Adjourn. 1 1 . • -i r~ u , 1 i F a COMMISSIONERS' COURT REGULAR MEETING JUNE 13, 1994 r 1 r • a pe ti 41 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, June 13, 1994, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Executive Assistant Bea Green secretary to Commissioners Cheryl Turney Auditor's Office John Reynolds Auditor Sandie Walker Treasurer Richard Vance County Engineer Linda Bayer Sheriff's Office Johnny Burkhalter Jail Administrator Phyllis Fahlquist LWV Bill Anderson Brazos County Resident Commissioner Sims gave the invocation and led the pledge of allegiance. The Court next considered Budget Amendment $93/94-18, which would reallocate funds budgeted for the Road & Bridge Department and the Sheriff's Office, transfer funds from the Non Departmental department and the Sheriff's Office to the jail and increase the budget of the Jail to comply with SB 57. *On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered renewal of a lease agreement between Brazos County and the Junior League for rental of space -in the Brazos Center located at 3232 Briarcrest, in Bryan, Texas. Term of the lease is for the period of one year commencing on June 1, 1994 and ending on May 31, 1995. A copy of the lease agreement is attached. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to approve the request of Constable Precinct 7 Winfred Pittman to forego the repair of the 1992 Ford Crown Victoria which was wrecked on May 31, 1994. This vehicle will be put up for auction. The Court next considered the appointment of Walter Odom as MHMR's Chairperson for Public Responsibility Committee (PRC). This position is not a part of the MHMR Board of Directors but is part of an over site committee that is required by law to monitor the MHMR. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to appoint Walter Odom as MHMR's Chairperson for Public Responsibility Committee (PRC). The next matter for consideration was the selection of a committee to review and select an Architect/Engineer for the Juvenile Detention Facility. On motion by the County Judge, seconded by Commissioner Turner, the Court voted unanimously to appoint Commissioners Norton and Sims and Ernie Wentrcek, Director of Juvenile Services, to the committee. The Court next considered the request from Aquila Southwest Pipeline Corporation to place two (2) road bores in the right-of-way of Old Highway 6 approximately 5,800.0 feet from its intersection with White Switch Road in Precinct 1. Included with the request is company check #018750 in the amount of $1,000.00. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Aquila Southwest Pipeline Corporation and authorized the installation. A copy of the request is attached hereto. TO DEPT BUDGET $0 i _ 825 Staffing t 3 i ` Commissioners Court meeting June 13, 1994 gam' . • h STATE OF TEXAS COUNTY OF BRAZOS • • u x-_ This agreement between BRAZOS COUNTY, TEXAS, hereinafter called Lessor, and JUNIOR LEAGUE OF BRYAWICOLLKGE BTATZON, hereinafter called Lessee, is made as follows Lessor, the owner of the Brazos Center, a multi-use building and the adjacent grounds has agreed and does hereby agree, to lease and demise unto Lessee, a portion of the Brazos Center, hereinafter described, upon the following terms and conditions. 1. Lessee shall be entitled to the space exclusively allocated to it by the Director of the Center for a term extending from June 1, 1991 until May 31, 1995. The space allocated to Lessee is described in Attachment •A• hereto attached, which has been signed by the Director of the Center. 2. Zn addition, fees for temporary use of space required for provisional, membership and board of directors meetings are included in this contract as well as space for the League Placement Fair and space occupied by two storage cabinets in the Brazos Center receiving area. All meetings held in other than League office space should be scheduled as far in advance as possible on a space available basis. 3. Fees for meetings involving small spaces for puppet show practice as well as for committee meetings are also covered in this contract provided the following conditions prevails a. meetings in small rooms are to be held only during normal business hours or after 5 p.m. when another activity is scheduled requiring a Brazos Center attendant to be on the premises; b. Zf the space used for the meeting has been previously set-up for a meeting scheduled at a later time by another group, the committee chairman will be responsible for determining that the room is in the exact state as when the room was entered; c. The committee chairman should give the Brazos Center office a notice of intention to meet no leas than one week in advance. d. Zn consideration therefore, Lessee agrees to pay the Lessor, on the first day of each calendar month during the term hereof, in advance, the sum of $323.00 (five hundred and twenty-five dollars) for rental of exclusively occupied space as well as for fees assessed for space for temporary uses described above. Zn addition, Lessee has permission for free use of Assembly Z, Assembly ZZZ and/or Assembly ZV for two six-hour periods as scheduled in advance with the Brazos Center. Additional uses of Assembly Z, Assembly ZZZ and/or Assembly ZV for membership meetings may be scheduled on a first-come, first-serve basis for $30 per day for each space. 3. Additional charges may be made for activities other than those specified in this contract. Lessee will pay the regular User fees for space used by it, other than space allocated to it under this agreement. 6. A. Lessor shall furnish all utilities, including gas, water and electricity. B. Lessee shall furnish telephone and answering service for itself. 7. Lessor does not provide and will not provide furnishings, custodial care, or maintenance of the space allocated to Lessee under this agreement. 8. Lessee shall take good care of the space allocated to it, reasonable wear and tear only excepted, and shall surrender the premises at the termination of this agreement. 9. Lessee agrees that no Improvements to or alteirstions to the space shall be made without the consent of Lessor in writing. 10. Risk or loss of all property owned by Lessee shall remain with Lessee, it being understood that Lessor will maintain no insurance on such property. Any insurance desired by Lessee on Lessee's property shall be purchased by Lessee at its expense. 11. Lessor shall not be liable to Lessee or the Lessee's employees for dny damage to person or property caused by the negligent act of Lessor, its agent, servants, or employees or due to the act of any other tenant in the building, or due to any detect or want of repair In any part of the building of which the allocated space forms a part. Lessee agrees to hold Lessor harmless from any and all claims, damages, expenses, including attorney's tees, growing out of or arising from any negligent act on the part of Lessee, its agents, servants or employees. 13. No sign shall be placed at, or on, or about the premises by Losses except with the approval of the Center Director in writing. 14. Lessee president, as designated below right, shall be issued only one key to the office allocated space and one key to storage closet space.
