PAGE, I 1r +1 1+ t 11 1. n F f l i f I } I f t COMMISSIONERS' COURT SPECIAL MEETING MARCH 7, 1994 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m.'on Monday, March 7, 1994, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding] Gary Norton, Commissioner of Precinct It Walter Wilcox, Commissioner of Precinct 21 Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4, Absents Mary Ann Ward, County Clerk. Langley Candidate for Treasurer Ramona Hibbits Crime Stoppers Commissioner Sims gave the invocation and led the pledge of allegiance. The first matter before the Court was consideration of an agreement with Brazos County Crimestoppers to house the Brazos County Crimestopper Program in the District Attorney's office. Crimestoppers will hire and supervise the employee and Brazos County will make the Crimestoppers employee an employee of the County and pay the benefits associated with being a county employee such as insurance, unemployment insurance, FICA and withholding, retirement and workers compensation for the Crimestopper employee. The cost to the County is approximately $6,900. Crimestoppers will reimburse the County ,.F 1 i ,y ll a. ' 7 ;a i • • • , f 9 r f' b b y a Commissioners Court meeting March 7, 1994 $22,000 a year for the salary of the Crimestoppers employee and agrees to reimburse the county for any additional salary that Crimestoppers grants to the employee. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to enter into agreement with the Crimestoppers and authorized the County Judge to execute the Agreement on behalf of Brazos County. A copy of the Agreement is attached hereto. The Court next reconsidered allowing boxing and wrestling matches in the Brazos County Pavilion. This had been tabled at a previous meeting to allow the Court to obtain more information on the request. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to deny the request for boxing and wrestling matches held at the Pavilion and requested that policy be set regarding such events. Commissioner Sims moved to re-bid the uniforms. There was no second. The County Judge wanted to see sample uniforms submitted along with the bid. The representative of the Sheriff's department stated they would be willing to try the new uniforms offered by Career Apparel. On motion by Commis- sioner Norton, seconded by Commissioner Sims, the Court voted unanimously to award the contract to Career Apparel and to notify R&R Uniforms. The Court next considered a Wavier of Competitive Bidding Requirements as provided in Section 262.027(a)(7a) of Vernon's Annotated Civil Statutes for the purchase of fly ash/bottom ash road building material from JTM Industries, Inc. for the Road and Bridge Department. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to approve the Waiver of Competitive Bidding Requirements and authorized the payment for all invoices through March 31, 1995. The Court next considered permitting the installation of saltwater pipelines in county right-of-way. Commissioner Norton read a statement into the record requesting that the Court adopt a policy allowing the installation of saltwater lines in county rights-of-way free of charge. Commissioner Sims seconded the motion. Commissioners Norton, Sims and the County Judge voted "Aye"= Commissioner Wilcox abstained. The Court next considered the request from Bert Wheeler to place a road bore in the right-of-way of Barron Road to install a water line. The site is located in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Bert Wheeler and authorized the installation. A copy of the request is attached hereto. The Court next considered four requests from Wickson Creek Special Utility District. The first to place a road bore in the right-of-way of Wilcox Lane for a water line installation. The second to place a road bore in the right- of-way of Frieda Lane approximately 0.1 mile from its intersection with Dilly Shaw Tap Road to install a water line. The third to place a road bore in the right-of-way of Dilly Shaw Tap Road approximately 0.5 miles from its intersection with FM 2776 to install a water line. These three sites are located in Precinct 2. The fourth to place a road bore in the right-of-way of Hearne Road for a water line installation. The site is located in Precinct 3. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to approve the request of Wickson Creek Special Utility District and authorized the installations. A copy of each request is attached hereto. The Court proceeded to consider the change of status of the following employees. Brazos County Crimestoppera needs a centrally located place to house the Brazos County Crimestoppers Program. Local law enforcement officials have agreed that a suitable site for such a program is in the Brazos County District Attorney's Office because it is located in the county's courthouse and because available space exists. The Brazos County Commissioners Court and District Attorney agree that an empty office in the District Attorney's Office can be used by the Crimestoppers Program to house its Program for as long as the space is not needed by the District Attorney's Office. Should the District Attorney need the space, he may revoke this agreement by notifying any member of Crimestoppers Board of Directors in writing, stating that the office is needed. The District Attorney should provide Crimestoppers a reasonable time to find another place to locate and such time period shall be not less than 30 days from the date notice is given and not longer than 180 days from the day notice is given. The office furniture currently in the office is available for use by the Crimestoppers Program but the Crimestoppers Program is - 1 - VC 3 -PAC E 2-Ty' • i~ j i ~ 1 ,i I~ • • • • r r. i k i , r / 4 s ' responsible for adding any additional furniture or equipment it deems necessary. The Crimestoppers Program will provide its own telephone line, equipment and office supplies, , The Brazos County Crimestoppers Program will hire and supervise an employee to run the Crimestoppers Program (the "Coordinator"). Crimestoppers has requested that Brazos County pay for such Coordinator the benefits normally associated with being a county employee. The Commissioners Court agrees to pay such benefits which include insurance for such Coordinator, unemployment insurance, FICA and withholding, retirement and workers compensation. The total cost to the county is approximately $6,900 for such benefits. In return for the payment of such benefits, the Crimestoppers Program agrees to allow the Coordinator to perform county services for up to 10 hours a week at the discretion of and under the supervision of the District Attorney. The Coordinator is required to abide by all policies and procedures promulgated by the Commissioners Court. The Crimestoppers Program agrees to reimburse the county $22,000 a year for the salary of the Coordinator and agrees to reimburse the county for any additional salary that Crimestoppers grants to the Coordinator. The County Engineer must be notified 72 hours prior to the beginning of construction in order that he or his designated inspector may inspect the actual installation. 2. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the County Engineer. 3. That Brazos County reserves the right to require Applicant to relocate or lower any such line at no cost to Brazos County, should same become necessary due to widening or lowering, or other alteration of the roadway or right-of-way. 4. That Brazos County will in no way be responsible for any damage which might occur to any existing utility lines in the right-of-way. 5. That the line will be constructed and maintained on the County right- of-way in accordance with governing laws. 6. That the line or lines will be constructed no less than twenty-four inches (24") lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway. 7. That all sites will be barricaded during the construction period. Construction of this line will begin on or after the 8th day of March , 19 2A--.
