Consider and take action on Resolution regarding the adoption of a Flexible Benefit Plan for Brazos County. 6. Consider and take action on the offering of PCA Health Plan. 7. Consider and take action on the disposition of various equipment of the Road and Bridge Department. 8. Consider and take action on request from GTE Southwest to install communication line in county right-of-way of Peach Creek Cut Off Road in Precinct 1. 9. Consider and take action on request from Wellborn Water Supply Corporation to install water lines in the following county rights-of-ways in Precinct 1. a. South Dowling Road b. Robin Drive 10. To slake arrangements call (409)361-4102. • f i i i ~i k f i' t E COMMISSIONERS' COURT SPECIAL MEETING AUGUST 1, 1994 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, August 1, 1994, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1, Absent; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Executive Assistant Carol Palmer Admin. Asst. to County Judge Bea Green Secretary to Commissioners John Reynolds Auditor Cheryl Turney Auditor's Office Sandie Walker Treasurer Richard Vance County Engineer Ernie Wentrcek Juvenile Services Sean Frerking Bryan/College Station Eagle Cindy Patrick Health For All Phyllis Fahlquist LWV Commissioner Sims gave the invocation and led the pledge of allegiance. The first matter before the Court was to consider hiring Robert R. Eisenbeck, Consulting Engineers to evaluate the findings of the Texas Department of Health in reference to the quality of air in the courthouse and make recommendations to correct any problems. Commissioner Sims asked how much this would cost at which the Judge answered that it would be negotiated. Commissioner Wilcox asked what other companies were considered. The County Judge informed him that the firm came highly recgmmended. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to negotiate a contract for services and return to court to consider the cost. The next matter for consideration was the recommendation of the committee for the new Juvenile Detention Facility. • • f z i r r 'r 3 Commissioners Court meeting August 1, 1994 Commissioner Sims reported on the selection procoss and recommended that the Court enter into negotiation for a contract with Cox/Croslin and Associates for the construction of the new Juvenile Detention Facility and to name the firm of Holster and Associates as the alternate selection. Commissioner Sims then made the motion. The County Judge seconded the motion and the court voted unanimously to enter into negotiation for a contract with Cox/Croslin and Associates for the construction of the new Juvenile Detention Facility and to name the firm of Holster and Associates as the alternate selection. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to adopt a resolution adopting a Flexible Benefit Plan for the benefit of Brazos County employees. The current Flexible Benefit Plan will cover a "Short" period from September 1, 1994 to December 31, 1994. The regular plan period will cover the year January 1, 1995 to December 31, 1995. Judge Holmgreen, acting on behalf of Brazos County will be authorized to sign agreements necessary to continue the Brazos County Flexible Benefits Plan. A copy of the Resolution is attached hereto. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to no longer offer the PCA Health Plan to Brazos County Employees. Currently only twelve (12) employees are on the plan and no mandate has been submitted by PCA to continue offering coverage. The Court next considered the disposition of various pieces of equipment from the Road and Bridge Department. On motion by Commissioner Sims, seconded by commissioner Wilcox, the Court voted unanimously to dispose of the following pieces of equipment with the exception of the Fujitsu Mobile Radio. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve the request of GTE Southwest and authorized the installation. A copy of the request is attached hereto. The Court next considered the two requests from Wellborn Water Supply Corporation. The first was to place a 2 inch service bore in the right-of-way of South Dowling Road at its intersection with Country Meadows for water line installation. The second to place a 2 inch service bore in the right-of-way of Robin Drive for water line installation. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval of both requests. