A regular meeting of the Commissioners' Court of Brazos }
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, October 11, 1993, with the following members
of the Court present:
R. J. Holmgreen, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;

Commissioner Sims gave the invocation and led the pledge
of allegiance.
The Court first considered Budget Amendment #92-93/29,
•
which would transfer funds budgeted for Justice of the Peace
Precinct 4 Place 1 to the office of Constable Precinct 7 and
increase the budget of the insurance fund. on motion by
Commissioner Norton, seconded by Commissioner Turner, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The County Judge read aloud a Proclamation designating
the month of October as "National Arts and Humanities Month".
The Court urges all citizens to participate in and celebrate

the cultural richness the Brazos Valley has to offer. On
motion by Commissioner Norton, seconded by Commissioner Sims
the Court moved to proclaim the month of October as "National
Arts and Humanities Month" throughout Brazos County. The
County Judge then presented the signed Proclamation to Dr.
Paul Parrish and Ms. Nancy Berry, representing the local Arts
Council.
The Court next considered entering into agreement with
the Brazos County Soil and Water Conservation District #450
for the district to provide soil and water conservation
service to the residents of Brazos County and to the county
proper. Cost to the County will be $4,400.00 annually. On
motion by Commissioner Sims, seconded by Commissioner Wilcox,
the Court voted unanimously to enter into agreement with the
Brazos County Soil and Water Conservation District #450. A
copy of the Agreement is attached hereto.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to table consideration of
the appointment of a Board Member to the Brazos County
Appraisal District until more information can be gathered.
On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to eliminate parties in
the Courthouse with the exception of Thanksgiving, Christmas
and retirement parties.
The Court next considered the request by Sprint/United
Telephone Co. of a road bore in the right-of-way of White
Switch Road approximately 0.7 mile from its intersection with
Old Highway 6 to install a communications cable. The site is
in Precinct 1. On motion by Commissioner Norton, seconded by
Commissioner Turner, the Court voted unanimously to approve
the request of Sprint/United Telephone Co. and authorized the
installation. A copy of the request is attached hereto.
The Court next considered awarding the following bids:
Bid No. 93-710 - Annual Bridge Repair Service
There were no bids received. On motion by
Commissioner Norton, seconded by Commissioner Sims
the Court voted unanimously to bid on each project
individually.

unanimously to accept the recommendation

On motion by Commissioner Norton,
seconded by Commissioner Wilcox, the
Court voted unanimously to accept the
recommendation of the Purchasing Agent

Cheryl Turney, Purchasing Agent, recom-
mended acceptance of the bid submitted by
Hogan Trucks based on parts availability
of the Volvo GMC Trucks. Commissioner
Norton moved to award the contract to the
low bidder White GMC Trucks with the
stipulation that parts be in our hands
within twenty four (24) hours. The
motion was seconded by Commissioner Sims.
Commissioners Norton, Sims, and Wilcox
voted "Aye". Commissioner Turner voted
"No". The motion carried and the Court
awarded the contract to White GMC Trucks.
The Court acknowledged receipt of the Extension Service
reports for September 1993 and acknowledged receipt of reports
from County and Precinct Offices showing revenues collected
and remitted to the County Treasurer. An excerpt from those
reports is attached hereto.

Commissioners' Court, the following members were present:

THAT WHEREAS, on October 11, 1993, the Court heard and
approved a budget amendment for the 1992-1993 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to s
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 28,

CONTRACTUAL AGREEMENT
BRAZOS COUNTY SOIL AND WATER CONSERVATION DISTRICT 0450
AND
BRAZOS COUNTY COMMISSIONERS COURT
Brazos County Soil and Water Conservation District M 450. hereinafter
called the District. and Brazos County Commissioners Court,
hereinafter called the County. does hereby enter into a contractual
agreement for the District to provide soil and water conservation
services to the residents of Brazos County and to the County proper.

