THE COMMISSIONERS' COURT WIM MEET IN REGULAR SESSION ON MONDAY, MAY
16, 1994 AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF THE BRAZOS
COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN, TEXAS.

SPECIAL MEETING
MAY 16, 1994

A special meeting of the Commissioners Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, May 16, 1994, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court first considered two Budget Amendments #93/94-
14 and 1193/94-15. Budget Amendment 1193/94-14 would transfer
funds budgeted for the Non Departmental Department to
Community Support and to correct an audit error. Budget
Amendment 1193/94-15 will show the beginning of the new budget
year for the Narcotics Trafficing Task Force Grant. On motion
by Commissioner Norton, seconded by Commissioner Turner, the
Court voted unanimously to approve the budget amendment as

submitted, a copy of which is attached hereto.
I The Court next considered three (3) requests from SWD
Limited for proposed installations in Precinct 1. The first
request is for two (2) installations on Peach Creek Road. One
is a parallel installation in the right-of-way of Peach Creek

Road beginning at the entrance to UPRC Allen-Dansby /1 oil
well for a distance of 6,080.0 feet to install a 4 inch
saltwater disposal line. The other installation is for a road
bore in the right-of-way of Peach Creek Road approximately 0.6
of a mile south of its intersection with Sulphur Springs Road
for a salt water disposal line installation. The second
request is for a road bore in the right-of-way of Rock Prairie
Road approximately 0.6 of a mile north of its intersection
with sulphur Springs Road for a salt water disposal line
installation. The third request is for a parallel
installation in the right-of-way of Peach Creek Cut-Off Road
beginning at its intersection with Peach Creek Road for a
distance of 7,795.0 feet. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Norton, seconded by Commissioner Turner, the
Court voted unanimously to approve the request of SWD Limited
and authorized the installations. A copy of each request is
attached hereto.
The Court next considered the request from Wellborn Water
Supply Corporation for a proposed road bore in the right-of-
way of Windy Ryon Road to install a water line. The site is
located in Precinct 1. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Norton, seconded by Commissioner Wilcox, the
Court voted unanimously to approve the request of Wellborn
Water supply Corporation and authorized the installation. A
copy of the request is attached hereto.
The Court next considered approval of the Final Plat of
Estates at River Run - Phase One. Richard Vance, County
Engineer, stated that he had reviewed the plat and it appeared
to be in order. Commissioner Wilcox asked about the width of
the driving surface of Hopes Creek Road. When told it was 35
feet from the centerline he recommended a minimum of 40 feet
width from the center of the road for all major thorough
fares. The County Judge noted that there was a very wide

easement indicated on the plat along Hopes Creek Road and
asked if the easement could be labeled "drainage and utility
easement". On motion by Commissioner Norton, seconded by
Commissioner Wilcox, the Court unanimously approved the Final
Plat of Estates at River Run - Phase One with the stipulation
that the 20 foot utility easement be labeled "drainage and
utility easement".
The Court proceeded to consider the change of status of
the following employees.

Formal notice Is hereby given that (Applicant) SPEEDWAY SWD L I M i T F D
proposes to place a (type) 4 inch polyethylene saltwater
pipeline within the right-of-way P e a c h e a c h Creek R o a d
in Brazos County, Texas as follows:
The location or description of the proposed Installation is more fully shown by
2 oples of the drawings attached to this notice.
1. The County Engineer must be notified prior to the beginning of construction In order that
they might be on hand to designate the actual location of the Installation.
2. That all damage to the roadways and right-of-ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-of-way.
4. That Brazos County Is in no way responsible for any damage that might occur to any
existing utility lines in the right-of-way.
6. That the line will be constructed and maintained on the County right-of-way In accordance
with governing laws.
6. That the line or lines will be constructed no less than forty-eight Inches (48') lower than the
lowest part of the drainage or bar ditch and the drainage Is to be considered at least two
feet (7) below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and in no case shall an open pit be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during'the construction period.
9. That the normal charge Is $500.00 per crossing and/or $40.00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM-Test method No. D-698; test
shall be conducted by an Independent Geotechnical testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer.
11. Construction shall be In strict conformance to the latest Texas Manual on Uniform Trafnc
Control Devices for Streets and Highwaa published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction. -
Construction of this line will begin on or after (date) May 23, 1994

for saltwater pipeline;
Dear Mr. Vance,
On behal of Speedway SWD, Limited and General Managing
Partner, GSI Oil & Gas, Inc., enclosed is the original Per-

mit Application for use of County R ght-of- ay y pee way
SWD Limited for the installation of a single saltwater pipe-
line.
As required, the application contains two (2) copies of
the plat. However, due to the fact that this request will
be the first considered by the commissioners under new
guidelines, I have included additional copies.
Concerning the requirement of installation of a
facility to be five (5) feet from the edge of the apparent
right-of-way and due to the irregularities of other utili-
ties in the placement of their facilities within County
right-of-way, (at times, private land is used instead of
County right-of-way), Speedway request permission to deter-
mine, at the time of construction, the location of its pipe-
line in the space available. This being either between the
existing utility and the apparent right-of-way or at a safe
distance between the centerline of the ditch and existing
utility. Upon completion of installation Speedway will sup-
ply your office with an as-built plat of our pipeline loca-

tion.

Formal notice is hereby given that (Applicant) SPEEDWAY SWD L I M I T E D
proposes to place a (type) 4 inch polyethylene saltwater
pipeline within the right-of-way (road) Rock P r a i r i e goad
In Brazos County, Texas as follows:
The location or description of the proposed Installation is more fully shown by
2 copies of the drawings attached to this notice.
I. The County Englneor must be notified prior to the beginning of construction In order that
they might be on hand to designate the actual location of the Installation.
2. That all damage to the roadways and right-ol-ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-of-way.
.4. That Brazos County Is in no way responsible for any damage that might occur to any
existing utility lines In the right-of-way.
5. That the line will be constructed and maintained on the County right-of-way In accordance
with governing laws.
8. That the line or lines will be constructed no less than forty-eight Inches (48') lower than the
lowest part of the drainage or bar ditch and the drainage is to be considered at least two
foot (7) below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and In no case shall an open ph be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge Is $500.00 per crossing and/or $40.00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch tine shall be compacted to 90% standard density ASTM-Test method No. D-698; test
shall be conducted by an Independent Gectechnical testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer,
11. Construction shall be In strict conformance to the latest Texas Manual on Uniform Traffic
Control Devices for Streets and Hlahwayi, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.
Construction of this line will begin on or after (date) May 23, 1994

Road, for saltwater pipeline;
Dear Mr. Vance,
On behal of Speedway SWD Limited and General Managing
Partner, GSI Oil S Gas, Inc., enclosed is the original Per-
mit Application for use of County Right-of-Way by Speedway
SWD Limited for the installation of a single saltwater pipe-
line.
As required, the application contains two (2) copies of
the plat. However, due to the fact that this request will
be the first considered by the commissioners under new
guidelines, I have included additional copies.
Concerning the requirement of installation of a
facility to be five (5) feet from the edge of the apparent
right-of-way and due to the irregularities of other utili-
ties in the placement of their facilities within County
right-of-way, (at times, private land is used instead of
County right-of-way), Speedway request permission to deter-
mine, at the time of construction, the location of its pipe-
line in the space available. This being either between the
existing utility and the apparent right-of-way or at a safe
distance between the centerline of the ditch and existing
utility. Upon completion of installation Speedway will sup-
ply your office with an as-built plat of our pipeline loca-
tion.
