Adjourn. s i } COMMISSIONERS' COURT REGULAR MEETING JANUARY 10, 1994 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, January 10, 1994, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: Ruth McLeod Executive Assistant Carol Palmer Admin. Jones Candidate for Co. Judge Commissioner Sims gave the invocation and led the pledge of allegiance. On motion by Commissioner Norton, seconded by Commissioner Turner, the Court voted unanimously to set the rate for milage reimbursement at $.28 per mile. The Court proceeded to the selection of the Salary Grievance Committee for 1994 in accordance with the law. Turner, seconded by Commissioner Sims, the Court proceeded to set the holidays to be observed by Brazos County for 1994: January 17, Martin Luther Ring Birthday April.l, Good Friday May 30, Memorial Day July 4, Independence Day September 5, Labor Day November 24-& 25 Thanksgiving December 23 & 26 Christmas January 2, 1995 New Year One (1) Floating Holiday The County Judge announced that he waived his right to sign-pay authorizations for the Road and Bridge Department. On motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to approve the waiver. On motion by Commissioner Norton, seconded by Commis- sioner Sims, the Court voted unanimously to adopt a Resolution authorizing the City of College Station to make joint application of 800 Megahertz radio frequencies as mandated by the FCC. This fequency is to be used for emergency vehicles. The Court next considered adopting a Resolution authorizing application for a grant to support the Brazos County Victim Assistance Program that is administered by the District Attorney's office. Such grant to be in the total amount of $69,510; $29,571.00 to be funded by the County, and $39,939.00 to be federal grant funds. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to authorize the County Judge to make application on behalf of Brazos County to the Criminal Justice Division and accept on behalf of Brazos County such grant funds as may be tendered. A copy of the resolution is attached hereto. The next matter before the Court was approval of a Contractual Agreement between Brazos County and the Brazos Maternal & Child Health Clinic. Brazos County will pay the amount of $60,000 annually. The Clinic will provide services to pregnant women who qualify for such services pursuant to the guidelines, interviews, lab work, physical exams, Commissioners Court meeting January 10, 1994 , educational information and medicine as needed. Term of the contract will be for one year beginning October 1, 1993 and terminating on September 30, 1994. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to enter into contractual agreement with the Brazos Maternal & Child Health Clinic. A copy of the contractual agreement is attached hereto. On motion by Commissioner Turner, seconded by Commis- sioner Wilcox, the Court voted unanimously to hold a Public Hearing on Tuesday, January 18, 1994 beginning at 7:00 p.m. at the Brazos Center for the purpose of enforcing load limits on county roads. i The Court next considered the request by Aquila Southwest Pipeline Corporation to place a road bore in the right-of-way of Peach Creek Road approximately 1,586.0 feet from its intersection with SH 6 for a natural gas pipeline i. ,F installation. The site is in Precinct 1. Enclosed with the request is company check $018206 in the amount of $500.00. On motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve the request of F; Aquila Southwest Pipeline Corporation and authorized the installation. The Court acknowledged receipt of the Extension Service t reports for December 1993 and acknowledged receipt of reports r from County and Precinct Offices showing revenues collected and remitted to the County Treasurer. At 9:50 a.m., the County Judge recessed the meeting until the arrival of legal counsel. The County Judge reconvened the meeting of the Commis- sioners' Court of Brazos County, Texas at 9:52 a.m. and announced the meeting closed to the public so that the Court could meet in closed executive session to discuss pending litigation as allowed under Section (6252-17(2)(e) Vernon's Texas Civil Statutes. At 10:37.m. the County Judge announced the meeting open to the public. On motion by the County Judge, seconded by Commissioner Norton, the Court voted unanimously to authorize the County Judge to sign a partial release on Trailite property per a court order for the sale of said property. At 10:40 a.m., the County Judge recessed the meeting until 1:00 p.m. at which time the Court would discuss pending litigation. The County Judge reconvened the meeting of the Commis- sioners' Court of Brazos County, Texas at 1:00 p.m. and announced the meeting closed to the public so that the Court could meet in closed executive session to discuss pending litigation as allowed under section (6252-17(2)(e) Vernon's c R~ _P P. On motion by Commissioner Norton, seconded by Commissioner Sims, the Court voted unanimously to authorize legal counsel to proceed with the defense of the Potter vs Brazos County