A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, March 21, 1994, with the following members of
the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;

Commissioner Sims gave the invocation and led the pledge
of allegiance.

The first matter before the Court was consideration of an
amendment to Contract No. 07-511-Z-00 between the Texas
-Department of Protective and Regulatory Services and Brazos
County for the purchase of protective homemaker services. The
amendment is for the reduction in the mileage reimbursement
I
rate from ;.28 per mile to ;.26 per mile. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
f voted unanimously to adopt the amendment to Contract Number
07-511-Z-00 and authorized the County Judge to execute it on
behalf of Brazos County. A copy of the contract amendment is
attached hereto.
The next matter for consideration was a tax refund to the

Commissioners Court meeting March 21, 1994
F.D.I.C.. In a Court settlement it was agreed that the
appraised value for 1992 taxes for property R26179, R26183,
R26193 and R26194 should be $410,766.00 instead of
$525,766.00. On motion by Commissioner Sims, seconded by
Commissioner Norton, the Court voted unanimously to refund
$505.89 in county taxes for 1992 to the F.D.I.C..
On motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to approve an application
for credit to the Brazos Valley Solid Waste Management Agency.
The new contract being developed with Texas Commercial Waste
requires the County to be responsible for its own charges to
the Brazos Valley Solid Waste Management Agency.
The Court next considered appointing law firms to
represent the Commissioners Court in various areas of
litigations. The County Judge named the following firms:
Bruchez, Goss, Thornton, Meronoff, Michel and Hawthorne
Davis and Davis
Hays, McConn, Price and Pickering
McGinnis, Lochridge and Kilgore, L.L.P.
Thornton, Payne, Watson and Kling
Youngkin, Catlin, Bryan, and Stacy
Commissioner Norton moved to approve the list submitted by the
County Judge. Commissioner Sims seconded the motion. After
some discussion it was suggested that the appointments be made
annually. Commissioner Norton agreed to amend his motion to
include the annual renewal. Commissioner Sims seconded the
amended motion. The motion passed unanimously.
The Court next considered the proposed building expansion
of the Health Department. The expansion is necessary due to
several new directives from both the Texas Department of
Health and the local Health Department Board. The Texas
Department of Health has provided funds. On motion by the
County Judge, seconded by Commissioner Norton, the Court voted
unanimously to approve the proposed building expansion of the
Health Department.
On motion by Commissioner Norton, seconded by Commis-
sioner Sims, the Court.voted unanimously to hold a public

hearing on Thursday, April 7, 1994 at 10:00 a.m. to hear
commentary for and against regarding the regulation requiring
food service establishments, retail food stores, mobile food
units, and roadside food vendors in the unincorporated areas
of Brazos County including areas in the extraterritorial
jurisdiction of the cities of Bryan and College Station to
obtain a permit from the county and pay the appropriate fees.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(A). This is for the purchase of the personal
and/or professional service, engineering services for
environmental protection from Holland Winder. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to approve the Exemption from Competitive
Bidding Requirements and authorized the payment for
professional services from Mr. Winder for the period ending
September 30, 1994.
The next matter for consideration was a request from Fain
McDougal to be allowed to substitute a Security instrument in
lieu of completing construction prior to Final Plat approval
for the Sweetwater Subdivision. The security instrument will
be an irrevocable Letter of Credit in the amount of
$501,493.96 issued by First American Bank and executed by Mr.
Ivan M. Olson, Executive Vice President. On motion by
Commissioner Norton, seconded by Commissioner Sims, the Court
voted unanimously to accept the security instrument.
The Court next considered approval of the Re-plat of
Nantucket Phase II, Lot 1, Block Thirteen (to be known as Snug
Harbor Phase I). On motion by Commissioner Norton, seconded
by Commissioner Turner, the Court unanimously approved the
final plat of Lot 1, Block Thirteen Nantucket Phase II.
The Court-next considered authorizing work outside of
county rights-of-way for the enhancement of county road
projects. The Road and Bridge Department requested permission
to enter the private property of Pete Clary located off Locke

Commissioners Court meeting March 21, 1994
Road to dispose of dead livestock. On motion by Commissioner
Sims, seconded by Commissioner Norton, the Court voted
unanimously to authorize the work.
The Court received, approved and ordered filed as
submitted the Treasurer's report for February 1994. A copy of
which is attached to and made a part of these minutes.
The Court proceeded to consider the change of status of
the following employees.

CONTRACT AMENDMENT NO. 1

TEXAS DEPARTMENT OF PROTECTIVE AND REGULATORY SERVICES
and
BRASOS COUNTY
Contract No. 07-511-2-00

The Texas Department of Protective and Regulatory Services and Brazos
County entered into a contract effective September 1, 1993, through
August 31, 1994, for the purchase of protective homemaker services.
Both parties agree to amend this contract as stated below:
Effective May 1, 1994, the budget line item for travel expenses of
the homemaker is reduced to allow for a reduction in the mileage
reimbursement rate from $.28 per mile to $.26 per mile. This is
necessary due to budgetary constraints and the Department's desire
to keep allowable travel costs the same between TDPRS direct
delivery staff and contract providers.
Reimbursement rates for travel may not exceed the maximum amount
established by the Texas Department of Protective and Regulatory
Services.
The total maximum reimbursable amount of the contract is decreased
by $95.24, from $25,000.00 to $24,904.76.
TOTAL MAXIMUM REIMBURSABLE AMOUNT OF CONTRACT: $24,904.76
The parties mutually agree that all terms and conditions of the original
contract not in conflict with the terms of this plan change amendment
shall remain in full force and effect.
In their capacities as stated below, the parties affix their signatures
and bind themselves.
