VIOL PAG E 3.3.E ~1 i e COMMISSIONERS' COURT SPECIAL MEETING r F 1 ti f S 4 i f i APRIL 11, 1994 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, April 11, 1994, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4, Absent; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Carol Palmer Bea Green John Reynolds Cheryl Turney Sandie Walker Richard Vance Linda Muegge Bobby Riggs Rita Watkins J. The Court next considered approval of the minutes of the Commissioners' Court meetings held January 10, 1994, January 18, 1994 (9:00 a.m. and 7:00 p.m.), January 24, 1994, January 31, 1994, February 7, 1994, February 14, 1994, February 21, 1994, February 22, 1994 and February 28, 1994. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the minutes as submitted. The Court next considered Budget Amendment #93/94-10, which would increase the grant revenue account for the S.T.A.R. Grant and increase the expense line item for equipment rent/lease for the S.T.A.R. Grant. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court VOL 13 Y . (I r~ Y1 t~ i i• • Commissioners Court meeting April 11, 1994 • • is voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. Commissioners Sims and Norton summarized the Minimum Security Jail Committee report for the Court. They stated that they met with Jack Crump of the Jail Commission, J. D. Langley, Judge of the 85th District Court, Bobby Riggs, Brazos County Sheriff, Rita Watkins, Chief Deputy Sheriff, Johnny Burkhalter, Jail Administrator and Bill Turner, District Attorney. Commissioner Norton informed the Court that grant monies were available in the amount of approximately $384,000 to add ninety six (96) temporary beds immediately. These are "no match" funds. The facility would have to meet Jail Standards specifications. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to authorize the County Judge, on behalf of Brazos County, to apply for the grant funds to add ninety six (96) temporary beds to the Minimum Security Jail and to accept those funds should they be awarded. The Court next considered the selection of an architect for the addition to the Minimum Security Jail. Emmett Trant and Associates, and the AW Group submitted proposals for the 144 bed Minimum Security Jail expansion. The County Judge stated he felt Emmett Trant and Associates were the best because they designed the Minimum Security Jail and were I familiar with the facility. On motion by Commissioner Turner, seconded by Commissioner Wilcox, the Court voted unanimously to award the contract to Emmett Trant and Associates for the Vol. planning and architectural design of the 144 bed expansion of the Minimum Security Jail. The Court next considered joining the Coalition of 1 Counties with Overcrowded Jails. The Coalition was formed because of the'serious over crowding problems facing Texas Department of Criminal Justice and individual counties. Allison and Associates will represent the Coalition before the Board of Criminal Justice, Texas Commission on Jail Standards c~ V I{ 4 1 E ~i i~ 4 t i I 4 r Commissioners Court meeting April 11, 1994 and numerous other committees. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to join the Coalition of Counties with Overcrowded Jails. The County will pay approximately $3,600 to participate in the Coalition. The Court next considered a Wavier of Competitive Bidding Requirements as provided in Article 262.024(a)(7)(D) of Vernon's Annotated Civil Statutes for the repair and service of the Road and Bridge Department equipment. On motion by Commissioner Norton, seconded by Commissioner Wilcox, the i 1 f Court voted unanimously to approve the Waiver of Competitive Bidding Requirements for: 1) Hogan's Trucks Unlimited for the repair and service of international Truck Equipment and approve the payment of said costs not to exceed $18,00.00, 2) Stewart & Stevenson, Inc. for the repair and service of John Deere Equipment and approve the payment of said costs not to exceed $18,00.00; 3) Mustang Tractor for the repair and service of Caterpillar Equipment and approve the payment of said costs not to exceed $60,000.00 and Case Power & Equipment for the repair and service of International Tractor Equipment and approve the payment of said costs not to exceed $60,000.00. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to participate in the purchase of a computerized Redbook of prescription drugs for the Brazos Valley Development Council Indigent Health Care Program. The cost to the County will be $5,500.00. The program will reduce the time the staff spends on the increasing number of cases. The Court next.considered a location for a public auction to be held on may 21, 1994. The City of College station is having an auction and the City of Bryan, College Station Independent School District, Bryan Independent School District and Brazos County will all be participating. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to host the City of College Station auction at the Road and Bridge Department. On motion by Commissioner Norton, seconded by Commis- sioner Sims, the Court voted unanimously to authorize the acquisition of right-of-way for the upgrading of Stousland and Straub Roads in Precinct 1. The Court next considered the request from Wellborn Water Supply Corporation to install a water line extension in the right-of-way of Stillwater Road. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to approve the request of Wellborn Water Supply Corporation and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from Ferguson Burleson County Gas Gathering System for a road bore in the right-of-way of Rye Loop Road approximately 0.4 mile Northwest of its intersection with OSR. The site is located in Precinct 4. Included with the request is company check #4163 in the amount of $500.00. The County Engineer stated that all appeared to be in order and recommended approval. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Ferguson Burleson County Gas Gathering System and authorized the installation. Traf. Task Force Claims--7959--thru--7982-- Commissioner Sims questioned two gasoline purchases by the Sheriff's Department at a local filling station. Commissioner Sims was informed that the pumps were down that day. Commissioner Sims also questioned check number 185487 in which sales tax is paid by the County. On motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to approve the Claims as submitted with the exception of sales tax on check #18587. The County Judge recessed the meeting until 10:00 a.m. to await the arrival of Kent Rider, attorney with Calame, Linebarger, Graham & Pefia. The County Judge reconvened the meeting of the Commis- sioners' Court of Brazos County, Texas at 10:00 a.m. and announced the meeting closed to the public so that the Court j 1 i , UMMOMMU ..y t 11 J r' v J Commissioners Court meeting April 11, 1994 • • t t• i I could meet in closed executive session to discuss litigation as allowed under Section (6252-17(2)(e) Vernon's Texas Civil Statutes. At 10:44 a.m. the County Judge announced the meeting open to the public. on motion by Commissioner Norton, seconded by Commissioner Sims the Court voted unanimously to execute the Ballot for Accepting or rejecting Plans for reorganization of Trailite, Inc. in the U.S Bankruptcy Court. The court voted to reject the Fifth Revised Plan of Reorganization as of February 26, 1994 proposed by Debtor, Trailite, Inc. and to accept the amended Plan of Reorganization dated January 7, 1994 proposed by the City of Bryan, the Bryan Independent School District and Brazos County. The Court also authorized the County Judge to execute a Partial Release on l} acres of the property belonging to Trailite in Carraba Estates to sell free and clear of liens signed by the U.S. Bankruptcy Court. The money gained in the sale will be used for payment of ad valorem taxes assessed by the County. Box 10006 Road: Rye Loop Road College Station, Texas 77842-0006 Precinct No.: _4_ Formal notice is hereby given that (Applicant) Ferguson-Burleson County Gas Gathering System proposes to place a (type) one six inch steel pipeline within the right-of-way of (road) Rye LooI2 Road in Brazos County, Texas as follows: The location or description of the proposed installation is more fully shown by one copies of the drawings attached to this notice. • • 1. 2. The County Engineer must be notified prior to the beginning of construction in order that they might be on hand to designate the actual location of the installation. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the County Engineer. That BRAZOS COUNTY reserves the right to require Applicant to relocate or lower any such line at no cost to BRAZOS COUNTY, should same become necessary due to widening or lowering, or other alteration of the roadway of right-of-way. Ditch line shall be compacted to 90% standard density ASTM-Test method No. D-698; test shall be conducted by an independent Geotechnical testing firm; copies of all test results shall be furnished to the office of the Brazos County Engineer.
