COMMISSIONERS' COURT REGULAR MEETING APRIL 3, 1995 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, April 3, 1995, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Sandie Walker, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. D. Schwartz G&K Services Daniel Haily G&K Services Gary Lang G&K Services Commissioner Cauley gave the invocation and led the pledge of allegiance. There was no citizen input and/or concerns. The County Judge read aloud a Proclamation designating the month of April as "Sexual Assault Awareness Month". The voIL :L.pnaF.~1.2- Commissioners Court meeting April 3, 1995 Court joins with the local Brazos County Rape Crisis Center to promote sexual assault awareness and avoidance in the community and to make our community more involved in the " effort to reduce sexual assault. On motion by Commissioner Sims, seconded by Commissioner Norton the Court moved to proclaim the month of April as "Sexual Assault Awareness Month" throughout Brazos County. The County Judge then presented the signed Proclamation to Ms Sherry Hostletler, representing the local Rape Crisis Center. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to adopt a Resolution proclaiming April 2-8, 1995, County Government Week and encouraged all its citizens to become more aware of the history and involved in the future of Brazos County. The next matter for consideration by the Court was a request submitted by the Sheriff requesting approval for out of state travel for Deputy Louis Koronka. Deputy Koronka would be traveling to St. Louis, Missouri to attend a "Triad Training" conference April 27 through the 29, 1995. This is the only seminar of this nature scheduled for this year. On motion by commissioner Norton, seconded by Commissioner Walker, the Court voted unanimously to grant the request from the Sheriff and approved payment of out of state travel expense for Deputy Koronka. d On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to load post Hickory Road and Walnut Road in Holt Hills Subdivision to I 30,000 pounds gross weight. A Public Hearing was held March 27, 1995 for public input relative to the load limiting. The Court next considered a request for the county to j I increase the amount of support to the MPO during the interim ` of reimbursement from the State. Elaine Wray, Director, asked for an additional $10,000.00. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to authorize the increase to the MPO during the I VOL ~ -,.PAOF. ,2/-g Commissioners Court meeting April 3, 1995 interim. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to reinstate the guidelines for Tax Abatement originally adopted March 3, 1992. The Court next considered a request from Constable Precinct 7, Winfred Pittman, to retain the law firm of Youngkin, Catlin, Bryan, Stacy & Dillard in order that they may continue to represent him in a civil suit styled Glpria Montoya vs. Winfred E. Pittman and Beneficial Texas, Inc.. This suite was initially filed in 1992. On motion by Commissioner Norton, seconded by Commissioner Walker, the Court voted unanimously to approve the request of Constable Precinct 7, Winfred Pittman, to retain the law firm of Youngkin, Catlin, Bryan, Stacy & Dillard in order that they may continue to represent him in a civil suit. . The next matter before the Court was a presentation by the Automation Study Committee followed by a request by Computer & Network Services for additional personnel. Commissioner Walker, Chairman, informed the Court that it was the consensus of the committee that an additional two (2) employees were necessary for the C&NS department. One (1) employee could assist with the computers and the other answer the phones. She also suggested creating a steering committee to help departments with their computer needs. On motion by Commissioner Walker, seconded by Commissioner Sims, the Court voted unanimously to authorize the C&NS Department to hire one (1) additional employee to work with the PC's and the Network. Classification for the employee will be pay group 12 step 1 with an annual salary of $24,200.00. On motion by Commissioner Walker, seconded by Commissioner Sims, the Court voted unanimously to contract with Junction 5-0-5 to provide an individual to answer the telephone for the C&NS Department. The County Judge wanted to amend the motion to restrict the temporary position to a two (2) month period but withdrew the V0~ PAO Commissioners Court meeting April 3, 1995 amendment. The Court also wanted a time frame set up for completion of the conversion for the Criminal Justice System. The Court next considered the request from the District Clerk for an additional temporary, full time employee to be responsible for the disposition of all criminal, civil and divorce exhibits. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the request of the District Clerk a temporary, full time position. Classification for the employee will be pay group 4, Step 1 with a salary of $6.21 per hour. The position will be funded until September 30, 1995. The next item for consideration was a request from i Justice of the Peace, Precinct 3, Ray Truelove, for additional personnel. Judge Truelove cited an increase in activity of the Court and that an additional employee would eliminate the need to close the office when both he and the full time clerk are out. Commissioner Walker moved to increase the part time position to full time with benefits and have one employee be certified and serve as a bailiff. Commissioner Norton seconded the motion. Commissioners Cauley, Norton and Walker voted "Aye". Commissioner Sims and the County Judge voted "No". The motion carried. The Court next considered completing a credit application for Eckerd's Pharmacy for juvenile and jail inmates to obtain prescription drugs after Downtown Pharmacy hours. On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to complete the credit application for Eckerd's Pharmacy for prescription drugs and to set the credit limit at $500.00. The Court next considered a financial and accounting software modification from Pentamation. Cost of the modification will be $640.00. