THE COMMISSIONERS' COURT WILL MEET IN SPECIAL SESSION ON MONDAY.
NOVEMBER 29, 1993 AT 9:00 A.M. IN THE COMMISSIONERS' COURTROOM OF THE

SPECIAL MEETING
NOVEMBER 29, 1993
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, November 29, 1993, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held July 6, 1993 (9:00 a.m.),
July 6, 1993 (1:30 p.m.), July 12, 1993, July 14, 1993, July
19, 1993, July 26, 1993 and July 30, 1993. On motion by
Commissioner Sims, seconded by Commissioner Wilcox, the Court
voted unanimously to approve the minutes as submitted.
Commissioner Sims abstained from voting on the minutes of July
6, 1993 because he was not present at those meetings.
The Court next considered approval of the City - County
Public Health Agreement for fiscal year 1993, 1994. This
agreement is entered into by the City of Bryan, City of
College Station and Brazos County to administer the Brazos
County Health Department. The purpose of the Health Depart-

ment is administering and enforcing all federal and state
health laws and city health ordinances in the respective
jurisdictions of each of the participating governmental
entities. Brazos County agrees to pay $129,141.00 and give
$254,902.00 in in -kind services. This represents 31% of the
total budget. On motion by Commissioner Norton, seconded by
Commissioner Wilcox, the Court voted unanimously to enter into
agreement with the Cities of Bryan and College Station for the
administration of the Brazos County Health Department. The
Court also authorized the County Judge to execute the
'Agreement on behalf of Brazos County. A copy of the Agreement
is attached hereto.
The Court next considered advertising for furniture bids.
Commissioner Sims noted that the purchasing agent was
specifying Steel Case furniture. He asked if this was a state
contract. The Purchasing Agent stated that some was and went
on to say the reason for this was for aesthetic continuity,
interchangeable parts and standardization. Commissioner Sims
then asked if this would allow Phelps Office Supply to bid.
After further discussion, Commissioner Sims moved to approve
the advertisement for bids with the stipulation that the
specifications be changed to read "Steel Case or comparable
quality ". The motion was seconded by Commissioner Wilcox and
passed unanimously.
The Court next considered two requests from Aquila
Southwest Pipeline Corporation. The first, for three road
bores for the installation of six pipelines in the following
county right -of -way. The first at Peach Creek Road approxi-
mately 379.0 feet from its intersection with Sulphur Springs
Road. The second on Sulphur Springs Road approximately 161.0
feet from its intersection with Peach Creek Road and the third
on Sulphur Springs Road approximately 569.0 feet from its
intersection with Old Barker Ranch Road. Included with the
request is company check $018017 in the amount of $3,000.00.
The sites are located in Precinct 1. The second to place two

Commissioners Court meeting November 29, 1993
road bores in the right -of -way of Greens Prairie Road approxi-
mately 1004.0 feet from its intersection with Arrighton Road
for installation of 2, 6.0 inch natural gas pipe lines.
Included with the request is company check #018042 in the
amount of $1,000.00. The sites are located in Precinct 1. On
motion by Commissioner Norton, seconded by Commissioner
Turner, the Court voted unanimously to approve both requests
of Aquila Southwest Pipeline Corporation and authorized the
installation. A copy of each request is attached hereto.
The Court next considered approval of the final plat of
Westminster, Phase One in Precinct 1. Commissioner Norton
stated that the plat conformed with the Road and Bridge Sub-
division regulation but that he still felt the subdivision was
poorly planned. On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court unanimously approved the final
plat of the Westminster, Phase One Subdivision.
The next matter before the Court was the re bid of Bid
No. 94 -732 - Landscape Timber and Cedar Posts.

Cheryl Turney, Purchasing Agent, recom-
mended acceptance of the bid submitted by
Brazos Bottom Crop Care to be purchased
as needed. On motion by Commissioner
Norton, seconded by Commissioner Sims,
the Court voted unanimously to accept the
recommendation of the Purchasing Agent
and award the contract to Brazos Bottom
Crop Care and to rebid the Cedar Posts.

COUNTY OF BRAZOS
WHEREAS, the City of Bryan, the City of College Station and Brazos County, have created an
administrative agency named the Brazos County Health Department for the public purpose and objective of
administering and enforcing all federal and state health laws and city health ordinances in the respective
jurisdictions of each of the participating governmental entities; and
WHEREAS, Article 4413(32c), V.A.T.C.S., authorizes intergovernmental contracting at the local level
including contracts between counties and cities; and
WHEREAS, the City of Bryan, the City of College Station and Brazos County, subject to the limitations
set forth herein, intend to share in the cost on a percentage basis with the County to collect and disburse the
funds;
NOW, THEREFORE, THE UNDERSIGNED MUTUALLY AGREE AS FOLLOWS.

