REGULAR MEETING
DECEMBER 13, 1993
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, December 13, 1993, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner.of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Milton Turner, Commissioner of Precinct 4, Absent;
Mary Ann Ward, County Clerk.

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court first considered approval of the minutes of the
Commissioners' Court meetings held August 2, 1993, August 9,
1993, August 16, 1993, August 23, 1993, August 25, 1993,
August 30, 1993 and August 31, 1993. On motion by Commis-
sioner Sims, seconded by Commissioner Norton, the Court voted
unanimously to approve the minutes as submitted. Commissioner
Wilcox abstained from voting on the minutes of August 31, 1993
because he was not at the meeting.
The Court next considered an order appointing James A.
Amis, Jr. to sit as Special Judge in County Court at Law I on
December 17, 1993 to allow Judge Davis to take vacation time.

On motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to approve the Order
naming James A. Amis, Jr. as Special Judge for County Court at
Law I on December 17, 1993. A full copy of the Order is
attached to and made a part of these minutes. -
The next matter before the Court was the payment of the
following annual assessments:
a) 1st and 14th Courts of Appeals
On motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to acknowledge and approve
the assessment of fees by the 1st and 14th Courts of Appeals
in the amount of $11,701.00 and authorized the payment
thereof.
b) Second Administrative Judicial Region of Texas
on motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to acknowledge and approve
the assessment of fees by the Second Administrative Judicial
Region of Texas in the amount of $3,687.56 and authorized the
payment thereof.
The Court next considered the purchase of vehicles for
the County and District Attorneys. The -Purchasing Agent
presented the following options:

The Purchasing Agent then recommended Option 4 for two cars
for the County Attorney and one car for the District Attorney:
Commissioner Wilcox said that the police package was not
necessary for those two offices. The County Attorney stated

that he preferred Option 2. Representatives of the District

Attorney's office told the Court that they preferred option 4.
Commissioner Norton explained that option 4 was the best
considering all the driving done by the two offices. Commis-
sioner Sims moved to accept the recommendation of the
Purchasing Agent and approve Option 4. The motion was
seconded by Commissioner Norton. Commissioners Norton and
Sims voted "Aye". Commissioner Wilcox voted "No". The motion
carried.
On motion by the County Judge, seconded by Commissioner
Norton, the Court voted unanimously to advertise for the
following bids:
a) Annual Elevator Maintenance Contract
b) Annual Insect Control Contract
c) Annual Lamp and Ballast Contract
? The Court, on motion by Commissioner Sims, seconded by
Commissioner Norton tabled consideration of a request from
Wellborn Water Supply Corporation of a proposed road bore in
the right-of-way of Batts Ferry Road because of a report from
Hugh Lindsay, a resident of the area that it appeared that
Wellborn Walter Supply Corporation had made an open cut across
the road rather than bored under it. He said that there was
now a big bump across the road. Commissioner Norton stated it
would be investigated.
The Court next considered the request from Merit Energy
to place a road bore in the right-of-way of Old Reliance Road
to install a 2 inch steel water injection line. The site is
located in Precinct 3. Included with the request is company
check $26495 in the amount of $500.00. On motion by Commis-
sioner Sims, seconded by Commissioner Norton, the Court voted
unanimously to approve the request of Merit Energy Company and
authorized the installation. A copy of the request is
attached hereto.
` The Court next considered authorizing work outside of
county rights-of-ways for the enhancement of county road
projects. The Road and Bridge Department requested permission

to enter the private property of Russell Ford located off of
Democrat Road in Precinct 3, to haul fill dirt to be used for
culvert installations. On motion by Commissioner Sims,
seconded by Commissioner Wilcox, the Court voted unanimously
to authorize the work.
The Court acknowledged receipt of the Extension Service
reports for November 1993 and acknowledged receipt of reports.
from County and Precinct Offices showing revenues collected,
and remitted to the County Treasurer. An excerpt from those
reports is attached hereto.

On this the 13th day of December, 1993, the Commissioners
Court of Brazos County, Texas, convened in Regular Session at the
term of the Court, at the Brazos County Courthouse, in
the City of Bryan, Texas, with the following members present, to-
wit:
R. J. Holmgreen, County Judge
Gary Norton, County Commissioner, Precinct No. 1
Walter Wilcox, County Commissioner, Precinct No. 2
Randy Sims, County Commissioner, Precinct No. 3
Milton Turner, County Commissioner, Precinct No. 4
Among other proceedings held, the following proposed order was
submitted:
WHEREAS, The Honorable Claude D. Davis, Judge of the County
Court at Law No. 1 of Brazos County, Texas, that on December 17,
1993 he will be absent from the bench due to vacation time.
WHEREAS, he has requested the appointment of James A. Amis to
sit as Special Judge of the County Court at Law No. 1 of Brazos
County, Texas on the above mentioned dates in all matters that are,
or may be, docketed on the Court's dockets for this day, and to
have and exercise all powers of a Special Judge in relation to
matters involved, it is, therefore;
ORDERED, ADJUDGED AND DECREED, pursuant to authority of
Article 30.03, Section 2, Code of Criminal Procedure, that James A.
Amis, a former Judge of County Court at Law of Brazos County,
Texas, to sit and hear all matters that are, or may be, docketed on
any of the Court's dockets on the above-mentioned days and shall
have and exercise all powers of such Special Judge in relation to
the matters involved;

The location or description of the proposed installation is more fully shown
by three copies of the drawings attached to this notice.

1. The County Engineer must be notified prior to the beginning of
construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That BRAZOS COUNTY reserves the right to require Applicant to
relocate or lower any such line at no cost to BRAZOS COUNTY, should same
become necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That BRAZOS COUNTY is in no way responsible for any damage that might
occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of way in-accordance with governing laws.
4 6. That the line or lines will be constructed no less than forty-eight
= inches (48") lower than the lowest part of the drainage or bar ditch and
the drainage is to be considered at least two feet (2') below the center
of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
centerline of the right-of-way or cased for such distance.
8. That all sites will be barracaded during construction period.
9. That the normal charge is $500 per crossing and/or $40 per rod when
paralleling the roadway established by the Commissioners' Court on
January 28, 1985.
