Jones, County Judge, Absent; Gary Norton, Commissioner of Precinct 1; Sandie Walker, Commissioner of Precinct 2, Presiding; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to adopt a resolution endorsing the naming of the prison to be constructed and operated in Brazos County, the J. W. Hamilton unit. A copy of the Resolution will be forwarded to the Texas Board of Criminal Justice and a copy attached hereto. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve payment of $120,260.00 to Emmett Trant and Associates for Architectural VOLPAGE 114, .r I Commissioners Court meeting March 13, 1995 and Engineering Services for the Brazos County Detention Center Addition. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to authorize the County Judge to execute the a Tax Resale Deed to the following individual: Edward Pivonka - Lot 4, Block 1, Korsarek Additon No. 2, City of Bryan, Brazos County, Texas, Less and Except one half of said lot. The next matter before the Court was an amendment to the contract with Junction Five-O-Five to include a provision for mowing at a cost of $50.00 per cycle and a provision for a 5% salary increase for personnel maintaining the sites. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the amendment to the contract with Junction Five-O-Five to include a provision for mowing at a cost of $50.00 per cycle and a provision for a 5% salary increase for personnel maintaining the sites. The Court next considered awarding the following bid: Bid No. 95-011 - Sale of Surplus Furniture Bidder Walter Wilcox Desk $35.00 Chair 1; 5.00 TOTAL $50.00 Cheryl Turney, Purchasing Agent, recom- mended acceptance of the only bid received, that being from Walter Wilcox. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the bid to Walter Wilcox. The Court next considered awarding the following bid: Bid No. 95-005 - Annual Inmate Clothing Contract. Cheryl Turney, Purchasing Agent, recommended acceptance of the bid submitted by the TDC on items 1,4,7, and 8 and to purchase the remaining items individually. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract on items 1,4,7 and VOL.~5' PAGE// 7 Commissioners Court meeting March 13, 1995 8 to the TDC and to go out for bids on the remaining items. A copy of the bid tabulation sheet is attached hereto. The Court next considered adopting a Resolution authorizing application for a grant to support the Youth Drug Detection & Prevention Program that will be administered by the Brazos County Juvenile Services Department. Such grant to be in the total amount of $15,000 and completely funded by the federal government. This is a five (5) year descending grant with no personnel expenses in the grant. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to make application on behalf of Brazos County to the Criminal Justice Division and accept on behalf of Brazos County such grant funds as may be tendered. A copy of the resolution is attached hereto. On motion by commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to approve a request from the Road and Bridge Department to accept a cost estimate submitted by the City of Bryan in the amount of $6,482.59 for a single phase distribution line relocation on the Macey Road project in Precinct 2. This is on the Kopetsky tract only. The Court next considered the request from United Telephone Company of Texas, Inc. for a parallel cable installation in the right-of-way of White Switch Road at its intersection with FM 159 extending for a distance of 268.0 feet in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Norton, seconded by Commissioner Sims, the court voted unanimously to approve the request United Telephone company of Texas, Inc. and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the Resubdivision Plat of Snug Harbor Phase II in the Nantucket Subdivision in Precinct 1. Oi motion by Commissioner Norton, seconded by Commissioner Sims the Court unanimously approved the Resubdivision Plat of Snu, Harbor Phase II in the Nantucket Subdivision in Precinct 1. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Dela Moomey on Broach Road to clear right-of-way to create a better sight distance around a curve. It was noted that the request was not signed by the property owner. On motion by Commissioner Walker, seconded by Commissioner Sims, the Court voted unanimously to authorize the work pending receipt of the property owner's signature. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Carl and Patsy Schaffhauser on FM 1179 to dispose of expired livestock. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The next matter for consideration by the Court was acceptance of an easement grant conveyed to Brazos County as easement for the purpose of expanding and improving Macey Road in Precinct 2. