THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON MONDAY,
DECEMBER 20, 1993 AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF THE

SPECIAL MEETING
DECEMBER 20, 1993
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, December 20, 1993, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4, Absent;
Mary Ann Ward, County Clerk.

The Court next considered approval of the minutes of the
-Commissioners' Court meetings held September 1, 1993 (10:00
a.m. & 10:30 a.m.), September 7, 1993 (9:00 a.m. & 1:30 p.m.),
September 8, 1993 (1:30 p.m.), September 9, 1993 (3:30 p.m.)
and September 13, 1993. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously
to approve the minutes as submitted. Commissioner Wilcox
abstained from voting on the minutes of both meetings held
September 1, 1993 because he did not attend them.
The Court next considered Budget Amendment #93/94-02 and
93/94-03. Budget Amendment #93/94-02 would transfer funds
budgeted for Non Departmental to the County and District

Grant to the Brazos Valley Narcotics Trafficking Task Force
Grant. Budget Amendment #93/94-03 would transfer funds
budgeted for Non Departmental to the Auditor's Department and
also reallocate funds in the Auditor's Department. On motion
by Commissioner Sims, seconded by Commissioner Norton, the
Court voted unanimously to approve the budget amendments as
submitted, a copy of each is attached hereto.
The Court next considered an Order appointing James A.
Amis, Jr. to sit as Special Judge in County Court at Law I on
December 20, 21, 28, 29, 30 and 31, 1993 to allow Judge Davis
to take vacation time. On motion by Commissioner Norton,
seconded by Commissioner Sims, the Court voted unanimously to
approve the Order naming James A. Amis, Jr. as Special Judge
for County Court at Law I for the dates of December 20, 21,
28, 29 and 30, 31, 1993. A full copy of the Order is attached
to and made a part of these minutes.
The Court next considered entering into agreement with
the Arts Council of Brazos Valley for economic development
through quality arts programs, arts related programs and
scholarships in the community. The County agrees to pay
$16,000.00 to the Arts Council for the year beginning October
1, 1992 and ending September 30, 1993. The County Judge told
the Court that he had verbal confirmation from the District
Attorney that this was legal. Commissioner Sims asked for
written confirmation from the District Attorney. On motion by
the County Judge, seconded by Commissioner Norton, the Court
voted unanimously to enter into agreement with the Arts
Council of Brazos Valley and authorized the County Judge to
execute the Agreement on behalf of Brazos County. A copy of
the Agreement is attached hereto.
The next matter for consideration was approval to
advertise for bids for financial software for Brazos County..
The County Auditor explained that the estimated cost would be
from $25,000.00 to $45,000.00 and that it would improve
payroll, reporting accounts payable and purchase orders. On

motion by the County Judge, seconded by Commissioner Norton,
the Court voted unanimously to authorize the Purchasing Agent
to advertise for bids for financial software.
On motion by Commissioner Turner, seconded by Commis-
sioner Wilcox, the Court voted unanimously to participate in
an auction held by the City of College Station on Saturday,
January 29, 1994. Attached is a list of Brazos County surplus
equipment and vehicles to be sold at the auction.
The Court next considered the request from Union Pacific
Resources Company to place a road bore in the right-of-way of
Greens Prairie Road East for a saltwater pipeline instal-
lation. The site is located in Precinct 1. Included with the
request was company check #128102 in the amount of $500.00.
On motion by Commissioner Norton, seconded by Commissioner
Sims, the Court voted unanimously to approve the request of
Union Pacific Resources Company and authorized the instal-
lation. Commissioner Wilcox abstained from voting. A copy of
the request is attached hereto.
The Court next considered the request f rom Wellborn Water
Supply Corporation to place a road bore in the right-of-way of
Batts Ferry Road to install a water line. The site is located
in Precinct 1. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to approve the
request of Wellborn Water Supply Corporation and authorized
the installation. A copy of the request is attached hereto.

Norton, the Court voted unanimously to approve the changes as
submitted.

on motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
Mr. Dan Williams asked the Court for permission to speak
about the Bullet Train. Mr. Williams has property near
Millican•and is concerned that Brazos County is not taking a
bigger part in getting rid of the Bullet Train Project.
The County Judge announced that agenda items for the
Commissioner Court meeting of December 31, 1993 needed to be
in his office by December 22, 1993.
There being no further business to come before the Court,
the meeting was adjourned.