case. Also, be it resolved that once these frequencies are granted by the FCC, implementation of the new frequencies would be requested to be delayed. It is further agreed that the City of College Station will serve as project manager and assemble a project team with representatives from the various governmental entities participating in the project. J. olmgreen Brazos County Judge ATTESTED: lyd4v, /Z'MJ zze~- Mary War Brazos County Clerk too, •I t THE STATE OF TEXAS § s; COUNTY OF BRAZOS § ZING APPLICATION FOR WHEREAS, the Criminal Justice Division, Office of the Governor, has indicated a need for programs aiding victims of crime, and has supported the establishment of such; and WHEREAS, the U.S. Department of Justice has supported programs for aiding victims of crime by establishment of a National Victims' Resource Center; and WHEREAS, among the several programs included in the 1994 Goals and Strategies for Texas is one which is designed to provide crisis 1• services for victims of crime; and WHEREAS, there presently being no other agency primarily responsible for offering services to victims of crime; and WHEREAS, there exists a continued need for an agency designed to provide crisis intervention, victim advocacy, referrals, education and support services for victims of juvenile and felony crimes in Brazils County; NOW, THEREFORE, BE IT RESOLVED BY THE COMISSIONERS COURT OF ~ BRAZOS COUNTY, TEXAS, at its meeting on the / day of 19", that: 1. The County Judge is authorized to make application on behalf of Brazos County to the Criminal Justice Division for grant funds to provide for the continuation of a Victim Assistance Program in Brazos County, Texas. -01 2. The County Judge is authorized to accept on behalf of Brazos County such grant funds as may be tendered by the Criminal Justice Division. 3. This resolution becomes effective upon adoption, and its recording in the Minutes of the Commissioners Court is ordered. At- R. ' i 1 • 4KS) A4W Q THIS CONTRACT IS ENTERED INTO BY AND BETWEEN BRAZOS COUNTY, TEXAS, acting by and through its duly elected County Commissioners (hereinafter "County"), and the BRAZOS MATERNAL & CHILD HEALTH CLINIC, INC. (hereinafter "Provider"), located in 1720 Barak Lane, Bryan, Texas 77802, RECITALS: WHEREAS, the medical care of the County's poor and indigent has become a growing problem; and WHEREAS, the County recognizes that good medical care of pregnant women results in healthier babies and less costly medical expenses incurred for the child in the future by the parents and the Community; and WHEREAS, the Court is interested in promoting such care through the Provider. NOW THEREFORE the parties above stated agree to the following terms and conditions to provide such indigent health care. TERM This contract shall continue in force and effect for a term of nine (9) months commencing on the 1st day of October, 1993 and terminating 30th day of September 1994. CANCELLATION This contract may be canceled by any of the parties hereto upon sixty (60) days written notice as provided herein. SERVICES TO BE PERFORMED BY PROVIDER Provider shall provide the following services through trained, salaried staff to pregnant women who qualify for such services pursuant to the guidelines currently implemented for making such determination: interviews, lab work, physical exams, educational information and medicine as needed (herein "Services"). USE OF COUNTY FUNDS Funds to be furnished to Provider as stated herein below 'shall be used to pay the salary and benefits of the Director of Provider and the Billing Clerk as described in Enclosure (1) attached hereto and made a part hereof for all purposes. S r COUNTY'S LIABILITY FOR PAYMENT The County agrees to reimburse the Provider for actual cost of the salaries as stated on Exhibit "A" up to a maximum of Sixty Thousand and No/100 Dollars ($60,000.00) for the term of this Contract. This sum shall be paid upon the following dates and in the following amounts: December 15, 1993 $ 15.000.00 March 15, 1994 $ 15,000.00 June 15, 1994 $ 15,000.00 September 15, 1994 $ 15,000.00 RESPONSIBILITIES OF PROVIDER Provider will be responsible for providing the following Services pursuant to this Contract: 1. All necessary application forms to potentially eligible individuals. 2. Obtaining and compiling information on each applicant for Providers Services with regard to residency and financial qualifications. 3. Maintaining this Contract. 4. Providing of the Provider's services. 5. Maintaining data files on clients and the Services provided thereto. 6. Respond to all and any inquiries by the County regarding the Clinic and its Services. 7. Assist the County with information needed for audit purposes. 8. Provide the County with quarterly financial statements. 9. Provide the County with any and all certified audits of Provider and the management letter prepared in connection therewith. 10. Provide financial statements evidencing how County funds are spent. Such statements to be submitted to County one week prior to the funding dates set forth herein above. 2 IN
