COMMISSIONERS' COURT
SPECIAL MEETING
JANUARY 31, 1994
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
F Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m.- on Monday, January 31, 1994, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
The following citizens and officials were in attendance:

Commissioner Sims gave the invocation and led the pledge

of allegiance.
7 The Court next considered Budget Amendment #93/94-05,
which would reallocate funds budgeted for the Grants fund and
transfer funds from the Non Departmental department to the
Appellate Judicial System fund, Community Support, and
transfer funds from General Fund revenue to the Sheriff's ,
Department. On motion by Commissioner Turner, seconded by
Commissioner Sims, the Court voted unanimously to approve the
budget amendment as submitted, a copy of which is attached
hereto.
The Court next considered an Order appointing James A.
Amis, Jr. to sit as Special Judge in County Court at Law II on
March 8 & 9, 1994 to allow Judge Ryan to take personal leave.
On motion by Commissioner Sims, seconded by Commissioner

Wilcox, the Court voted unanimously to approve the order
naming James A. Amis, Jr. as Special Judge for County Court at
Law II March 8 6 9, 1994. A full copy of the order is
attached to and made a part of these minutes.
The Court next considered awarding the following bid:

Cheryl Turney, Purchasing Agent, recom-
mended acceptance of the low bid submit-
ted by Ace Pest Control upon receipt of
their insurance certificate. On motion
by Commissioner Norton, seconded by Com-
missioner Sims, the Court voted unani-
mously to accept the recommendation of
the Purchasing Agent and award the con-
tract to Ace Pest Control upon receipt of
their insurance certificate.
The Court next considered awarding the following bid:

Labor per Hour $66.67
Cheryl Turney, Purchasing Agent, recom-
mended acceptance of the only bid submit-
ted by Montgomery Elevator Company. On
motion by Commissioner Sims, seconded by
Commissioner Turner, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Montgomery Elevator Company.
The Purchasing Agent informed the Court that no bids had
been received on Bid No. 94-739, the annual lamp 6 ballast
contract. It was the consensus of the Court to re-bid the
item.
-The Court next reconsidered Bid No. 94-733 - Furniture.

The Purchasing Agent informed the Court that bids could not be
awarded to bidder solely on the basis of being a local
supplier. The Purchasing Agent then recommend the bid be
awarded to the low bidder, Hodges Business Interiors. On
motion by Commissioner Norton, seconded by Commissioner Sims,
the Court voted unanimously to accept the recommendation of
the Purchasing Agent and award the contract to Hodges Business
Interiors. A copy of the bid tabulation is attached hereto.
It was the consensus of the Court to consider Competitive
Bids for various items at a later date.
The Court next considered creating the position of Right-
Of-Way Procurement Officer for the Road & Bridge Department.
The County Engineer explained that it was difficult to upgrade
or maintain roads because of the lack of right-of-way. He
went on to say that one individual was needed to do the work
and keep all the records, because right now the information
was scattered amongst too many people. The County Judge moved
to proceed and to bring a budget back to the Court.
Commissioner Wilcox seconded the motion. Commissioner Sims
recommended not delaying any longer and suggested that the
County Engineer, Commissioner Turner and Commissioner Norton
come to an agreement on what was needed for the job. He also
recommended advertising the position. The County Engineer
recommended a salary of $27,000 to 630,000 dollars annually.
The County Judge withdrew his motion and Commissioner Wilcox
withdrew his second. On motion by Commissioner Norton,
seconded by Commissioner Sims, the Court voted unanimously to
proceed with locating someone for the position.
The Court next considered the request from Wellborn Water
Supply Corporation to install two water lines. The first is
to place a road bore in the right-of-way of Sandpiper Cove in
Nantucket Subdivision for a water line installation. The
second is to place a road bore in the right-of-way of Peach
Creek Cut Off Road approximately 1.0 miles form its
intersection with State Highway 6 for a water line

installation. The sites are located in Precinct 1. On motion
by Commissioner Norton, seconded by Commissioner Sims, the
Court voted unanimously to approve the request of Wellborn
Water Supply Corporation and authorized the installation. A
copy of the request is attached hereto.
The Court next considered authorizing work outside of
county right-of-ways for the enhancement of county road
projects. The Road and Bridge Department submitted three
requests. The first for permission to enter the private
property of Jane Moore located off FM 2776 for the purpose of
burying dead livestock. The second to enter the private
property of Wayne Bourn for the purpose of removing a drainage
obstruction to allow water to drain from Old Bundick Road. The

third request is to enter the private property of Frank A.

Orts located off Elmo Weedon Road for the purpose of burying
dead livestock. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to authorize
all the work.

Commissioner Sims questioned claim #2003 and #2004.
Claims #2003 was payment to a local restaurant for lunches for
the Judges. Claim #2004 was for a Blue Book for the District
Attorney's office. Commissioner Norton moved to approve the
claims as submitted. The motion was seconded by Commissioner
Turner. Commissioners Norton, Turner and the County Judge
voted "Aye". Commissioners Sims and Wilcox voted to pay all
claims except claims numbered 2003 and 2004.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 31st day of January 1994 at a special meeting of the
Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on January 31, 1994, the Court heard and

approved a budget amendment for the 1993-1994 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 13,
1993, the following amendment(s) to the original are hereby
authorized, as described on the attached 1 page(s).

Court of Brazos County, Texas convene in Regular Session at the
Special Term of the Court, at the Brazos County Courthouse, in the
City of Bryan, Texas, with the following members present, to-wit:
R. J. Holmgreen, County Judge
Gary Norton, County Commissioner, Precinct No. 1
Walter Wilcox, County Commissioner, Precinct No. 2
Randy Sims, County Commissioner, Precinct No. 3
Milton Turner, County Commissioner, Precinct No. 4.
Among other proceedings had, the following proposed order was
submitted:
WHEREAS, the Honorable Sarah Ryan, Judge of the County Court
at Law No. 2 of Brazos County, Texas, having made known to the
Commissioners Court of Brazos County, Texas, that on March 8-9,
1994, she wishes to take personal leave; and
WHEREAS, she has requested the appointment of the Hon. James
A. Amis, Jr. to sit as Special Judge of the County Court at Law
No. 2 of Brazos County, Texas on March 8-9, 1994 in all matters
that are, or may be, docketed on the Court's dockets for those
days, and to have and exercise all powers of a Special Judge in
relation to matters involved, it is therefore:
ORDERED, ADJUDGED AND DECREED, pursuant to the authority of
Article 30.03, Section 2, Code of Criminal Procedure, that the Hon.
James A. Amis, Jr., sit and hear all matters that are, or may be,
docketed on any of the Court's dockets on March 7, 1994, and shall
have and exercise all powers of such Special Judge in relation to
the matters involved;
•
WHEREAS, the Court having considered the proposed order and
deeming that it should be approved; it is therefore:
ORDERED, ADJUDGED AND DECREED by the Commissioners Court of
Brazos County, Texas, that the order as submitted having been read,
it was moved and seconded that same should be approved. Thereupon,

shown by 3 copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.
2. -That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazos County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-
of-way in accordance with governing laws.
6. That the line or lines will be constructed no less than twenty-four
inches (24") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (2') below
the center of the roadway.
7. That all sites will be barricaded during the constructnion period.
