A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, October 18, 1993, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;

Commissioner Sims gave the invocation and led the pledge
of allegiance.

The Court next considered Budget Amendment #92/93-30,
which would reallocate funds budgeted for the Sheriff's office
and transfer funds from the Road & Bridge #2 Fund to the Road
and Bridge General Fund. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously
to approve the budget amendment as submitted, a copy of which
is attached hereto.
On motion by the County Judge, seconded by Commissioner
Sims, the Court voted unanimously to appoint Jason McLendon as
presiding judge of Precinct 20 for the current voting year.

The next matter for consideration was four (4) separate
tax refunds.
a) Parkway Circle Apartments, Ltd. $46.10
b) David Alkosser et al $2,488.95
c) Texas Huntington Apartments, Ltd. $51.47
d) Gables Apartments, Ltd. $2,190.70
In a Court settlement it was agreed that the appraised value
for 1992 of each property should be reduced. on motion by the
County Judge, seconded by Commissioner Turner, the Court voted
unanimously to refund a total of $4777.31 in county taxes for
1992 to the four previously named property owners.
The Court next considered awarding the following bid:
Bid No. 94-724 - Computer Hardware
Cheryl Turney, Purchasing Agent, recom-
mended acceptance of the bid submitted by
Computer Access on item #1 and the bid
submitted by Computerland for items #2
thru #7. on motion by Commissioner
Turner, seconded by Commissioner Norton,
the Court voted unanimously to accept the
recommendation of the Purchasing Agent
and award the contract to Computer Access
and Computerland. A copy of the bid
tabulation is attached hereto.
The Court next considered awarding the following bids:

Commissioner Sims, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to ConAgg Transport.
The Court next considered setting a speed limit on Koppe
Bridge Road in Precinct 1. The court met earlier in a public
hearing to hear commentary for and against the setting of a
speed limit on Koppe Bridge Road. On motion by Commissioner
Norton, seconded by Commissioner Turner, the Court voted
unanimously to set the speed limit at 35 miles per hour on
Koppe Bridge Road.
The Court next considered the request from the City of
College Station to install a water and sanitary sewer line in
the right-of-way Graham Road beginning at its intersection
with Chamber Road and extending to FM 2154. The site is
located in Precinct 1. On motion by Commissioner Norton,
seconded by Commissioner Sims, the Court voted unanimously to
approve the request of the City of College Station and
authorized the installation. A copy of the request is
attached hereto.
The Court next considered approval of the following
preliminary plats in Precinct 1:
Creekwood Estates - Commissioner Norton told the
Court that there were 56 acres in the subdivision
and that no record of the plat having been accepted
by the Court could be found. In the interim, lots
had been sold and homes built. If it were to be
re-divided a vacating plat and a re-lat would be
necessary. In order to facilitate matters, he
asked if Creekline Road could be straightened and
if a 70 foot right-of-way could be achieved down
the length of the road. On motion by Commissioner
Norton, seconded by Commissioner Sims, the Court
voted unanimously to accept the preliminary plat
with the stipulations that Creekline Road be
straightened and that there be a 70 foot right-of-
way down the length of the road.
Westminster Subdivision - Commissioner Norton
stated that current regulations required 100 foot
rights-of-way on Barron Road since this is a major
thoroughfare. He also stated that he felt the
subdivision was poorly planned because driveways
were placed on Wellborn Road. On motion by
Commissioner Norton, seconded by Commissioner Sims,
the Court voted unanimously to approve the
preliminary plat with the stipulation that there be
a 100 foot right-of-way on Barron Road.
The Court next considered approval of the final plat of

