J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Executive Assistant Carol Palmer Admin. Asst. to County Judge Bea Green Secretary to Commissioners Cheryl Turney Auditor's Office John Reynolds Auditor Richard Vance County Engineer Linda Muegge Road & Bridge J. R. Burkhalter Jail Administrator Bobby Riggs Sheriff Phyllis Dozier Brazos Center Al Jones Candidate for County Judge Maynard E. Hill Acme Glass Company Commissioner Sims gave the invocation and led the pledge of allegiance. The County Judge read aloud a Proclamation designating the week of May 9 through 13, 1994 as "Foster Family Week". The Court joins with the local human service agencies to urge everyone to give special attention to the contribution made by Foster Families. On motion by Commissioner Sims, seconded by Commissioner Norton the Court moved to proclaim the week of May 9 through 13, 1994 as "Foster Family Week" throughout Brazos County. The County Judge read aloud a Proclamation designating the month of May 1994 as "Fair Housing Month". The Court affirms its support for on-going national, state and local efforts to promote fair housing practices. On motion by the County Judge, seconded by Commissioner Norton the Court moved to proclaim the month of May 1994 as "Fair Housing Month" 4 i • • • Y L s -SAI O Commissioners Court meeting May 9, 1994 i f a throughout Brazos County. The Court next considered Budget Amendment #93/94-13, which would reallocate funds budgeted for the Task Force and transfer funds from the Non Departmental Department to Capital Projects and Data Processing. On motion by the County Judge, seconded by Commissioner Wilcox, the Court voted unanimously to approve the budget amendment as submitted., a copy of which is attached hereto. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to authorize the County Judge to execute a Tax Resale Deed to the following individuals: Florene K. Grace and Marvin Bruce Marvin - Tract 1: .25 acres, being the Northeast 1/2 of Lot 15, Kapchinskie Subdivision Tract 2: .25 acres, being the Southwest 1/2 of Lot 15, Kapchinskie Subdivision Brazos County, Texas The Court next considered payment of partial costs of road improvement and development for the State Prison. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the Court voted unanimously to approve payment of the County's portion, $300,000, to the City of Bryan for the partial costs of road improvement and site development for the State Prison location. It was the consensus of the Court to table consideration of the proposed Budget Policy for Brazos County. The Court next reconsidered Bid No. 94-747 Six (6) sets of Two (2) Doors for the entrance to the Brazos Center. At the previous Commissioners Court meeting, the Court delayed action until such time as certain questions could be answered regarding the doors. Ll. r • l r G r k , t F' k r F • Commissioners Court meeting May 9, 1994 Acme Glass. The Court next considered the request from United Telephone Company to place road bores 'and parallel installations in the rights-of-way of Old Highway 6 and White Switch Road. The sites are located in Precinct 1. The County Engineer stated that all appeared to be in order and recom- mended approval. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of United Telephone Company and authorized the installation. A copy of the request is attached hereto. The Court next considered two requests from Aquila South- west Pipeline Corporation. The first to place a parallel installation in the right-of-way of Ball Circle Road beginning at its intersection with Pipeline Road for a distance of 2,110.0 feet. Included with the request is company check 11018651 in the amount of $5,116.40. The second, to place a road bore in the right-of-way of Pipeline Road approximately 3,168.0 feet from its intersection with Peach Creek Cut Off Road. Included with the request is company check 11018650 in the amount of $500.00. Both sites are located in Precinct 1. The County Engineer said there was a line of sight problem which would require that the line be buried at a depth of 8 feet rather that the customary 6 feet. Commissioner Sims asked that the pipeline be installed as close to the right-of- way line as possible. On motion by the County Judge, seconded by Commis-sioner Norton, the Court voted unanimously to approve the request of Aquila Southwest Pipeline Corporation subject to the conditions stipulated and authorized the installation. A copy of each request is attached hereto. Commissioner Wilcox recommended that the pipeline company give a two (2) year guarantee that they will fix any damage that is a direct result of their installation. The Court next considered acceptance of a Warranty Deed r. J ~i I for right-of-way on Graham Road in Precinct 1. Winslow Jeanna C. Fiske Jack E. Winslow, Jr. City of Bryan, Texas K. W. Brown & Assoc., Inc. Crowley & Waltman Int. Central Bank (gift deed) First American Bank (gift deed) Federal Deposit Insurance Corporation (gift deed) Commissioner Wilcox stated that the deed needs to include a drawing of the property in relationship to the roadway. The Court next considered acceptance of a Warranty Deed and Correction Warranty Deed for right-of-way on Nunn Jones in Precinct 3. