BRAZOS COUNTY COMMISSIONERS' COURT MEETING
THE COMMLSSIONERS' COURT WILL MEET IN SPECIAL SESSION ON MONDAY,
MARCH 20, 1995 AT 6:30 P.M. IN THE COMMISSIONERS' COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.
1. Invocation - Commissioner Walker.
2. Pledge of Allegiance - Commissioner Walker.
Consider and take action on the following items:
3. Request from County Clerk for permission to bid on hardware equipment Oukebox,
monitor and printer) to facilitate conversion to Optical Disc of microfilm of criminal records.
4. Establish credit limits for all Brazos County VISA card accounts.
5. Establish speed limits on Weedon Loop in Precinct 3 in accordance with Public Hearing
conducted March 13, 1995.
6. The naming of a formerly un-named portion of a road that attaches to Koppe Bridge Road
to Burkhalter Lane in accordance with Public Hearing conducted March 13, 1995. Site is located
in Precinct 1.
7. Budget Amendment No. 94/95-14.
8. Request from Road and Bridge to fund job position currently held by Oliver Fields at
Sheriffs Department supervising inmate crew(s) at county work sites to maintain current man
hours.
9. Authorization for Purchasing Agent to advertise for a vehicle for Constable Duane Peters,
Precinct 4.
10. A Resolution Authorizing Application for Grant to Purchase Juvenile Services for a
revised amount as previously approved in Commissioners' Court on February 13, 1995 and
authorize the County Judge to accept such grant funds.
11. The reappointment of Mr. Hawley West and Mr. Raymond McCallum as Fire
Commissioners to the Brazos County Fire Prevention District #2 Fire Commissioners Board.

13. The Preliminary Plat of Trinity Gardens Addition, Volume 1253, Page 600, 5.00 Acre
Tract in the Thomas Caruthers League, a subdivision located in Precinct 1.
14. The Final Plat of Lots 14, Block 1 Cole Creek Estates, called 15.35 acres, Maria Kegans
League - Abstract No. 28, a subdivision located in Precinct 3.
15. Request from Wickson Creek Special Utility District for water line installation in the
right-of-way of Cole Lane to provide service to county residents. Site is located in Precinct 3.

17. Request from Road and Bridge to enter Tonkaway Ranch located off Tonkaway Lake
Road for the purpose of excavating an outlet channel into the property to drain water from
culverts under Tonkaway Lake Road for the health, safety and welfare of the general public. Site
is located in Precinct 3.
18. Presentation by Jeffrey K. Brown, Attorney at Law, concerning the Activity Report on
Delinquent Tax Collections for the period October 1, 1994 to December 31, 1994.
19. Consider and take action on advertising for bids for Delinquent Tax Collections Attorney
for Brazos County.
20. Consider and take action on the following Tax Resale Deeds and authorization for County
Judge to execute deeds:
a. Lots 2, 2A, 2B, 3 and 3A, Block 1, Thomas Heights Addition to Richard Pena
b. Lots 1, 2 and 3, Block 88, Millican Townsite to John Cheatham and Alta Cheatham.
21. Consider and take action on the:
a. Resignation of R. J. Holmgreen from the B/CS Economic Development Corporation
Board of Directors.
b. Appointment of Judge Alvin W. Jones to the B/CS Economic Development
Corporation Board of Directors.
22. Acknowledge receipt of monthly reports from County Treasurer.
23. Consider and take action on Personnel Changes of Status.
24. Citizen input and/or concerns.
25. Consider and take action on payment of claims.

MARCH 20, 1995
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, March 20, 1995, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1,;
Sandie Walker, Commissioner of Precinct 2;

Commissioner Walker gave the invocation and led the
pledge of allegiance.
The County Judge asked for citizen's input. There was
none.
The first matter before the Court was a request from the
County Clerk for permission to advertise for bids on hardware
equipment when microfilm of criminal records is converted to
an optical disc system. On motion by Commissioner Norton,
seconded by Commissioner Walker, the court voted unanimously
to authorize the Purchasing Agent to advertise for bids on
hardware and software for an optical disc system.