THIS AGREEMENT, made and entered into this a day of fir, *M, by

and between ARTS COUNCIL OF BRAZOS VALLEY, a private non-profit corporation chartered
by the State of Texas, acting by and through its duly authorized agent and officer, hereinafter
referred to as ACBV. and the County of Brazos, State of Texas acting by and through its County
Judge, duly authorized so to act, hereinafter referred to as County,
WHEREAS, Article 3, Section 52-a of the Constitution, Section 381 of the Local
Government Code of the State of Texas and V.A.T.S. §5190.6 provide for COUNTY to engage
in economic development activities; and,
WHEREAS, a primary focus of economic development inquiries is the quality of arts
programs in a community; and,

WHEREAS, ACBV provides assistance to local arts organizations of the COUNTY through
funding and support which improves the quality of life in COUNTY and which assists in attracting
industry and business to COUNTY; and,
WHEREAS, COUNTY provides various youth-related services; and,
a
WHEREAS, ACBV has provided funding and support for programs ;nvolving substance
abuse prevention and education for Brazos County children through arts programs and continues
to provide arts-related programs and scholarships for young people which foster positive self- i

image and thereby assists in prevention of drug and alcohol use and abuse; and,

WHEREAS, Article 1528m, V.A.T.S., recognizes that the health, education, and general
welfare of the citizens of the State of Texas require promotion and education about the
performing, dramatic, visual, and literary arts; and
WHEREAS, said Article permits COUNTY to provide funding for cultural education
facilities, and is to be liberally construed; and,
WHEREAS, ACBV provides funding to member organizations, in part, for facilities
acquisition and upkeep; and,
. EREAS, Article 5190.7. V.A.T.S. permits COUNTY to assist with urban enterprise

zones; and,
WHEREAS, ACBV through its funding programs has provided benefit to Brazos County,

through programs attracting over 25

of goods from Brazos County merchants; and,
WHEREAS, ACBV has provided funding to assist local performing arts groups; and,
WHEREAS, Chapter 318 of the Local Government Code of the State of Texas provides
for historic preservation activities by COUNTY; and,
WHEREAS, ACBV provides funding to member organizations for historic preservation;
and,
WHEREAS, other programs provided by COUNTY are directly benefdted by ACBV and
its member organizations. '
NOW, THEREFORE, COUNTY and ACBV hereby agree as follows:

ACBV through its funding and support of member organizations agrees to continue to
provide the above enumerated services which it has provided and agrees to continue to engage
in support of arts organizations.
II.
COUNTY, for and in consideration of the services provided to COUNTY, hereby agrees
to pay to ACBV a lump sum payment of SIXTEEN THOUSAND DOLLARS, ($16,000.00) for the
year beginning October 1, 1992 and ending September 30, 1993.
ACBV agrees to provide an accounting of how the $16,000.00 was distributed to meet the
above described services.
ACBV hereby agrees to hold COUNTY, its officers, agents, servants, and employees
harmless from any loss, damage, injury or claim arising from any negligent act during the course
of its operations.

Attached is a contract between the Arts Council and Brazos
County. Also attached is prior correspondence which explains my
position on the contract.
In summary, Brazos County cannot donate $16,000 to the Brazos
Valley Arts Council. However, it can contract with the Arts
Council to provide services the County is authorized to provide.
I believe the contract describes services by the Arts Council
performed on behalf of the County and authorized by legislature.
Therefore, I believe the funds can be distributed as per the
contract. A strict accounting should be maintained by the Arts
Council to insure the money was spent as directed by the contract.

Attached is a contract between the Arts Council and Brazos
County. Also attached is prior correspondence which explains my
position on the contract.
In summary, Brazos County cannot donate $16,000 to the Brazos
Valley Arts Council. However, it can contract with the Arts
Council to provide services the County is authorized to provide.
I believe the contract describes services by the Arts Council
performed on behalf of the County and authorized by legislature.
Therefore, I believe the funds can be distributed as per the
contract. A strict accounting should be maintained by the Arts
council to insure the money was spent as directed by the contract.

advertising by means of direct mail and media as determined

responsible for the collection and payment of all funds
including sales taxes, will direct or provide for the
accounting and arranging of sale items, all included in the

The location or description of the proposed installation Is more fully shown by
3 coples of the drawings attached to this notice.
1. The County Engineer must be notified prior to the beginning of construction in order that
they might be on hand to designate the actual location of the Installation.
2. That all damage to the roadways and right-of-ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-of-way.
4. That Brazos County Is In no way responsible for any damage that might occur to any
existing utility lines In the right-of-way.
5. That the line will be constructed and maintained on the County right-of-way in accordance
with governing laws.
6. That the line or lines will be constructed no less than forty-eight Inches (48') lower than the
lowest part of the drainage or bar ditch and the drainage Is to be considered at least two
feet (2) below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and In no case shall an open pit be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge Is $500.00 per crossing and/or $40.00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM-Test method No. D-698; test
shall be conducted by an Independent Geotechnical testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer.
11. Construction shall be in strict conformance to the latest Texas Manual On Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of , .
Transportation, and all other State and Federal laws governing utility construction.
