VOL 6 PACE ~D3 COMMISSIONERS' COURT SPECIAL MEETING MARCH 6, 1995 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, March 6, 1995, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1, Absent; Sandie Walker, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3, Absent; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The court first heard from Mr. Bob Pavlinski, Human Resources Technician with JES Employment Services. Mr. Pavlinski informed the Court that he was working with the Sheriff's Department on a program to reduce the cost for training new employees. The program will reimburse the County or a period of time that select employees are trained. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to appoint Marselaine Clarke to continue for a two year term as a Board VO S PAG~`,~ mnissioners Court meeting March 6, 1995 Trustee member of Mental Health Mental Retardation thority of Brazos Valley. The appointment is for a two year rm, beginning March 1, 1995 and ending March 1, 1997. The next matter before the Court was consideration of a me change for the Data Processing Department. In a memo the to Processing Manager stated she would like to change the me to Computer and Network Services (CNS) because the name descriptive of the current and future role of the department. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to approve the request of the Manager of Data Processing and authorize the name change to Computer and Network Services (CNS). The Court next considered a request from the County Attorney for VISA cards for three divisions of his department. Commissioner Walker asked who would be responsible for the card. The County Attorney answered that first the employee whose name is on the card, second Julie Ramirez of his office and third the Commissioners Court. On motion by the County Judge, seconded by Commissioner Walker, the Court voted unanimously to authorize the County Attorney to have eight (8) VISA credit cards for his department. The Court next considered entering into an Interlocal Agreement to purchase materials and supplies from Texas A&M University Procurement and Material Services as authorized by the Interlocal Cooperation Act. V.T.C.A. Government Code Chapter 791. This will allow the County to obtain the best purchase price on materials and supplies. on motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to enter into an Interlocal Agreement to purchase materials and supplies from Texas A&M University Procurement and Material Services. The Court next considered entering into an Interlocal Agreement to with the City of Bryan, City of College Station and any other public entity for the sale at auction of equipment and materials at a prorated cost of advertising and V4 S PAC3E,S Commissioners Court meeting March 6, 1995 commission as authorized by the Interlocal Cooperation act. V.T.C.A. Government Code Chapter 791. This will allow the County to obtain the best possible price for the sale at auction surplus equipment and materials. On motion by Commissioner Cauley, seconded by Commissioner Walker, the Court voted unanimously to enter into an Interlocal Agreement to with the City of Bryan, City of College Station and any other public entity for the sale at auction on June 17, 1995 of equipment and materials at a prorated cost of advertising and commission. On motion by Commissioner Walker, seconded by commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Blankenship. The Court next considered approval of the Preliminary Plat of Lots 1-4 of Cole Creek Estates in Precinct 3. Don Garrett, Engineer, informed the Court that the property is two hundred feet inside the Bryan ETJ. The City of Bryan has requested a letter from the County stating that the County will not require the private access road (Deer Creek Road) to be brought up to County standards. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court unanimously approved the Preliminary Plat of Lots 1-4 of Cole Creek Estates with the stipulation that Commissioner Sims draft a letter to the City of Bryan stating the County will not require Deer Creek Road be brought up to County standards. The Court next considered load posting Hickory Road and Walnut Road in Holt Hills Subdivision in Precinct 1 at 30,000 lbs. gross weight. The Court was informed that a Public Hearing was required before this action could be taken. On motion by Commissioner Cauley, seconded by Commissioner Walker, the Court voted unanimously to hold a Public Hearing on March 27, 1995 at 11:00 a.m. to consider load posting Hickory Road and Walnut Road in Holt Hills Subdivision in Precinct 1 at 30,000 lbs. gross weight. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to advertise for bids on Janitorial supplies. The County Judge asked the head of the Maintenance Department what supplies cost, at which Mr. Dobbins answered between $21,000 and $23,000 annually. A copy of the Resolution is attached hereto and a copy will be forwarded to the State 9 Representative and Senator. i On motion by Commissioner Walker, seconded by the County Judge, the Court voted unanimously to adopt a resolution supporting the passage of Senate Bill 411 and House Bill 175 to help alleviate the problems that exist in the Whistleblowers Act. Commissioner Cauley stated that he had looked at the issues on behalf of the individual and urged caution by elected officials in this respect. He did not want employees unduly punished if they report a situation. A copy of the Resolution is attached hereto and a copy will be forwarded to the State Representative and Senator. The Court received, approved and ordered filed as submitted the Treasurer's report for February 1995. A copy of which is attached to and made a part of these minutes. The Court proceeded to consider the change of status of the following employees. Government Code Chapter 791, to enter into joint contracts and agreements for the performance of governmental functions and services including administrative functions normally associated with the operation of goverment such as purchasing of necessary materials and supplies; WHEREAS, it is the desire of the aforesaid participating governments to comply with and fiuther the policies and purposes of the Interlocal Cooperation Act; WHEREAS, the participating governments cannot normally obtain the best possible purchase price for materials and supplies acting individually and without cooperation; and WHEREAS, it is deemed in the best interest of all participating governments that said governments do enter into a mutually satisfactory agreement for the purchase of materials and supplies for the year 1995; NOW, THEREFORE, the parties hereto, in consideration of the mutual covenants and conditions contained herein, promise and agree as to each of the other parties and as to all of the parties as follows: 1. Texas A&M University shall be responsible for all such administrative duties as may be necessary to lawfully facilitate processing and preparation of any bids as may be required for the purchase of any commodity provided, 2. Brazos County shall pay by invoice on a cost recovery basis the cost of any items purchased through the Texas A&M Procurement and Material Services. 3. Nothing in this agreement shall prevent Brazos County from purchasing and/or accepting and awarding bids for commodities subject to this agreement on its own behalf. All items provided for the sale are owned by the participating entity and each entity is responsible for goods before, during, and after the sale. Any unsold items shall be removed from Brazos County property promptly. 4. Auctioneer shall be responsible for payment to each participating entity for goods sold and monies collected, less all listed expenses and fees, within seven banking days of stated auction date.