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed executed by William L. Jackson and wife Delana M. Jackson and a Correction Warranty Deed executed by Albert A. Schultz for the expansion of Nunn Jones Road. The Court next considered the request from Wickson Creek Special Utility District to place a road bore in the right-of- way of Steephollow Road for a water line installation. The site is located in Precinct 3., The County Engineer stated that all appeared to be in order and recommended approval. 'rY 77803 ~12 y J 10 mv la Dear Sir: Formal notice is hereby given that the United Telephone Company of Texas, ~ Inc. proposes to install buried communications Cable upon and along the right-of-way of county roads in Brazos County, Texas, i as follows: I t IMPROVED ROADS (paved) - The contractor will plow cable in backslope with 8' of right-of-way line. Pipe will be bored under all paved county roads i extending from ditch line to ditch line with a minimum cover of 30". IMPROVED ROADS (gravel) - The contractor will plow cable in the backslope of the road, one track of the plow tractor on the backslope the other may F come to the shoulder of the road neither whole tractor nor plow will be on the road surface. UNIMPROVED ROADS (dirt) - Same as improved, unless, because of ditches, trees and other terrain features, it is more practical to plow in center of road. In these cases, the cable will be plowed in the center of the road. Not applicable in County. BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be burned or disposed of and not left in the ditch. Rocks brought up by tractor or plow will be disposed of. DEPTH OF CABLE - All cables will be placed at a minimum depth of 30" except where crossing dams or ditches, at which locations the depth of. cables will be at a minimum of 36". The following are requirements which are made on the contractor: 1. The plowing equipment shall be subject to the approval of the Engineer and the Public Authorities having jurisdiction over highway and road rights-of-way. 2. The equipment and construction methods used by the contractor shall be such as to cause minimum displacement of the soil. The slot made in the soil by the cable plow shall be closed immediately by driving a vehicle track or wheel over the slot or by other suitable means. 3. Damage to banks, ditches, driveways, and roads caused by the equipment shall be immediately repaired to the satisfaction of the Engineer and Public Authorities having jurisdiction over highway and road right-of- way where involved. j 4. Trenches shall be promptly back-filled with earth. and mechanically ' tamped at six (6) inch lifts so that the earth is restored to original grade to assure no hazard to vehicular, animal or pedestrian traffic. No trenches shall be left open overnight. 1 ' S. The usual 10% fees withheld from contractor until repairs are made satisfactory with Engineer and Public Authorities having jurisdiction of right-of-way involved. _ 3 YSlLS 1~ _ • • i ■ 1 WO Brazos County will not be held liable at any future date for acciaental damages to the buried cable plant by road working equipment such as maintainers, hole diggers, etc. In the event of such damages the Telephone Company will be notifited immediately. The County Commissioners Court may require the owners to relocate this line, for valid reasons under the law, by giving thirty (30) days written notice. a. Where communication facilities are located on county road ROW the Telephone Company will relocate said facilities at no expense to the County. b. Where communication facilities are located on private property the County will reimburse the Telephone Company for the relocation of said facilities. At any place where a communications line crosses over a county road, it shall be constructed and maintained at least eighteen (18) feet above the surface of the traffic lane. Please notify Donald Wingard (409) 825-7516 forty-eight (48) hours prior to starting construction of the line, in order that a representative may be present. The locations of the proposed lines are more fully shown by the copies attached to this notice.
