Y A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
1 Courthouse in Bryan, Brazos County, Texas, beginning at 9:00

Commissioner Sims gave the invocation and led the pledge

of allegiance.
y The Court next considered Budget Amendment $93/94-16,
a
which would increase the funds budgeted for the Commissioners
office and the office of Constable Precinct 7. Constable
Pittman was questioned on the condition of the vehicle needing
repair. On motion by Commissioner Turner, seconded by
i
Commissioner Norton, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto. a
The next matter for consideration by the Court was a
written request submitted by the District Attorney requesting
Attorney Deena McConnell. Ms. McConnell would be traveling to
San Francisco, California to attend the Association of

Government Attorneys in Capital Litigation seminar during the
week of July 27 through the 30, 1994. On motion by
commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to grant the request from the District
Attorney and approved payment of out of state travel expense
for Ms. Deena McConnell.
The Court next considered acceptance of a Warranty Deed
for right-of-way on Grassbur Road in Precinct 3. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to authorize the County Judge to accept on
behalf of Brazos County a Warranty Deed from L. A. Ford, Jr.
and Sandra K. Ford for the expansion of Grassbur Road.
The next matter for consideration by the Court was
acceptance of two easement grants for the improvement of two
county roads. One easement grant James Edward Rumfield and
Brenda J. Rumfield on the expansion of Macey Road in Precinct
2 and one easement grant from Gordon W. Brumbaugh and wife
Lois J. Brumbaugh on the expansion of Stousland Road located
in Precinct 1. On motion by Commissioner Wilcox, seconded by
Commissioner Norton, the Court voted unanimously to accept the
easement grants from James Edward Rumfield and Brenda J.
Rumfield on the expansion of Macey Road in Precinct 2 and
Gordon W. Brumbaugh and wife Lois J. Brumbaugh on the
expansion of Stousland Road located in Precinct 1.
The Court next considered three requests from Wickson
Creek Special Utility District. The first, to install a water
line in the right-of-way of Fawn Lake Drive in Precinct 2.
The second, to place a road bore in the right-of-way of Dilly
Shaw Tap Road approximately 0.9 mile from its intersection
with FM 2776 for water line installation. The site is in

Precinct 2. The third, is to place four (4) road bores in the
rights-of-way of Waterway Drive and Royal Oaks Drive for water
line installations. The site is Precinct 3. The County
Engineer stated that all appeared to be in order and

recommended approval. On motion by Commissioner Sims,
seconded by Commissioner Wilcox, the Court voted unanimously
to approve all the requests of Wickson Creek Special Utility
District and authorized the installations. A copy of each
request is attached hereto.
The Court next considered approval of the Final Plat of
Spencer's Cove Subdivision in Precinct 1. Richard Vance,
County Engineer, stated that he had reviewed the plat and it
appeared to be in order. Commissioner Norton asked for the
final Engineer's Analysis prior to signing the plat. On
motion by Commissioner Norton, seconded by Commissioner
Wilcox, the Court unanimously approved the final plat of
Spencer's Cove Subdivision with the stipulation noted.
The Court next considered authorizing work outside of
county rights-of-way for the enhancement of county road
projects. The first request was for permission to enter the
private property of Homer L. Rice on Homer Rice Road to clear
brush from the intersection of Homer Rice Road and Allen Road
(a' blind corner) to create a better sight distance for
motorists. The site is in Precinct 4. The second request was
for permission to enter the private property of Vince Court
located off of FM 50 at Cotrone-Dix Road to dispose of dead
livestock for health purposes. The site is in Precinct 4.
The third regriest was to enter the property of Jane Moore
located off of FM 2776 to dispose of dead livestock for health
purposes. The sight is in Precinct 2. On motion by
Commissioner Wilcox, seconded by Commissioner Turner, the
Court voted unanimously to authorize the work.
The court received, approved and ordered filed as
submitted the Treasurer's report for April 1994 and the second
quarter report for fiscal year 1994. A copy of which is
attached to and made a part of these minutes.

The following proceedings were held:
THAT WHEREAS, on May 23, 1994, the Court heard and approved a
budget amendment for the 1993-1994 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual ands unforeseen conditions which could not be
reasonably included in the original budget adopted September 13,
1993, the following amendments) to the original are hereby
authorized, as described on the attached 1 page(s).

TO THE COMMISSIONERS' COURT OF BRAZOS COUNTY, TEXAS
BRAZOS COUNTY COURTHOUSE
BRYAN, TEXAS 77803
Formal notice is hereby given that Wickson Creek Specialty Utility District
(Applicant), proposes to place a Water Line
within the right-of-way of Fawn Lake Drive (name of
road) in Brazos County, Texas as follows:
The location or description•of the proposed installation is more fully
shown by 3 copies of the drawings attached to this notice.

1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazo's County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-
of-way in accordance with governing laws.
6. That the line or lines will be constructed no less than twenty-four
inches (24°) lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (21) below
the center of the roadway.

7. That all sites will be barricaded during the construction period.
Construction of this line will begin on or after the 16th day of
May , 19 94.
