Special Judge in County Court at Law II on
s April 17, 1995 to allow Judge Ryan to do take vacation leave.
On motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to approve the order
naming Claude Davis as Special Judge for County Court at Law
II on April 17, 1995. A full copy of the Order is attacheLd to
and made a part of these minutes.
The Court next considered a request from Constable
Precinct 7, Winfred Pittman, for permission to seek adequate
office space within the incorporated city limits of College
Station, which comprise the jurisdictional boundaries of
Justice Precinct 7. On motion by Commissioner Norton,
seconded by Commissioner Cauley, the Court voted unanimously
to. authorize Constable Pittman to seek a new location for
office space within the city limits of College Station and if
necessary the County would retain the services of a real
estate company to assist in locating appropriate space.
No action was taken on the request by Constable Winfred
Pittman, Justice Precinct 7, for the purchase of portable
weight scales.
The Court next considered a Supplement to the Independent
Contractor Agreement with Junction Five-0-Five for an
additional recycling center site location on Silver Hill Road
in Precinct 4. On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the Supplement to the Independent Contractor Agreement in
which the county agrees to pay Junction Five-0-Five One
Thousand One Hundred Eighty Six & 50/100 dollars per month for
the services to be rendered by Junction Five-0-Five at the
site described. A copy of the Supplement is attached.
On motion by Commissioner Cauley, seconded by
Commissioner Norton, the Court voted unanimously to table

consideration of consolidation of the county cash accounts by
the County Auditor. on motion by Commissioner Cauley,
seconded by Commissioner Norton, the Court voted unanimously
to withdraw the motion to table consideration of consolidation
of the county cash accounts and to consolidate all accounts
with the exception of Fund 22, Road and Bridge Capitol
Projects. The accounting of that fund will be determined by
Commissioners Cauley and Norton, Ruth McLeod and Richard
Vance.
On motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to reappoint Commissioner
Randy Sims to the Bryan/College Station Economic Development
Corporation Board of Directors.
The Court next considered acceptance of a cost estimate
submitted by the City of Bryan in the amount of $2,031.99 for
the relocation of a single phase distribution line along Hicks
Lane in Precinct 3. On motion by Commissioner Sims, seconded
by Commissioner Norton, the Court voted unanimously to accept
the cost estimate in the amount of $2,031.99 and to approve
payment thereof.
The Court next considered the request from GTE to place
a road bore in the right-of-way of Edge School House Road.
The site is located in Precinct 2. The County Engineer stated
that all appeared to be in order and recommended approval. on
motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to approve the request of
GTE and authorized the installation. A copy of the request is
attached hereto.
The Court next considered the request from GTE to place
a road bore in the right-of-way of Cliff Road approximately
1140 feet from its intersection with SH21. The site is
located in Precinct 3. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Sims, seconded by Commissioner Cauley, the
Court voted unanimously to approve the request of GTE and

The Court next considered the request from Wickon Creek

that all appeared to be in order and recommended approval. On
motion by Commissioner Walker, seconded by Commissioner Sims,
the Court voted unanimously to approve the request of Wickson

The Court next considered a request from the Road &
Bridge Department for acceptance of a cost estimate of
$28,750.00 from Wickson Creek Special Utility District for the
relocation of water line(s) on Elmo Weedon Road in Precinct 3.
On motion by Commissioner Norton, seconded by commissioner
Cauley, the Court voted unanimously to accept the cost
estimate of $28,750.00 and authorize the payment thereof.
The Court next considered approval of the Preliminary
Plat of Carter Lake Acres in Precinct 1. Richard Vance,
County Engineer, stated that he had reviewed the plat and it
appeared to be in order. On motion by Commissioner Norton,
seconded by Commissioner Cauley, the Court unanimously
approved the Preliminary Plat as submitted.

Smetana Water Supply for a proposed road bore in right-of-way
of West 28th Street approximately 0.3 mile from its inter-
section with SH21 for a water line installation. The site is
in Precinct 4. The County Engineer stated that the line was
in the right-of-way, that all appeared to be in order and
recommended approval. On motion by Commissioner Cauley,
seconded by Commissioner Sims, the Court voted unanimously to
approve the request of Fairview Smetana Water Supply and
authorized the installation. A copy of the request is
attached hereto.
On motion by the County Judge seconded by commissioner
Cauley, the Court voted unanimously to table consideration of
the request submitted by Constable Precinct 2, for the
commissioning of three additional non-paid regular deputy
constables.

Regular Session at the Special Term of the Court, at the
Brazos County Courthouse, in the City of Bryan, Texas,

SUPPLEMENT TO INDEPENDENT CONTRACTOR AGREEMENT
WHEREAS, Brazos County, Texas, acting by and through ;ts duly elected Commissioners

Court (hereinafter "COUNTY") and Junction Five-O-Five, a Texas non-profit corporation
(hereinafter "JUNCTION"), executed a Independent Contract Agreement dated the 17th day of
November 1992 for the establishment and management of recycling centers in Brazros County,
Texas (hereinafter the "Agreement"); and
WHEREAS, it was contemplated by the parties that additional recycling center sites would
be added over time to be operated upon the same terms and conditions set forth in said
Agreement.
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS that for and in consideration
of the mutual conditions and covenants herein set forth the receipt and sufficiency is hereby
acinwwledged, the parties hereto agree as follows:
1. To add to the list of recycling center sites to be operated pursuant to the Agreement
the site(s) described on Exhibit "A: attached hereto and made a part hereof for all
purposes.

2. COUNTY agrees to pay JUNCTION the sum of One thousand one hundred
eighty-sixand 50 /100 Dollars 1,186.50 ) per month for the services to be
rendered by JUNCTION at the site(s) described pursuant hereto and the
Agreement.
In all other respects the terms and conditions of the Agreement remain

TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Texas as follows:
At Edge Community, on FM 974, turn north on Edge School
House Road, go past community building, at second curve,
front of new cattle guard on right, will place a road
bore under Edge School House Road at fence line. At this
point, will be 1174' from next road to left (ped 9).
The location and description of this line and associated
appurtenances is more fully shown by two copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin in March 27, 1995.

Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Texas as follows:
Beginning at a point approximately 1140' southeast of
the function of Hwy 21 and Cliff Road, a road bore
will be made southwest across Cliff Road; buried cable
will be placed through the bore and then will continue
for 25' northwest at 2' within the southwest right-of-way
of Cliff Road. The proposed cable will be placed to a
minimum depth of 30". The bore will be 4' deep.
The location and description of this line and associated
appurtenances is more fully shown by two copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