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to approve the modification in the amount of $640.00 and to pay for it from the Capital Project Fund. VOL -57 PAGE_ -0 Commissioners Court meeting April 3, 1995 The next matter for consideration was approval to advertise for bids for a vehicle for Constable, Precinct 4, Duane Peters. One Ford agency has a vehicle for ;15,994 but Constable Peters only has $14,000.00 in his budget. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for a vehicle and to amend the Constable Precinct 4 budget should the cost of the vehicle exceed the $14,000.00. The next matter for consideration was the renewal of the Boiler & Machinery Insurance Policy from Arthur J. Gallagher & Company effective April 1, 1995. This year the premium will increase 5% from $3,882.00 to $4,076.00. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to renew the Boiler & Machinery Insurance Policy from Arthur J. Gallagher & Company effective April 1, 1995. The Court next considered awarding the following bid: Bid No. 95-006 - Uniform Rental Contract Cheryl Turney, Purchasing Agent, recommended acceptance of the low bid submitted by Mission Uniform & Linen Company. On motion by Commissioner Norton, seconded by Commissioner Walker, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to mission Uniform & Linen Company. A copy of the bid tabulation is attached hereto. The Court next considered requests by various County departments for the purchase of furniture. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the furniture requests but to delete one (1) right return secretarial desk for the Boot Camp. A copy of the requests is attached hereto. The next matter for consideration by the Court was acceptance of an easement grant conveyed to Brazos County as easement for the purpose of expanding and improving Macey Road in Precinct 2. On motion by Commissioner Walker, seconded by VOt~ ZPAOE~ L . - T Commissioners Court meeting April 3, 1995 Commissioner Norton, the Court voted unanimously to authorize the County Judge to accept the easement grant from Stephen P. Haas and Mary E. Haas for the expansion of Macey Road located in Precinct 2. The next matter for consideration by the Court was acceptance of an easement grant conveyed to Brazos County as easement for the purpose of expanding and improving Macey Road in Precinct 2. On motion by Commissioner Walker, seconded by Commissioner Norton, the Court voted unanimously to authorize the county Judge to accept the easement grant from Caroline Denk McDonald and Caroline McDonald for the expansion of Macey Road located in Precinct 2. The next matter for consideration by the Court was acceptance of an easement grant conveyed to Brazos County as easement for the purpose of expanding and improving Macey Road in Precinct 2. On motion by Commissioner Walker, seconded by Commissioner Norton, the Court voted unanimously to authorize the County Judge to accept the easement grant from Jason Glen Wager and wife Tracy Lynette Wager for the expansion of Macey Road located in Precinct 2. The Court next considered acceptance of a Warranty Deed for right-of-way on Hicks Lane in Precinct 3. On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed for a 2.195 acre tract from Robert L. Carroll, Lamar H. Carroll, Alice C. Josey and Robert T. Carroll for the expansion and improvements to Hicks Lane. The Court next considered the request from Wellborn Water Supply Corporation to place a 2.0" service bore in the right- of-way of North Dowling Road. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Norton, seconded by Commissioner Walker, the Court voted unanimously to approve the request of Wellborn water Supply vOt._~_PAQ~~A " I' Commissioners Court meeting April 3, 1995 Corporation and authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Jason Wager on Macey Road to excavate a 50'x 100' channel easement to allow proper drainage from Macey roadway. The site is located in Precinct 2. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered approval of the Final Plat of Lake Ridge Estates, a private subdivision in Precinct 1. Commissioner Norton wanted the following statement to appear on the plat: "This is a private Subdivision and all streets or roads will be maintained by the developer or the landowners. Brazos County will not be responsible for any road or street maintenance nor drainage maintenance." Commissioner Norton then moved to approve the final plat of Lake Ridge Estates, a private subdivision with the added verbiage included on the final plat. Commissioner Walker seconded the motion and it carried unanimously. The Court next considered approval of the Final Plat of Lots 1-3, Block 1, Trinity Gardens Addition in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court unanimously approved the final plat of Lots 1-3, Block 1, Trinity Gardens Addition in Precinct 1 with the following stipulations: 1) Show 20' utility easement along east and north property boundary 2) Show 10' utility easement along either side of all interior lot lines 3) Number Note 3 The Court next considered approval of the Preliminary Plat of Willow Bend Subdivision located in Precinct 3. On motion by Commissioner Walker, seconded by Commissioner vo PAGE aa3 Commissioners Court meeting April 3, 1995 Cauley, the Court unanimously approved the Preliminary Plat of the Willow Bend Subdivision with the following conditions: 1) Addition of 10' Utility Easement along the northwest boundary of the subdivision 2) Show additional right-of-way dedication dimensions along Hardy Weedon Road and approximate existing Hardy Weedon right- of-way width The Court did not consider item 29 of the agenda. The Final Plat of Lots 1-4, Block 1, Cole Creek Estates, called 15.85 acres, Maria Kegans League, located in Precinct 3. The County Judge stated the following items needed to be considered in workshop session: 1) Juvenile Center 2) Travel Expenses 3) Dues for Professional Services 4) Insurance Company to sell additional insurance to employees The County Judge suggested setting the workshop Session for Thursday, April 13, 1995 at 1:30 p.m.. There being no further business to come before the Court, the meeting was adjourned.