The Court next considered establishing credit limits for
all Brazos County VISA card accounts. On motion by the County
Judge, seconded by Commissioner Sims, the Court voted
unanimously to approve credit limits for the departments
within the county that currently have been authorized the use
of VISA credit cards, as follows:

On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to set the speed limit on
Weedon Loop in Precinct 3 at 45 miles per hour. This is done
in accordance with the Public Hearing held on March 13, 1995.
On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted unanimously to name a
formerly un-named portion of a road that abuts Koppe Bridge
Road to Burkhalter Lane in accordance with a Public Hearing
held March 13, 1995. The site is located in Precinct 1.
The Court next considered Budget Amendment #94/95-14,
which would reallocate funds budgeted for the District
Attorney's Office; increase the Computer and Network Services
Department for maintenance contracts and software rental, and
increase the State Inmate Reimbursement line in the Revenue
Budget. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to approve

the budget amendment as submitted, a copy of which is attached
hereto.
The next matter before the Court was consideration of a
request from the Road and Bridge Department to fund a job
position currently held by Oliver Fields at the Sheriff's
Department supervising inmate work crews at county work sites.
After considerable discussion and on motion by the County
Judge and seconded by Commissioner Sims the Court voted
unanimously to table consideration until the next meeting to
allow the Court to gather more information.
The next matter for consideration was approval to
advertise for bids for a vehicle for Constable Duane Peters,
Precinct 4. The County Judge explained that there was some
confusion over how many cars were authorized for purchase in
the 1994-1995 budget year. Constable Peters explained it was
too late to order a vehicle with a police package and that he
would be willing to wait another year for a vehicle. He went
on to say that because of the delay, he did not want to be
denied his second car for the 1995-1996 budget year. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to encumber the funds for the
purchase of a vehicle for Constable Precinct 4 and to
authorize the Purchasing Agent to advertise for bids for a car
with a police package.
On motion by Commissioner Norton, seconded by
Commissioner Walker, the Court voted unanimously to adopt a
resolution authorizing the County Judge to make application
to the Criminal Justice Division, Office of the Governor, for
grant funds to purchase juvenile services for selected
juvenile offenders and to authorize the County Judge to accept
such grant funds should they be tendered. This resolution
revises the amount of the grant authorization of February 13,
1995.
On motion by Commissioner Walker, seconded by
Commissioner Norton, the Court voted unanimously to reappoint

Commissioners Court meeting March 20, 1995
Mr. Hawley West and Mr. Raymond McCallum as Fire Commissioners
to the Brazos County Fire Prevention District $2 Fire
Commissioners Board. Terms will be for two (2) years
beginning January 1995 and ending December 31, 1996. T h e
Court next considered acceptance of the construction of the
roads and drainage structures in the Sweetwater Subdivision
and the substitution of an Irrevocable Letter of Credit in the
amount of $41,282.80 to serve as a Maintenance Guarantee for
a minimum of two (2) years from August 1, 1994. The
subdivision site is located in Precinct 1. On motion by
Commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to accept the construction of the
roads and drainage structures and the Irrevocable Letter of
Credit from First American Bank for Sweetwater Land
Development Company.
The Court next considered approval of the Preliminary
Plat of Trinity Gardens Addition in Precinct 1. Commissioner
Norton stated that in his view this should be a vacating plat
and a replat. The County Engineer recommended approval
subject to 1) the addition of a 20 foot utility easement
around the perimeter of the subdvision and 2) addition of a 10
foot utility easement along common lot lines. These additions
are to be noted on the final plat. On motion by Commissioner
Norton, seconded by Commissioner Cauley, the Court unanimously
approved the Preliminary Plat of Trinity Gardens Addition in
Precinct 1 with the noted additions.
The Court next considered approval of the Final Plat of
Lots 1-4, Block 1 Cole Creek Estates in Precinct 3. Richard
Vance, County Engineer, recommended acceptance with the
following conditions. 1) add the word "County" to private
subdivision note and 2) add City of Bryan signature lines. On
motion by Commissioner Sims, seconded by Commissioner Norton,
the Court unanimously approved the Final Plat of Lots 1-4,
Block 1 Cole Creek Estates in Precinct 3 with the conditions
previously stated.

