COMMISSIONERS' COURT SPECIAL MEETING JANUARY 18, 1994 i• A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, January 18, 1994, with the following members of the Court present: R. J. Holmgreen, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The following citizens and officials were in attendance: i Ruth McLeod Executive Assistant Carol Palmer Admin. Fahlquist LWV r Commissioner Sims gave the invocation and led the pledge ' of allegiance. The Court next considered Budget Amendment #93/94-04, E which would reallocate funds budgeted for the office of Constable Precinct 5 and transfer funds from Non Departmental to Community Support. On motion by Commissioner Wilcox, seconded by Commissioner Turner, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. On motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to reappoint Commissioner -1 Milton Turner to the 9-1-1 Board of Managers. The next matter for consideration was an Operations and Maintenance Agreement with the Soil Conservation Service for the Big Creek Watershed. This is a modification of the original watershed agreement. The Brazos Bounty Commissioners r- I 11, 1 Commissioners Court meeting January 18, 1994 • • • Court will be added as a sponsor for the said watershed plan and is to assume O&M responsibilities as it relates only to the improvements and structures made to and located on sites 5 and 6, Big Creek Watershed, Brazos County, Texas. On motion by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted unanimously to enter into an Operations and Maintenance Agreement with the Soil Conservation Service for the Big Creek Watershed. A copy of the Agreement is attached hereto. The Court next considered the appointment of a liaison from the Commissioners' Court to the Road and Bridge Department. Commissioner Wilcox moved to appoint Commissioner Milton Turner to the position. Commissioner Turner seconded the motion. Commissioner Sims read aloud the portion of the minutes of Commissioners Court meeting dated January 28, 1985 stating the responsibilities of liaison would be rotated annually. The County Judge recommended that Commissioner Turner and Commissioner Norton work cooperatively in that capacity. Commissioner Wilcox moved to amend his-motion to include Commissioner Norton. The County Judge seconded the motion and it carried unanimously. The Court received, approved and ordered filed as submitted the Certification of the Juvenile Detention Facility. The inspection and certification was carried out by the Juvenile Probation Board on January 10, 1994. A copy'of the Certification is attached hereto. The Court next considered approval of the Final Plat of Creekridge Estates Phase One. Commissioner Wilcox reminded the Court that the Subdivision Regulations require a 70 foot right-of-way and a set back line where streets have a 90 degree turn. Commissioner Norton reminded the Court that this subdivision was established in 1973 and that no record could be found stating the Plat had been accepted by the Court. The y 70 foot right-of-way is impossible to achieve in many cases. Com- missioner Norton then moved the accept the subdivision with the variance to the 70 foot right-of-way requirement. Commis- sioner Sims seconded the motion. Commissioner Norton, Sims and Turner voted "Aye", Commissioner Wilcox voted "No". The f E r t >p (q f" r' motion carried to approve the final plat of the Creekridge Estates Phase One Subdivision with the 70 foot right-of-way variance. The Court next considered authorizing work outside of county rights-of-ways for the enhancement of county road projects. The Road and Bridge Department requested permission to enter the private property of Carlos Kelly located off FM 1179 for the purpose of disposing of dead livestock. On motion by Commissioner Turner, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. The Court proceeded to consider the change of status of the following employees. The motion was seconded by Commissioner Norton with Commissioners Norton, Sims and Turner voting "Aye". Commissioner Wilcox voted "No". on motion by Commissioner Turner, seconded by Commissioner Norton, the Court voted unanimously to approve all other changes as submitted. TO GF BUDGET $0 }jI • i C I A • .i i ~ a A • Ll MANUALLY-SIGNED ' SUPPLEMENTAL WATERSHED AGREEMENT NO. 11 n BIG CREEK (BRAZOS COUNTS WATERSHED, TEXAS Between the Brazos County Soil and Water Conservation District ' Local Organization Brazos County Commissioners Court Local Organization State of Texas t (hereinafter referred to as the Sponsors) E I i and the Soil Conservation Service United States Department of Agriculture (hereinafter referred to as SCS) WHEREAS, the watershed plan for Big Creek (Brazos County) Watershed, State of Texas. executed by the Sponsors named therein and the SCS, became effective, on the 19th day of August, 1964; and WHEREAS, in order to carry out the watershed plan for said watershed, it has become necessary to modify said watershed agreement as supplemented; and WHEREAS, the responsibility for administration of the Watershed and Protection and Flood Prevention Act, as amended, has been assigned by the Secretary of Agriculture to the Soil Conservation Service (SCS); and WHEREAS, a Supplemental Watershed Plan which modifies the watershed plan dated August 17, 1971 for said watershed has been developed through the cooperative efforts of the Sponsors and the SCS; NOW, THEREFORE, the Secretary of Agriculture through the SCS and the Sponsors hereby agree upon the following modifications of the terms, conditions, and stipulations of said watershed agreement; (1) Brazos County Water Control and Improvement District No. 1, Big Creek is no longer a sponsor of the watershed-plan for said watershed and discharge their responsibilities to the Brazos County Commissioners Court as recorded in agreement between Brazos County, Texas, acting by and through its duly authorized Commissioners Court, and Brazos County Water Control and Improvement District No. 1, Big Creek acting therein by and through • .i`~ Vi'a' r>- r~ ~•-f.,•~ w• ►k. (3) Change the name of Brazos-Robertson Soil Conservation District to Brazos County Soil and Water Conservation District. (4) Floodwater Retarding Structures Nos. IA, 2A, 3, 4A and 4B and all Channel Improvements are hereby deleted from the planned works of improvements. CLERK JUVENELE DETENTION FACILITY o~CA_ , FUSE ~Jt..o L.-PL Y We, the undersigned, hereby certify to the Commissioner's Court of Brazos County, Texas, that we have personally inspected the detention facilities at the Courthouse located in Bryan, Brazos County, Texas, to determine whether the facility is suitable for the detention of children as provided by Section 51.12(c) of the Texas Family Code. We hereby find that: r 1. Children in detention are not detained in or committed to a compartment of a jail in which adults are detained or committed; 2. Children in detention are not permitted contact with adults who are detained or committed to jail; 3. The detention facility meets the requirements of Article 5115, Revised Civil Statutes of Texas, 1925, as amended, defining "safe and suitable jails"; 4. The detention facility meets the "Standards for Juvenile Detention Facilities" as required by Section 75.041, Texas Human Resources Code, and as adopted by the Texas Juvenile Probation commission, effective the 11th day of November, 1986. THEREFORE, the Brazos County Detention Center is hereby certified as a suitable facility for children until the next annual onsite inspection due one year from the above personal visit.