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept the easement grant of 0.387 acre from Don H. Kopetsky and wife Martha Jane Kopetsky for the expansion of Macey Road located in Precinct 2. The Court next heard a presentation by District Attorney, Bill Turner concerning appointed counsel in capital cases. The District Attorney explained that over the last decade Brazos County has had nine capital murder cases pending, five have resulted in executions carried out. Each defendant has been represented by the Texas Resource Center on their appeal. Due to legislation passed in Congress, there is now a law that states all habeas corpus defendants on death row would have appointed legal council through the Federal Courts. This could delay the process for years. In order to expedite the appeals process, the District Attorney asked for permission to approach Judge Delaney to appoint a local attorney to represent Jeff Emery in the appeals court on a death row hearing. Commissioner Sims asked the District Attorney what the cost to the county would be, whereupon the District Attorney stated since this was the first such request he could only estimate at $10,000.00. After considerable discussion, Commissioner Cauley moved to pay for an attorney to expedite the appeals process in the Emery case. Commissioner Walker seconded the motion. Commissioners Cauley, Norton and Walker voted "Aye". Commissioner Sims voted "No". The motion carried. The Court next heard a presentation from representatives of McCord Engineering and Phyllis Dozier on the Brazos Center .Parking and. Area Light1hg Additions. The McCord VOL__c-S,PACE -LA.Q.- Commissioners Court meeting March 13, 1995 representatives gave the members of the Court a cost estimate for the courtyard lighting project and a comparison schedule showing a High Pressure Sodium Lighting System versus a Metal Halide System. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to go out for bids on the designs submitted by McCord Engineering. The Court acknowledged receipt of the Extension Service reports for February 1995 and acknowledged receipt of reports from County and Precinct Offices showing revenues collected and remitted to the County Treasurer. TEXAS RESOLUTION OF THE BRAZOS COUNTY COMMISSIONERS COURT WHEREAS, the Texas Department of Criminal Justice has elected to construct and operate a state prison in Brazos County; and WHEREAS, the Texas Board of Criminal Justice will be selecting a name for this facility at its March meeting and has solicited suggestions from the citizens of Brazos County; and WHEREAS, J. W. Hamilton, Jr. served as Sheriff of Brazos County from January 1, 1947 to August 10, 1978; and WHEREAS, during a distinguished career as Sheriff that exceeded three decades, J. W. Hamilton, Jr. brought to the job a commitment to public service, dedication, and a sense of justice, and WHEREAS, during J. W. Hamilton, Jr.'s tenure as Sheriff, the Brazos County Sheriffs Department enjoyed an excellent reputation due to his leadership and his desire to serve his fellowman; and WHEREAS, as a result of his insistence that his employees further their education, both academically and professionally, many of his staff have gone on to record distinguished careers of their own; and WHEREAS, Sheriff Hamilton, a true gentleman, enforced the law in Brazos County with a sense of fairness and impartiality; THEREFORE BE IT RESOLVED that the Commissioners Court of Brazos County wholeheartedly endorse the naming of the prison in Brazos County the J. March 7, 1995 Al Jones County Judge Brazos County 300 East 26th Street, suite 114 Bryan, Tx 77803-5327 Dear Judge Jones: I am writing concerning the Independent Contractor Agreement between Junction Five-0-Five and Brazos County. which was approved on November 16, 1992. At this time we are managing three (3) collection sites. Up to this point we have Included lawn maintenance as a part of our services. In the original contract, there was no provision for the up-keep and mowing. We are as interested as Brazos County In keeping the sites in good repair and as attractive as we can. The original contract is two (2) years old without a component for the mowing. I would like to propose the following as an amendment to our original contract: 1) A provision for mowing. Usually twelve (12) mowing cycles are sufficient for our roadside park maintenance. I think $50.00 per cycle Is an attractive price considering travel time and weed eating around the fence. This could be paid upon delivery of the service or as an add-on to the monthly charge. 