Sweetwater Subdivision in Precinct 1. Richard Vance, County
Engineer, stated that he had reviewed the plat and it appeared
to be in order. On motion by Commissioner Norton, seconded by
commissioner Turner, the Court unanimously approved the final
plat of the Sweetwater Subdivision.
The Court next considered authorizing two requests to
work outside of county rights-of-way for the enhancement of
county road projects. The first was a request from Road and
Bridge Department to enter the private property of Joe
Bonifazi on the northeast side of Dilly Shaw Tap Road to clean
out an existing drainage channel to allow water to drain from
a culvert under Dilly Shaw Tap Road. On motion by the County
Judge, seconded by Commissioner Norton, the Court voted
unanimously to authorize the work. The second request was to
enter the property of Debra Riddell at the intersection of
Francis Road and Bickham Cemetery Road to dispose of dead
livestock. On motion by the County Judge, seconded by Commis-
sioner Norton, the Court voted unanimously to authorize the
work.
The Court next considered setting a speed limit in Rustic
Oaks Subdivision and a stop sign at Rustic Oaks Drive and
Grassbur Road in Precinct 3. The court met earlier in a
public hearing to hear commentary for and against the setting
of a speed limit in the subdivision and the stop sign at
Rustic Oaks Drive and Grassbur Road. On motion by Commis-
sioner Sims, seconded by Commissioner Norton, the Court voted
unanimously to set the speed limit at 30 miles per hour in the
Rustic Oaks Subdivision and to place a stop sign at Rustic
Oaks Drive and Grassbur Road.
The Court next considered the request from GTE Southwest,
Inc. to place a buried cable in the north right-of-way Road of
Andert Road beginning at its intersection with SH 21 for a
distance of 250.0 feet in a southeasterly direction. The site
is located in Precinct 3. On motion by Commissioner Sims,
seconded by Commissioner Norton, the Court voted unanimously

to approve the request of GTE and authorized the installation.

The Court next considered two requests from Wickson Creek
Special Utility District. The first a proposed 4.0 inch road
bore in the right-of-way of Elmo Weedon Road approximately 0.3
mile from its intersection with SH 30 to install a 2.0 inch
water line. The site is located in Precinct 3. The second a
proposed 4.0 inch road bore in the right-of-way of Cliff Road
approximately 400.0 feet from its intersection with SH 21 to
install a 3.0 inch water line. The site is located in
Precinct 3. On motion by Commissioner Sims, seconded by Com-
missioner Norton, the Court voted unanimously to approve the
two requests of Wickson Creek Special utility District and
authorized the installation. A copy of each request is
attached hereto.

I understand and agree that:
I. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.
3. That Brazils County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-
of-way in accordance with governing laws.
6: That the line or lines will be constructed no less than twenty-four
inches (24") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (2') below
the center of the roadway.
7. That all sites will be barricaded during the construction period.
Construction of this line will begin on or after the I ST day of

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road
in Brazos County, Kurten, Texas as follows:
Beginning 48' Southwest of the intersection of Hwy 21
and Andert Road, we propose to place a buried line along
parallel to and 5' inside of the North right-of-way of
Andert Road a distance of 250' in a Southeasterly direction.
The location and description of this line and associated
appurtenances is more fully shown by four copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by GTE does
not constitute a waiver, surrender, abandonment or impairment
of any property rights, franchise, easement, license, authority,
permission, privilege or right now granted by law or may be
granted in the future and any provision or provisions so con-
strued shall be null and void.
Construction of this line will begin on Oct 30, 1993.

TO THE COMMISSIONERS' COURT OF BRAZOS COUNTY, TEXAS
BRAZOS COUNTY COURTHOUSE
BRYAN, TEXAS 77803
Formal notice is hereby given that Wick Ann creek Special Utility
District (Applicant), proposes to place a Road Bore/Waterline
across
x he right-of-way of Cliff Road (name of
road) in Brazos County, Texas as follows:
The location or description*of the proposed installation is more fully
shown by 3 copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he or his designated inspector may
inspect the actual installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the County
Engineer.

3. That Brazo's County reserves the right to require Applicant to
relocate or lower any such line at no cost to Brazos County, should
same become necessary due to widening or lowering, or other
alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
" might occur to any existing utility lines in the right-of-way.

i i 5. That the line will be constructed and maintained on the County right-
of-way in accordance with governing laws.

i 6. That the line or lines will be constructed no less than twenty-four
inches (24") lower than the lowest part of the drainage or bar ditch
i I and the drainage is to be considered at least two feet (2') below
the center of the roadway.
7. That all sites will be barricaded during the construction period.
Construction of this line will begin on or after the 12th day of
October , 19 93.