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve the requests of Wellborn Water Supply Corporation and authorized the installation. A copy of each request is attached hereto. The Court next considered two requests from Ferguson Burleson County Gas Gathering System. The first was for a proposed road bore in the right-of-way of Old Highway 6 i 1 . ■ f • • . S i r 1 i • } Commissioners Court meeting August 1, 1994 approximately 500 feet south of its intersection with White Switch Road. The site is located in Precinct 1. Included with the request is company check 14438 in the amount of $500.00. The second request was for to three (3) road bores in the right-of-way of White Switch Road. The road bores are approximately 1.35 miles, 1.85 miles and 2.65 miles south of the intersection of White Switch Road and F.M. 2154.' The sites are located in Precinct 1. Included with the request is company check 14437 in the amount of $1,500.00. The County Engineer stated that all appeared to be in order and recommended approval of both requests. On motion by commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve the requests of Ferguson Burleson County Gas Gathering System and authorized the installations. A copy of each request is attached hereto. The next matter for consideration by the Court was a written request submitted by John Delaney, Judge of the 272nd • District Court, requesting approval for out of state travel for himself. Judge Delaney would be traveling to New Orleans, Louisiana to attend a meeting of the Judicial Administration Division of the American Bar Association during the week of August 2 through the 10, 1994. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to grant the request from the District Judge and approved payment of out of state travel expense for Judge Delaney. WHEREAS, the Commissioners' Court of Brazos County, Texas recognizes that continued participation in a Flexible Benefit Plan, as amended September 1, 1991, will benefit both the County and its employees; and, WHEREAS, the Commissioners' Court wishes to furnish Brazos County employees with the opportunity to receive certain nontaxable benefits provided by Brazos County in lieu of taxable compensations; and, WHEREAS, it is the intention of Brazos County that the plan be continued and will qualify as a "Cafeteria Plan" as that term is defined in Section 125(d) of the Internal Revenue Code of 1986 (as amended); and, WHEREAS, Brazos County will take all necessary actions to insure that this plan, in operation shall, at all times, qualify as a "Cafeteria Plan" within the meaning and requirements of Section 125 of the Internal Revenue Code; and, WHEREAS, the current Flexible Benefit Plan will cover the "short year" period September 1, 1994 to December 31. 1994. Additionally, the "regular plan" period will cover the year January 1 to December 31, 1995; NOW, THEREFORE BE IT RESOLVED, by the Commissioner's Court of Brazos County, Texas at its meeting on the 1st day of August, 1994 that: The County Judge of Brazos County, acting on behalf of Brazos County be authorized to sign agreements necessary to continue the Brazos County Flexible Benefits Plan. Construction shall he strict conformance to the latest Texas Manual on Uniform Traffic Control Devices for Streets and Highways, published by the Texas Department of Transportation, and all other State and Federal laws governing utility construction. Box 10006 Road: Old Hwy 6 College Station, Texas 77842-0006 Precinct No.: I t • r Formal notice is hereby given that (Applicant) Ferguson-Burleson County Gas Gathering System proposes to place a (type) 1036" O.D pipeline within the right- of-way of (road) Old Hwy 6 in Brazos County, Texas as follows: The location or description of the proposed Installation Is more fully shown by _.L copies of the drawings attached to this notice. 1. The County Engineer must he notified prior to the beginning of construction in order that they might he on hand to designate the actual location of the installation. 2. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the County Engineer. 3. That BRAZOS COUNTY reserves the right to require Applicant to relocate or lower any such line at no cost to BRAZOS COUNTY, should same become necessary due to widening or lowering, or other alteration of the roadway or right-of-way. 4. That BRAZOS COUNTY is in no way responsible for any damage that might occur to any existing utility lines in the right-of-way. 5. That the line will be constructed and maintained on the county right- of-way in accordance with governing laws. 6. That the line or lines will be constructed no less than forty-eight inches (48') lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway. 7. That all roads be bored to forty feet (40') on either side of the centerline of the right-of- way or cased for such distance. 8. That all sites will be barricaded during construction period. 9. That the normal charge is $500 per crossing and/or $40 per rod when paralleling the roadway established by the Commissioners' Court on January 28, 1985. 10. Ditch line shall be compacted to 90% standard density ASTM-Teat method No. D-698; test shall be conducted by an independent Geotechnical testing firm; copies of all test results shall be furnished to the office of the Brazos County Engineer. ll. Construction shall be strict conformance to the latest Texas Manual on Uniform Traffic Control Devices for Streets and Highways, published by the Texas Department of Transportation, and all other State and Federal laws governing utility construction. Construction of this line will begin on or after (dale) July 15. 1994.
