County, Texas was held in the Commissioners' Courtroom in the 4 Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, July 5, 1994, with the following members of i the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1, Absent; Walter Wilcox, Commissioner of Precinct 2, Absent; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The first matter before the Court was a request from Dale Fritz, District Director, to appoint' Greg Kaase as the new County Agent 4-H to fill the vacancy left by Greg Byer. Brazos County's portion of the salary will be $7,480.00. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to appoint Greg Kaase as the new County Agent. 4 The court next considered Budget Amendment 1493/94-21, f1 which would reallocate funds budgeted for the Road and Bridge i' Department, Justices of the Peace Precinct 3 and Precinct 7 i s Place 2 and transfer funds from the Non Departmental Depar- tment the Jail. On motion by Commissioner Sims, seconded by t n } 1 4 I Im t r I I f F t~ i Commissioner Turner, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to approve Change Order I to the contract between Dinosaur Construction and Brazos County for the Brazos County Emergency Medium Security Facility in the amount of $4,827.63. A copy of Change Order I is attached hereto. The Court next considered Change Order I to the contract between Elliott Construction, Inc. and Brazos County for the Brazos County/Wellborn W.S.C. Cawthon Water Service Project. This Change Order is merely for wording on the contract with no increase to the cost of the contract. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve Change Order I to the contract between Elliott Construction, Inc. and Brazos County for the Brazos County/Wellborn W.S.C. Cawthon Water Service Project. A copy of Change Order I is attached hereto. The Court next considered an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(7)(A). This is for the excavation and water line adjustment services by Wickson Creek Special Utility District on Grassbur Road. The Commissioners Court determined that this service can only be obtained from one source. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements and authorized the payment in the amount of $15,480.00. The Court next considered an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(2). This is for the purchase of fire alarm and television installation services for the medium security jail from College Station Elec, Inc.. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the Exemption of Competitive Bidding 0 • • • Requirements and authorized the payment invoice numbers 9407- TV, 9407-PH and 9407-FA in the amount of $4,639.55. The Court next considered the request from GTE Southwest to place a buried cable and replace a GTE pedestal An the right-of-way of Greens Prairie Road beginning at its intersection with Woodlake Drive for a distance of 1,696.0 feet. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to approve the request of GTE Southwest and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from Aquila Southwest Pipeline Corporation for two road bores in the right-of-way of Greens Prairie Road approximately 9,340.0 feet from its intersection with Arrington Road for natural gas line installation(s). The site is located in Precinct 1. Included with the request is company check #018846 in the amount of $1,00.00. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Aquila Southwest Pipeline Corporation and authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of county rights-of-ways for the enhancement of county road projects. The Road and Bridge Department requested permission to enter the private property of William Gray on old Bundick Road to remove a tree leaning out over the county right-of- way. On motion by Commissioner Sims, seconded by Commissioner Turner, the Court voted unanimously to authorize the work. The next matter for consideration by the Court was acceptance of an easement grant conveyed to Brazos County as easement for the purpose of expanding and improving Nichols Roadway in Precinct 2. Richard Vance, County Engineer, stated that he had reviewed the plat and it appeared to be in order. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court unanimously approved the re-plat of a remainder of Tract No. 19 Porterfield/Watson Subdivision Phase II. The Court proceeded to consider the change of status of the following employees. Notwithstanding anything else contained with this contract the Contractor shall indemnify, hold harmless, and defend the Owner, its agents, servants, employees, representatives. officers, and engineer from and against any and all claims or liability or alleged claims or liability made by any person, firm, or entity including but not limited to, claims of liability or liability without fault and claims of liability or liability by virtue of the obligations that the Contractor assumes toward its indemnitee(s), arising from or claimed to have arisen from or incidental to the work to be performed hereunder and including cost of suit, attorneys' fees, all other related costs, damages, judgements and expenses or whatever kind or character arising directly or indirectly from any cause whatsoever in connection with or incidental to this contract and the Work to be performed hereunder. Notwithstanding the foregoing. Contractor specifically agrees to so indemnify, hold harmless, and defend the Owner, its agents, servants, employees, representations, officers and engineers from and against any and all such liability, suits, action, legal proceeding, damages of judgments, or demands that may be made or pursued by an agent, servant, representative, employee of the Contractor, or of any subcontractor, or materialman, or any person entity or anyone acting on behalf of the Contractor in connection with or incidental to this Contract which are alleged to be attributable to any condition existing at the worksite or arising out of the Work. The Contractor agrees to waive any and all claims it may have against the Owner resulting form or arising out of claims and claims co%,cred by this indemnity agreement and agrees that any insurance carrier shall not be entitled to subrogation under any circumstances against the Owner, its agents, servants, representatives, officers, employees, and engineers. 2. Contractor agrees to provide, at the time of the execution of this Contract, a Certificate of Incumbency and a Corporate Resolution authorizing certain named officers to execute this Contract on behalf of the Contractor. 3. Notwithstanding anything herein to the contrary, Contractor agrees to look only to the engineering firm of Duff Consulting Engineers, Inc. for any additional compensation due and owing to the Contractor for extra %vork required as a result of errors in the calculations of the ground elevations, contour lines, or benchmarks, premised on certified survey data made prior to the time the original disturbing of the ground clearly showing the errors in calculation existing which resulted or would have resulted in the extra work for which additional compensation is being requested. 4. Notwithstanding anything herein to the contrary, Contractor agrees to look only to the engineering firm of Duff Consulting Engineers, Inc. for any additional compensation due and owing Contractor for extra work required as a result of a discrepancy between drawings and maps prepared by Duff Consulting Engineers, Inc. and actual conditions on•the ground. 5. A GENERAL TELEPHONE NOTICE OF COMMUNICATION COMPANY LINE INSTALLATION June 17, 1994 r i E l M r F TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY ATTENTION COUNTY JUDGE: Formal notice is hereby givon that GTE will construct a communication line within the right-of-way of a County Road in Brazos County, Texas as follows: Beginning at the intersection of Greens Prairie Road and Woodlake Drive, we propose to replace an existing GTE pedestal with a 4x8x4 handhole within Southeast ROW of Greens Prairie Road. We propose to place a buried line along, parallel to and 5 feet inside of the Southeast ROW a distance of 1696 feet within the Northeast ROW. The location and description of this line and associated appurtenances is more fully shown by four copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is , expressly understood that tender of this notice by GTE does not constitute a waiver, surrender, abandonment or impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so con- strued shall be null and void. That the normal charge is $500.00 per crossing and/or $40.00 per rod when paralleling the roadway established by the Commissioners' Court on January 28, 1985. 10. Ditch I:ne shall be compacted to 90% standard density ASTM-Test method No. D-698; test shall be conducted by an independent Geotechnical testing firm; copies of all test results shall bo furnished to the office of the Brazos County Engineer. 11. Construction shall be In strict conformance to the latest Texas Manual on Uniform Traffic Control Devices for Streets and Highways, published by the Texas Department of Transportation, and all other State and Federal laws governing utility construction.
