A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, March 28, 1994, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Absent;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2, Presiding;
Randy Sims, Commissioner of Precinct 3;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court first considered approval of the minutes of the
Commissioners' Court meetings held November 1, 1993, November
18, 1993, November 22, 1993, November 29, 1993, December 6,
1993, December 13, 1993, December 20, 1993 and December 31,
1993. On motion by Commissioner Sims, seconded by
Commissioner Wilcox, the Court voted unanimously to approve
the minutes as submitted.
The Court next considered Budget Amendment 493/94-09,
which would reallocate funds budgeted for the Landfill and
transfer funds from the Non Departmental Department to the

Commissioners Court meeting March 28, 1994
Landfill. On motion by Commissioner Turner, seconded by
G Commissioner Sims, the Court voted unanimously to approve the
budget amendment as submitted, a copy of which is attached
r hereto.
0 The Court next heard from Dr. Charles Schultz,
representative of the Brazos County Historical Society, who
thanked the Court for its support. He introduced Dr. Rosemary
and Calvin Boykin, who documented and photographed every
r historical marker in Brazos County. Dr. Schultz then
presented the Boykins' notes and pictures to Mrs. Clara
Mounce, Librarian for the City of Bryan. Dr. Schultz went on

to tell the Court that the Commission would be receiving the
Distinguished Service Award in 1994. Commissioner Sims
thanked the Boykins for all their work.
The next matter for consideration was the appointment of
Allison and Associates and Bickerstaff, Heath and Smiley to
represent the Commissioners Court in various areas of liti-
gation for a period of one (1) year. On motion by Commis-
sioner Sims, seconded by Commissioner Norton, the Court voted
unanimously to appoint Allison and Associates and Bickerstaff,
Heath and Smiley to represent the Commissioners Court in
various areas of litigation for a period of one (1) year.
On motion by Commissioner Sims, seconded by Commissioner
Wilcox, the Court voted unanimously to exempt from competitive
bidding requirements the following companies:
Services for County Area Emergency Calls from City of
Bryan/City of College Station
Local Government Code, Section 262.024(x)(2)
Purchase of Prescriptions and/or Medication for Indigents
from Downtown Pharmacy
Local Government Code, Section 262.024(a)(2)

Local Government Code, Section 262.024(a)(8)
Commissioner Sims asked if Sysco Foods did not need an
exemption. The County Auditor said not yet.
The next matter for consideration was approval to
advertise for bids for six sets (6) of two doors (2) for the
entrance to the Brazos Center. On motion by Commissioner
Sims, seconded by Commissioner Wilcox, the Court voted
unanimously to authorize the Purchasing Agent to advertise for
bids for doors for the Brazos Center.
The next matter before the Court was approval of a
Contract for Services between Brazos County and Brazos
Beautiful, Inc. for the improvement of the aesthetic
appearance of Brazos County. Brazos County will pay
$11,000.00 annually in turn Brazos Beautiful will provide
services in litter control and beautification and will develop
programs directed toward solid waste management and recycling.
Term of the contract will be fiscal year 1993-1994. On motion
by Commissioner Sims, seconded by Commissioner Turner, the
Court voted unanimously to enter into contractual agreement
with Brazos Beautiful. A copy of the contractual agreement is
attached hereto.
The Court next considered TB testing and Hepatitis "B"
Vaccinations for the Brazos County Jail inmates, employees and
volunteers. Senate Bill 57 has mandated all inmates,
personnel and volunteers in a Penal Institution be tested for
T.B.. The Texas Department of Health will supply the vaccine
for testing and the medication for those with positive T.B.
after X-rays. The County will pay for the X-rays and reading
there of. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to approve the
T.B. testing and Hepatitis "B" vaccinations for the Brazos
County Jail inmates, employees and volunteers.

Commissioners Court meeting March 28, 1994
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to table consideration of
an architect for the Minimum Security Jail addition.
The Court next considered alternate supplier for Annual
Hot Mix Asphaltic Concrete - Pavement Contract - Bid No. 93-
697 and Annual Flexible Base Contract - Bid No. 93-699 for the
Road and Bridge Department. The County Engineer stated that
Hot Mix plants were not always running when hot mix was needed
by the county. He said that they needed an alternate location
where they can buy the mix and flexible base. The Purchasing
Agent asked the Court that Young Brothers be considered an
alternate supplier through the remainder of the contract
period for Hot Mix and that Young Brothers be first alternate
and Gifford Hill be second alternate for the Flexible Base
Contract. On motion by Commissioner Turner, seconded by
Commissioner Norton, the Court voted unanimously to accept the
recommendation of the Purchasing Agent and recognize Young
Brothers as alternate supplier for Hot Mix. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to recognize Young Brothers as the first
alternate and Gifford Hill be second alternate for the
Flexible Base Contract.
The Court next considered approval of the Preliminary
Plat of Lake Ridge Estates, a private subdivision, in Precinct
1. Ray Crow, Engineering Aide, stated that he had reviewed
the plat and that all requirements had been met. Commissioner
Sims said that before the Final Plat is accepted the Court has
to know what will be done about the lake. Commissioner Wilcox
said he wanted an 80 foot right-of-way on Lakeside Drive. He
then asked the County Engineer if the 70 foot right-of-way on
Lakeside Drive was adequate. The County Engineer stated he
felt it would be adequate. On motion by Commissioner Norton,
seconded by Commissioner Turner, the Court unanimously
approved the Preliminary plat of Lake Ridge Estates
Subdivision, in Precinct 1.

' This is an a9reement by and between the County of Brazos

(hereinafter referred to as "COUNTY") and BRAZOS BEAUTIFUL, INC.,
a non-profit association for the improvement of the aesthetic
appearance of Brazos County (hereinafter referred to as "BRAZOS
BEAUTIFUL").
WHEREAS, BRAZOS BEAUTIFUL has been created to provide
assistance to the community in litter control and beautification;
WHEREAS, BRAZOS BEAUTIFUL has expanded its efforts into solid
waste management and recycling;
NOW, THEREFORE, FOR AND IN CONSIDERATION of mutual promises
recited herein, the parties agree as follows:
1. BRAZOS BEAUTIFUL shall provide services in litter control
and beautification and will develop programs. directed toward solid
waste management and recycling. BRAZOS BEAUTIFUL shall also assist
in conducting a pilot program for the County Citizen Collection and
Recycling Stations for the rural citizens of Brazos County.
2. BRAZOS BEAUTIFUL will be funded by the COUNTY in the
amount of Eleven Thousand Dollars ($11,000.00), from the County
1993-94 Fiscal Year Funds.
3. BRAZOS BEAUTIFUL shall maintain fiscal records and
supporting documentation in the form of canceled checks, payroll
records, invoices, or other documents required for all expenditures

4. BRAZOS BEAUTIFUL shall submit a financial statement to
COUNTY annually.
5. All notices and documentation required to be sent to

6. It is understood and agreed that COUNTY'S participation
in BRAZOS BEAUTIFUL is limited to the contribution of funds.
COUNTY at no time shall be liable or responsible for the acts of
BRAZOS BEAUTIFUL, it agents, or employees.
7. Either of the parties shall have the right to terminate
9 this agreement in whole or in part at any time. Notice to
terminate this agreement will be given in writing at least thirty
(30) days prior to the date of termination. The notice shall '
include the reasons for such termination, the effective date of the
t termination, and in the case of partial termination, the portion of
t the agreement to be terminated.