2) 1 would like to see a 5% increase in our monthly charge, so we can give raises to the men who have been manning the sites. A five per cent (5%) raise would make the monthly payment $1,186.50. If the mowing charge was billed per month, the total would be $1,236 50. This contract has proved to be beneficial to our mission of finding employment for people with disabilities and our goals relating to environmental Issues. I think the sites have decreased roadside dumping and they are more attractive than the roll-off dumpsters that were previously used. RECOMMENDATION TD_( q 07 0 g DATE OF AWARD STATE OF TEXAS COUNTY OF BRAZOS A RESOLUTION AUTHORIZING APPLICATION FOR GRANT ENTITLED YOUTH DRUG DETECTION & PREVENTION PROGRAM WHEREAS, the Governor of Texas, through the Criminal Justice Division, under the provisions of the Juvenile Justice and Delinquency Prevention c and within the authority of the Texas Family Code, has set forth a program to provide special services for juvenile offenders; and WHEREAS, in implementing the aforementioned program, the Governor is making grant funds available for drug detection and prevention programs for juvenile offenders; and WHEREAS, the Juvenile Court serving Brazos County has continuing need for a wide range of services to be provided to selected juveniles. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONER'S COURT OF BRAZOS COUNTY at its meeting on the 13th day of March, 1995, that: 1. The County Judge of Brazos County be authorized to make application to the Criminal Justice Division, Office of the Governor, for grant funds to be used for a drug detection and prevention program for selected juvenile offenders; 2. The County Judge be authorized to accept such grant funds should they be tendered; 3. This Resolution becomes effective upon its adoption. Alvin W. Hwy 21 Bryan, TX 77803 Dear Sir: Formal notice is hereby given that the United Telephone Company of Texas, Inc. proposes to install buried communications Cable upon and along the right-of-way of county roads in Rrazn s County, Texas, as follows: IMPROVED ROADS (paved) - The contractor will plow cable in backslope with 8' of right-of-way line. Pipe will be bored under all paved county roads extending from ditch line to ditch line with a minimum cover of 30". IMPROVED ROADS (gravel) - The contractor will plow cable in the backslope of the road, one track of the plow tractor on the backslope the other may come to the shoulder of the road neither whole tractor nor plow will be on the road surface. UNIMPROVED ROADS (dirt) - Same as improved, unless, because of ditches, trees and other terrain features, it is more practical to plow in center of road. In these cases, the cable will be plowed in the center of the road. Not applicable in County. BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be burned or disposed of and not left in the ditch. Rocks brought up by tractor or plow will be disposed of. DEPTH OF CABLE - All cables will be placed at a minimum depth of 30" except where crossing dams or ditches, at which locations the depth of cables will be at a minimum of 36". The following are requirements which are made on the contractor: 1. The plowing equipment shall be subject to the approval of the Engineer and the Public Authorities having jurisdiction over highway and road rights-of-way. 2. The equipment and construction methods used by the contractor shall be such as to cause minimum displacement of the soil. The slot made in the soil by the cable plow shall be closed immediately by driving a vehicle track or wheel over the slot or by other suitable means. 3. Damage to banks. ditches, driveways, and roads caused by the equipment shall be immediately repaired to the satisfaction of the Engineer and Public Authorities having jurisdiction over highway and road right-of- way where involved. a. Trenches shall be promptly back-filled with earth. and mechanically tamped at six (6) inch 14fts so that the earth is restored to original grade to assure no hazard to vehicular, animal or pedestrian traffic. No trenches shall be left open overnight. 5. The usual 10% fees withheld from contractor until repairs are made satisfactory with Engineer and Public Authorities having jurisdiction of right-of-way involved. o VOL S'- PAQE1,~ r," 0►I x „ T WO 3605 97M3 ; Rra~p~ County will not be held liable at any future date for accidental damages to the buried cable plant by road working equipment such as maintainers, hole diggers, etc. In the event of such damages the Telephone Company will be notifited immediately. The County Commissioners Court may require the owners to relocate this line, for valid reasons under the law, by giving thirty (30) days written notice. a. Where communication facilities are located on county road ROW the Telephone Company will relocate said facilities at no expense to the County. b. Where communication facilities are located on private property the County will reimburse the Telephone Company for the relocation of said facilities. At any place where a communications line crosses over a county road, it shall be constructed and maintained at least eighteen (18) feet above the surface of the traffic lane. Please notify Joe E. "Jody" Smith forty-eight (48) hours prior to starting construction of the line, in order that a representative may be present. The locations of the proposed lines are more fully shown by the copies attached to this notice. Construction of this line will begin on or after the _1A_ day of April 1925..