The Court next considered the request from Wickson Creek
Special Utility District to install a water line in the right-
of-way of Cole Lane to provide service to county residents.
The site is located in Precinct 3. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Sims, seconded by Commissioner Norton,
the Court voted unanimously to approve the request of Wickson
Creek Special Utility District and authorized the
installation. A copy of the request is attached hereto.
The Court next considered the request from Wickson Creek
Special Utility District to install a water line in the right-
of-way of Cliff Road to provide service to county residents.
The site is located in Precinct 3. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the request of Wickson
Creek Special Utility District and authorized the
installation. A copy of the request is attached hereto.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the Tonkaway Ranch on Tonkaway Lake Road
to clear out an outlet channel to allow water to drain from
culverts under the road. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously
to authorize the work.
The Court next heard a presentation from Jeff Brown,
representative of Calame, Linebarger, Graham and Pefia,
concerning delinquent tax collections for the period of
October 1, 1994 to December 31, 1994.
The Court next considered advertising for bids for a
delinquent tax collections attorney. It was explained that
the court had received a letter from a local attorney offering
to do delinquent tax collection. Commissioner Norton stated

tax attorney is working on this year's delinquent tax suits.
Commissioner Norton then moved to request proposals in
December of 1995. Commissioner Norton amended his motion to
request proposals in August of 1995. Commissioner Sims
seconded the motion and it carried unanimously.
On motion by Commissioner Norton, seconded by
Commissioner Walker, the Court voted unanimously to authorize
the County Judge to execute Tax Resale Deeds to the following
individuals:
Richard Pefia - Lots 2, 2A, 2B, 3 & 3A, Block 1, Thomas
Heights Addition, City of Bryan, Brazos
County, Texas.
and
John Cheatham and Alta Cheatham - Lots 1, 2, and 3, Block
88, Millican Townsite, Brazos County,
Texas
on motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to accept the letter of
resignation from the Bryan-College Station Economic
Development Corporation Board of Directors submitted by R. J.
Holmgreen. On motion by Commissioner Sims, seconded by
Commissioner Walker, the Court voted unanimously to appoint
Alvin W. Jones to the Board of Directors of the Bryan-College
Station Economic Development Corporation.
The Court received, approved and ordered filed as
submitted the Treasurer's report for February 1995. A copy of
which is attached to and made a part of these minutes.

On motion by Commissioner walker, seconded by Commis-
sioner Norton, the Court voted unanimously to approve the
Claims as submitted.
The County Judge had the following comments:
1) Plans and Specifications prepared by
Emmett Trant on the Medium security Jail
are available for viewing
2) Senate Bill 438 - Trucking industry is
being acted upon currently. Commissioner
Norton stated that counties lost this
round with this bill.
3) Travis Bryan, Jr. requested a resolution
on April 12, 1995 declaring Bill Fitch
Day in Brazos County.
4) The County Judge is very concerned about
travel expenses for county employees.
The Judge feels the county should not
exceed amount allowed for state and
federal travel.
There being no further business to come before the Court,
the meeting was adjourned.

THAT WHEREAS, on March 20, 1995, the Court heard and approved

reasonably included in the original budget adopted September 8,

A RESOLUTION AUTHORIZING APPLICATION
FOR GRANT ENTITLED YOUTH DRUG DETECTION &
PREVENTION PROGRAM
WHEREAS, the Governor of Texas, through the Criminal Justice Division,
under the provisions of the Juvenile Justice and Delinquency Prevention Act and
within the authority of the Texas Family Code, has set forth a program to
provide special services for juvenile offenders; and
WHEREAS, in implementing the aforementioned program, the Governor is
making grant funds available for drug detection and prevention programs for
juvenile offenders; and
WHEREAS, the Juvenile Court serving Brazos County has continuing need for
a wide range of services to be provided to selected juveniles.
NOW1 THEREFORE, BE IT RESOLVED BY THE COMMISSIONER'S
COURT OF BRAZOS COUNTY at its meeting on the 13th day of March,
1995, that:
1. The County Judge of Brazos County be authorized to make
application to the Criminal Justice Division, Office of the Governor,
for grant funds to be used for a drug detection and prevention
program for selected juvenile offenders;
2. The County Judge be authorized to accept such grant funds should
they be tendered;
3. This Resolution becomes effective upon its adoption.

The location or description of the proposed installation is more fully shown by
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and right-of-ways will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.
4. That Brazos County is in no way responsible for any damage that might
occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-of-
way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight inches
(48") lower than the center of the roadway whether there is, or is not, a
borrow ditch.
7. That all sites will be barricaded during the construction period.
Construction of this line will begin on or after (date) 27th day of

4. That Brazos County is in no way responsible for any damage that might
occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-of-
way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight inches
(480) lower than the center of the roadway whether there is, or is not, a
borrow ditch.
7. That all sites will be barricaded during the construction period.
Construction of this line will begin on or after (date) 27th day of
March .19 95