This contract is for a period of one year and all payments shall be made from current revenues of each of
the parties. Payments shall be made by the City of College Station and the City of Bryan to Brazos County
at the Brazos County Courthouse prior to the tenth day of each month with each monthly share representing
one - twelfth (1/12) of the respective total share of the cities. If credit is due any of the parties, Brazos County
shall make the necessary reimbursement no later than the end of the first (1st) quarter of the next fiscal contract
year. Reimbursement due to overpayment shall be made in the amount overpaid by the entity. All
unencumbered funds at the close of the contract year shall be deposited into the Public Health Account (see
Section 5) to be designated for use for Public Health Services mutually beneficial to each party, or shall be used
to reduce local budget contributions in the following fiscal year. No appropriation of the money in this
Agreement shall be made unless unanimously approved by the City of Bryan, the City of College Station and
Brazos County.
4.
The chairman of the governing board shall have the authority to make expenditures as budgeted. Authority
for non - budgeted items shall come only from the approval of the governing board (known as the Brazos County
Board of Health).
5.
The Brazos County Health Department shall maintain records of all income (service fees collected) and
disbursements of the Public Health Account. Such records shall be brought before the governing board each
quarter for approval. No appropriation of money in this account shall be made unless unanimously approved
by the governing board.
6.
The Brazos County Health Department shall maintain records of usage of the facilities and services by the
citizens of each city and citizens of the county who live outside the two cities. Such records shall *be used to
determine the percentage of costs to be charged to the participating entities for the following contract year.
7.
The Brazos County Health Department will be under the supervision of the governing board consisting of
one representative from each of the three participating governmental entities.
8.
This contract can be renewed on an annual basis by resolution.
9.
The Director of the Brazos County Health Department shall submit financial and activity reports for both
Health Department and Public Health Accounts upon request by members of the governing board; but in no
event shall such financial and activity reports be submitted less frequently than quarterly. The Director shall
submit the annual financial and activity report no later than the close of the first quarter of the next fiscal year.

10.
Brazos County agrees to procure and maintain public liability insurance in the amount of not less that
$1,000,000.00, insuring against risks and claims arising out of the operation of the Health Department (except
for professional liability claims against medical doctors, who shall provide their own professional liability
insurance). The cost of liability insurance shall be included in the annual budget of the Brazos County Health
Department.

In Brazos County, Texas as follows:
The location or description of the proposed installation is more fully shown by
5 copies of the drawings attached to this notice.
I . The County Engineer must be notified prior to [lie beginning of construction in order that
they might be on hand to designate the actual location of the installation.
2. That all damage to the roadways and right -of -ways will be repaired to their original condition
to the Satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration r' the roadway or right -of -way.
4. That Brazos County is in no way responsible for any damage that might occur to any
existing utility lines In the right -of -way.
5. That the line will be constructed and maintained on the County right -of -way in accordance
with governing laws.
6. That the line or lines will be constructed no less than forty -eight inches (48') lower than the
lowest part of the drainage or bar ditch and the drainage is to be considered at least two
feet (2') below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and in no case shall an open pit be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge is $500.00 per crossing and /or $40.00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM -Test method No. D -698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer.
11. Construction shall be in strict conformance to the latest Texas Manual on Uniform Tralfic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.
Construction of this line will begin on or after (date) 11/18/93

1. The County Engineer must be notified prior to the beginning of construction in order that
they might be on hand to designate the actual location of the installation.
2. That all damage to the roadways and right -ol -ways will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such
line at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right -of -way.
4. That Brazos County is in no way responsible for any damage that might occur to any
existing utility lines in the right -of -way.
5. That the line will be constructed and maintained on the County right -of -way in accordance
with governing taws.
6. That the line or lines will be constructed no less than forty -eight inches (48') lower than the
lowest part of the drainage or bar ditch and the drainage is to be considered at least two
feet (2') below the center of the roadway.
7. That all roads shall be bored and cased for such distance, from toe of slope to toe of slope
and in no case shall an open pit be allowed within four feet of the shoulder of the road.
8. That all sites will be barricaded during the construction period.
9. That the normal charge is $500.00 per crossing and /or $40.00 per rod when paralleling the
roadway established by the Commissioners' Court on January 28, 1985.
10. Ditch line shall be compacted to 90% standard density ASTM -Test method No. D•698; test
shall be conducted by an independent Geolechnical testing firm; copies of all test results
shall be furnished to the office of the Brazos County Engineer.
11. Construction shall be in strict conformance to the latest Texas Manual on Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.
Construction of this line will begin on or after (date) 11 -29 -93