Those services will include, but not be limited to, erosion control.
water management, and rural development. This will be carried out by
planning and application through informal agreements with land users,
or, as required by Federal or State law. An information and
recognition program will be used to inform the public. Technical
assistance is utilized through a Memo Of Understanding between the
District and the USDA- Soil Conservation Service.
Erosion control will keep the land productive for its various uses for
many generations. Sediment resulting from erosion clogs our local
streams reducing water carrying capacity and resulting in local
flooding. Excessive siltation ruins our local wetlands. and:
therefore, reduces a dwindling wildlife habitat. Silt from erosion
carries many pollutants directly into our local streams and rivers.
Conservation practices consists of erosion control structures. erosion
control ponds, gully shaping, diversions, vegetating old fields.
proper management of grazing resources.
Water management includes recommendations for proper irrigation, flood
control, and water quality. Irrigated crops account for 75% of all
water used. Proper irrigation'saves that resource for tomorrows uses
including domestic consumption. Proper irrigation helps to keep
agriculture pollutants from entering underground water supplies.
Conservation practices include total evaluation of irrigation systems
and application procedures, precision land levelling, underground
pipelines. Water management includes floodplain management.
•
The District's role in Rural development in Brazos County is in
providing fire protection utilizing dry hydrants. Insurance rates
outside the city limits can be lowered a great deal, as well as
provide a reliable source of water to fight rural fires. Farm ponds
provide the water and we plan the dry hydrant system. The District is
evaluating the use of artificial wetlands to replace the septic tank
filter fields. The prospects are very promising. but. much work
remains to be done before this technology can be implemented. (rater
quality in rural Brazos County will be greatly inhanced if this method
can be used.

The District and the County have interfaced every since the inception
of the District in 1942. Many conservation problem affect not only
the individual landowner but the County itself.
The District contracts to Brazos County to provide the above services
for 1994 FY for $4400.00

Dear Sirs
Formal notice is hereby given that Sprint / United Telephone
proposes to install buried communications Cable upon and along the
right-of-way of county roads in Brazos County, Texas,
as follows:
IMPROVED ROADS (paved) - The contractor will plow cable in backslope with
8' of right-of-way line. Pipe will be bored under all paved county roads
extending from ditch line to ditch line with a minimum cover of 30".
IMPROVED ROADS (gravel) - The contractor will plow cable in the backslope
of the road, one track of the plow tractor on the backslope the other may
come to the shoulder of the road neither whole tractor nor plow will be on
the road surface.
UNIMPROVED ROADS (dirt) - Same as improved, unless, because of ditches,
trees and other terrain features, it is more practical to plow in center
of road. In these cases, the cable will be plowed in the center of the
road. Not applicable in County.
BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be burned or
disposed of and not left in the ditch. Rocks brought up by tractor or
plow will be disposed of.
DEPTH OF CABLE - All cables will be placed at a minimum depth of 30"
except where crossing dams or ditches, at which locations the depth of
cables will be at a minimum of 36".
The following are requirements which are made on the contractor:
1. The plowing equipment shall be subject to the approval of the
Engineer and the Public Authorities having jurisdiction over highway
and road rights-of-way.
2. The equipment and construction methods used by the contractor shall
be such as to cause minimum displacement of the soil. The slot made
in the soil by the cable plow shall be closed immediately by driving
a vehicle track or wheel over the slot or by other suitable means.
3. Damage to banks, ditches, driveways, and roads caused by the equipment
shall be immediately repaired to the satisfaction of the Engineer and
Public Authorities having jurisdiction over highway and road right-of-

way where involved.
4. Trenches shall be promptly back-filled with earth, and mechanically
tamped at six (6) inch lifts so that the earth is restored to original
grade to assure no hazard to vehicular, animal or pedestrian traffic.
No trenches shall be left open overnight.
3. The usual 10% fees withheld from contractor until repairs are made
satisfactory with Engineer and Public Authorities having jurisdiction
of right-of-way involved.

Navasota
Brazos County will not be held liable at any future
date for accidental damages to the buried cable plant by road working
equipment such as maintainers, hole diggers, etc. In the event of
such damages the Telephone Company will be notifited immediately.
The County Commissioners Court may require the owners to relocate this
line, for valid reasons under the law, by giving thirty (30) days
written notice.
a. Where communication facilities are located on county
road ROW the Telephone Company will relocate said
facilities at no expense to the County.
b. Where communication facilities are located on private
property the County will reimburse the Telephone Company
for the relocation of said facilities.

At any place where a communications line crosses overa county road, it
shall be constructed and maintained at least eighteen (18) feet above
the surface of the traffic lane.
Please notify forty-eight (48)
hours prior to starting construction of the line, in order that a
representative may be present.
The locations of the proposed lines are more fully shown by the copies
attached to this notice.
Construction of this line will begin on or after the 9th day of
September , 1993.
